that story is colin kaepernick. does it from the sidelines. the 49ers are the late toast follow in the footsteps of the second string quarterback. today the team announced that they will make a $1 million donation to a pair of bay area groups, this after kap himself vowed to donate his first $1 is million in earnings this season and additionally he'll prodate from hisgers i sales which have soared to number one in the nfl. >> the jersey sales jumped because people's belief that there can be change and we can make this country better and that they believe that i was someone that could help that change, and for me that support is something i have to give back to the communities for that cause because that's what their belief is, that's what my belief is and we can work towards a common goal. >> all right. kaepernick continues to draw support for his national anthem protest. seahawks wideout and former stanford cardinal doug baldwin

tweeted this out. our team will honor the country and flag in a pregame demonstration of unity, and in tonight's game the big thursday night game that we had here on neighbors bay area, there was a player on the broncos, brandon marshall, a linebacker, a college teammate of kap's at nevada also took a knee. you played in the nfl for 16 years. how do you see these protests on the field at nfl game? >> well, it's interesting because when -- when is it going to be that maybe you have five guys next week, ten guys the following week, i think eventually the nfl is going to step in and probably put a kibosh to this. >> with that it's time to bring in another voice, and that's our good friend over at csnbayarea didn't come, our insider matt maiocco. let's talk about kaepernick, the player. gets a chance to work with a

real master mind offensively in chip kelly. how is kap adjusting to what chip kelly and his system can do? >> colin kaepernick did not win the starting job so he'll have to wait for his time to come. blaine gabbert is the starter. colin kaepernick feels this is a similar kind of system that he ran at nevada when he was a duel threat. 49ers traded up and got him in 2011 so he hasn't got his strength back. he feels like he still has a lot of improving to do, but he feels like if he's given that opportunity he can step in and win football games. the last time he started the season on the bench was 2012 and he ended up being the starting quarterback in the super bowl that season. >> i know blaine gabbert gets the start but i've got a sneaking suspicion i might see number 7 at some point. how likely is it, and you're an insider on this, how likely is it that we see two quarterbacks on monday night against the l.a. rams, a special package for colin kaepernick because he has

special gifts chip kelly can harness? >> i don't think you'll see this week. i don't think his running ability and his strength is everything, you know, not back to where it was before all the surgery, so i don't think that that's going to be the case, and i think chip kelly has to have a long leash with blaine gabbert, at least for a while because you can't just base the starting quarterback being blaine gabbert on everything that you've seen, the body of work from the off-season program through training camp and then just pull the plug on him immediately so i think the 49ers are waiting until they feel like kaepernick is all the way back before they think about adding in some packages such as that. >> i'm hearing you say no now, leaving an opening for a couple days from now. that's what i like. let's talk about the running game. that will help any quarterback whoever gets the start. carlos hyde, the lead back, is going through concussion protocol. how like is it that we see him in the starting lineup on sunday? >> 100%. he's been fully cleared and is ready to play.

let's talk about it. let's talk about the quarterbacks. the 49ers will be a run-oriented team. that hasn't changed. chip kelly likes to run the ball. that kind of gets lost a lot of times in that short passing game and the up tempo kind of attack that they like to run, but they like to spread it out. carlos hyde has a very good feel for that spread run game. the 49ers offensive line a lot better than it has been in the past or a lot better than it was last year so expect a lot of carlos hyde on monday night against the l.a. rams. >> matt maiocco our 49ers insider getting ready for monday night, levi stadium. the l.a. rams come to town. thanks for the insights. we move along and to quote the late al davis, the greatness of the raiders is in its future. why derek carr is ready to lead oakland back to the postseason. we'll discuss next on "xfinity sports post-game."

it's the moment raiders fans have been waiting for. after a big, maybe huge off-season, silver and black open the 2016 season in the big easy taking on drew brees and the new orleans saints. quarterback derek carr says his team is ready for this moment. >> the feeling preparing for this game is like a feeling we had during the last year mid-season. you know, that's how it feels. you know, we're preparing. we know that we have a great task ahead of us in new orleans. they have recently -- i mean, they were a super bowl team not too long ago. goodness. they have a half fame quarterback. they have great young players on defense so you know what they have, and, you know, now we're just preparing for them. it's not like we have to do this. it's none of that. we're just playing football, man. we're preparing the way our coaches have taught us, and, you know, we want to go out there and play clean, solid football.

