80s around the tri-valley. san francisco upper 60s. low 80s around the south bay. so a pretty pleasant start to your friday morning now. anthony in for mike with a look at your friday morning commute. >> looking at good conditions. we have a couple of spots that are of concern this morning. in fact, on 680 northbound at 84 eastbound there is some slowing here. in fact, there was a report of a car fire, another one, in fact, and this is not picking up on the slowing that i was seeing just a minute ago. keep in mind there is slowing 680 northbound through sunol. the south bay we have construction in the roadway where 101 meet. but overall, lots of green on the map p that means good to go. we'll track more, back to you. now to something we've been tracking all morning long. former stanford swimmer brock turner is about to be released from jail. it could happen at any minute as we take a live look at all of the folks, members of the media, protesters, gathered outside awaiting that moment. he's going to walk out a free man very soon. >> in the last ten minutes bob redell talked with the sheriff

laurie smith. she made mention of the revised sentencing law that's now on the governor's desk, ab-2888. right now the issue is him walking out of jail and whether or not he's going to get any sort of preferential treatment which has been the accusation all along, bob. >> sheriff laurie smith made a point of the fact that he as not received any preferential treatment during his three-month stay under her control as far as being the sheriff of santa clara county. he says, we he has, however, been in protective custody because of the nature of the case and the high-profile nature of it but he would be walking out the front entrance of the jail here. any time between now and the next couple of hours. it could be as late as 9:00 in the morning. but you can see that the main entrance there, the same entrance that any other inmate would leave and if you look to your left you will see they set up barricades, presented a clear

walkway for him to get out and it's lined with members of media though there are a few people from the public who are upset with the short sentence that he received. you will recall that judge aaron persky sentenced brock turner to six months in jail for the sexual assault of an unconscious woman while he was a stanford whether he was also a star swimmer and because of good behavior he is only serving three months of the sentence which is why there's been so much outrage. another reason why they put these barricades out, sheriff's department was expecting many more protesters out here. there's only been a few people out here this morning. here's the sheriff talking about the arrangement for this morning. >> you know, i knew that this was of interest to the public. this is -- we want too make sure that he's treated exactly the same way as anyone else is. certainly we have a lot of people here this morning and we need to make sure the public is safe but this is how everyone comes out and there is no special treatment.

>> you can see the aerial view of the entrance to the jail here where we're expecting brock turner to be leaving at any moment. there's probably a window here between now and 9:00 that he's expected to come out. when he does leave, he's expected to travel back to his home state of ohio. he will be on probation for three years. he will have to register as a sex offender and attend drug and alcohol sessions. you were mentioned ab-2888. that is a bill that is on the desk of governor jerry brown. the sheriff issued a letter urging the governor to sign that bill. this is a bill that would require minimum prison sentences for people convict oefd sexual assault of unconscious people. reporting live here outside the main jail in downtown san jose, bob redell, "today in the bay." >> bob, we will be checking back in with you shortly. thank you. this is a story we've been follow for months and will continue to watch. bob will have an update on the release of brock turner which should happen in the next four hour or so according to the sheriff's own words. next report is coming up in the

next half hour. new this morning, also, in an argument ends in gunfire on the streets of hayward. this happened in the area of south garden avenue and eighth street near interstate 880. police athe victim was just walking down the street when it appears he was involved in an argument with another person or perhaps several people. that man was shot in the torso and left in the street. he is now in the hospital with nonlife-threatening injuries but right now the search continues for suspects. now to another subject story that a lot of people are still weighing in on. 49ers quarterback kol pin kaepernick did it again. he did not stand during the national anthem. instead, he took a knee. ♪ kaepernick's continued sideline protests drew loud boos last night in san diego as the chargers were honoring the military ahead of the game. kaepernick did stand while 240

military personnel unfurled a u.s. super flag. but he kneeled for the anthem. he's been sitting during the national anthem at games in the last several preseason games. he says he's protesting the oppression of african-americans in this country and policing tactics. the quarterback did address the issue again after the game last night. >> i'm not anti-american. i love america. i love people. that's why i'm doing this. i want to help make america better. i think having these conversations helps everybody have a better understanding of where everybody is coming from. >> a lot of questions about what he would do next if he were to take this stand. how else he would get involved. kaepernick is now promising to donate the first $1 million of his 2016 salary to various community organizations. 49ers safety eric reid joined kaepernick's protest last night. the 49ers did win the game. the final score, 31-21.

