officer-involved shooting in california only grows after we find out what this man is actually pointing at police officers. it's not a gun. "today in the bay" starts right now. a very good thursday morning to you. inching closer to the weekend. i'm laura garcia-cannon. >> i'm sam brock. we hope that that commute is not going to be inching forward. at least things are moving pretty well. >> feet, yards, miles per hour. we're looking at the roadways right now. it's a good flow of traffic. we'll take you to the maps. i do have my eyes on one crash in hayward. this happened much earlier this morning, southbound 880 just before you get to 92. one of the cars involved was in the center divide. they've moved to the right shoulder. chp will update approaching the san mateo bridge. a clear look, rob. it feels much cooler than a couple days ago. >> seeing the cool onshore

winds. fairfield seeing winds of 30 miles per hour out of the southwest helping to bring low clouds in to abo clouds. this is all good news around the loma fire. elevations of 2500 feet, temperatures in the 60s. 10 to 15 degrees cooler than the same time yesterday as we have high temperatures close to the 80s. i want to point out humidity levels are going to start to drop tomorrow as we watch a shift in the wind. today winds not too bad. friday we'll have to watch out for gusty winds and dry conditions as the northwest winds pick up during the day tomorrow. laura? >> no doubt firefighters paying close attention to that as well as developing news that we continue to follow all week long here on "today in the bay." in the south bay this out-of-control wildfire continues to burn in the santa cruz mountains. firefighters making progress but the danger very real. gilroy where cal fire will give us an update. how is the situation going so far this morning? >> reporter: there is progress being made. we're at the command camp at christmas hill park in gilroy. this is where the more than 1,000 men and women fighting the fire, this is where they come after their exhaustive 24-hour shifts to sleep, get food and a briefing. there will be a 7:00 a.m. briefing just over a couple hours from now, the briefing for the captain and battalion chiefs. we hope to hear they've achieved more containment. the latest numbers from cal fire, right now the loma fire has burned over 2,800 acres, 22% contained. there have been some mandatory evacuations that have been lifted. the residents who live on the santa cruz county side of the loma fire are allowed to go back home while the evacuation orders are still in effect for those who live on the santa clara

county side of the fire. bay area air quality management district is warning residents, especially those living in places close to the fire, warning them to limit their time outside because of the smoke. >> not healthy. we went and got spray painting masks so we could go outside and trying to stay inside and stay away from it. >> reporter: coming up, we'll hear from one battalion chief out on the front lines talking about the highly unusual fire behavior he's witnessing at the loma fire because of the drought. live in gilroy, bob redell, "today in the bay." >> thank you for the update. in the meantime protesters want their message heard. demonstrators taking to the strip mall overnight where a black man was killed by a police officer. that happened in el cajon about 15 miles east of san diego. >> black lives matter! >> they're shouting black lives

matter, holding up their arms, walking down the streets, this as we learn more details about that shooting. police say the object the victim pulled from his pocket was not a gun, it was a vape smoking device. investigators say the two officers shot this man only after one minute arriving on scene. there's individuvideo of the sh. the victim's name is alfred olango, a refugee from uganda. in a few hours, the suspect at the center of a bizarre kidnapping case in vallejo is about to plead guilty. "today in the bay's" chuck coppola choining us from vallejo. no one expecting this turn in the case. good morning. >> reporter: good morning sam and laura, at first 38-year-old matthew muller entered a plea of not guilty and wanted a jury trial. now he's changed his mind and accepted a plea bargain, admit to one count of kidnapping and not face what could be a lengthy

trial on charges of sexual assault. denise huskins cried foul to protect the vallejo police. >> if you give him an opportunity to get back out on the street, he's not going to change his stripes. he's a psychopath. >> reporter: the attorney says it contains details of the alleged mishandling coming out in the trial. huskins is said to be taken by force from her boy friend's home in march of last year. she showed up at her harnts' home in huntington beach two days later. chuck coppola, "today in the bay." it is 5:05. authorities have released a sketch of the man they believe shot and killed a college student as the victim played pokemon go along san francisco's water front. u.s. park police are looking for

a man fitting this image seen leaving the area where calvin riley was shot on august 6th. police also released a photo of a white four-door toyota avalon they believe may be connected. investigators believe a woman may have been driving the getaway car. >> the search right now is getting desperate. 15-year-old naomi lomax of antioch has been missing for 12 days, last seen saturday, september 17 near black diamond middle school. they say the number of days lomax is missing is extremely concerning. a local theme park is gearing up for halloween without its latest attraction. the virtual reality ride called vr fear offended some in the mental health community because it takes plaps in a hospital. within days of opening, great america ended up closing that ride. 5:06 right now. let's check the forecast. certainly feeling fall in the air this morning, rob.

