we're following this morning. more trouble for an already embattled county jail. a former santa clara county deputy is behind bars for allegedly beating an inmate three years ago. >> "today in the bay's" bob redell is joining us live from the santa clara county main jail where detail thons latest case of inmate abuse. bob, good morning. >> good morning to you, sam and laura. what makes this case unusual that the district attorney's office initially passed on pressing charges against this former deputy here at the santa clara main jail, but yesterday the d.a. came to a different conclusion and had -- filed charges against timmy tree, had him arrested at his east san jose home and placed him in the very jail that he used to work. he faces charges related to the beating of an inmate in october 2013 while he was a correctional officer here. tree allegedly kicked an inmate h nis head and face, cutting his face and breaking his jaw. sources close to the investigation tell us tree was trying to help a fellow officer

subdue the inmate who had become unruly. the sources say that in the process tree used force that was considered excessive. >> it went through internal investigation. he has not worked for the sheriff's office since then. he was immediately put on adm administrative leave. >> reporter: back then the sheriff's office recommended charges be filed against tree but after several weeks the d.a.'s office declined for reasons unknown. flash forward to this past march. the s.o. resubmitted the complaint. the d.a.'s office conduct additional interviews with pain mateses and five months later, yesterday, decided to press charges. a judge set bond for tree at $75,000. tree was let go from the sheriff's office after his 18 months of paid administrative leave expired this past august. this isn't the only problem at the jail. three other former deputies are facing murder charges. they're accuse of beating inmate michael tyree. he was found dead in a cell a year ago.

reporting live here in san jose, bob redell, "today in the bay." >> bob, thank you very much. right now only on nbc bay area we have video of a fight during a san francisco cab ride that ended with the passenger allegedly gouging the driver's eye. obviously it's very dark here in this part of the video. that's why we highlighted the driver and passenger. the dash cam video provided by sf super scab shows the passenger in the backseat. you see right there with his 36-year-old is doing exactly is hard to tell but he does something to the driver. the driver responds seconds later the 65-year-old cab driver starts to hit the passenger. that fight continues outside before police eventually arrive. and the passenger was arrested. now, some kaksity drivers tell thus is a tough job. >> having such a bad -- it was so difficult to make money now we have to take more chances. >> alleged victim, the driver, was released from the hospital after a few hours. we're told his eye is going to be okay. the district attorney's office is deciding how to charge the

suspect. new details this morning. we now know the names of two brothers shot and killed in san jose. we first brought you this story yesterday morning. the brothers were found in a bullet riddled car near spartan stadium. the victims, 27-year-old michael ramirez and 36-year-old artero ramir ramirez. the weapon was an ak-47. >> they may do what they think they did was successful but in the end they will be unsuccessful because statistically it's probably going to happen to them. that's an unfortunate thing to say. but it is the truth. >> 2340 no arrests have been made. this is the 32nd and 33rd homicide in san jose this year alone. san jose is considering drastic measures to deal with the reduced of police officers. city leaders are on the verge of declaring a public safety state of emergency due to dwindling

police staffing numbers. senior leaders met with the chief and members of the police union. they agree at least 500 officers are needed to fully staff patrols. right now they're almost 100 officers short of that number so officers in other divisions will need to be redeployed. >> it's going to mean closure of more unit, more people not investigating specialized crimes and things of that nature. >> a state of emergency would override the current police union contract in order to get more officers on the streets. taking a stern stance against hard alcohol on campus. stanford is cutting down on high volume drinking effective immediately. hard alcohol is now banned at all parties on campus. that includes fraternities and sororities. however, students 21 and older will be allowed to keep hard liquor but nothing bigger than pint sized bottles in their rooms. the university says that this new policy is not related to the sexual assault case involving former stanford swimmer brock

turner. happening today, the first day of the school year for students in the ear of lake county hit hard by the massive clayton wildfire. students and staff hat all lower lake schools will return to class this morning. that's the same area ravaged by fire ten days ago. the district delayed the start for one day in lower lake to allow more time to clean up and give staff and students a chance to prepare for today's opening. as they head back to school, firefighters continue to douse the remaining flames left from the clayton fire. it is currently 96% contained after scorching nearly 4,000 acres and hundreds of structures. police say a serial arsonist sparked that fire. now, across the state hundreds of crews remain on the front lines trying to contain several fires. >> this time it's a historic landmark being threatened. here's a look at the six largest fires burning in california. at the moment, the most problematic is the chimney fire burning in san luis opibo