also, in oakland last night another player took a seat during the national anthem. it was not a member of the silver and black though. it was a seahawks secondary player, starting cornerback jeremy lane. he was the only one to do so. lane tells us that he likes kaepernick's message and stance which is why he decided to join the protest. new this morning, los gatos city council voted to reject that controversial north 40 project. developers wanted to build on 44 acres between highway 17 and los gatos boulevard just south of highway 8 a. if you've been around thereoff seen the orange markers. that plan called for tearing down an orchard and building 320 homes and 66,000 square feet of retail stores. locals were concerned about traffic and that big box stores would hurt these small business owners but business owners closest to north 40 say that they did support the development because of that increase foot traffic. to this developing story now

in hurricane hermine which whipped through florida's gulf coast overnight bringing with it 80-mile-per-hour winds and life-threatening storm surges as well. as florida wakes up to the aftermath of that fast-moving storm, the east coast all of the way up to new jersey bracing for what's next. all right. "today in the bay's" jay gray joining us this morning from va vana, georgia, where the affects are going felt from the storms through florida to georgia. >> yes, sam, kris, good morning. thankfully a break right now in between the outer bands of hermine. it moves into the savannah area. we have seen this morning intense rain and swirling winds. that's what you get with the outer bands of this storm. but there is that break in between those as you get closer to the eye of the core of the storm, it's more tightly wound and there's no break in between the bands. so we're enjoying a little downtime here. but i can tell you the rain has been very tough at times. we already have building water in some of the low-lying areas

here. and then there's a concern with the wind. we should see gusts of 40 to 45 miles an hour through the afternoon here. savannah, a beautiful old city but it's got older trees and that could mean some limbs or trees top with that wind bringing down power lines as well. crews were stationed here yesterday, prepared to move in. once this storm clears the area, we'll get about 10 to 12 inches of rain i'm told. that will cause some flooding issues as well. and hermine is going to stick around. it's going to move through georgia into the carolinas and then up the east coast as you talk, that's going to be a problem through early next week. so the entire holiday weekend, this storm is going to effect millions as it moves further north and to the east, what we'll see is the rain continue but also offshore rip tides. so a big warning for a lot of those who thought they might spend the holiday out one more trip to the beach, it's going to be kind of dangerous. you will need to watch that and wait until the storm clears.

"today in the bay's" tracie potts ask joining us live in washington, d.c. with all the reaction this morning. tracie, good morning. >> sam and kris, that's not confusing at all, is it? we'll try and break it down for you. on wednesday donald trump made it clear that he thinks that all people who came into this country illegally should be deported. in the last 24 hours seems to be back off that a bit when it comes to people who have not committed crimes. one day after insisting all undocumented immigrants must be deported, donald trump seems to being baing off. >> killers and drug dealers an all of them, they're gone. then we're going to make a determination as to what we're going to do. >> reporter: democratic running mate tim kaine's questioning why trump didn't insist in private that mexico pay for a wall at the boarder? >> he kind of chickened out and choked when he got right to it. >> reporter: trump also catching heat this morning after "the new york times" published an internal document showing questions and answers for his appearance at a black church in detroit this weekend, are all

