take a live look outside......(e michelle/2shot good morning. it's 7:00 on this sunday, october 9th. a live look outside in san jose. a beautiful shot out there. good morning and thanks for joining us. i'm michelle roberts with anthony slaughter. yesterday was hot. same thing today? >> it will down just a bit. yesterday we had 90s. even san francisco got to 86. you'll be thinking about turning on the heat in the next couple days because we have cooler weather and rain by the end of the week. it will be near dry day but temperatures not all that bad, in the 40s and 50s. not as chilly as it has been, but later this afternoon we will see under full sunshine

temperatures warm quickly but because of that natural ac that starts to kick in, we aren't going to see temperatures as hot. san francisco for instance only 77 degrees after yesterday close to 90. we'll be closer to the mid-80s after in the 90s yesterday. you will notice the cooler weather in the afternoon hours. it will get breezy, especially in san francisco. you'll have to deal with gusty binds this afternoon. >> thanks, anthony. a day on the bay ends in chaos. several people, including three children, are recovering this morning after a scary and dangerous ordeal off pier 45 in san francisco. take a look at this video shot by a witness usinge ing ing a g. you can see witnesses scrambling to help 30 people when their boat overturned 100 yards off pier 45. passengers and crews on another boat helped people struggling in the water. >> the guys were getting life jackets and throwing them over to the people. there were a lot of people in the water. a couple kids in the water.

sgr >> it's still an open and active investigation as to what happened. sfpd will be involved in determining if there was any criminal activity involved. >> five adults and three children were taken to area hospitals. one 5-year-old boy was listed in critical condition, and he is expected to be okay. we're also hearing from one good samaritan who helped save lives there. david griffith is a crew member on the happy days boat which was nearby. he says 20 years of experience on the water has taught him to act quickly. >> there's just a ton of people in the water. just started throwing life rings. >> witnesses say another person swam up into the cabin of the overturned boat and rescued a father and his child trapped inside. now, this is the second time in five weeks the boat has capsized in the bay. a catamaran carrying 15 vsea scouts and a chaperone capsized and they were all rescued and

unhurt. we are also foalillowing th story on our nbc bay area app. you can watch the rescue at nbcbayarea.com. now to decision 2016. yet another donald trump firestorm has republicans rushing to do damage control. some prominent party members now calling for trump to quit his position as the republican presidential nominee. it comes after a newly released audio recording from 2005. in it trump can be heard using lewd and graphic language about women. but despite this new controversy, trump says he's refusing to leave the race. peggy bunker has the latest. >> not one self-respecting woman should vote for that man. >> reporter: senator barbara boxer expressing outrage over donald trump's comments about women. even trump's wife melania spoke about the controversy saying the words my husband used are unacceptable and offensive to me. i hope people will accept his

be a major issue during the second presidential debate tonight. it's a town hall-style debate which will provide more one-on-one audience interaction. it's being hosted at washington university in st. louis. coverage starts at 6:00 and we will be showing it on cozi tv comcast channel 186 because of sunday night football. after a 12-hour standoff, a man accused of shooting three police officers in palm springs has been araesed. two of those officers died from their injuries. fellow officers lined the streets last night outside the hospital waiting for the two deceased officers to take a final patrol in the city they served and protected. the officers were killed while responding to a domestic disturbance call. investigators say the gunman opened fire without warning while the officers were trying to talk with him at the front door. officer jose gilbert vega, a 35-year-old veteran was due to retire in december. and another was a new mother.

