first a check of the weather. rob mayeda joins us. >> the weekend is coming, seeing temperatures on the rise the next couple days. you still need a jacket for the morning. 40s in the bay area. tri-valley, north bay down to 45 degrees. afternoon highs in the valleys in the low 80s today. by the time we get to tonight, could see 80s and 90s inland. >> in the south bay, a new crash for you. extra slow off 880 westbound on 237. that's the commute to first. we have a crash which should be clearing quickly but you see how quickly this buildup forms. over here in livermore, dublin westbound 580. reports of a deer hit on the roadway. i didn't see any activity on the camera. but see slowing on sensors. and approaching the bay bridge,

crash at the curve. talk more about that coming up. back to you. >> thank you very much. breaking news we have been following since 4:30. one person dead, another in the hospital following an overnight shooting. today in the bay bob redell is near bee and seventh street. it has been an active scene all morning. what's the latest? >> reporter: hayward police just left the scene. it happened here in front of this small apartment complex on the 1700 block of bee street. there was a car, you can see broken glass. it was around 11:30 last night when someone opened fire. this is what the car looks like. it was removed from the scene an hour ago on the back of a wrecker, white sedan. driver's side window and passenger window were shot out and passenger side, two windows in the driver's seat, one of the passenger windows was shot out around 11:30. one person in the car was shot

and killed. the other person injured. taken to eden medical center for treatment. their condition unknown. as far as there being suspects, police haven't released a description or indicated whether they made any arrests. we spoke with what we believe were homicide detectives, they said the public information officer would release more information soon. one person shot and killed, another person injured in a shooting that took place in this driveway at this small apartment complex. live in hayward, bob redell, today in the bay. 6:03. more breaking news as millions of people are bracing for the worst as an intense finding hurricane matthew bears down on the southeast coast. all flights from the bay area to south florida are cancelled. evacuation orders are in effect from south florida up to the carolinas. so far the path of the hurricane left at least 25 people dead after hitting haiti and cuba very hard.

threats of violence taking over social media. some law enforcement call it a hoax, but the hoax reportedly became real for a mother in concord. she told police a man dressed in a clown outfit tried to take her baby. >> he had a wig on, black, but smiled and said oh, and took her hand and grabbed it, looked like he wanted to kiss but didn't. he touched her arm instead. >> she fought back and the clown ran away. police are taking it seriously. the incident comes after several bay area schools were threatened by clowns on social media. b.a.r.t. will be paying out. the transit agency agreed to settle a wrongful death suit. a trainee was operating the train that day. an investigation found the

operator supposed to be supervising was not present and may have been texting on a cell phone. could this have been prevented? anger on the peninsula. two women struck by a car in an east palo alto intersection that many say is known to be dangerous. the driver hit the women last night while they were crossing bay road near addison avenue. injuries are not considered life-threatening. but five years ago a seven-year-old was hit and killed in that same intersection. the city added crosswalk lights but neighbors say it is not enough. >> we need lights at every crosswalk. need butt ons. something has to happen around here, this is insane. it is going to keep happening. >> the driver was arrested on suspicion of driving under the influence. 6:09. another cool start to the morning. the afternoon should look nice. the blue angels are in town for a practice run. >> and clear skies, we hope. >> clear skies, good visibility

devices and found pornography at his office. he is now in custody. two sexual assaults on the campus. one suspect is behind bars. first one was two weeks ago in a graduate dorm. over the weekend, campus police put out a safety alert, saying another alleged rape happened in another dorm. many students saying they have been required to participate in sexual assault education and add it is not just about awareness. >> i think it is culture. i don't think it necessarily changes right away. >> last month, governor brown signed a tougher rape sentencing law inspired by the case of brock turner. problems with the replacement samsung phone.

it happened yesterday in kentucky. nobody was hurt. that phone began to emit smoke before takeoff. here's the interesting part. the samsung 7 was replacement phone according to the passenger who says he replaced the original samsung 7 phone which the company warned was prone to exploding. and theranos is laying off people. >> disappointing results. elizabeth holmes says she's shutting down theranos labs, laying off hundreds of people who stuck by her as many, including "the wall street journal," said her sence is fraudulent. theranos claimed to be able to test a single drop of blood for a host of diseases. most doubt that. the federal government says the labs are badly mismanaged. homestead, we are profoundly grateful to team members many of whom have devoted years to theranos and our mission, for their commitment to our company.

6:17. nbc bay area responds to a woman with a problem frig.. >> consumer investigator chris chmura has the frustrating story. >> good morning. jacqueline stone bought a refrigerator from sears three years ago, it recently stopped working. since it was under warranty, she called sears and scheduled a service appointment. she says the repair person didn't show up. she scheduled another appointment. again, no show. two weeks later, she says the refrigerator was full of mold. she called sears and asked to replace it but the company said no, pointing to her warranty that requires four service accounts. -- attempts. she argues it is unsafe because of mold which might not have been a problem if the original service call was answered but sears wouldn't budge until we called. they said it requires four service attempts. after we called, sears changed its mind, said it is going to go ahead and replace that refrigerator and pay $250 to

tuesday protesters in that country threw stones at her vehicle. 30-year-old sharon gray was going to attend a planned biology meeting there, anger had been brewing since sunday. at least 55 died in a stampede during a religious festival. police are blamed for sparking the stampede. a dispute among a couple of juveniles led to one of them being stabbed at a taco bell in the east bay. the two started to fight 5:00 last night and the restaurant was on string dale avenue near the mall in pleasanton. they tracked down the suspect after setting up a perimeter. we are told he is now in custody. the victim will recover from injuries. sheriff's deputies in santa clara have another way to keep guns out of the wrong hands. pete, we understand deputies will have access to gun vaults in their personal cars. >> reporter: good morning, laura. santa clara sheriff's department

will unveil gun vaults around 10:30 a.m. they ordered about 700 of them. it will be in deputies cars, squad cars and personal cars they take home. they tweeted a photo last night. this is from the santa clara twitter account. the lock box is still in packing. the size is 11 by 8 inches. new requirement after passage of senate bill 869 signed into law last week by governor jerry brown. they have to either lock them in the trunk of squad cars or personal take home cars or secure it in the lock box where no one can see it. the point of these comes after several incidents involving guns being stolen from law enforcement vehicles. the most high profile incident last year when it was used in
