visible injuries. the motive and circumstances surrounding the death are under investigation. the man's identity has not been released. this is the city's 34th homicide of the year. "today in the bay's" bob redell following the breaking news story this morning. his live report is coming up in 30 minutes. happening today, this san jose father is expected in court. he is accuse of severely abusing his 6-week of old infant daughter. "today in the bay's" kris sanchez has been comping this story. she join us live from san jose. kris, this little girl is fighting more life this morning. she's in critical condition. >> reporter: she is. she has 14 different fractures in her little body including a skull fracture that doctors told investigators could not have happened by accident. we expect we'll learn more about that later today but the baby's father 32-year-old matthew zabala, was arrested at the family home in san jose's burbank neighborhood. he is now here at the main jail and will appear before a judge today. the charges are related to a

savage assault on the infant baby girl who arrived at valley medical center by ambulance on tuesday afternoon. at that point she was already in cardiac arrest. doctors examined her the reason became apparent. >> doctors conducted x-rays. they learned that there was over 14 different fractures throughout her body, including her skull. in this young 6-week-old infant, she's at a point in her life, the most vulnerable point of her life. she can't even feed herself. it's a horrible crime. >> reporter: again, the baby is in critical condition at valley medical center. zabala was arrested on felony child abuse and felony domestic abuse charges. nbc bay area sources say he spent time in prison after he was convicted of abusing one of his other children as well. garlts interviewed the baby's mother but have not named her so far. in san jose, kris sanchez, "today in the bay." the heated debate continues after a peninsula judge is

reassigned. but as critics say that is still not enough. the santa clara county judge who presided over the stanford sexual assault trial will no longer hear criminal cases. it's a voluntary move by judge aaron persky following his six-month sentencing of former stanford swimmer brock turner in june. since then persky has faced global criticism by a number of recall groups who are still moving to try to oust the judge all together. they want him off government payrolls immediately. >> these crimes against women and sex crimes are not treated by this judge like they're felonies. he treats them like their minor dis misdemeanors. >> groups are now working to collect enough signature ur choose to get a recall measure on the ballot. the request denied. the long awaited trial of garcia torres will not be moved from the current venue. yesterday a superior court judge ruled the man akilling sierra

lamar can get a fair trial in santa clara county. the judge also ruled the attorneys can refile to move that case in the future. se air la a lamar was 15 years old. to this day, her body has not been found. jury selection in this case starts in september. to a story we first brought you "today in the bay." police made an arrest in connection to a shooting wednesday morning in daly city. this morning 20-year-old jordan perez is behind bars accused of shooting a man near the b.a.r.t. station. the victim remains in stable condition. so far, no motive has been revealed. it's 5:04 on your friday morning. and another cab driver attacked in san francisco. police are hoping that this video could help them catch the suspects. this is dash cam footage taken from inside a san francisco cab. police say that four men were inside thatúujt when they suddenly tazed and robbed the

driver. this happened earlier this month in the city's neighborhood and so far no arrests. we also reported this week that another cab driver was attacked by a passenger in san francisco. that passenger was ultimately arrested. the attack was also captured on dash cam video. new warning for b.a.r.t. riders using cellphones to be on alert. if they times reports at least 13 b.a.r.t. riders have had their devices stolen over the past two weeks. most victims were iphone users. b.a.r.t. police say the incidents all took place at nine stations between san francisco and oakland. in ten cases suspects grabbed the phones from victims while they were on the train and they dashed on the platform. two other cases happened out on the platform. we're following developments in central italy this morning where hopes are fading to find more suffer vif evers from wednesday's deadly 6.2 earthquake. dramatic new drone footage shows the devastation in the villages near the town of amatrice. the number of people killed

circle around and the flames die down. they were going up pretty high right here off the ashby avenue off-ramp. all these folks were slowing as the commute built right here. again, west 80 at ashby. off ramp closed for a few minutes as, again, fire crews are on scene. but the flames are gone. just smoke in the area. that was a big change, changed a lot. fire burst off, lots of flames and distraction and slowing. some recovery now. no problems at the bay bridge. should see the metering lights turn on in ten minutes. maybe a little longer because it's friday with a lighter commute. the rest of the bay shows a smooth flow of traffic. i'm tracking this crash in san ramon. and san mateo bridge, westbound, your commute direction looks great. no problems across on the peninsula. back to you. >> thank you. coming up next, new measures to save lives on the golden gate bridge. plus, remember this house fire in pittsburg this week? we reported it to you yesterday. a blind man was pulled out of it. but he wasn't the only one.