>> raiders/saints. on paper these teams evenly matched. both 7-9 last season and both teams in the middle of the pack in terms of takeaways. saints with the eighth highest scoring team on offense, but defensively ranking dead last. what will derek carr of the silver and black be able to do? can they shred the saints defense? we continue on "xfiniti post-game." scott bair is here. they are looking for a big game and a big season and what is it going to take for carr to elevate to that elite status in the nfl among quarterbacks? >> the best quarterbacks in this league perform in the fourth quarter when the game is on the line and everybody is looking to the guy with the football. can you make big plays when it matters most, and a couple of times late last year against minnesota, against kansas city, derek carr threw some ill-timed picks and got himself in trouble. if he can excel in those games,

because let's be honest, 50%, 60% of these games are decide within ten points in the fourth quarter he needs to step up and excel. he's already efficient. he already has the arm talent. he has a mastery of the scheme. now it's about performing well in the clutch. >> all right. that's the offensive side of the ball. defensive side of the ball you want to keep your team in t.raiders went out and added some key pieced. in the secondary they add shaun smith and a linebacker in bruce irvin and draft carl joseph at safety. how long does it take new pieces to gel with the old pieces and the leftovers from last year to make a cohesive defensive unit? >> if you remember last year they got off to a slow start and they got better and stronger as the year went on, so this is a situation where if they were playing a lot of basic stuff in the preseason. i think you're going to see the defense a little more complex. you're going to see a little more blitzing going on and they are going to come together starting this weekend. >> all right. we'll see if they can do it

against one heck of a future hall of fame quarterback in drew brees. but when a season starts as a fan i love power rankings. here's what i'm doing right near. csnbayarea.com. look at scott bair's nfl power rankings. heading into week one. >> what? >> what? >> look at that. >> just outside the top ten. he's got a vikings team without teddy bridgewater ranked just ahead of them. scott, how do you explain yourself? how do you grade it this way and not have the raiders in the top ten right now in. >> number one it's the preseason and it's fun and i would like -- i'm going to dangle that carrot out there for the silver and black. they haven't earned it yet. they have a lot of talent, and we haven't seen what they are going to do. vikings still have a guy named adrian peterson, i don't know, jim, if you've ever heard of him and the defense is good. this is a team on the rise, a team that could get into the top ten, a team that i believe will ultimately make the playoffs this season. again, they just have to go out and win some tough games,

especially early ones on the road and kind of get this season off on the right foot and i think a good showing in new orleans is the way to do that. >> that's a tall order, making the playoffs. remember, a couple years ago it was it a three-win team and elevate to seven wins this last season. tough to make the jump from seven to be a playoff team, but i'm going to ask you, bill, give me some reasons to believe. why should i think the raiders can make the elevation make the leap to a playoff team and end the drought? >> because they have got talent at every position and their quarterback, you know, is making improvements, and now going into his third season it's time for him to put the team on his back, along with a lot of great talent and go out there and start winning some football games, and this is a quarterback-driven league. derek carr is ready and come sunday he's going up against one of the best quarterbacks to ever play in drew brees, and it's time for him to do his thing.