script scripted. meantime, vice president joe biden is addressing hillary clinton's ties to her family's foundations. >> i think the clinton foundation like all foundations have found themselves in a position where things are changing and i think she's going to change. >> reporter: a.p. review of clinton's public schedule as secretary of state found dozens of meetings with foundation donors. the state department has confirmed they will release the rest of her public schedule by october 17th, before the election. and her campaign confirms that she will now be traveling on to press plain starting monday. she's caught some heat for not giving reporters enough access. she hasn't had any news conferences this year. but it sounds like she may end up getting a lot of questions in route as she starts traveling on that plane monday. >> all right. i'd like to be on that plane. >> i think a lot of people would like to be, yeah, a fly on the wall, if you will. as we talk about travel right now, travel that went wrong yesterday. it's going to take some rocket

scientists to figure out what went wrong with the spacex rocket that exploded while on the launchpad yesterday. >> it was spectacular. scott mcgrew, they're going to have their work cut out for them. >> the falcon 9 is in lots of little pieces but this is not the first time that spacex has had to deal with rapid unscheduled disassembly. what we would call a big kaboom. we have video that shows the detonation here. starts in the upper stage. and then it's just catastrophic. there had been reports the rocket was carrying a facebook satellite that sort of true. i talked to the satellite's makers in israel overnight. facebook was going to rent time on that satellite to beam internet access to parts of africa but facebook didn't pay for or invest in the actual satellite. nothing special at the satellite itself as much as it was the satellite's planned orbit. it was perfect for broadcasting into southern africa. you really cannot over state what a lousy week it's been for elon musk. even before his rocket blew up.

coming up at 11:00 this morning, then reopen at 5:00 this evening. that will releet saturday, sunday, and monday. labor day weekend is right in front of us. that means barbecues and lots of time at the pool, right? unless it's not actually cool weather. >> you may be huddling by the barbecues if you're out on the coast. seeing cool temperatures. in fact, today is probably going to be the warmest day of the next three to four days around the bay area outside right now, we've been seeing temperatures in the 50s and keeping a close eye on those labor day plans beingesqued by now tropical storm hermine. winds have come down a bit to 60 miles per hour. but the slow pat of this storm as it moves from georgia to south carolina over the outer banks of north carolina and then essentially parks itself just offshore of new york and around the east coast for the next two to three days. a lingering impact with beach erosion and heavy rains. hurricane lester still approaching hawaii. it's still curving off to the north. we hope that pattern holds by

saturday. some large surf but the worst and wind and rain off hawaii. around the bay area, temperatures in the 50s. cool start. 51 degrees already this morning. down around santa rosa. got some chilly temperatures for the afternoon highs climbing into the 80s. upper 60s around san francisco. north bay and tri-valley today with highs in the mird 80s in the forecast. but here's the reason why labor day weekend is going to stay cool as you can see the upper air pattern continues to keep this trough in place. you are going to see cool temperatures from the bay area up towards lake tahoe. three-day outlook looking at temperatures close to 70 and monterrey bay we'll have highs in the upper 60s with some areas of drizzle and mist and we'll probably see the same tomorrow morning in san francisco. temperatures in the low 60s. staying cool for labor day weekend. even the valleys. inland temperatures cooling. upper 70s and low 80s. heading through the weekend. the pleasant weekend ahead, let's see if the friday commute is still pleasant at this hour with anthony. >>ed hoing up good right now. noting looking up too much. as far as incidents of traffic

is starting to build a little bit but i do want to show you the spot this morning at 680 northbound near the 84 connector. report of a stall, breakdown, crews on the scene trying to put out a fire now in that area. you can see lots of green getting around this. not a lot of congestion through this area. across parts of 84 through livermore keep in mind near ysabel avenue, parts of that street is closed headed that direction as well. but across the rest of the east bay looking good. keep in mind the oakland as have a game this evening so you have a little more company. take you out side right now and dublin, congestion building but not too bad. we don't have any accidents coming through the altamont pass. back to you guys. >> big sign is dark this morning. notice that? coming up, causing a stink. the proposed multi-million dollar sewage tanks that has some peninsula residents all fired up. the smell of fear is in the air

as san mateo leaders 5:25 on your friday. and the smell of fear is in the air along with other things, too. as san mateo leaders consider installing a 5 million gallon sewage tank. hundreds of community member have signed a petition to block it from going in. many are afraid the fumes will make them sick. others worry their home values are going to plummet. the city says the $900 million program is going to keep the streets and the bay cleaner. they add the tank will be buried underground and will have odor

