to your travel times. back to you. >> thank you very much, mike. a car chase ends with a suspect hitting a light pole right next to att park. it started about 3:30 this morning when officers responded to a carjacking in the richmond district. that car was later spotted and officers chased it to 2nd and king street. that's when the car crashed into the light pole and parking meter. three suspects have been taken to the hospital. they'll be later transported to the san francisco county jail. bob redell is headed to the scene and will bring us a live report as soon as he arrives. a developing story to tell you about out of san jose this morning. at least one person shot overnight. this happened in the east foothills area near piedmont and sierra road close to a gas station. it appears the investigation is centered around a car near one of the pumps. so far police aren't revealing anything about the victim's condition or if any suspects are in custody.

"today in the bay's" kris sanchez will bring us an update in our next half hour. a sobering story now. an elderly woman is brutally beaten in her home. this morning slaer sheriff's deputies are trying to track down the two men who attacked the 88-year-old woman. flo douglas told investigators two hispanic men broke into her home in the san jose foothills early monday morning. they attacked her and then came back and attacked her again. she's now in the hospital with several facial and head trauma injuries. the suspect stole her car and abandoned it down the street. that's when a neighbor found douglas. >> it was horrible, horrible. poor thing. she didn't deserve this. she's a sweet person. >> she remembers being assaulted, a period when they were gone and then came back and ransacked her house. also stole jewelry from her person. >> douglas' neighbors say they continue to check up on her at the hospital and they are praying for the best.

a convicted sks offender ak@tempted of trying to kidnapping two young women is expected to enter a plea. 56-year-old david lee russell was arrested last week. residents helped police track him down with their tips. investigators say russell twice tried to abduct young women in san jose. he's a repeat sex offender whose parole ended three years ago. a challenge to lawmakers after a little boy, a 3-year-old dies in a dui-related crash. we know this is the second time that the driver is accused of getting behind the wheel impaired. >> "today in the bay's" pete suratos live in walnut creek this morning. pete, the family of the little boy who died is now calling for change in the law. >> good morning, laura and sam. the mother of that 3-year-old who was killed who was also in that car is recovering from her injuries at the kaiser in walnut creek. the suspected drunk driver who caused the accident has a history of driving under the

influence. that driver we're talking about is 39-year-old yarenit malihan. according to chp he was under the influence of drugs when she rear-ended a stranded car on friday parked on the side of northbound 680, injuring the mother and child and sadly killing 3-year-old elijah dunn. she was arrested for a dui back in june. in that case she's facing a charge of child cruelty. chp issues a pink slip or temp license if someone is caught driving drunk for 30 days. if someone is driving under the influence of drugs, chp does not take away their driver's license. we spoke with the grandfather of the wids who say the law needs to change to make sure it doesn't happen again. >> she can't get away with this. the community is coming together. we need something done. my family is up there in agony right now. >> reporter: a tough time for this family indeed.

malihan is the wife of an alameda county sheriff's deputy. she was released on bail on saturday. a gofundme page is set up for the family of the 3-year-old. last time i checked they have raised nearly $70,000. you can help them out and we have the information on our website at nbcbayarea.com. live in walnut creek, pete suratos for "today in the bay." >> it's at $69,000 right now, thank you very much. two people are now behind bars accused of spray painting racial slurs on an antioch home and torching it. 27-year-old roy sorvari and 25-year-old christyne mcdaniel are accused of throwing three molotov cocktails at that home last wednesday. this is the aftermath of the family covering up the racial slurs. police say this started with a dispute between someone at the home and one of the suspect's relatives. court documents accuse the two of plotting to murder and torture the family at least a week before that crime.

they face multiple charges including conspiracy to commit murder, mayhem and torture, all of them with hate crime enhancements. >> i don't know why they did what they did. however, it is a crime of hate, so it's not acceptable. >> both suspects are being held on more than a million dollars' bail. at 6:07. let's take a look at the soberanes fire. the 107,000-acre fire started on july 22nd. it is still not under control, just 60% contained. firefighters are hoping to have it fully contained at least by the end of the month. it's a very different look at that fire. the u.s. forest service teamed up with google earth to show just how much area has been scorched. pretty big map area there. it also shows what kind of terrain the firefighters have been facing. vector control teams will be out in the south bay late tonight spraying to combat west nile virus. fogging will start at 11:00 p.m.

