we have the late developing details. welcome to the special prime time edition of nbc bay area news. pressured out of his job hearing criminal cases judge aaron persky is getting a new assignment, all steming from the controversial decision regarding the stanford student. >> nbc bay area scott budman has more. >> yes, judge persky has been dealing with fire after he handed down a six-month sentence. he asked to be removed from such cases and will be handing down cases instead from palo alto. >> you want a judge to focus on the facts ought what the evidence shows. but what has occurred here is there has been such a national firestorm over this one decision that it made it almost

impractical for the judge to continue sitting on criminal cases. >> now, even within the last hour the leader of a group that has been trying to get judge persky recalled spoke out in palo alto saying she is not satisfied with him moving from one court to another. >> so in our opinion, judge persky is biassed and should not be on the bench, and the voters of santa clara county have the right to decide. >> since the incident, the judge has been involved in several protests where members of the group ultraviolet demanded the removal of judge persky, with more than a million signatures given. the judicial assignments rotate every year and have to be approved by the presiding judge. a little more on the case and the controversial sentence that triggered the wave of criticism for the judge. in march, the judge found brock

turner guilty of three felony assaults on an unconscious woman. the judge sentenced turner to six months in jail and three month's probation, and could have sentenced had him to ten years. he is ordered to register as a sex offender. he is expected to be released on september 2. >> well, a disturbing crime in mountain view, police say a man is under arrest for allegedly using a hidden camera to record people in the bathroom, including a toddler. this is the man chasing chargs,s 34-year-old jose balasteros, officers say last week a woman came forward saying she received on-line photos of herself in the bathroom. the mountain view police tracked him down with the help of their cyber crime unit. and police are hoping for help on a taser robbing of a cab

driver. take a look at the alleged robbers right before the attack. keep watching and you will see sparks of electricity from the taser. the robber happened earlier this month, police hope the video will create a few new leads. anyone with information on this attack should call sfpd. request denied, the long awaited high profile trial of the man accused of killing the morgan hill teenager, sierra lamar, today, the judge ruled he will likely get a fair trial in santa clara trial. but the judge did not completely close the case ruling whe ing t attorneys can refile to move the case in the future. we spoke with lamar's family. >> happy with that decision, because yeah, it helps the family a lot to be able to go and -- go to the court

proceedings as much as we can. >> sierra lamar was 15 years old when she went missing on march 15th, 2012, in morgan hill on the way to the high school. her body has not been found. the jury selection will happen in september. and he is charged with starting the devastating fire in lake county. tonight, we learned how cal-fire found the arsonist. >> reporter: we are very confident that this is our guy, a serial arsonist. >> and now we're getting a look at just why investigators are so confident that 40-year-old damon pasok was responsible for the fire. a cal-fire report details the year-long investigation what began in july of last year. time and time again, cal-fire says a car believed to be driven by pashilk was seen at the

fires, captured by gps and trackitrack ing devices. >> every single one of these fires had the potential to do destruction. >> during one of the fires, the investigators saw the suspect apparently admiring his alleged handywork, quote, he appeared to be watching the fire and taking pictures. in another case, pashilk left a casino during which time the fire started nearby. pashilk then returned back to the casino where the investigator then saw him inside. legal analyst steven clark calls the case a strong one, although investigators only found a twisted paper item and a burned matchbook at the site. he said that pashilk's presence at so many will be tough to explain. >> so many fires, the common thread between this individual

being there at the time and place of the fires in such short order, that is key to the prosecution's case. >> pashilk's alleged activity blew up on august 13th, police say he was driving and went to 13 miles an hour at the fire, then sped away. the fire started one minute after pashilk passed by. so far he has been charged with starting or attempting to start 13 fires but we're told that more charges are on the way linking hlink ing him to at least four other fires. new details now about the story and the blind man rescued from his burning home. a go fund me page has been set up after the fire destroyed his house in the east bay, happening in pittburg, the man has two roommates, one of whom is pregnant. the close friend said they all

lost everything. the blind man has been hospitalized now for smoke inhalation. and a wet mess to clean up for san francisco after more than 12 homes flooded after a new construction crew caused a water main break. more on the story. >> reporter: neighbors say they were absolutely stunned to see aw what they described as a river flowing down the street here. you can see the high water line near the side of the garage. in all, 14 homes impacted. >> it was literally so high that it was coming over the fence. >> reporter: water flowed from the street above into her new apartment. serena didn't want to give her last name but says it was ankle deep. >> the majority went inside the bathroom and kitchen and in our living room. >> reporter: her home is on the san francisco daily city border, where daly city's director of water resources said a

contractor was improving a project. >> during that work, the pipeline came up done and caused the 8-inch water main to leak down wilson street. >> reporter: he says about 43,000 gallons of water spilled before it was capped. >> 11 homes, and then the next block affected by the water damage. >> reporter: while most appeared to be into garages, neighbors say some have shared living spaces. they also shared pictures of the flooding and the mess it left behind. >> it looked like a river rushing when it's flooded. >> reporter: the utility said the contractor is working with the retoration firm. >> making sure they're helped. >> reporter: the water department said they are still trying to determine the extent of the impact to each of the homes. in the meantime, we're told that the cleanup will continue tomorrow. in san francisco, christie

