class for the first time since two of their classmates were killed in a car accident. plus, students threatened at a south bay high school. the safety measures the district is taking to make sure all students are safe. he was bleeding and vomiting. i asked him if he was all right. >> bruce miller arrested again. now cut from the 49ers. the new surveillance of the athlete's moments after he allegedly beat a 70-year-old man and his son. bay. 80s and now 90s making a comeback today around the tri-valley. areas south of downtown san jose we'll let you know how long the heat is going to stick around in the forecast. now once again to see what's happening with your commute, here's mike. >> after early morning crashes one of them being this san jose. cleared up. san jose shows you the tiniest build north 101. right on schedule for the south bay. no major problems. let's use the whole map. tri-valley. sorting out to typical pattern from 580 down towards sunol boulevard. southbound commute direction. 880 down toward union city. on the peninsula, no delays, no problems. the bridges looking good. dumbarton bridge in san mateo getting across the bay. bay bridge, we'll talk about that. i do want to show you build from walnut creek and the approach to the bay bridge has the backup, the worse of it off of 580 and 24. unnerving message from a school communitys a students are threatened at a south bay high school and this morning there's word of an arrest. kris sanchez is joining us live

from fremont high in sunnyvale. despite this arrest there's going to be more security on campus today and showing parents things are going to be okay. >> right. they are trying to make sure that families feel safe act sending their students to school here at fremont high school in sunnyvale. sunnyvale dps, department of public safety, said they're going to have increased security here. the school district also trying to reassure parents. but it was a rattling weekend for palmlies here in this district and at this school because some of them saw anonymous threats posted on social media targeting fremont high school here in sunnyvale. either the district nor sunnyvale public safety will specify what that threat was. only to say that it was anonymous. the super tuesday says that staff immediately called sunnyvale public safety and police tracked down the person who they believe is responsible for making those threats. that person is now under arrest. now, in an e-mail from the

fremont union superintendent to families it reads in part, at this time sunnyvale public safety does not anticipate any of these threats as being valid. however, out of an abundance of caution, sunnyvale public safety will have a presence on both the fremont and homestead campuses in cupertino during the day today to ensure the safety of our students and staff. we don't know whether the source of that threat is a student. we do know that one person is now in custody. and police say they're not releasing more details because it is an ongoing investigation. in regard to the additional safety we haven't seen any out here yet but the first bell doesn't ring for another hour and a half. in sunnyvale, kris sanchez, "today in the bay." . >> thank you, kris. breaking news. a terrible wreck in oakland. two people ejected from an suv after the driver loses control. it happened in high street and san leandro boulevard overnight. the suv flipped a few times. went across several lanes hitting parked cars.

three people were hurt. one seriously. oakland police are looking into what caused that crash. new this morning, firefighters quickly doused a two alarm plaz in san francisco's hayes valley neighborhood. crews worked to keep it from spreading into any neighboring homes. no word on how many people were displaced an so far the cause is under investigation. we're getting new look at surveillance this morning that shows former 49er bruce miller moments after he allegedly attackeded a father and his adult son inside a san francisco hotel. >> "today in the bay's" pete suratos is live in san francisco for us this morning. pete, miller is now off the team after what's now his second arrest. >> reporter: good morning, laura and sam. yes, first arrest was back in 2015. that was in santa clara. this latest one was here in san francisco. according to sfpd he got into an alleged altercation inside this

marriott in fisherman's wharf. that surveillance video, he stumbled across the street over here at that travel lodge. let's get to that surveillance video. in that video you can see him in jogging pants with blood on his tank top following this alleged fight. they say it happened around 2:45 a.m. on monday. intoxicated miller went into the marriott and tried to get into a room that wasn't his. that's when a 70-year-old man came out of his room and told him he had the wrong room. that man's 29-year-old son came out and checked on his dad and that's when miller attacked them. they were taken to the hospital for their injuries. here's the desk manager who called 911 explaining miller's situation. >> came outside this way. and he sat down here and he started vomiting over here. >> reporter: this is not his first run-in with the law. just a year ago he was arrested after he pushed a woman to the ground and destroyed her cellphone at the rivermark plaza in santa clara.