security. the big announcement from the city of santa clara stemming from colin kaepernick's debate on the national anthem. nbc bay area news starts right now. good evening, and thanks for joining us. i'm jessica aguirre. >> and i'm raj mattia. on in primetime because of the nfl season opener. panthers and broncos and soon it will be 49ers, and the santa clara police department will be there to back them up. levi stadium will be secure for "monday night football" despite the objections from the santa clara pd towards colin kaepernick. all of this happening this evening. let's bring in nbc bay area's ian cole who broke the story. you've been on the forefront of all of this for several days now. what happened tonight? >> basically the officers who warned they may not volunteer at these games say they will. it's unknown how many officers were planning on sitting out for the first 49er game because last friday the santa clara police union sent a letter to the 49ers stating they were upset over colin kaepernick's statements will police officers, and the fact that he wore socks at a

practice showing pigs in police uniforms, so what changed? well, yesterday the santa clara mayor showed support for the officers in a statement but encouraged them to continue to volunteer at the games saying if they didn't their actions could be misunderstood. >> this issue that mr. kaepernick talked about is a huge issue in our country, a huge issue. it's a lot bigger than whether or not he sits down or they sit out. it's bigger than that. >> santa clara is the lead police agency during 49er games. typically about 70 of those officers volunteer to work overtime as off-cutie security. the police chief says he's pleased today and told us that the games were always going to be fully staffed, even if he had to reach out to other bay area departments. coming up tonight at 11:00, hear from the president of the silicon valley naacp who met with the chief and union after the decision was made and why he's suggesting colin kaepernick meet with them as well. live in the newsroom. ian cull, nbc bay area news. >> a lot of different angles to

this story. did you see tonight's game here on nbc bay area? another player joined kaepernick's national anthem protest. here it is. that's his college teammate from the university of nevada reno broncos linebacker brandon marshall. saw there taking a knee during the national anthem. more players are expected to join the protest this sunday. >> not just players, management is joining the movement as well. 49ers will give $1 million to two bay area groups. it is exact same amount that kaepernick promised to donate to the community from his earnings this season. the 49ers pledge will go to the silicon valley community foundation and the san francisco foundation. team ceo jed york says it's earmarked for racial and economic inequality and fostering communication and collaboration between law enforcement and the communities they serve here in the bay area. the 49ers cut ties with bruce miller after he was arrested for allegedly assaulting a 70-year-old man. today the san francisco d.a.

charged him with seven felonies, including assault with a deadly weapon. the weapon was a cane. prosecutors say miller attacked two men at a san francisco hotel on monday and given that one of them is elderly the charges are enhanced. miller is now scheduled to appear in court tomorrow afternoon. >> are there headlines this evening, new and chilling details about the so-called serial shooter? michael lewis is accused of ten shootings in san jose over the past few months but another concern tonight is there a second shooter? nbc bay area's michelle roberts joins us from san jose. michelle, what do we know? >> at this point police don't know if there is a second person and they do believe michael lewis opened fire here on blossom hill road and he was in court today and he'll be in court again tomorrow. >> today a san jose judge set bail at $100,000 for michael lewis. the 30-year-old is accused of shooting cars along blossom hill

road in the middle of the night between may and august. >> lewis who has a criminal history including charges of stealing money and assault did not enter a plea in court today, but he did appear to mouth the words help me to friends and relatives to courtroom. >> we know this guy was capable of doing anything. >> sergeant enrique garcia said he was arrested after police noticed a black dodge charger in the area saying the car had been linked to the case. >> they are giving suspects commands to exit the car, but suspect is not complying. eventually the driver takes off. >> police say they chased lewis for several blocks in the car and then on foot before making the arrest. during the follow-up investigation detectives say they have found a handgun in the house and the crime lab determined that gun was used in four of the ten shootings. today police say they don't know if lewis was the only shooter. >> you're not playing around. you're shooting a handgun at a car. >> two people were wounded by

release of the 19-year-old at the center of a police sex scandal. gaup was jailed last week after allegedly assaulting a worker at the rehab facility she checked into. >> currently right now they are just looking at ways of getting her out of jail and getting her back home to the bay area. >> meanwhile, advocates of sex trafficking victims are anxiously awaiting to hear if criminal charges will be filed against the police officers accused of having sex with gaup, some allegedly while she was underage. the city of oakland has announced it's disciplining 12 of its officers and the livermore police department says a veteran officer has resigned following its investigation. >> a regular civilian of the community would be prosecuted for anything pertaining to sexual assault with a minor and we're looking for the same outcome. >> tonight questions still remain how did gaup end up in florida, and who paid for it.