smith, nbc bay area. and the owner of the a's may have a new home for his team, john fisher got a guided tour of the terminal today, not far from the coliseum. more from the coliseum, this is big money and big politics. >> reporter: absolutely, raj, and the big headline tonight is who is now getting involved in the decision to possibly move the oakland a's out of the coliseum here. and fans say it's a move that could also keep the a's and the raiders from leaving town. a guided tour lasting less than an hour. >> well, this was an exploratory decision. >> reporter: to explore building a new stadium for the oakland a's at the terminal. >> what they saw was an active terminal with trucks going out, trucks that temporarily store

containers at this this facility. >> reporter: the court officials escorted the a's owner john fisher along with others throughout the 50-acre site. >> today is the first time you're hearing the silent partner, if you will, mr. fisher. >> reporter: it's unclear if the mayor was part of the tour, she has long promoted the location to give the a's a baseball-only stadium. but the co-founder of save oakland sports says that fisher's involvement is telling and could also keep the raiders from going to las vegas. >> by them moving out of the coliseum they will have the whole site to themselves. >> this is a view showing it, the port officials say it could be a long time coming. >> at this stage there is no proposal here. again, this was an exploratory visit today and no telling what it leads to. >> reporter: and typically, port officials say when parties are interested in leasing out space at the port that remains

with the bay area investigative unit holding the area accountable. an a stunning and heartbreaking accusation in the south bay, a 6 week old infant is clinging to life now after investigators say she was beaten by her father. >> even the investigators are shaking their heads tonight while the baby girl is fighting for her life. investigators say this man, 32-year-old matthew zabala violently beat his own 6 month-old doctor. >> doctors conducted x-rays and

learned there was over 14 different fractures to her body. >> the little girl is in critical condition at valley medical center. family members brought her in sunday after the baby suffered cardiac arrest. after interviewing the family, sheriff's office's determined her own father was responsible. >> it is very difficult, a horrible crime, the sheriff's office's employees want to protect our community. this young infant is at the point in her life, the most vulnerable point in her life. she can't even feed herself. it's a horrible crime. >> most neighbors we spoke with don't remember seeing zabala in the area. this woman was going for a walk, when she learned what happened, she could not continue. >> i walked back, it bothered me so far. >> zabala has prior convictions for child abuse, even serving time in prison for the crimes. >> he will be in court in the next couple of days. i'm damion trujillo, nbc bay

area news. and a body may be linked to a crash that happened this morning, early this morning a pickup truck hit the guard rail. when the chp arrived the truck was there but the driver was gone. later in the day a caltrans worker found a body in a waterway a few miles away. no word yet if that was the driver of the pickup truck. well, the bobcat that is roaming around a saratoga neighborhood has the neighborhood on alert, the animal experts say there is not a lot they can do about it. nbc joining us now from saratoga. and laura, this bobcat seems very comfortable just walking through people's yards. >> reporter: well, that is right, peggy, neighbors say they have seen the bobcat all over the area here. and i talked to one man whose surveillance video caught the bobcat in his driveway, take a look. >> we first thought it was a mountain lion.

>> reporter: take a look at video captured there in the saratoga hills, you see a bobcat roaming the driveway in the otherwise nice quiet neighborhood. >> it's nice to live with the animals, but at the same time we worry about safety. >> he is worried about the safety of his 3-year-old son. >> he is always roaming, and we are not going to let him go out by himself. >> this man found the remains of an animal, believes it was a deer eaten by coyotes. >> they're out there all the time, they're howling, making a lot of noise. >> their stance is million somebody gets hurt or an animal attacks they're not going to come out. so we're left with the situation of having to fend for ourselves until somebody gets hurt. >> reporter: steve gonzales with the wildlife organization says

our investigative unit is digging into a system thatcalifs well, they say they didn't have a fighting chance to get better. our investigative unit is digging into a story where california workers say they're unfairly denied medical care. >> and we learned what happened when they tried to appeal the denial. >> the investigation found most of the time viewers agreed, people don't need the medical treatment they asked. critics say this proves the deck is stacked against the workers and in some cases can lead to devastating consequences. >> she was just such a funny person. >> lori mays was always up for a

laugh, just ask her mom. joan says her daughter wore her sense of humor. >> i don't mean to offend you, that's just a bonus. >> reporter: lori helped women with at-risk pregnancies. on a house call, she slipped and got surgery but the pain in her back and legs would not stop. the funny lori slid into depression in depression. >> so the worker's compensation acknowledged the link between chronic pain and depression. >> reporter: when drugs stopped working in 2014, lori received an operation that seemed to be very effective. but when her daughtoctor reques more treatment last year, it was denied. lori asked the state for an independent medical review, but in february, the doctor reviewing her case decided to uphold the denial. the week lori received the

