morning. winds are active this afternoon. temperatures are cool. starting this morning different. in the 50s where we should be this time of year. unlike the past couple mornings, it has been mild. the other thing you'll notice is winds. that's the other thing you notice when you get going, especially across san francisco at the coastline, higher elevations as well. look at the high temperatures later on. 60s for most of us throughout the day, a few low 70s, san jose, concord, livermore at 70. oakland 67. 65 for san francisco. we will talk about the weekend forecast around the corner on time to work. looking at the peninsula. we had a lot of wind reported early this morning at 4:00 in san francisco. that might have calmed down for the time being. i want to show you what else calmed down. northbound 101, coming up north of san martin avenue. they reopened two lanes a few

minutes early from the overnight construction. no stall that i can see on either side of the bridge. from time to time, we will see the camera shake. wind advisory. developing overnight in contra costa county, people tell us they heard gunshots and screaming outside their houses in concord. now we know two people were shot in their own home, one in critical condition right now. >> sharon katsuda joining us from concord. sharon, police are investigating what relationship might exist between people that attacked and those two that were in their home at the time. >> reporter: that's right. the shooting happened behind us in this private neighborhood, you can see seven homes away from the area. police were here all last night, the last investigators left about an hour ago. neighbors on the 2900 block of

bella drive heard gunshots about 9:50. police say the suspect or suspects shot them in the home. the woman said she was followed home. there was possibly a pickup truck involved in the shooting. >> it happened fairly late so there wasn't too many neighbors that were actually outside who saw what happened but they did hear the shots. not sure about the relationship with the boyfriend, girlfriend, husband, wife. i believe two victims live together. >> police say that female victim is 29 years old. the female victim shot in the head is 28 years old. police say the suspects were wearing all black clothing. last we heard the male victim is in critical condition. live in concord. sharon katsuda, today in the bay. developing out east, live out to charlotte, north carolina. all is calm now, but this is after a full night of developments in that southern city.

state of emergency declared in north carolina with the clouds over the city now as protesters clashed with police for a second night in a row. police in riot gear fired tear gas into a crowd blocking the interstate and the violence only escalated from there. one person is in critical condition after being shot by a protester. they stress the shooter was not a police officer. >> i don't know, they shot somebody laying there in front of the omni, there was blood, there was a crowd of people. i don't know if he's dead. >> panic, confusion, tear gas. four police officers were also injured in that melee. all of the chaos resulting from a police involved shooting tuesday when a black police officer shot and killed a black man named keith lamont scott during an investigation at an apartment building. we will take a closer look at damage left behind coming up in

a live report in the next hour. back at home. students of san jose university feeling uneasy after the discovery of swastikas and other hate filled graffiti at two separate dorms. in one they placed a swastika in place in name tags. in the other, swastika and hate language were put in a seven person suite in campus village. those images are calling for student meetings. we have a live report at the bottom of the hour. still have no answers about what caused a stench that sent dozens to the hospital with breathing problems. you can see the coast guard was out investigating an oil sheen seen on the water. that could be to blame for the stench, but we don't know yet. authorities are looking at the tanker that's docked at the phillips refinery and could be the source of the spill. >> may have some. we don't know. there are a lot of unknowns.

this is one possibility, if it was lighter oil, it could have just evaporated. >> it promised a lot of 911 calls and dozens went to the hospital feeling sick. they issued a shelter in place which has been lifted. oakland police are debuting a new substation. it is at high street and international boulevard. that station is a place for kids to do homework and work on computers alongside officers. opd says it is a chance for officers to interact with the community there. we are talking law enforcement, in berkeley, a bombshell after sudden resignation of the police chief. michael meehan cited personal reasons in an announcement. he wrote a detailed letter explaining the decision to leave in a month. instead, they accepted that

effective immediately. while he faced few controversies during time as chief, others say the friction was brewing among rank and file. >> tensions between him and the police force and thank god it wasn't some sexual relationship or misuse of force or guns or covering up something. >> following meehan's announcement, city leaders quickly appointed berkeley captain greenwood as acting chief. berkeley is one of many bay area police departments currently without a police chief. back in may, san francisco police former chief was forced out and a search is under way for his replacement. the interim chief chaplain is in the running. in june, oakland went through not one but three chiefs in the wake of a sex abuse scandal. the department is still looking for a permanent replacement. lastly, hayward's chief is out on administrative leave. not so fast, the nfl

commissioner says that raiders move to vegas may not be likely. the governor of nevada intends to call state lawmakers into special session early next month to consider a public financing plan for a new stadium there. however, nfl commissioner goodell thinks there's a deal to be had in oakland. and there's speculation former raider ronnie lot is part of a group looking to buy the coliseum site for a stadium here. >> let's make a deal to keep the raiders in town. i think a lot of people would be behind that. a lot of people are behind changes we see in the forecast, anthony. very pleasant, but cool. >> starts at 7:21 this morning, fall. 54 in livermore, 58 in san jose. 55 in santa rosa, 53 in napa. winds are gusty for the first half of the day. been gusty in san francisco. overnight, up to gusts of 40

an oakland police officer set up a go fund me page to help the family of the two-year-old. the community contributed $15,000. the toddler died tuesday when he ran into the street chasing a ball and was hit by the bus. >> nice to see the community trying to rally behind that family. 5:25. nbc bay area responds to a south bay woman that called about a water resistant phone that turned out to be not water resistant. >> we have the story, how he helped her get results. >> reporter: good morning. michelle martinez bought the samsung galaxy 7 edge. she chose that model, it is advertised as being water resistant. three days later, it was splashd with water on vacation and quit working. michelle asked t mobile to replace it, told her she had to file an insurance claim, and pay a $175 deductible. she didn't think that was fair