>> we're seeing pretty gusty winds out towards the east bay, towards solano county. 50s across the board. areas of low clouds. if you're going through the carquinez straits this morning, the onshore winds keeping our temperatures on the cooling trend the last couple days, low 60s in san francisco. 70s to near 80 in san jose. for the weekend, more clouds and a chance of midday rain on sunday, showers into monday. temperatures by the end of the weekend across the valleys only in the upper 60s. mike. >> so much better. at least i like it better. i like this, too, over on the peninsula i saw this red just crop up. red speed sensors mean speeds are crawling through the area of southbound 280 between edgewood road through woodside to sam hill. very unusual. just popped up. construction crews may be moving through the area. i'll check on anything out of the ordinary for the peninsula.

today -- answering tough wells fargo ceo will be under fire once again on capitol hill answering more tough questions about the millions of fake accounts opened by his employees. >> "today in the bay's" edward lawrence joins us live in washington, d.c. this morning. wells fargo ceo really being grilled by lawmakers. >> reporter: sam and laura, expect to see some very angry members of the house financial services committee. the ceo for wells fargo john stumpf lost $41 million, he's having to give up of his salary, but he did not lose his job. that's what angered a lot of people. wells fargo paid a huge fine or is going to pay a huge fine, now they're getting a public

tarring. their most profitable business partner is suspending a relationship with them. that's the state of california. the state of california says they will halt the business relationship with wells fargo for one year. that means wells fargo will not be a dealer-broker in any transaction and will not be able to underwrite any bonds issued by the state of california. california issues the most bonds in the entire united states, and they have control of assets over $2 trillion, a huge loss. expect the ceo today to apologize and tell the committee members ha the practices, the sales practices that led to all of this did not meet their ethical standards. still investigators said it went on for years, and employees made bonuses. reporting live in washington, edward lawrence. >> in the meantime many political pundits say hillary clinton won the first

presidential debate on monday. but what do the voters think? new polls are emerging now. a new nbc news survey monkey poll finds 52% of likely voters say clinton did win. 21% felt donald trump won the debate. the next presidential showdown is scheduled for st. louis october 29th. actor alec baldwin taking on a new role. it's a role you may be familiar with. he's going to play the donald. baldwin will play trump in what will likely be numerous sketches at least through the november election on "saturday night live." the season premier is this weekend. as always, it airs saturday night, 11:30 p.m. right here on nbc bay area. >> expect many viral videos. turning to business news, the problems for samsung are not just limited to smart phones catching fire. now there are safety concerns with their washing machines. >> citibank making it easy to

send money through smart phones. landon dowdy is live at cnbc world headquarters. good morning. i think she's there. there she is. >> good morning. oil prices are retreating today -- hey, guys, are you there? oil prices are retreating today, that after they hit a six-week high. traders are waiting for more details on opec's deals to cut production in an attempt. goldman sachs says the deal could add $10 to prices next year but skeptical opec members. watching data today on unemployment, housing and gdp. yesterday the market rallying, the dow up 110 points to 18,339. the nasdaq rising 12 to 5318. meanwhile samsung is in talks with the consumer product safety commission to address potential issues and problems with its

degrees around palo alto this morning. some smoke in the south bay. air quality for areas south of san jose today with moderate levels of smoke pollution. san francisco right now, low clouds, 56 degrees, misty skies out on the coast. san jose also in the upper 50s this morning, hazy conditions, notice the wind speeds, as you're coming in highway 4, interstate 80 through fairfield. wind speeds up to 40 miles per hour with the gusts and onshore winds will keep the temperatures down. again, the cooling trend will continue today with 70s to low 80s around the south bay. low 60s for san francisco. peninsula temperatures, 60s to mid 70s. low 70s around the north bay. things get interesting tomorrow. first, a relatively -- a dry cold front goes on buy. behind it we'll get gusty northwest winds. on saturday, increasing clouds. sunday, home game for the 49ers hosting the cowboys, may have to deal with rain at times on