a football game showed up on facebook. welcome back everyone. 6:13. a stanford student is being targeted after a picture of her at a football game showed up on facebook. it's not what she was doing, but what she was wearing, a hijab worn by some muslim women. students were photographed at the game last fall including you saf. the candid picture eventually turned up in an ad promoting a vip football experience. not everyone thought it was appropriate. shortly after the picture appeared on facebook, the insults started arriving. many targeting her hijab and also the fact that she is muslim. >> why do they think they get to dictate what i can do as a woman, as muslim woman, as a black muslim woman? >> she also tweeted out some of the insults, eventually finding far more supporters than detractors. she credits strong support from stanford students and apd

administrators with helping her through. former nsa contractor edward snowden is about to appear via video today. he's been living in political asylum since leaking classified information about the u.s. government. now he makes all his appearances by video hookup. today marks the launch of a campaign urging president obama to pardon him. that movement is supported by a number of groups including the aclu, amnesty international, human rights watch and others. the iphone 7 goes on sale on friday. this morning some of the big reviews are in. >> scott mcgrew looked them over. these are serious reviews. >> you'll hear reviews from bloggers who got maybe a few minutes with the phone in last week's apple showcase after the announcement, maybe they got to snap a couple pictures. honestly we don't care about those reviews. apple did give the phone to a select few journalists to use full time. those are the reviews we care about and those were just

published. the "wall street journal's" jeff ross says apple offers plenty of reasons to retain our loyalty. there is enough reason to get over the headphone thing and upgrade. like livermore and san jose as we head from friday through sunday. starting with both the roads and the rails for the south bay. most of the traffic flow looks pretty standard on our maps. i want to show you the live camera, 101 northbound, showing a lot of slowing right around the 680 interchange. seeing things start to break apart as far as the backup goes here. earlier crash at mckee is still on the shoulder. let me show you the map. this backup is right here on the map, north of 680. we're seeing the morning commute start to build. slow from capital expressway toward 880. 87 seeing more slowing as well. overall, silicon valley moves very well. the tri-valley moves nicely as well. 680 not so bad after an earlier crash, two crashes cleared to the shoulder. wednesday commute lighter than yesterday. smooth drive over here for hayward and the san mateo bridge. no surprises for the pattern on the 880 side. on the bay bridge the metering

it happened on sunday. luckily no one was hurt. it did cause some damage to the woman's louis vuitton bag. she say it is lithium battery in her e-cigarette device exploded. she believes it's a freak accident. wondering other vapors to be aware especially around children. whether the risk of the explosion or losing the louis vuitton bag will get her to give up e-cigarettes. an independent study concludes electronic cigarettes can help smokers quit without the side effects tied to products like a nick teen patch. the group found irritation of the throat and mouth are the most common side effects. they also say the longer-term data isn't yet available. a separate study in england found many who tried vaping eventually did quit smoking entirely. 6:24. women's groups are outraged after governor brown vetoed a series of bills that would have

exempt taxes on tampons and diapers. brown said the bills would cost the state too much money and yearly revenues of up to $300 million. one female legislator called it, quote, man slamming. berkeley's so-called right to know ordinance about cell phones requires berkeley merchants to inform phone buyers about the claims that cell phones give off radiation. earlier this year a judge lifted an injunction preventing berkeley's law from taking effect. the cell phone industry wants that injunction to be put back in place until a final ruling is issued. the case is being heard in san francisco. >> that is squarely contrary to science, facts and the fcc's carefully considered findings. >> have they ever said putting a cell phone in your pocket is

unsafe? >> no, but they have repeatedly said here are the standards you have to live under in order to get a cell phone approved so we can cert five it as safe. >> a final ruling on the injunction is not expected for the next couple of months. appeals may eventually take this case all the way to the supreme court. every day dust in your home could be harming your health. researchers from george washington university say household dust can contain chemicals from k3407b products. they tested dust from homes in 14 states and found traces of 45 toxic chemicals used in vinyl flooring, personal care and cleaning products and home furnishings. experts say the chemicals can be inhaled, ingested and absorbed through the skin are linked to cancer, developmental as well as reproductive problems. coming up next on "today in the bay," a major break in a cold case almost 50 years after the crime. how investigators finally tracked down the suspects in connection with the murders of two young california girls.