letter, her family was at the beach. she came home first. >> there was a note on the front door saying don't go in the back yard call the police. i knew right away what it meant. >> a suicide note. her family found these notes, too, we treat our employees while injured worse than we treat our veterans, i'm worn out, depleted, gone. she was her little girl. >> having your child pass away. >> it's a reckless disregard for human life. >> reporter: the imr letter surprised the attorney. >> do you believe the decision contributed to lori's decision? >> without question it did. >> reporter: lori's case is extreme, but critics of the worker's comp system said that they rubber stamp denials that the injured workers say they

need. we provided data and injured workers contested nearly 600,000 treatment denials, our analysis found that reviewers held up nearly 90% of the denials. supporters of the system say this number proves the entire process is working. critics have another view. >> it's hard to believe that anything could be that upsided. >> reporter: they changed the way they resolve disputes. injured workers used to argue cases before the judge, now they decide the case is necessary based on guidelines that dictate which treatments are best. some say that it is too rigid. >> does the one size fit all work in this case? >> of course not. >> the company declined an interview request. we learned the reviewers are confidential. that means nameless, faceless doctors are making decisions

about patients they have never seen. the outcomes are final for one year. >> is the independent review process working? >> no. >> reporter: diane worley serves on the california attorney's organization. >> if the treatment the doctor is asking for is not the right treatment then the goal should be to find what the right treatment is. >> reporter: but you say their goal is not doing that currently. >> that is because critics say they're saving money, systems costs are down $800 million each year. but worley says it's gone too far. research from the insurance industry shows even after imr, 96% of all medical services are approved. in this july report the state writes independent medical professionals apply the appropriate evidence-based medical standard. we asked the state for an interview by our request was declined. what does that say to you?

the clock to try to find survivors around the towns. >> reporter: well here, the search and rescue operations are still under way. we've seen army trucks bringing in. >> flood lights, local authorities say they plan to work through the night trying to dig through the rubble to see if there are any remaining survivors. obviously, time is running out for those who may be trapped under the bricks and stones. when that took place, the man survived for 72 hours. so they hope that those kinds of positive stories could still be repeated. the folks we spoke to here, the residents are devastated by this earthquake, most of them are not able to return to their homes, even the homes that are still standing. it's simply too dangerous, they were cleared from this area. authorities set up temporary

not zika -- was brought home from the olympics. =vo= there is some relief in medals. it appears only medals were brought home, and no zika. the world health association says so far there were no cases associated with the olympics. it still will be monitored. doctors say there is a one week incubation period with the virus. as you recall, there were concerns about zika, several athletes with drew from the games because of concerns. and today marks the 100th anniversary of the establishment of the park service and we all get a present from now through sund sunday. this is pretty cool. national parks like yosemite have free admission. there are more than 400 national parks across the country. that is a nice little perk. >> next weekend, i can't wait. like the highlight of my summer. i am looking forward to it. >> just thinking ahead. next weekend, no rain.

also areas of drizzle. south bay, sun breaking through. we'll look at moderate air quality for the skies, hazy, 57 degrees, the large change for friday's forecast, this area of high pressure pushing off to the south and weekend. so then eventually we'll see cooler temperatures in by the accused weekend. tomorrow, cupertino, 79 degrees, again, fantastic weather for summer, peninsula, 62, spotty drizzle, half moon bay, el paso, 74, san francisco, low 60s, breaks of sun. for the north bay, east bay, temperatures going down again a couple of degrees with pleasanton at 83, up into the north bay, mill valley, 70s, santa rosa, looking at 77. larger change again comes by saturday and sunday. a trough of low pressure to the north associated with that is

cooler air. so as that wraps around the trough of low pressure it will help to drop the temperatures as we head to saturday and sunday. definitely, no way no how, will we have any hundredth as we go into the weekend. keep the ac's off, as we head into saturday we'll look at what we can expect. napa, of course a hot spot when it comes places to go, 60s on saturday, by 2 and 3:00 just 80 degrees that is it. santa cruz, usually one of the warmest beach location, typically in the 70s, but saturday we'll start in the 50s and finish the day with 60s. so it's not going to be beach weather so to speak in santa cruz where you can have the bathing suit on and kind of walk around. you will have to still have that light jacket with you. san francisco, you can see over the next several days temperatures to remain for the 60s. looking good.

and for the inland valleys, fire danger remaining low as we hover in the 80s. 72, next tuesday, we'll look at the forecast as new numbers come in. we may have to put 70s in here for next week. i know a whole lot of folks at home are not disappointed if we had had to put 70s in here. >> thank you. well, ryan lochte left rio before news broke that he was not actually vandalized at a gas station. this stems from his exaggerated claim of being robbed at gunpoint. lochte failed to mention that he and three teens vandalized gas station after a heavy night of drinking. lochte will stand trial or be tried and also possibly convicted even if he does not go back. okay, earlier tonight, on nbc bay area, thursday night football, preseason with the regular season right around the