county. they protect the manned lark which remains closed to the public. but not just the property but the castle is home to an extensive heart collection. the chimney fire has burned more than 31,000 acres. it is 35% contained at this point. and there's still activity at the hearst castle. they're using it as base of operation to contain the fire. >> we have seen so much smoke over the entire state of california it seems. check in with rob. >> winds have out of the south pushing the smoke up into central and northern california though we're hopeful over the next 24 hours upper level winds out of the northwest may send more of the smoke away from the bay area. so the south bay today still seeing patches of smoke. but improving air quality out towards the north bay and peninsula. outside right now, temperatures in the 50s. drizzle for the peninsula in san francisco. our friends at los gatos union heading back to school over the last week or so, numbers in the mid 80s for highs. one of the warmer spots in the

immigration plan. part of it won't change. >> we're going to build a wall, folks. we're going to build a wall. >> reporter: his campaign manager signaled trump will soften on deporting an estimated 11 million illegal immigrants in this country already. trump now says he would separate illegal immigrants into two categories, the, quote, bad ones who would be deported immediately, and everyone else who would go through the process of existing immigration laws. >> hillary clinton's plan amounts to total and absolute total open borders. open borders. >> reporter: meanwhile hillary clinton took time off from campaigning for an appearance on "jimmy kimmel." >> have you considered using face time instead of e-mail. >> actually i think that's really good advice. >> reporter: her campaign is not laughing. another 15,000 clinton e-mails were released by the conservative watchdog judicial watch, e-mails that were deleted from her server but recovered by the fbi. >> some of those were government

records. some of them may have been classified. it raises questions as to why this massive deletion of records took place at all. >> reporter: they outline how big donors to the clinton foundation got access to clinton when she was secretary of state through her top aide yuma abedin. some of the e-mails show that the requests all went through her deputy chief of staff at the time she was secretary of state. but not all the donors got everything they wanted but they got access. reporting live in washington, edward lawrence. back to you. >> thank you. let's go back to local news at 5:14. happening today san jose leaders are meeting to consider possible changes to the city's recent rent control ordinance. in june, city council members agreed to 5% per year rent hike cap. many critics still consider that amount to be too high. landlords can petition the city for higher rent increases to cover capital improvements or debt service. today's meeting takes place at 1:30. now to big court decision

just in time or back to school. >> scott mcgrew, big win for schoolteachers. >> that's right. some would say a loss for school students. a lawsuit that would have made it easier to fire poorly performing teachers will not go forward. the california state supreme court said it would not hear an appeals court case that effectively kills the whole rest. the lawsuit said california school kids were hurt by poor teachers who kept their jobs because they had tenure. a silicon valley high tech ceo david welch took up the cause and said that's not fair. just because you've taught a long time shouldn't mean your job is protected. welch who runs is one of silicon valley's richest but created students matter which brought that suit. it originally won in court, finding students' rights to do due process were hurt by teachers who effectively could not be fired. but appeals court disagreed and again, the state supreme court on monday refused to hear the

case. the appeals court ruling will stand. let's check your news before the bell. landon dowdy is live at cnbc world headquarters. good morning, landon. >> hi, scott. good morning to you as well. wall street could start off with green arrows. futures are higher this morning. markets ending mixed on monday on light volume as the dow finished lower. the nasdaq rose for the ninth straight session. look for data on new home sales and best buy reporting earnings in the last hour beating wall street estimates. shares of the electronics retailer surging on the news. on monday the dow slipping 23 points to 18529. the nasdaq up six to 5244. scott, back over to you. >> there is a scandal in your bedroom. somebody not telling the truth about your sheets. target has dropped a brand caldwell spun. walmart is thinking of dropping the brand as well on the same suspicion the sheets are not egyptian cotton. targeting offering refunds. i looked it up because i didn't know what egyptian cotton is and

and llamllamas. when you get there she might have a name. how about an otter with a life straight out of a novel now found a permanent home at the monterrey bay aquarium. she was rescued as pup. following her first release survived by bitten on the shark. fish and wildlife rangers named her unreleasable. researchers used her to collect data and they're examining sea otters functions. sure is a cute little poser. now she's back at the aquarium where she will serve as a surrogate mother for rea bill tating pups. talk about the most interesting otter in the world. >> as it's taking a chug right there. >> wants to be back at the monterrey bay aquarium. >> three times she came back. the third time she said it was health concerns. i consider the shark bite a