he tweeted, no contest at the time and it resulted in only a disturbing the pieeace convecti. shortly after that the san francisco 49ers released miller after five years with the team. coming up, we'll hear from hotel patrons about this incident. we're live in san francisco, pete suratos for "today in the bay." if you would like to watch the full surveillance video in connection with bruce miller's arrest we posted the unedited clip on our website, nbcbayarea.com. it will be a very emotional first day of class for students in the east bay. they remember two of their own classmates killed in a crash over the weekend. here's a live pictures from james logan high school where students are leaving candles in memory of izaiah meese and joe ioramo. the teenagers were killed in a car crash on 880 certainly sunday morning. 17-year-old izaiah meese was driving a honda which collide with a damage truck. family and friends say the teens

were out for a late night snack. more than 100 people showed up to mourn their death. >> you want them to explore, you want them to be independent. i think we raise our kids to be independent. but we also don't want to shelter them too much. >> the highway patrol is still investigating what caused the crash. 14-year-old boy hit by a car while riding his bike has died. city of oakland made that announcement on facebook yesterday noting the boy's family was with him at the hospital. witnesses say the boy was actually riding on the sidewalk but he veered on the street to avoid pedestrians when he was hit. the driver is cooperating with the investigation. the city says there's no indication that alcohol or drugs were involved. the search continues in the south bay for a man who police say tried to kidnap two young women. police are looking for david lee russell, 56-year-old who has prior convictions for assaults against womennd is considered

extremely dangerous. investigators say that russell carried out two attempted kid p kidnappings last week, very close calls. first one on monday and hamilton and meridian avenues. >> the mere fact that the crimes were committed in san jose, people in the entire bay area should be on the lookout because how easily can he just drive 30 minutes and be in another county. >> keep a close watch out. police say the attempted kidnappings happened in the evening about 5:00 on busy intersections. in both of these cases the women were just walking alone. fortunately both of them were able to fight back and get away. crews are battling a fast moving wildfire. the so-called saddle fik fire in butte county is growing to 400 acres in just a matter of hours yesterday. so far at least two structures have been destroyed. the fire is now progressing downhill make it difficult for

firefighters to battle the flames. it's currently only 10% contained. frustrating milestone for firefighters. the soberanes wildfire burning in monterrey county has charred more than 100,000 acres. that wildfire has been burning near big sur for more than a month now. one person died and nearly 60 homes are destroyed. and it is still only 60% contained. firefighters say it's going to be a while before it is completely under control. >> a testament to how difficult the conditions are for firefighters. we've been watch that for weeks now. rob mayeda stepping in for kari hall. we're going of show you the baby pictures in a second, but first, the local forecast. >> our temperatures this morning if the 40s and 50s. air quality an issue today as north winds pick up the wildfire smoke from butte county spilling towards the bay area during the day today. moderate levels of air pollution around the bay area of highs today starting to rise back to more summer like levels. close to 90 south of san jose. low 70s for san francisco.

mid 90s today around the tri-valley. we could see upper 90s around livermore tomorrow. it's a busy start in the morning. mike has more on that. >> in addition to our normal build we have a new crash, so concern for 580. the rest of the bay no real concern. south bay, san jose northbound 101 just a little blip there. hayward, standard flow toward fremont. getting in toward livermore. fast lane for one vehicle. watching for any slowing coming in the commute direction. so far you're looking good though heading toward the dublin interchange. southbound to sunol boulevard. look across the bay at the foster city side of the san mateo bridge. give you an idea of the volume. standard, 92, of course, seeing more traffic head over towards san mateo. no delays on the peninsula. back to you. up next on "today in the bay," amazing wedding photo and the pride and groo m don't even know that it isth it exists. the photographer's effort to

just about 6:14 on your tuesday morning. and there is one fewer gun range in the bay area as of this morning. after a half century the east bay chabot gun club has closed its doors. there's a big turpout at the gun club yesterday which was actually the club's last day of operations. it's located in castro valley and it sits on the east bay regional park district's property and the district is not renewi ing the lease. the club failed to come up with an adequate environmental plan to clean up lead pollution. now the district is leading clean-up efforts. >> it's going to cost a lot of money to clean up that site because of all the lead bullets that have been pounded into the dirt there for so long. anywhere between 2 and $20 million, i think, depending on the extent of the contamination. >> if you don't have a good place to train and to practice, you're going to have accidents. it's pretty simple.