filters. >> it was alarming and shocking not to have really been reached out to. >> the tank would be empty. it would be cleaned after each use. >> the upgrades are all part of a state mandate. clean water program manager says the tank will only be used during rainstorms to stop raw sewage from spilling into the streets. there will be no final decision until january. san francisco superior court judge blocked the city ord nansz protecting school employees from evictions during the school year. that ordinance was unanimously approved by the board of supervisors in may. yesterday a judge ruled that it is in conflict with state law and prevents property owners from making major rehabilitation or moving into their properties between september and june. the legislation was introduced in response to the housing crisis which is creating a shortage of teachers in the city who say they can't find a place to live. coming up next, the much anticipated release of former stanford swimmer brork turner is

by the afternoon, highs in mid 80s and tr tri-valley. 60 nsz san francisco. things looking pretty good for your friday forecast. now let's see what's happening p your friday commute. >> looking good as well. all depends on where you're traveling. in fact, for most of us if you're just headed toward the bay bridge toll plaza, 880 corridor, 101 headed up to the peninsula. wide open lanes. it's through the sunol grade if you're travel that direction, 680 northbound over near the 84 connector there was a report of a breakdown with a car fire but you can see the green on the map denotes that people are getting through without problems. over toward the bay bridge toll plaza, a couple of things happening on 880 and towards the caldecott tunnel but looks more impressive than it is because you can see not a whole lot of folk on the road this morning. maybe taking advantage of that four-day weekend. back to you.

5:31. back to your breaking news this morning. you see this is one of our live cameras there. outside the main jail in santa clara county where convicted sex offender brock turner is expected to be released any time now. this comes after serving three months in jail for sexually assaulting an unconscious woman. it is a sentence that has created a fire storm of controversy across the nation and that's the reason for the high level of interest outside the jail today. "today in the bay's" bob redell is joining us live from the county jail this morning as we await brock turner's release. and bob, we saw sheriff smith come out and address the public within the last 30 or 40 minutes. tell us what is the atmosphere like right now? >> well, basically it's just a lot of us members of the media out here and then there's a few individual civilians who have a high interest in this case. brock turner expected to exit out the front entrance of the main jail here in downtown san jose just like any other inmate would. the sheriff, laurie smith, out here earlier making a point to

say he will not be receiving any preferential treatment. you will notice barricades are set up to open up a clear pathway for him. they national initially put them out here in case there was a large protest which has not turned out. gn, he's expected to walk out any time between now and maybe around 9:00. that's what we heard from the sheriff's office. aaron persky, the judge who sentenced brock turner to six months in jail for the sexual assault of an unconscious woman on stanford's campus, his sentence has created a lot of outrage. there was one rape survivor here who is quite upset to that and add to the fact that even though he was sentenced to six months in jail, he's only serving three months of that sentence. >> this is just an issue that's really near and dear to my part, ending rape culture. i think it's difficult what this judge did and he's getting out so early. we just came down to look him in the eyes and just to show our support.

now when brock turner exits this morning, he's expected to travel back to his home state of ohio where he will be on probation for the next three years. he will also have to register as a sex offender and attend drug and alcohol counseling sessions. now, there is a bill on the governor's desk, governor terry brown's desk, ab-28888. this morning laurie smith, the sheriff sent out a letter, expressing her support for this bill. and basically this bill would put up minimum prison sentences for anyone convicted of sexually assaulting an unconscious person. that bill the result of this brock turner case and the sheriff, again, urging governor brown to sign ab-2888. the main jail downtown san jose await for brock turner to be released at any moment now. reporting for "today in the bay," bob redell. >> thank you very much.