sunday and scattered showers follow into monday. along with the cloud cover and the chance of seeing some rain which could add up in rain gauges, especially north of the golden gate, north coast maybe a half inch or more. that's great news. by the way, air that's cold enough we could see snowshowers late in the weekend. if your travel plans include interstate 80 or highway 50, it could get down to 6,000 feet. here is your seven-day forecast, look at the numbers cooling, san francisco in the low 60s throughout and our inland temperatures that were in the 90s to 100 degrees, upper 60s by sunday with rainality time. scattered showers on monday. a bit warmer tuesday into wednesday. finally a zf thseven-day foreca that looks and feels like fall. >> take note there may be big changes in the weather over the weekend. over hear looking at first the innocence. we'll see if we have major

airlines are seeing a sharp rise in unruly passengers. that is according to the international air transport association. incidents of people being verbally abusive have spiked 17%. 11% of the cases there was actually physical aggression or damage to the aircraft. returning after a long time at sea. the crew of a bay area-based coast guard cutter. stratton is frequently deployed in the battle against drug smugglers. lately taking part in what's a major military enterprise in the arctic. the ship is returning to its berth in alameda after 114 days. quite a bit whammarmer here. >> consumer investigator chris chmura has the story. ray tore i don't ordered three pieces of furniture from ramos furniture in fremont and paid $2800 up front.

ramos said the furniture would be delivered within five weeks but it wasn't. ramos loaned ray the floor models. the store said it would swap them when his furniture came in. ray says he couldn't get his new furniture and ramos ignored his phone calls about the furniture or a refund. we reached out and there was finger-pointing on both sides. ramos says ray wasn't consistent in asking what he wanted, either new furniture or a refund. they decided a $2800 refund was best. ramos issued a short statement. we tried to help the customer as best as possible. we decided to give a full refund. the lesson here, when ordering furniture, don't pay for everything up front. a 25% to 30% deposit is standard. also, ask the retailer if that's refundable should you change your mind. if you have a consumer complaint, you can call it.

you can barely catch the lights as you come around approaching 98. we're able to see that because the skies are clear. what else do you have, rob? >> fog up closer to 1,000 to 2,000 feet, patchy low clouds. cool temperatures and mild and breezy into the afternoon. 70s and 80s inland. around the loma fire, big changes in the hilltops, numbers in the 60s. same time yesterday we had 70s above 2,000 feet. so things have cooled down. afternoon temperatures today look pretty good. notice as we head through the next 24 hours, we'll see cooler temperatures towards friday. the wind speeds are important. gusty winds expected to move in during the day tomorrow and unfortunately that's going to make things dry in the hillside as we approach the weekend once again. laura? >> thank you very much. certainly firefighters paying close attention to those conditions because this is a look at the loma fire. it's developing news we continue to follow from the south bay this morning. it is still burning in the santa cruz mountains, very active.

firefighters are making some progress. the danger still very, very real. "today in the bay's" bob redell has been following the story, fri first from the fire lines, now he's in gilroy where some of the firefighters have been resting after this massive fire fight. how is the situation going so far, bob? >> reporter: good morning. here at the cal fire base camp at christmas hill park in gilroy, this is where some of the thousand men and women on the lines after an exhaustive 24-hour shift come to get food and rest. the briefing takes place at 7:00 a.m. this morning. we expect new numbers at that point. we know cal fire has lifted the evacuation orders for the people on the santa cruz county side of the fire, but the order remains in effect for those on the santa clara county side. the latest numbers given yesterday, the loma fire is 22%

contained, has burned over 2800 acres. again, there are more than 1,000 men and women fighting that fire. now, part of the challenge for those firefighters, the santa cruz mountains are super dry because of the california drought, so dry the fire is burning through some areas twice. >> on this fire, this slope has been burning a second time and completely burning out the second amount of fuel. we're having to almost deal with this fire twice in some places. >> reporter: this fire destroyed one home, damaged another and taken out six out buildings. there are still 325 homes threatened. in the next half hour, we'll hear from one south bay resident on how he's dealing with the bad smoke caused by the fire. live in gilroy, bob redell, "today in the bay." >> bob, thank you very much. another police shooting that protesters say was unjust find, especially in light of the evidence we or just learning. a black man was shot to death at