>> the club had about a thousand members. some of us tell them they're going to have to drive out of the bay area to find another outdoor range. technical problems causing delays for some british airways flights a cross the country. it stems from a computer glitch for the airlines check-in system. they are apologizing to customers and urging them to check-in online. british airway says it's seeing delays in heathrow but isn't commenting on social media reports on issues in san francisco, washington, d.c., and atlanta. as you say, lots of people encouraging kids to per storm stemm careers. >> that's right. scott mcgrew, sometimes that encouragement you say goes tfar >> wells fargo apologizing for a series of advertisements aimed at parents of teens trying to help them learn financial independence. the ads which went viral online said things like a ballerina yesterday, an engineer today.

it was to be bought by a company based in beijing. but the merger was dependent on one thing, and that was the successful launch of their very last satellite which blew up. >> so they pulled back. >> yeah. >> for good reason. >> it's a tough call. call the boss and say, hey, boss -- >> guess what happened. >> bad timing or good timing for the company that was going to buy them out. >> probably so. >> right. thank you. 6:17. pollution concerns mounting this morning with a boat still overturned in the delta right now. the spirit of sacramento took on water just off the coast of bethel island in contra costa county on sunday morning. right now it's surrounded by a barrier trying to prevent any pollution. but investigators feel that paddle boat can still leak 600 gallons of deesle fuel into the water. >> we're going to go out there and make sure the minimize the impact to our water. make sure our wildlife and our waterway is protected. >> the coast guard is currently investigating how that boat even sank and so far they've been

degrees and change between now and temperatures in the mid 40s and a few spots to closing in on 90 later today. feels like fall for sure right now around santa rosa. sun rise coming up at 6:45. let's show you your hour-by-hour school cast at los gatos. one of the warmer spots around the south bay as the numbers approach 90 by around 2:00 and 3:00. notice the smoke we're seeing across the bay area at sun rise. wind shift the winds out of the north will push smoke from the north across the bay area into the afternoon. notice the wind speed. not that strong sea breeze. weak offshore winds through 2:00 in the afternoon. and then by the evening commute you will see the sea breeze try to make a comeback. high temperatures today, south for san jose and morgan hill. 90 degrees. 70s closer to san francisco. north by temperatures today in the about 80s to near 90. tri-valley, so the little heat spell that we'll see will peak tomorrow. stay warm in san francisco through at least thursday and our valley temperatures holding

on to the 90s through thursday. cooling in the sea breeze makes a comeback approaching the weekend. so the hottest temperatures will be watching those around the strv tomorrow but we're also watching the tri-valley commute right now. >> that's right. a traffic hot spot or potential there because there was the build as well as a crash. that crash has cleared from 580 through livermore. the south bay is also cleared from any slowing northbound. don't be surprised. folks kicks in over the next ten minutes because 6:30 is when we cecil con valley start to show that build. over again, north livermore avenue. it's cleared out of laps. activity on the shoulder. not a problem though. 680, a standard build there for your tri-valley commute. smooth flow of traffic, slowing around hercules and the build down the east shore freeway through burerkeley. and the maze is slowing. that backup now over here as well as 580 approaching the bay bridge toll plaza. palo alto side, smooth drive but the build starts knot past south

brock turner registering as a sex offender in ohio. he's at the green county sheriff's office there. he returned to his hometown near dayton, a suburb of dayton, ohio, after being released from the santa clara main jail in san jose last friday. you watched that breaking news right here on "today in the bay." the former stanford swimmer who only served three months of a six-month long jail sentence for sexually assaulting an unconscious woman on stanford's campus. he was released early for good behavior. coming up, we'll bring you a live report from ohio. new cellphone video shows a drup group of people knocking down a popular rock formation on an oregon beach. the formation known as duck bill crumbled last week. state park officials originally thought this weather caused that damage but this new cellphone video revealed a group of people knocked it over. they claim they did it because it was a safety hazard. officials say they will review

the footage. in oakland cemetery needs to expand but in order to do that it has to chop down dozen of trees. we're not talking about ordinary trees. the east bay times reports mountain view cemetery wants to remove 200 coast live oaks. some of them are more than a century old. oakland of course is named after the oak trees. the crowded cemetery says cutting the trees down will make more room. the cemetery has 5,000 oak trees in total. it's now up to the city's planning commission to decide. good news this morning. cervical cancer rates in women are down by 50%. the reason, more women are getting tested regularly. the american cancer society says cervical cancer is one of the most common causes of death for american women. regular pap tests are critical but lifestyle changes can also help, eating well, not smoking or drinking heavily and practicing safe sex can keep the disease at bay. fon profits like tracy lane foundation are helping women who