oakland city leaders are demanding answers and say they are worried for her well-being. >> there is a moral obligation to make sure that she's getting care and support. >> tonight an online fund-raiser has been launched for the teenager, and the alameda county d.a. says expect a decision on possible charges against the officers tomorrow. in oakland, jodi hernandez, nbc bay area news. >> okay. thank you, jodi. a political dustup and you see berkeley getting attention online. >> tolerance at uc berkeley, what tolerance looked like. >> video recorded by a campus republican group. members claimed protesters rushed them yesterday and then tried to steal their life-sized cutout of donald trump. a video was posted and no one was hurt in the scuffle. a silicon valley engineer is now suing valley fair mall in the south bay. he works at apple and says that mall security guard right there

pulled a gun on him. his offense, he says he ran over a traffic cone. >> it happened during the christmas shopping season. the engineer caught the confrontation on his cell phone. damien tarullo is at the offices of the man's attorney and both the mall and the guard are named in the suit. >> reporter: yes. the lawsuit here claims assault, false imprisonment and negligence. the victim says he was so traumatized he missed five months of work. nicholas buchanan says he was staring down the barrel of this gun just outside valley fair mall. he says it's all because he ran over an orange traffic cone. >> put it in park. >> the local -- the security guard who was at the site considered that a capital offense, chased him down. >> richard alexander is representing the driver nicholas buick nap. police identified the guard as francis fielding who was working in the mall parking garage for srmi security, and in the video

the guard supervisor tells the guard to put the gun away and confronts the driver. >> if you unlock your door or i'll take our your window. >> he fails all personality tests as well for his belligerency and handling a very minor event. >> westfield valley fair told nbc bay area they do not comment on pending litigation. the guard francis fielding did not return his calls and his supervisors were not shot. >> that is insane. i didn't know they were insane and i didn't know they carried guns and just for running over a cone, wow. >> investigators noted the guard had no valid gun permit nor his security guard id as is required. police recommended criminal charges against the guard but the d.a. chose not to file. the guards we saw at the mall were not armed and employed by a

company called universal protection services. damian trujillo, nbc bay area news. >> san jose police tell us two women were robbed at gunpoint at santana row. the robbery happened near hatton street, an area where people park before shopping at the outdoor mall. police say two men threatened women with a handgun and took a purse from one of the women. spoke to shoppers in the area about the robbery. >> it's scary to me because i like to come shopping by myself. >> it's quite scary. you try and feel safe when you ask that on your own, but if that can happen to somebody then you're going to be more vigilant where you go and what time you go there. >> the men sped away in a small white four-door car. they have not been caught. santana row management is not commenting on that robbery. >> from stanford university to sex offender school, that's where brock turner is now heading. as part of his probation the former stanford student must enroll in a sex offender

program. tonight we take a look at the program and turner's chances of committing another sexual assault. >> after jail the first step for brock turner was to register as a sex offender. this is his new life, one year in a sex offender management program and a lifetime on the sex offender registry. >> just like the victim, he's never going to forget this. >> reporter: santa clara county refers sex offenders to five providers in its management program. one of them is psychologist robert land. >> there's three people in the room. there's the provider. there's the individual offender, and there espolice detective so everything that we do we have to keep the public safety in mind. >> reporter: he says attempting to change distorted thinking and dangerous behavior is a major part of the program and studies show that with treatment a sex offender is anywhere from 25% to 50% less likely to reoffend. >> perpetrators of sexual violence are very charismatic.

