right now on nbc bay area news, three people in the hospital. the collision caught on camera. good evening, everyone. thank you for joining us. i'm terry mcsweeney. >> and i'm peggy bunker. that crash happened a few hours ago in oakland. one person is in critical condition. christie smith smoz us what happened. we do want to warn you, this video is tough to watch. >> reporter: neighbors describe a loud crash and a terrible landing for two young men on motorcycles. the disturbing wreck was actual caught on surveillance tape. neighbors say it's a scene they won't forget and we have to warn you that some of that video is graphic. >> a big thud.

bam! bam! >> reporter: that's how bobby jones describes hearing the impact of the crash near 16th and peralta streets earlier this evening. >> it was startling at first. >> reporter: there's unsettling surveillance video as the car pulls out and two dirt bike riders crash into the side. the crash sent them both to hospital. neighbors tried to help. >> there were numerous people here, crying to comfort them before the ambulance and other security rolled in. >> reporter: he said they weren't wearing helmets. one sergeant told us the motorcycles were stolen. the driver of the car was hurt too. neighbors say they have seen crashes at this corner before, but nothing like this. >> you really don't want to see those things happen like this, because it's heartbreaking to see.

>> reporter: because of the seriousness of the crash, oakland police spent hours at the scene, and they say neighbors were very helpful in their investigation. in oakland, christie smith, nbc bay area news. a baby born months premat e prematurely after a deadly accident is showing improvement tonight. his condition has been upgraded from critical to serious. the child's 18-year-old mother was killed in the car crash early wednesday morning. she was seven months' pregnant. we are continuing to watch the wildfires that now two years in a row have devastate lake county. many evacuees have had to get out of their homes, are being allowed to go back, after the wildfire ravaged their neighborhoods. 189 homes are gone. lost to the clayton fire. many of those were in the neighborhood of lower lake. tonight that fire is 90% contained. all evacuations have been lifted. police say that the fire is allegedly the work of suspected

serial arsonist damon pash ook, he's in jail, currently facing several charges. there's progress tonight in southern california, with the blue cut fire. it's now 68% contained president at least 100 homes have burned there, but firefighters expect that number to go up as more damage is uncovered. now, some areas are still under evacuation, but a majority have been lifted. many people now heading back to their homes for the very first time today. >> the olympics are coming to a grand conclusion, but part of the spotlight is focused on a scandal that just won't go away. take a look at the olympic flame, burning in rio de janeiro, where team usa added more medals to the count. there are also new questions about u.s. swimmer ryan lochte and his story about being robbed at gunpoint. tonight, we have team coverage from jessica aguirre reporting from rio, but first, lochte's

latest story and new information from a witness. >> well, terry, all of the u.s. swimmers involved in this scandal are now back here in the united states. and ryan lochte is still trying to explain himself. >> these guys -- >> reporter: the controversy stems from ryan lochte's story last week, that men, posing as police, robbed him at gunpoint. nbc bay area's jessica aguirre is in rio. our crews tracked down a man who tells a much different story. >> he says he intervened to help lochte, conger, bents and feigen. he said he tried to explain to them that the owner wanted them to pay for the damage they did in the bathroom. fernandez said a security guard pulled out a gun and pointed it to the ground to stop the swimmers from running away, but he never pointed it at lochte. >> no, no, no police. >> reporter: to pay for the damage, fernando said the

athletes handed him money and he gave the money to the security guard. then the swimmers left in a cab. ryan lochte sat down with matt lauer to try once again to explain what happened. >> i mean, there was a gun pointed in our direction. we were all frightened. and we wanted to get out of there as quick as possible. the only way we knew, this guy is saying, you have to give him money. >> but when pressed, lochte called his behavior and admitted changing his story. >> that's why i'm taking full responsibility for it. because i over-exaggerated that story, and if i never done that, we wouldn't be in this mess. >> mary alfavro, nbc bay area news. now to the biggest wins for team usa on friday. a very strong night for track and field. gold in the 1500 meter race, the first american runner to take first place in over 100 years. both the women and men's team took gold in the 4 by 4 relay.

the women's volleyball team not leaving rio empty handed either. they recover from a very tough loss in the semifinals that wiped out the netherlands to take home bronze. now to the women's basket team. they won a sixth consecutive gold medal, warrior superstars and the rest of team usa hoping for the same victory on the final night of the olympic games. so a very good night as we wrap up the olympics. >> well, they're not olympic athletes yet, but they could be in 2020. tokyo is adding surfing as an official sport. >> surfers from brazil to the bay area could not be more excited. jessica aguirre hit the beaches to find out first hand. >> reporter: the literal translation is -- but really, that translates anywhere. and now surfers all around the world, from rio de janeiro, to the california coast, are looking for that sweet wave that they can ride all the way to the next olympic games.