donations are being raised for the people who lost their home in a fire in pittsburg. a follow-up right now and donations are being raised for the people who lost their home in a fire in pittsburg earlier this week. that fire critically injured a blind man and destroyed the home that he lived in with a 19-year-old pregnant woman and that woman's godmother.

agofundme page has been set up to help them get back on their feet. we're told the blind man remains in critical but stable condition. and the officer who helped rescue them from that fire is recovering after surgery. he was injured by falling glass during the rescue. no word on what started the fire. the golden gate bridge district is turning to technology to help reach young people who are considering suicide at the bridge. district officials say in the past 15 years the number of people under 25 coming to the bridge to commit suicide has increased more than five fold. in response, the district is partnering with a national non-profit crisis text line. the goal is to better reach out to troubled young people who frequently use text messages to xun kate. crews are going to be out today installing crisis text sign on the bridge. investigative unit exclusive this morning. if you've ever hired a lawyer who ended up you felt cheated you out of money there's a place you can go for help. of course the california bar.

peninsula have no delays. over here you might find some delay although we don't see any showing up on sensors. remember the smart corridor started yesterday. pete suratos told us about the ever overhead signs. might be using them as you're approaching the ashby off-ramp. live shot. we have the fire over here. still have the off-ramp. it's closed off of westbound 80. frontage road still usable. there may be signs lit upcoming out of richmond approaching the scene causing folks to shift over. i see a smooth drive. we'll track it. back to you. we start with breaking news. >> that's right. bob redell is following it for thus morning. police investigating the city's 34th homicide. it happened overnight right here in san jose. what do you know, bob? >> reporter: well, good morning. from what san jose police have told us they have not yet made any arrests. investigators are still trying to identify the suspect in this murder that took place last night at around 8:30. this is near will intersection of bonita and herald. this is a neighborhood that

almost sits underneath the 280/101 flyover. police received the 911 call that came in as possible dead body. when the officers arrived they found a man suffering from what police describe as visible injuries. he died soon after at the scene. it appears he was located behind a chain linked fence in a grassy area underneath the interstate. police are still trying to figure out what led up to this killing. as you mentioned, this is the 34th om side of the year for the city of san jose. you compare that to last year. 34th. that is four more than total for 2015. reporting live here outside san jose police headquarters, bob redell, "today in the bay." >> bob, thank you very much. some very disturbing accusations in the south bay as well. this morning a father is expected to make his first court appearance on charges that he severely beat his infant daughter. investigators say that 32-year-old matthew zabala violent by beat his 6-week-old

daughter. family members brought her there on sunday after the baby had suffered cardiac arrest. doctors found 14 different fractures on her body. after interviewing the family sheriffs investigators determined that her own father was responsible. >> it's extremely difficult. it's horrific crime. sheriff's office employees we want to protect our community and this young 6-week-old infant, she's at a most vulnerable point of her life. she can't even feed herself. it's a horrible crime. >> zabala has prior convictions for child abuse as well, even serving time in prison for those crimes. moving on now. robbing banks without a disguise. that's what police say the thief has done at least twice. recently at south bay banks. sack a look at the images. san jose police say this man has robbed two banks in the last two weeks. actually the last week. most recent one yesterday at a wells fargo in west san jose. investigators say that man simply hands a note to the

teller saying that he's armed and demanding cash. >> he's just a plain guy walking in and it will be hard for any witnesses to recognize that bank robbery is going on. >> as you can tell from these series of surveillance videos, he's wearing a hat but his face is entirely uncovered. police are asking you to call if you have any information in this case. a rash of burglaries in an upscale east bay neighborhood. residents say police response is not enough so they're trying to do something about it themselves. there have been teb break-ins in livermore including four in one day and four attempted break-ins. locals we talk to say police have been responsive but they want more. close to 200 people attended a community competing at independence park all concerned about home burglaries. they say they want more officers on the streets. >> there's communities that are third of our size and they have more officers per capita. >> we want to make sure that the