they can go through the program saying everything that they are supposed to say, doing everything they are supposed to do and turn around and reoffend. >> cat len cennic retired last month after working with domestic violence victims, many of whom were sexually assaulted. she says there isn't enough data to know if sex offender programs actually work. >> brock turner, i believe, will reoffend. >> reporter: dr. land admits there's no easy physical. the big challenge for brock tirn's therapist in his home state of ohio will be getting him to admit he did wrong. >> if you get somebody into treatment that is not motivated to change, that affects the treatment a lot. >> reporter: turner has been paroled and our requests for specifics about the sex offender program there and therapists can recommend extending treatment if the patient isn't progressing. >> it's not your typical body

smart dock like this. from thereto video is uploaded to a cloud-based server where it will stay for a year or indefinitely if that video is used as evidence. >> from that point everything is managed through an evidence management software. >> reporter: the department felt these specific cameras offer more transparency. what's the response when someone has concerns saying big brother is watching me and i don't want to be filmed? >> well, there is a legal standard, and the legal standard is that if we're in a public place and if you're in a public place you're freely able to record what's going on in that public place. >> reporter: 40 officers are expected to be outfitted with the cameras in the next few months. >> that's how it works. >> now the san ramon city council approved of the video cameras. all 40 cameras came with nearly a $33,000 price tag. the department owns the equipment and will only pay for the storage of the video. >> well, tonight the criticism and support continues for the president of the san francisco school board.

he's made national headlines for his proposal to rename some public schools. matt haney is clarifying his stance. he says he wants to make sure that school communities know that it's their choice to rename schools. he said george washington high school and francis scott key elementary were named after important figures in american history but they were also slave owners. he suggested to rename a school after mayo angelou and wants to open a dialogue about historical leaders who may be relevant and more representative to students and families today. >> the plan was to bring it to the board. i think i'm going to tank a little bit of time to listen to people and talk to people about what makes sense here and make sure we clarify some of these things before we jump into this. i think george washington high school has been especially challenge. >> haney says the proposal to rename the schools could be introduced this month or possibly later on. he's received an onslaught of

feeding your friends. there is a downside to this. no drone delivery, at least yet. levi stadium insists it's a drone-free zone. this all kicks off monday night against the rams here at levi stadium. minimum order is 20 bucks. reporting live in santa clara, scott budman, nbc bay area news. >> scott likes ruffles, we can see that. according to noaa's latest climate update la nina is not likely to develop this winter. that weather system usually brings higher than average snowfall to the northern third of the country. forecasters say the chance for la nina is now only 40%, and with less winter snow comes increased drought concerns so we may be back again talking about water conservation. >> well, the good news in all of this is the long range outlooks don't show anything in terms of below average rainfall for this winter so there may still be a little silver lining here in the forecast to come. as we get a look at your

microclimate forecast, can you see right now the huge temperature drops we talked about yesterday. that colder air is moving n.right now running anywhere between 5 to 18 degrees colder across the bay area. that made is so much more comfortable. san jose with a hive 80 degrees. currently 46 and we'll find patchy clouds into the overnight hours eventually dropping to 59 by 3:00 and also 4:00 in the morning. we get the fall back in san francisco and also patchy areas of drizzle and 53. low clouds spreading here throughout entire bay area and a much achilier morning than we've been used to as widespread 50s are expected here throughout the bay area. a look at your microclimate forecast on friday. temperatures near average to slightly below. that will put san jose at 84 degrees and cupertino 82. over to palo alto 79 and san francisco, we have the typical 60s coming on back with patchy areas of fog, especially near the marina and a cool 62

degrees. for the north bay, east bay and also for the tri-vale, we'll go as warm as 87 in livermore but that really is my hottest temperature for tomorrow for the east bay, oakland fantastic weather and 71 degrees and over towards fremont 82 and walnut creek coming in at 85. do i want to direct your attention to the fall pattern that we're currently dealing with right now that helped our temperatures to drop off. it as if the fog at the immediate coastline will stay in place as we head into saturday's forecast as well so we're looking at some fantastic weather again comin this weekend. now i want to push it ahead into next week. we had mention the the possibility of maybe some spotty showers as we head into next tuesday and wednesday and now for a second day in a row. forecast models are still hinting at maybe some coastal showers developing again next tuesday and also wednesday. if we saw anything to this point it will be trace amounts to maybe 5/100 of an inch.