a strip mall in el cajon on tuesday. >> black lives matter! >> as those protesters chant "black lives matter" new details are coming to light about the shooting. police say the object that the victim pulled from his pocket was not a weapon, it was a vape smoking device. investigators say the two officers on scene shot that man after being there for one minute. there's video of the shooting but it's not being released by investigators. the victim's name is alfred olango, a refugee from uganda. the suspect at the center of a bizarre kidnapping case in vallejo is expected to plead guilty. police first thought this case was a hoax. matthew muller is expected to take a plea deal in sacramento, he's accused of kidnapping denise huskins and tieing up she and her boyfriend, aaron quinn, last year. quinn's attorney is not happy saying muller may get a lighter sentence than he deserves.

"today in the bay's" kris sanchez joining us live from lafayette. sounds like there's not a lot b.a.r.t. can do, this is a free speech issue. good morning. >> reporter: good morning to you, sam. we haven't seen any of those hateful flyers on the windshields here at the b.a.r.t. station in lafayette this morning. as you said, b.a.r.t. says if there were, they would be protected by the first amendment guarantee to the freedom of speech. an nbc bay area viewer contacted us after finding two of about a hundred flyers with anti-semitic speech. we can tell you there were slurs

aimed at jewish people and an instruction to, quote, brow bead them, flog them and harass them. the flyers also directed people to a blog titled waterboarding committee which lists jewish members of this community by name. that viewer who contacted us tells us she also notified b.a.r.t. and b.a.r.t. police who told her there wasn't much they could do. she was worried about being on camera but told us, quote, i believe in free speech, but this seems like hate speech. they're always telling people to say something when they see something. i tried to say something to b.a.r.t., and i got nothing. we reached out to b.a.r.t. and got a response. the quote, appellate court case law warns that leafletting free speech material on windshields is allowable. we checked in with the lafayette police department, they say they're going to follow up on the case. again, some folks might be feeling a little unsure about who is sitting next to them on the train today.

kris sanchez, "today in the bay." >> thank you very much, kris. 5:35 right now. is someone targeting some of the most vulnerable people in san jose? at least three homeless have been stabbed to death this year. officers are questioning people at an encampment after the body of a man was found stabbed to death on tuesday. two others have died the same way. crime stoppers is offering a $1,000 reward for any information that leads to an arrest. a trail ablaze and police are searching for who is responsible for setting several fires in concord. the latest fire was set last night. all this is happening along the iron horse trail in concord. police say 30 fires have been set there in the past few months. firefighters so far have been able to contain the flames before any major damage has caused anyone any harm. the people living in that area are certainly worried. >> the houses are going to burn sooner or later. a couple weeks ago we had four fires out here within a few

minutes. >> so far, no suspect has been caught. 5:36. stanford health care is about to be named in two lawsuits linked to an anesthesia technician who pleaded no contest to sexual battery. the one-time worker, robert laughing jer was accused of groping several male patients. one of the patients was a minor when he says he was groped. the second is against a whistle-blower who believes he was retaliated against after investigating the incident. crisis averted for now. late yesterday congress passed a temporary spending measure called a continuing resolution that keeps the government operating through the beginning of december. then we get to go through this whole thing again. a shutdown would have started tomorrow if they didn't reach a deal. that measure includes $1 billion for battling the zika virus. the body of long-time israeli leader shimon peres lying in state in jerusalem. we have a live look outside

israel's parliament building where dignitaries along with thousands of people are paying their final respects. there you see the coffin. this is the actual video feed of a broadcast being aired right now throughout israel. shimon peres died yesterday at the age of 93 after suffering a stroke. president obama will lead the u.s. delegation at tomorrow's funeral. ts saying good-bye to a passionate and talented baseball player. the entire miami marlins baseball team gathered outside the ball park yesterday to send off the hers of fernandez. jose fernandez was killed early sunday morning when a boat carrying him and his two friends crashed off miami beach. >> the players had to play a game after that as well. 5:38. an intense search under weigh in