other in critical condition. this happened on belleau drive, not far from alameda. police believe they entered and shot both a man and woman. sharon katsuda will have a live report at the top of the hour. another developing story from charlotte. we look live at the city. a gloomy day on a morning that follows nights of turmoil where anger and racial tension boiled over yet again after another officer involved shooting. north carolina hundreds took to the streets rallying about the death of keith lamont scott. sarah rose ar i don't see has more. >> reporter: chris, it was violent protests for a second night in a row, saw it tuesday

and last night with protesters, hundreds marching up the street in uptown charlotte, that's what the heart of the city is called, uptown, all in protest of the 43-year-old keith scott shot and killed tuesday by police. we have anger, racial tensions boiling over after another officer involved shooting. the unrest in charlotte continued. second night of violent protests brings out police in riot gear using flash grenades, rubber bullets and tear gas. hundreds taking to the streets with signs, protesting the death of 43-year-old keith scott killed tuesday by police. overnight the loud booms sent demonstrators running for cover. police saying at least one person was shot, the gunman was not a police officer. >> i don't know, they shot somebody, he is laying there in front of the omni, there's blood and a crowd of people and i

don't know if he is dead. >> reporter: the violence continued with several people injured, including officers. setting fires, throwing rocks near the scene keith scott was killed earlier. they think he ignored officer commands to drop his weapon, despite witnesses saying scott didn't have a gun but instead was holding a book and was shot waiting for his son to get off the bus. an evening beginning with a peaceful candlelight vigil was soon overshadowed with a display of violence. the governor called in for backup bringing in national guard and highway patrol to keep officers safe and be a backup for officers should more protests arise today. live in charlotte, sarah rose ar i don't see, back to you.

>> thank you very much. no word on the stench that sent hundreds to the hospital. an oil sheen was spotted in the san pablo bay. authorities are looking at the tanker that's docked at the phillips refinery in rodeo. that could be the source of the spill. the coast guard can't say if it is behind that odor that prompted hundreds to call 911 late tuesday night. dozens felt sick and the city ended up issuing a city wide shelter in place. there were several rape cases reported at uc berkeley in recent weeks and now an arrest. berkeley police arrested this 25-year-old man for raping a 19-year-old student in her dorm three weeks ago. police say the victims did know the suspect but gave no other details. this was the fifth rape case

reported on campus just this month. students of san jose state university feeling uneasy this morning after discovery of swastikas and hate filled graffiti at two separate dorms. bob bird ellis looking into this story. what are you learning? >> reporter: good morning, sam. we spoke to one student yesterday at san jose state, hoping this was some twisted joke and not an actual threat, but police of course are taking it very seriously. they're investigating the two separate instances and both took place on tuesday night. one was inside washburn hall. someone created a swastika out of name tags, put it on a hallway door, moved it to a window in a dorm room. wrote something hateful. police won't indicate what it was, only that it targeted a specific group of people. and students in a seven person suite came across another swastika and more hate speech.

>> people should be educated on how things like this aren't a joke. people were actually hurt by this, many families lost people in the holocaust. >> a little bit awkward, yeah. >> reporter: racism is not acceptable. i would say this symbol is anti-semitic, right, so it is not acceptable but it is a reality we deal with. >> reporter: san jose sent a letter to campus to let us know what happened. let's us know how sad and angry the university is over the hate speech. the campus will be organizing in person meetings with students as well. live at san jose state, bob redell, today in the bay. 5:36. a tragic accident in sierra, nevada takes the life of a grad student. she was killed sunday climbing. she was 26 years old.

she was a fourth year grad student studying immunology. authorities say she was climbing near bear creek spire when she lost her footing, fell more than 800 feet. this is the second tragic accident to hit a bay area university this week. monday, we reported the death of a student that drowned in a lake east of fresno. happening today, san francisco supervisors will hold a hotly anticipated hearing about the slowly sinking millenium tower, the high-rise sunk more than a foot in the short time since it finished. today supervisors will hear from current and former building inspectors about what they knew and when. nbc bay area investigative reporter broke that story. he now says a top member of mayor's staff will also face tough questions. he formerly was a private

consultant that got major projects built, including millenium tower. one of the most well known mayors, kevin johnson, assaulted at a dinner event. protesters threw a pie in his face. that's when johnson fought back, allegedly punching the man in the face. the protester was arrested. johnson is a former nba star, cal basketball player. he was elected mayor of sacramento back in 2008. nasa is giving us a new look at the damage caused by the massive fire near big sur that continues to burn. this combines infrared and green light. areas in red shows places that are burned. it is now the costliest fire in u.s. history, tab of more than $200 million and counting. full containment is expected by end of the month. >> that image is sobering. shows us exactly what we already knew, that we are seeing such extensive damage this fire

iraqi troops along with forces from a pro-iraqi government militia reportedly retook som 5:43. new this morning, iraqi troops with forces from pro-government militia reportedly retook villages from isis. video showed tanks firing at targets and showed thick smoke billowing in the distance. that footage demonstrated some families were fleeing crossfire, being assisted by iraqi troops. the prime minister says the country is working at retaking mosul, the second largest city and has been held by isis since 2014. some call t mobile the uncarrier. today that is definitely true. >> subscribers are having all kinds of issues just connecting. >> all kinds of trouble. hearing reports of an outage of t mobile service throughout the united states overnight, sam. about two hours ago, t mobile announced it was back up and running. if you're having trouble, we would love for you to tell us.