health concern as well. >> no kidding. let me in that nice aquarium. >> occupational hazard. if you have plans for the weekend, think about going to the aquarium but temperatures are dropping. >> never too early about heading to monterrey. nice weather usually. a lot of low clouds and drizzle in the morning. maybe not so good for a warm day in monterrey is good to keep our valley temperatures running mild again. right now temperatures in the 50s. some of that drizzle in san francisco. and across the peninsula this morning we'll start off in san jose. 62 degrees. some low clouds. and of course a lot of schools getting back in session over the last week or so including out towards saratoga union. last week getting started. today we've got numbers in the mid 80s for this afternoon. out towards livermore, a few patches of low clouds. 58 degrees. the livermore school district started up yesterday and look at those those numbers. mid 80s in livermore. probably one of the warmer spots you will see around the bay area today. look at low clouds in the tri-valley. out towards the strait for morning and then by noon the clearing skies inland. typical summer trend that you

come to expect in the bay area with the low clouds lingering on the seashore for today. highs in san francisco staying in the 60s. same in monterrey today. closer to 80 in san jose. north bay temperatures, sweb toss low 80s. mid 80s around the tri-valley. looks like for the next 24 hours temperatures trying to climb. not going to impact you in san francisco. you're going to be stuck with low clouds and highs in the 60s. but tomorrow, a bit warmer for those valleys. 80s, maybe close to 90. trending cooler again as we approach the weekend. and speaking of the tri-valley, issues for the morning commute, mike. >> we had the flat tires reported. lots of 680 showing slowing and past the three sets of flat tires, a fender bender now creating another backup on highway 84. we're concerned about your tri-valley dmut. more folks coming off the interchange. rob showed you that live picture with a lot of traffic for 580. looking toward the bay bridge toll plaza.

crash near stinson beach.. c-h-p officers say a van somehow

a daring raft rescue following the crash near stinson beach. chp officers say a van somehow lost control, the driver of that van crashing about 250 feet down a ravine yesterday. there were three men in that van. two of them were able to climb up to the road and nag down help. chp helicopter was able to pull the driver eventually to safety. no one was seriously injured. officers are not sure what caused the driver of that van to actually lose control. happening today, president obama travels to baton rouge, louisiana, to get a firsthand look at the damage caused by historic flooding. 13 people were killed and more than 60,000 homes damaged. local newspapers urge the president to cut his summer vacation short and pay a visit to the region. the white house is pushing back. >> tell you what the president is focused on is the response on the ground and people whose lives in louisiana has been turned upside-down by this terrible flooding event. the white house says that president has already signed a disaster declaration to help

flood victims. it's starting to look like the fight to restore iconic names at yosemite national park could end up in court. the park is involved in a trademark dispute with the company that recently lost its vendor concessions, delaware north. as a result, legendary names including the awani hotel and curry village underwent name changes. delaware north wants $51 million to have the old names to be used again because mediation efforts have come up empty. both sides suggest the dispute end in court. east bay mud agreed to a six figure settlement for a spill that last spring contaminated oakland creek. the east bay times reports the utility is going to pay $426,000 for a concrete spill into the rock ridge in april of 2015. a district worker accidentally left the pipe valve open for about two hours. including other costs east bay mud is going to have to shell out about $2 million to cover all the damages.

new details now on the massive price increase for epipens. congress is now getting involved after public outcry. the demanding answers after the skyrocketing cost of the pen. the devices are used to prevent potentially delayed ant flack tick shock. senators are sending messages to mylan asking the company to justify the increase. the cost has gone up 400% since 2008. they're concerned parents cannot afford the pens for children as they head back to school. mylan had declined to comment on the price hike, instead blaming high deductible 45ehealth plans a community coming together to save a sick coyote. the neighborhoods that he's been spotted in and why he needs help. i'm kris sanchez at stanford where the policy regarding hard alcohol has changed though the administration says it's not as a result of the conviction of

"today in the bay's" kris sanchez is there live with what these new rules entail. kris, this is happening just as the school year is about to begin. >> reporter: right, the school year is about to begin but they say this is about changing the culture surrounding drinking, reducing the pressure for young people who feel like they don't have a choice if they want to sit in. this is the letter that was sent out to students. it reads in part that this is to generate solutions that reduce risk for students, that reduce the pressure on students to drink, and that meaningfully change stanford's culture around alcohol. the administration says the policy change is not directly related to the brock turner

case. the former swimmer was an vikt oefd sexually assaulting a young woman after a party where both of them drank hard alcohol though he was under age. a new policy means no hard liquor in undergrad housing. that includes common areas, also fraternity, sororities are included under that. no hard liquor bottles larger than 750 milliliters, the sidze of a wine bottle. students over the age of 21 can only have beer or wine at undergrad parties. graduate students can have hard liquor although they're supposed to keep it in mixed drinks, no shots. small pints in their dorm rules. they could be kicked out of the dorms. we checked the policies for other bay area campuses. all of which say they are subject to state law. uc berkeley, over 21, they can have alcohol but not in common areas. and minors can not be in the presence of that alcohol. at san jose state, only for folks over 21 and minors can be