101. an earlier crash at mckee kind of rippled back over there. the rest of the commute looks standard, watching the end of 280, king and second. at&t park, police activity. be aware you might have to take a couple-block detour. >> let's go right to that, mike. an update now to breaking news out of san francisco, as mike just mentioned, right by at&t park. a carjacking suspect that basically crisscrossed the city. now they've shut down part of the area, an intersection right by at&t park. >> that's right. we want to go live to bob redell live at the scene right now. very active we understand out there, bob. >> reporter: you can see this is the end of the police pursuit that started around 3:30, starting in the richmond district and ending in front of the ball park. the intersection of 2nd and king. that's the car that was stolen earlier this morning.

they lost control, took out a lamp post, hit the side of the tree. remarkably they're all alive. two of the suspects were stuck in the car. the third one, when this crash happened, took off, the police took off and were able to catch the suspect. all three suspects are in the hospital, and they will be transported eventually to jail. this started, as i mentioned, just before 3:30 this morning. this is on the 6000 block of geary in the richmond district. police were able to locate the vehicle and that's when they tried to pull over the vehicle, they didn't stop. they had this pursuit through the city. one witness tells me that he saw this car coming around on the bend on king street right before the crash. and after the crash counted roughly about ten police vehicles in pursuit. they're right there on the scene when this crash happened. again, three suspects in the hospital, on their way to jail.

once they recover -- this is after a carjacking, the driver's condition is not known. we noted they were not in the car at the time of the crash. right now 2nd and king back down to townsend, in front of the ball park, this is shut down until the wreck is cleared. bob redell, "today in the bay." >> quite a mess by the ball park. in the meantime, a busy east san jose intersection blocked off by crime scene tape as police comb for evidence in a late night shooting right next to a gas station. "today in the bay's" kris sanchez is live near the corner of piedmont and sierra roads. chris, last night there was a lot of activity there. not as much right now, but a lot of questions to answer. >> we're getting a better lay of the land now that the sun is starting to rise. this even in the dark was a very well-lit gas station here at the corner of sierra road and piedmont road in the east san jose foothills. we did see surveillance cameras

so perhaps san jose police. >> reporter: know what happened. that shooting was reported just after 10:00. our crew on the scene reported it appeared that the investigation centered around a car near one of the pumps. we know one person was shot, perhaps in the abdomen and the leg. because of health privacy laws, we can't see what that person's condition is at this point. we did see a clerk inside the store who appeared to be okay. police have not given us a suspect dripgt to share with you at this point. if that changes, we'll let you know on air. and we'll post it on our wesh site and social media account. this is sierra road near the piedmont road intersection. it is sandwiched between station 19 and a post office right next door. this is a major intersection so perhaps if you were in the area, you might have seen something that didn't seem totally amiss last night, but now in the context of what we're reporting

this morning, it might be a clue that might help police solve this crime. if you saw something, you can call, you can report it anonymously via crime stoppers. in san jose, kris sanchez, "today in the bay." >> thanks for the latest, kris. 6:34. new details about the woman who slammed into a parked car killing a 3-year-old boy. california highway patrol revealed yarenit malihan, an alameda county sheriff's deputy's wife was under the influence of drugs, not alcohol, during the crash. this isn't the first time she's been arrested for driving while impaired. court documents show she was arrested for dui in pleasanton back in june. records show there was an additional charge of child cruelty because she had a child in the back of the car at the time. now many are wondering how she was able to keep her driver's license. >> we do not take a driver's license for a drug-related dui because of the way the law is written.