remember two of their own classmates killed in a crash over the weekend. "today in the bay's" redell is live in union city. grief counselors will be on hand as students arrive this morning. >> reporter: the first thing that students will see when they arrive here at james logan high and i don't know i don't know city, laura, are these hundreds of candles lit yesterday in memory of their two classmates. yes, there will be grief counselors here on hand today in case there are students who need help coping with the death of those two students. students are izaiah meese 17 years old and joe ioramo 16 years old, went by the nickname of junior. two teens were out early sunday morning for what family and friends say was a late night snack. meese was behind the wheel of a honda after after midnight they collided with a dodge truck. meesa died at the scene. yesterday about 150 family and friends. gathered here outside the high school the light the candles i

arrested again. now released from the team. bruce miller is no longer a member of the san francisco 49ers. >> police say he beat up a father and son at a san francisco marriott. "today in the bay's" pete suratos is live in san francisco with new surveillance video of miller just moments after this alleged attack took place. pete? >> good morning, laura and sam. as a result, he's facing several assault charges and that alleged attack happened here in this marriott in fisherman's wharf. in that surveillance video, it shows him stumbling across the street at this travel lodge presumably in that lobby area. let's get to some of that surveillance video. you can see him stumbling around with blood on his tank top and j jogging pants. the travel lodge manager who called 911 said miller was also vomiting. they say it took place around 2:45 a.m. on monday. you see intoxicated miller went into the marriott and tried to get into a room that wasn't his and that's when a 70-year-old

man opened the door and told him he had the wrong room. when that man's 29-year-old son came out to help his dad miller allegedly attacked both of them. both men were taken to a hospital for their injuries. here's what motel patrons at this marriott had to say about this incident. >> i was afraid. i think it was an attack or something like that. >> another black eye for the 49ers even though we're not 49er fans i hate to see that go on. >> another black eye indeed. this is not his first run-in with the law. miller was arrested after he pushed a woman to the ground and destroyed her cellphone in santa clara. he pleaded no contest at the time and resulted in only a disturbing the peace conviction. and shortly after his arrest on monday the san francisco 49ers released the tight end who played for the team for five seasons. live in san francisco, pete suratos for "today in the bay." >> pete, thank you very much. there is a new arrest in a year long murder investigation

solano county. they arrested him during a traffic stop. he gunned down a woman outside her home last year. investigators are still looking for the getaway driver. they currently have an arrest warrant for richard hill. arm and dangerous. anyone with information is asked to call the sheriff's office. east bay mayor is demanding the state do more after another highway shooting this fast holiday weekend. nearly 30 in the bay area since november. the latest on 880 and oakland on sunday. the mayor of hercules is asking the state for $2 million for -- to put up cameras along several freeways. >> our proposal with license plate reader, on and off-ramps. we should have been able to capture that license plate. so the cameras are part of the problem. the cameras will solve what's occurring. it's going to be a deterrent. >> the shooting happened about 5:00 on sunday night near the

high street off-ramp. oakland police say the driver of the silver mercedes hit two cars on the freeway and then opened fire. no one was shot. two people were injured from that crash. the gunman is still on the loose this morning. you may remember a follow-up now, a sick coyote who wildlife officials were searching for for weeks has been found dead. that animal was struck by a car in danville. as you can see, the coyote was suffering from mange when it was spotted last month. emergency services believe it was ant threat to people. they planned to safely catch and care tort animal before releasing it back into the wild. 6:36. to the race for the white house where it is officially crunch time for both candidates vying for the presidency come november. hillary clinton and donald trump are campaigning in critical states today. trump in virginia and north carolina while clinton is in florida. yesterday both presidential hopefuls spent their labor day in the battleground state of ohio. at one point their private planes were parked just across from each other on the tarmac at

cleveland hopkins international airport. early vetting begins in a few weks and tomorrow clinton and trump will participate in the first ever commander in chief forum. moderated by nbc's matt lauer. the first presidential debate is at the end of the month. back to work today for congress. but not for long. lawmakers are returning from a seven-week break but they'll have less than a month to do and deal with key issues before leaving capitol hill again and heading home to campaign for the november election. by october 1st congress must figure out a way to fund the federal government and prevent a shut down. other items on the agenda are funds to fight the zika virus and policy legislation that determines how much is spent on the nation's military. happening right now, tropical storm newton strengthened into a hurricane and barreling toward mexico's baja california peninsula. the hurricane made landfall near