"mercury news" reports that persky recused himself from an upcoming legal hearing. persky was supposed to consider reducing the sentence for a man convict oefd child pornography. the merc reports that persky that some may now doubt his impartiality. now to a developing story. a former santa clara county correctional deputy is facing criminal charges accused in a

violent assault at the jail where he once worked. late last night they released the booking photo for one-time guard timmy tree accuse of beating an inmate at the main jail in fall of 2013. investigators say he kicked the inmate in the face and head and broke the inmate's jaw. >> went through internal investigation. he has not worked for the sheriff's office since then. he was immediately put on administrative leave. >> at the time the district attorney looked over the case and declined to file charges. tree was on leave for about 18 months. then left his job last. 5:34. happening later today the former petsmart groomer charged with killing a pet is expected in court this morning. 101 is going to be back inside a redwood city courtroom for further arraignment. investigators say that a dog suddenly died in his care and it happened while he was worked as a groomer at the san mateo petsmart last may. the dog suffered broken ribs and a punctured lung. a former raiders star behind

bars. accuse of being caught naked with drugs in someone's backyard. er vine police cited 47-year-old todd marinovich for tris passing, possession of controlled substance and marijuana. he was carrying all of that in a brown paper bag. marinovich was picked up by the raiders in the 1919 draft. played two seasons with the sill rer and black before released over drug issues. marinovich has had several drug related arrests since he left the nfl. berkeley's first homicide victim of the year is being identified as fwoo-year-old alex goodwin. goodwin was shot and killed in the area of mabel and burnett streets last thursday. he was from berkeley. police say the shooting does not appear to be random. no arrests in this deadly shoots. authorities are hoping a new reward can help solve a east bay shooting. 19-year-old cory mattie died august 6th as she rode her bicycle to a friend's house in

richmond. the shooter unloaded 17 rounds near 24th street. police so far have no leads and still can't figure out a motive. family members tell nbc bay area because cory looked like the man she may have been the victim of mistaken identity or a hate crime. >> do you think she was targeted because she was lesbian? >> that's what i think so. they have missouri tive. they have no -- i mean, not motive, but reason to shoot at her 17 times. >> police now offering a 10,000 reward for information leading to an arrest. a pellet gun shooting spree in san jose leaves at least one person injured. this happened about 9:00 yesterday morning at an apartment complex on fifth street. not far from san jose state. police say that somebody shot a pellet gun across the street and ended up hitting a man in the head. he was taken to a nearby hospital and thankfully he is expected to be okay. police say they have identified a suspect but they haven't arrested anyone yet. neighbors say there's been a

recent increase in shootings in that area of the city. >> we just had a double homicide, two blocks away. last night. and a week ago, maybe a little more, somebody else right down p street here. so it's a problem. >> some neighbors say the pellet gun shootings have been going o for about a month but police say they haven't received any reports of any recent shootings in that area. the search is on this morning for a sick coyote walking the streets in danville. wildlife experts say the coyote has mange comping the skin and mights. could be in danville for discarded food. the animal is not a threat to people but small pets should be kept indoors. people have reported numerous sitings giving wildlife agencys a better chance to catch it. >> it's refreshing to deal with the community that seems to really care about this animal's welfare. >> it looks pretty sick. mange is not deadly but being in the city increases the coyote's

starting over. following just a horrific wildfire. today students in lower lake are going to be heading back to school after the clayton fire destroyed almost 200 homes and businesses. "today in the bay's" pete suratos is live there now. pete, so many families trying to recover. this was not exactly the way they wanted the school year to start. good morning. >> reporter: definitely right. good morning to you. schools. >> reporter: slated to start in this area last week but that was pushed back as a result of the clayton fire. now, we were here for the better part of last week. as a result of this fire you had 300 structures destroyed around lower lake. and authorities arrested 40 years damon pashilk responsible for this fire. as a result, the unified school district pushed back the first day of school from august 15th, last monday, to this week. there was a mandatory staff meet for district staff that took

>> reporter: good morning. our investigation examines claims by patients that are broken worker comp system is making it impossible for people to recover from their injuries. take chp officer ryan schneider. he was hurt on the job when a drunk driver swerved in front of him. doctors requested and rerequested treatment foreman 300 times in three years. sniders says routine delays and denials of medical care has made it hard to get better. our investigation found other workers complained to the state and delay and denial tactics and suffering needlessly for too long. the state passed new workers comp reforms in 2013. our investigation found there's no way to know how many injured workers are getting or not getting the care doctors say they need. the state doesn't keep track. now, the state says delivering timely benefits to injured workers is a high priority. to read the full response from the state and to watch our full investigation head to