>> i'm totally sad for him, for his family, for leslie's family. >> it's unbelievable that she wouldn't be going home. >> 27-year-old officer leslie zerebeny had been on the force for a year and a half. she recently returned to duty after giving bir tot a baby girl just four months ago. officers from all over the country are sending their condolences including from departments here in the bay area. morgan hill pd tweeted out this photo saying that they're heart broken by the attack. san mateo police also tweeted out a message adding they are wishing a full recovery to the officer whoer is vi er isurvive. and the elderly woman who was seriously injured after a robber attacked her last month has died. 88-year-old flo douglas died early yesterday morning. she spent the last four weeks in critical condition following a violent home invasion robbery. deputies arrested 19-year-old

zachary cuen for the arrest. he lived directly across the street from douglas and was allegedly caught on camera driving her car and using her credit cards. now that she's gone, her family has messages for her accused killer. >> i would just tell the truth in spite of what anyone else will tell you. >> there is a go fund me account for douglas that was meant to pay for her ongoing care but now will be used for her final expenses. douglas is being called a pillar of san jose's african-american community. a bay area man accused of trying to kidnap a child is in jail this morning. emeryville police say they arrested eddie fontenett after they got a report that a man tried to grab a 5-year-old child out of a relative's arms twice. the relative was able to scream for help and the man ran away. police say they later found fontenette in the same area and arrested him. the giants are in a tough

hurricane matthew has been downgraded to a category 1, but it is still leaving a path of destruction. the storm continues to wreak havoc on the east coast drenching the carolinas after battering both florida and georgia. at least 11 people in the u.s. have died and more than a million are without power. police in north carolina rescued a mother and her baby from floodwaters. the storm shut down the nascar race at charlotte motor speedway, uprooted trees, created dangerous conditions on the roads, and flooded homes. >> we have our neighbors here with us, and, you know, my heart just bleeds for our neighbors. >> yeah. you get a little bit emotional talking about it. why? >> they just have a complete loss. >> south carolina's governor is warning that it could be days before it's safe for people living along the coast to return home. a train crash in new york sends several people to the hospital and causes major delays last night. this is video of crews evacuating people off the passenger train on the long

(adlib) it is football sunday. a live look outside in oakland where the raiders will be playing the chargers this afternoon. it's going to be a nice, warm day. more proof that fire season in california isn't over yet. fives from all over marin county

battled a new brush fire this weekend. you're looking at one of the planes dropping flame retardant yesterday afternoon. in vegetation fire is burning near st. francis drake boulevard. the marin county sheriff tweeted out this picture of the flames. the fire is now under control, but firefighters spent extra time protecting nearby businesses just in case the fire flared back up. and in the santa cruz mountains, the loma fire is still burning, but for now some relief for neighbors. county leaders held a meeting in los gatos yesterday to show people where they can find the proper resources to help with their recovery. all evacuation orders have been lifted. >> so there are families with children. there are elderly that need to have knowledge that they can be evacuated and/or receive treatment. >> the loma fire is now 95% contained. since the fire started last month, 12 homes have been destroyed and nearly 4,500 acres

have been burned. it's day three of fleet week in san francisco, and the blue angels have been putting on an incredible show. wow. check that out. the famed pilots took to the skies just after 3:00 yesterday, but clouds showed up hours earlier to get a really good view. once the show got going, all eyes were on the sky to watch the main attraction. >> i saw them fly over the bridge, and that's kind of my favorite part because it's pretty and i also like how loud they are. >> that's true. if you missed it yesterday, the blue angels will be flying again today between 3:00 and 4:00. much more information on fleet week festivities this weekend, head to our website, nbcbayarea.com. there you can also find some raw video of the blue angels practicing as well as some other video. it's really incredible to see in person. it was my first time going to fleet week. great weather out there. >> it's going to be even nicer today. yesterday was a little warm,

especially for san francisco. mid-80s. 86 was the high yesterday. that's well above average. >> today better though? >> yes. back into the 70s. we'll see temperatures a little bit more comfortable abable eve coastline. if you're getting into the water, 86 probably didn't feel that bad. we're looking at clear skies. beautiful sunrise over the north bay. same view for the tri-valley and temperatures generally in the 40s and 50s right now. in the afternoon we'll stay sunny and temperatures not as hot. for instance, san francisco, 77 there after yesterday 86, and that's because we're going to see winds kick up this afternoon at the coastline so it will be a little breezy and that's that natural ac that will hinder our temperatures. 86 for you in the tri-valley and 82 for the peninsula. same deal for the south bay. we'll be looking at mid-80s along with the north bay. you will notice that seven-day forecast forecast cocoming up. we're talking about the chance of rain. we'll detail that in a little bit. if you're headed to the beaches today from the north bay down through the south bay from santa cruz all the way to daga bay, we