in between world famous beaches is the birth place of brazilian surf culture. >> i think everyone tries to schedule their day around, you know, surfing. >> reporter: for the first time ever, surfing will be an olympic sport at the tokyo games. so athletes from the brazilian coast to the californian coast still have four years to train. >> that will be awesome. train really hard the next four years and see what happens. >> pacific's pan easey is currently 24th in america, but for 2020, he's hoping for more. >> i'm more of an air guy. i like to do airs. >> when we see him going for a big maneuver, it's kind of just knowing that he's probably going to stick it eight times out of ten. >> surf coaches think the 19-year-old has a good shot at making team usa, so long as the contest features waves made by

that mother is speaking out. she was watching her children play at washington square park on san francisco's north beach, this was last friday. when suddenly without warning a 100-pound tree branch cracked down, hitting her right on top of the head and lower back. she suffered a fractured skull and severed spinal cord. she said she's in a lot of pain but she's thankful that the branch only hit her and not either of her daughters. >> this all pretty much what happened, they were really scared. they don't know what to do at that moment. >> i can move by myself. >> her husband said her doctors don't know when she'll be able to go home yet. but as for the tree, they have determined all of the pines in the park are in good condition, it was just a freak accident. delays at both the pleasant hill and glen park station friday evening. two trains had to be taken out of service.

because of repairs being made in san francisco. nbc bay area responds to a couple that got married in san francisco. >> bride and groom very upset about their wedding video, they're now making a vrl cafede case out of it. this has caused chatter in the newsroom. >> i think it will change people's perspectives when they see viral videos. the couple here are sharing their story about a possible peril of getting married in the internet age. they're so embarrassed by this episode, they have filed this case anonymously. >> it could be any bride and groom. >> reporter: meet the bay area plaintiff in a federal lawsuit over there, her wedding video, shot in 2013. we've agreed to blur the footage because the bride's suit says this clip has left her shock, mortified, anguished, humiliated and shamed. during the reception, the garter

removal goes badly, thanks to a groom who had to much alcohol. >> she was left in tears, though she quickly got over it. the husband joked that he'd renew vows in a couple of years and make it up to me. >> but last summer they discovered part of their video had been uploaded to youtube. a friend of my husband's in jirld, who wasn't even at the wedding, saw the video online. >> this regrettable scene then went viral. >> within a few days, it was up to two million views. >> where else was it? >> everywhere. >> the huffington post, cos mo, facebook, reddit. and many others. >> it hurts. >> she accuses the photographer of uploading it to yup without the couple's permission. she also claims that the clip that went viral is actually longer and more damaging than what's on the dvd she keeps locked up at home. >> we didn't know that footage existed until we saw it online.

>> reporter: the company she hired is based in chicago. we requested an interview and its founders responded, saying, in our 12-year history in delivers thousands of wedding videos videos, we've never experienced anything like this. we are very upset and disappointed by the situation, and we have spent considerable time removing our video from the internet. did you catch that? "our video." it's the couple's wedding but george street owns the video. >> there's no question in the law about that. >> this university professor explains something few consumers realize. although you pay for a photographer's services, the images they capture, remain their property. >> any photograph by any photographer is considered a creative work that belongs to the author, the photographer, and they have full rights.

>> while george street owns the video, the bride argues that letting it loose on the internet was an intentional infliction of emotional distress. >> it's important that companies understand if they don't take that responsibility seriously, there's a price to pay for that. >> reporter: the bride's lawyer, hank burg oin, said the video regularly reappears online. he contends george street is on the hook for the recurring cost of getting it removed. he says a trial will also unearth whether or not anyone made money. ultimately, he wants a jury to decide the case. >> if it has to tell its story, it has to make its excuses to real people. >> reporter: is there a lesson here for the rest of us? perhaps. the professor said you can try to protect yourself in a contract, insisting on transferring ownership rights to you. >> negotiate, and you can try

95%. over 83,000 acres in the clayton fire impacting the north bay. lots of smoke in the atmosphere. cloudy skies as well, fog rolling back. east bay, 75 degrees. san francisco, 64. north bay to 80. we have high pressure in control of our weather, creating the sinking air and that's why the smoke is being pushed down into our valleys. that's why it looks so hazy across the bay area. tomorrow the fog rolls back in, we'll see thunderstorms pop up from yosemite over towards lake tahoe and those could come with lightning. continue to watch that. forecast for tomorrow, san mateo, 72. san francisco, mid 60s for highs, mid 80s for the trivalley. pleasantton 85. oakland tomorrow, 72 degrees. air quality will stay in the moderate range, at least for tomorrow. should start to improve by monday, but all depending on the fires, if the firefighters can