>> i don't want the lady out of jail again. she's going to get behind the wheel under the influence again. she didn't learn the first time. >> as the investigation into the crash continues, communities are coming together to mourn the young life lost. there's currently a gofundme account in elijah dunn's name that's already generated up to $69,000. laura, 43 years later and now a break in the case. there are two new suspects in the 1973 double murder. investigators say 12-year-old valerie lane and 13-year-old doris derryberry were killed after they vanished from a shopping trip. investigators found their bodies along a dirt road 35 miles north of sacramento. using technology not available in 1973, officials recently found a dna match for 65-year-old larry don patterson and 65-year-old william lloyd harbour. both men are now in custody. as soon as today, authorities may release the images of a man who is believed to have set fire to a 9/11 memorial in menlo park.

this happened sunday outside the menlo district fire station in east palo alto. police san jose surveillance video shows a man with a distinctive walk approaching the display of 343 american flags that firefighters placed there to remember first responders who died in the twin towers. in all, about a half dozen of those flags burned. >> stopping at the corner, waiting for traffic to leave and squatting down, setting the flags on fire. >> police say the man's distinct walk could be enough for someone to identify him. if the video is not released today, it should be out by tomorrow. democratic vice presidential hopeful tim kaine will be in the bay area in a few hours. >> campaigning for running mate hillary clinton who is expected to return to the cain trail tomorrow. tracie potts live in washington, d.c. donald trump we're told will be releasing medical history today. good morning. >> reporter: well, good morning.

the bolt is all electric. the volt is a plug-in hybrid. chevy says the bolt will be available by the end of the year. now, the obvious comparison we need to make is with the tesla model through. the bolt is going to be a long-range car, 238 miles. that's a long range for an electric car, and available by the end of the year. meanwhile, the tesla full of mystery. we know it will have a slightly shorter range. we think it will cost about $35,000. and we have no idea when you will actually get to drive one. so bolt or tesla? steve wozniak got a chance to drive the bolt. and he says tesla will have a difficult time selling me a model 3. woz likes the fold-down seats

40s around the north bay. clear skies in san jose. there's a look at healdsburg this morning, 49 degrees, patchy clouds, temperatures in the low 50s. into san jose, clear skies, close to 50. our south bay microclimates, down to 47 in morgan hill. not a lot of wind to talk about this morning. but the sea breeze will pick up heading into the afternoon which will keep our temperatures slightly below average for another day. highs in the 60s near san francisco, 70s to low 80s around the south bay. north bay temperatures comfortable. 80s around the tri-valley over towards walnut creek and antioch. cool temperatures for now. the area of low pressure has moved on. behind it, high pressure building in, so a jump back to summer-like temperatures as we head back to the second half of the week. san francisco climbing closer to the 70s as we head into the weekend. you'll notice the inland temperatures jumping by friday.

here are the top stories on nbc it's 6:57. before you head out the door, here are the top stories on nbc bay area. breaking news this morning. bob redell is live in san francisco at the scene of a dramatic crash right by at&t park. this likely started as a carjacking. >> reporter: correct. there were three carjacking suspects in what's left of this car they tried to steal from the richmond district. it crashed here in front of at&t park near the intersection of second and king where police are processing the scene for evidence. now, according to a witness, they say there were about ten san francisco police cars in pursuit of this car when it lost control, hit a light post and crashed into the tree. the three suspects in the car, one of them got out on foot.

the other two remained in the car. all three suspects in the hospital, soon to be taken to jail after being treated and released, assuming their injuries will permit it. the carjacking happened in the richmond district. police heard about it. they were able to catch up with the car, tried to pull them over. obviously they didn't listen to the command and there was this chase that ended at second and king. as a result, second and king is shut down until they're able to clear the wreck. >> live in at&t park, bob redell, "today in the bay." more breaking news coming into the newsroom. a deadly shooting down the block from an east bay b.a.r.t. station. a live look at the scene right now. oakland police say a man was shot inside a vehicle near the fruitvale station about two hours ago. when officers arrived, the victim was already dead. homicide investigators are now headed to the scene. we'll continue to follow