cabo earlier this morning. it's expected to travel through the region today and then move farther north into northern mexico. people living in those areas right now are under a hurricane warning. >> looks like they're getting ready there. ready for your day? let's check in with rob. he's in for kari with a look at our forecast. >> temperatures right now in the 50s but quickly warming heading into the afternoon. this is the first of three days we could see 90s across some of our value is will. areas of south of san jose, even san francisco getting in on the warming trend. low 70s in the forecast. mid 80s for the north bay and tri-valley today climbing into the mid 90s. quick check of the seven-day forecast. valley temperatures in a few spots including the tri-valley could approach the upper 90s for wednesday. to see what's happening right now, here's mike. >> that's right, rob. after a quick start tort morning commute, 5:00, saw activity. 6:00, easing back in as folks returning to work. look at your map all over the bay. we do talk about san francisco. earlier crash at the maze has cleared.

coming up an 6:43 on your tuesday morning. i.t.t. technical institute is closing all of its campuses. that announcement comes just a week after the campus estopped enrolling new students following a federal crack down on for-profit colleges. i.t.t. tech and other companies have recently been kritize r sized for accepting money and government grants and loans but failing to provide adequate job training for students. currently there are two campuses in the bay area, one in oakland and one in concord. we're going to continue to follow this story and bring you more in our news day newscast. within the last hour or so, former stanford swimmer brock turner registered as a sex offender. gad difficult schwartz is in ohio with the latest for us. good morning. >> reporter: good morning. just a little while ago. we saw brock tump eturner walk

the sheriff's office. this is the first time we've seen him registering as sex offender locally since he was released four or five day ace go in california. at one point during that time we saw his mother try to shield him from the cameras, trying to shimd her son from the cameras. but at this point most people here in the town in these small communities know that he is here. in fact, coming up in our "today" show story we show you the protesters camped out out side his home. many of them with sign, protest signs. others armed. making it very clear that brock turner is not welcome back home. we're going to hear from some of those people in our story as well as give you the latist on the recall efforts with judge aaron persky, the judge that ordered brock turner up to six months in jail. that turneded out being three months in jail because of the california good time in served

jail. >> that will be coming up in the "today" show. whack in california, a push to protect women ho suffered sexual assault and rape. rape survivors along with women's rights leaders are going to urge governor brown to sign the justice for victims act. building a press conference at the state capital in sacramento in only a few hours. the bill if signed by governor brown will eliminate the stature of limitations for rape crimes. a bill cosby accuser and attorney gloria allred will be joining the press conference. san mateo county is taking a closer look at drone in order to better understand how to utilize and regulate the devices. drones will be the topic of discussion during the board of supervisors meeting today. it's really a study session on drones. members from the san carlos airport parks and rec department are among the few groups giving presentations today. the meeting is at the hall of justice and records in redwood city at 9:00 this morning. the housing market may be

hot and we certainly need more homes here but homebuilders can't find enough workers to get the job done. the national association of homebuilders estimate there are about 200,000 unfilled construction jobs at all levels of experience. that figure is up 81% from just two years ago. without enough workers construction is trailing demand for homes. also with labor costs rising builders are resorting to making more expensive homes abandoning the starter market causing a tight supply of entry level homes. some silicon valley organizations are kicking around the idea of encouraging young women to pursue a career in construction. >> get my tool belt. it pays well. >> it matches the same criteria that people are using when we're encouraging young women to pursue careers in technology. there is a shortage of women in jobs. you heard op stemm, science,

6:55. welcome back. be fr you head out the door here are the top stories on nbc bay area. >> threats against students, we learned over the weekend, that this all came via social media. >> reporter: right. and we just learned in the last ten minutes those were threats directed at jewish students here at fremont high school in sun sunnyva sunnyvale. we just got an updated e-mail of the letter that parents got just this morning from the principal here but, again, the threats were directed at jewish students. however, the assistant

superintendent said they were not addressed to n. violence. parents were rattled as they saw the threats on social media over the weekend. neither the district for public safety would specify who is under arrest but the person responsible is in custody. now, here is an e-mail, the earlier e-mail from the fremont union superintendent to family which reads in part, at this time sunnyvale public safety does not anticipate that any of the threats are valid. however, out of abundance of caution, sunnyvale public safety will have a presence both at fremont high school and at homestead high school to ensure the safety of our students and staff. homestead high school is in cupertino but in the same district. again, we just don't if the source of the threat is a student. we hope to find out more. we understand that sunnyvale police are going to be talking to us later this morning. we have seen increased security. in fact, just behind me there was an additional police car here in front of the high school. again, out of abundance of caution the first bell is at