police department is staffed according to the city plan. >> livermore police say they have 91 sworn officers on staff with only 2 vacancies. new this morning. two men are in custody after police say they were found with explosives last night in fairfield. it happened when police stopped a suspicious car on central place right near the scandia family center. one of the men were a wanted felon. uncovered burglary tools and stole listen property along with what's described as improvised explosive devices, or ieds. explosives team was called to help dispose of those devices. mountain view man in jail for recording people in a rest room, including a toddler. he's facing multiple charges. the crime happened at a home on middle field road where he was renting a room. officers say last week a woman came forward saying she received

online photos of herself in the rest room. mountain view police tracked him down with the help of their cyber crime unit. not guilty plea by a man charged with beating a homeless man to death three months ago in golden gate park. 26-year-old michael grass dl so was arrested on tuesday and charged with murder, torture, and conspiracy. he's one of six people accused of brutally assaulting steven williams for three days, then dumping his body in a pond. four other people have already been charged in connection to williams' death. a sixth suspect was caught in arizona earlier this week. she's expected to be extradited to san francisco sometime in the next couple of days. san jose's police staffing problem is said to be getting so severe some officers are camping outside headquarters because they're working so much. making a statement or an actual need? when our crew was there the parking lot looked a bit like an rv park with more than a dozen mobile homes. officers who lives far away like

owner yesterday felt threatened by a possibly mentally disturbed man who was carrying a knife. this happened along a popular walking trail right near morery point in pacifica. the dog owner took photos of the man and gave them to police. we spoke with that observer. he didn't want to be identified. she did explain the man as he walked by had a knife by his side. >> it's there so i the stab your dog if he gets anywhere near me. i felt threatened. i felt threatened for my dog and for myself. >> pacifica police point out they are not treating this case as a crime but looking into whether the man may have made other dog owners fearful as well. happening today, berkeley city council members are trying to beat voters to the punch and quickly. it would raise the minimum wage to $15 an hour scaled by 2018. two measures are currently listed on the november ballot. city council members fear that they create confusion for voters

so they're calling this ordinance, quote, a compromise. today's vote is taking place during the council's summer recess and was only announced yesterday. 5:37. he may be out of rio but he's still in hot water. more trouble for ryan lochte after rio police are charging him with filing a false robbery report. it all stems from lochte's exaggerated claim of being robbed at gun point. he will be informed of the charges in the united states and then can decide whether to introduce a defense in brazil. lochte's lawyer says so far the swimmer has not heard anything from rio officials. no reported cases of the zika virus in athletes in rio or spectator os anyone associated with the olympics. world health officials are monitoring but doctors say there was a one-week incubation period of the virus. lots of people are ready to feel the burn in a big way and has nothing to do with bernie sanders. >> sanders, no.

in philadelphia - and we want to friday morning. pretty scary moment caught on video in philadelphia. we need to warn you the images are graphic but the officer hit in the video is expected to be okay. >> this involves a drunk driver. police say that drunk driver zoomed past a police officer standing near a car along the road. you see how close that is. the next incident, the officer is gone. knocked literally out of his shoes 15 feet into the air. alert truck driver gave chase and notified ms. and caught up to the driver and arrested him. that officer suffered nonlife-threatening injuries. a new assignment this morning for the santa clara county judge in the standford sexual assault trial.

aaron persky will no longer hear criminal cases. >> as he asked to be reassigned. "today in the bay's" pete suratos joining us live from palo alto this morning. pete, what's the judge saying now? >> good morning, sam and laura. this was at his own request and now judge aaron persky will only handle civil cases but this all happens amidst a lot of pressure for him to resign from his bench all together. persky is still technically transfer back to criminal case it is he so chooses. the judge has been at the center of attention for handing down what critics called a lenient jail sentence for brock turner. giving turner six months in jail for sexually assaulting a woman at a stanford frat party last year. since we've seen advocacy groups like ultraviolet gathering signatures this past week petitions the judicial commission to take action, not to mention official recall effort from current stanford law professor to remove the judge from the bench. here's that stanford law professor weighing in.