we are going to continue to stay on top of brock turner's anticipated release. as for what's next for the former stanford swimmer, once he's a free man, let's take a closer look again one more time. he's going to be on probation for a period of three years. that's first. turner will also be required to register as a sex offender. that's for life. turner is also banned from stanford for stepping foot on the campus that is the harshest possible sanction a university can impose on a student. this is a story we've been following for months now. we will continue to watch it throughout the morning. bob redell is having another update on the release of brock turner coming up in our next half hour. taking a knee. all eyes are on kol inwicolin kaepernick, not because of his performance on the field but because of what happened before the game last night. he once again decided to not stand during the national anthem and instead he knelt down. with reaction following yet another protest from the controversial athlete and, pete, what is taking a knee mean in this context? >> good morning, kris. it was the fourth game in a row that colin kaepernick refused to stand during the national anthem. he took that knee in respect to the veterans that were at the game. just all the people that have been critiquing him. we have that video of him take that knee and you don't see him there but he was joined by fellow 49er and pro bowl safety eric reid who was a very popular member of the team. and in oakland, you had seattle seahawks cornerback jeremy lane sitting down on the bench during the national anthem. as i mentioned, kaepernick's to kneel and sit on the bench was more for veterans. a green beret who recently tried out ironically for the seattle seahawks but was released. now, those two men embraced following the anthem. now, the point of all this, of

kap's protest is to bring attention to what he considers the on going oppression of minorities in this country. kaepernick spoke at length afterwards about his actions. >> i'm not anti-american. i love america. i love people, that's why i'm doing this. i want to help make america better. and i think having these conversations helps everybody have a better understanding of where everybody is coming from. >> reporter: kaepernick also mentioned after the game he plans to work with different community organizations, even promising to donate his first $1 million this season to these organizations. he didn't name which organization. now, kap's next opportunity to sit or kneel at game will be during the season opener right here at levi stadium on monday night on september f12th. that'ss a s that's assuming he makes the final roster. pete suratos, for "today in the bay." the woman at the center of the police sex abuse scandal involving dozens of police

officers from around the bay area is in florida this morning in jail. 19-year-old from richmond who called herself celeste guap is now facing an aggravated battery charge. the police report from florida says that she had a violent episode at voluntary rehab facility. it started when she ran outside and exposed herself to people on the street and threatened staff and even bit a security officer on the arm. again, according to the police repo report. once she was arrested police say she repeatedly banged her head against the patrol car window and propositioned officers. experts say she needs help. >> that kind of sexual acting out behavior isn't just -- doesn't just occur one day. right? there's got to be some underlying thing. >> more than a dozen police officers here in the bay area are under investigation for having sex with the richmond woman. some of them while she was under age. guap says some of the encounters happened when she was a minor. right now to story you will

only see on nbc bay area. a south bay high schoolteacher says he has proof of a crime but the police officer are too understaffed to do anything about it. he claims that he has video of one of his former students at willow glen high school shattering his car wind shill with a rock in front of his south san jose home. he showed us the video, the same video he shared with san jose police. >> we live in the middle of silicon valley and you wish that there were enough officers to come and help out and, you know, take care of it. i understand there's worst crimes happening in the city. >> san jose police says the case has been assigned to a detective who is going to investigate. the police department has been mired in a staffing crisis for several years now. on tuesday the city council declared a state of emergency in order to allow the chief to pull more detectives out of their current jobs to help answer 911 calls and put more folks on the streets. that means though even fewer detectives will be able to help victims like kimmerer.

151,000 jobs, kris, added to the american economy in the month of august. categories that did well, computer and i.t. as well as service jobs, restaurants, that kind of thing. construction and manufacturing jobs sank. here are the numbers. unemployment rate sticks at 4.9%. 151,000 jobs is a good medium number. certainly not as strong as it had been in the past few months. historically though august has not been a strong month no matter what the state of the economy. now, what will wall street think of this? we'll see that with the market open less than an hour from now. it's about what we expected. the question is going to be what does the fed think? samsung will recall galaxy note 7 worldwide. the new phone has a problem but we're just days away from unveiling the apple iphone 7. the big competitor. samsung says it will give us details on the recall in two