china. at least 27 people are missing after a massive landslide was triggered by typhoon meggi. crews are hammered as rain continues to pound china. that landslide happened yesterday afternoon and destroyed several buildings. heavy rain has forced more than 18,000 people from their homes. 5:39 right now. we'll check our own micro climate forecast. rob is in for kari who remains on attorney leave. >> this morning we're watching breezy changes in the forecast, gusty winds in solano county and comfortably cool temperatures around the bay area. mid 50s outside. check out the wind speeds in solano county. southwest at 30. the wind is good news for air quality for most of the bay area except the south bay where smoke will be drifting into san jose south into the afternoon. highs around the bay area quite cool, back into the 6 os and mid 70s for most spots and trending cooler for the weekend with more clouds and a chance of seeing

some rain for your sunday plans. saturday looks to be the drier half of the weekend, but cool. look at those temperatures inland. upper 60s with rain changing to showers on monday. a bit warmer by next wednesday. >> a nice smooth flow of traffic. one of the changes in the south bay, the first burst you see for san jose, 101 at 680 a crash has cleared from the roadway. there's a tiny bit of re siddal slowing. more slowing for westbound 80, the upper eastshore freeway. we have a couple of crashes reported. both sound like they're completely clear of lanes. now we have recovery after that happened. that's early slowing for the upper east shore. the bay bridge toll plaza shows the backup because the metering lights are on right on schedule. back to you. >> thank you very much. 5:40. 2,000 cars stolen from san francisco every year. for one bay area woman it's become a very strange way of life. >> sorry. i'm going to be a couple hours late because my car got stolen

returns, you wouldn't think it could possibly happen this much to one car owner in san francisco. kaya nicholson has a 1997 honda civic. she's named it boomerang because, as we first told you earlier this summer, it was actually returned four separate times after being stolen. now make it five. it happened again this week. this time she tracked the thief with an app on her smart phone. >> actually moved to another place about four blocks away. i figured the guy was still actively driving it around. >> when she final guy got her car back, nickholson says the thief left items for her including glasses and a sweatshirt. police told her to get a lock or a new car if she really wants to prevent number six. looks like she did put a lock on the steering while. >> finally. the effort to extend b.a.r.t. eastward through the tri-valley getting a big push forward, more than a million in funding approved.

the money will cover costs for environmental work. they also approved funding to improve the a train connection. governor brown has stopped out a law that would have banned smoking in state parks and beaches. lawmakers approved a bill that would have fined smokers $250 for smoking or disposing of tobacco products there. the governor yesterday issued a veto and called for a more measured and less punitive approach to smoking. who is behind the wheel of your ride share? the next time you call for one, uber and lyft will be forced to conduct background checks beyond just seven years which is what current regulations are. starting next year, they won't be able to employ drivers with sex offenses or violent felonies on their record. p the companies don't comply, they'll be fined up to $5,000 per banned drivers. >> the company that brought the smart phone into the world

now in parts of the south bay, some are told to stay inside. we learned earlier this week the san jose unified school district has told administrators to instruct principals to keep students inside during the school day, that way you can avoid any potential health risks because of the smoke that is just sitting there like a heavy fog. >> it's really rough. the particulate matter in there, i was out yesterday, and i could feel it in my lunges. kept the kids in, even keep the dogs in. >> the winds have been light so we've been looking at the smoke settling in to morgan hill and san jose. what is good news for firefighters that the wind speeds have been light, not good news for air quality. probably more of that today. as the winds pick up, air quality should improve in the south bay tomorrow. notice the one loan spot with smoke pollution is the south bay. wind speeds, this afternoon pushing smoke towards south san

jose and morgan hill. friday, turning gusty. that will push more of the smoke away from the bay area. humidity levels will drop so fire conditions may get more extreme for friday. i think air quality will get better around the bay area. temperatures this morning in the 50s and 60s. gusty winds pushing those low clouds into sacramento this morning. and during the day, inland sunshine, if you're going to find sunshine on the coast, santa cruz the most likely spot. our valley temperatures running quite cool for the numbers we saw two days ago in the bay area. 70s to low 80s in san jose. 60s to 70s around the peninsula. for the north bay, highs in the low 70s. 70s to low 80s in pleasanton and livermore. we'll see the cold front pass by without rain but cooler drier air rushing through on friday. the drier half of your weekend will be saturday.