are looking at rip currents. keep it in mind. let's switch gears and give you an update on hurricane matthew. packing winds up to 75 miles per hour. it's lost its hurricane chs characteristics but still spreading heavy rain. here back at home we are going to eventually see things quiet down and get a little wet for us here at home. so we'll put the future cast into motion. things will stay quay yet, today, tomorrow, even the next couple days. we're not introducing a chance of rain until thursday night into friday and it will be a big system. i want to show you wednesday. lots of rain across the pacific moving up towards the pacific northwest. that's going to be the first of a series of storms, but look at thursday's system. look at these colors here. we haven't seen a storm system like this produce colors like this which would mean some very heavy rain moving into the north

bay as soon as friday and look how it holds together even as it pushes down towards the south bay and omp never near tahoe. this could be a very strong system for us producing maybe 3/4 of an inch across parts of the north bay and maybe a 1/2 inch for some of our elevations across the santa cruz mountains. we'll be looking at the computer models to vary for the amounts because look what happens on saturday around 2:00. we could be pushing more than one inch and close to two inches in the north bay and one inch for san francisco. so a series of three systems could be impacting us next weekend. keep that in mind as you make plans to get outside because it may be kind of wet next weekend. 85 today in san jose. 86 in gilroy. 77 for san francisco, and even nice in santa cruz today, 78 degrees. you'll notice, michelle, over the next couple day it's temperatu temperatures kind of fall off. in san francisco we introduce the fog tomorrow. clouds picking up for thursday

jose to teach piano. for free. >> exactly. again, one more time. >> reporter: she says the idea really grew out of her own elementary school experience when budget cuts ended her school's music program. >> that kind of like stung me a little bit because like i really missed the classes. now we're going to try again. who wants to play in front of the class? >> reporter: megan held onto that notion and wanted to make sure younger kids didn't miss out on what she loved. so megan raised nearly $4,000 to buy enough keyboards and music books to get her program called music for all off the ground. >> i feel like anybody, like anyone can just like if they take the time and effort, they can make a difference in this community. >> reporter: megan says she wants to run music for all until she's old enough to head off to college, then hand it over to one of her younger siblings. her students may be not good enough by then to win

after she was honored she got right back to work calling verts and surge urging them to vote for hillary clinton. she became a senator in 1993 after ten years in the how many times house of representatives. it's now up to a federal judge to decide who is right in that lawsuit against airbnb. the two sides went head to head in federal course on thursday but the judge still hasn't made a ruling. this lawsuit could affect everyone in san francisco. >> that includes people who don't use airbnb because at the heart of this issue is the housing crisis in san francisco. the supply is just too low and what is available is junction too expensive. airbnb believes its platform gives people a way to earn some extra money but city leaders think too many people are turning their short-term rentals into year-round illegal hotels which reduces the amount of

housing in san francisco. now, a judge will weigh in on the legal battle. >> instead of working with the city, what they did is they simply went ahead and sued. >> reporter: how would you describe how airbnb has handled the situation? >> very arrogant. >> reporter: san francisco supervisor david compos says airbnb should be forced to take responsibility for their thousands of users who continue to break the law by renting out their homes online without first registering with the city. >> that's why san francisco is not going to be intimidated by what is essentially a bully tactic on the part of this company. >> reporter: for over a year and a half anyone in san francisco wanting to rent out their home shorm term has been required to get a $50 permit from the city, but our investigation exposed how that registration process has largely been ignored. until may we revealed that at least 82% of hosts are breaking the law since they failed to

register with the city. >> folks have been robbing residents of that housing and airbnb has essentially been driving the getaway car. >> reporter: after our investigation campos and other members of the board of supervisors approved a new law that would allow the city to charge home sharing companies up to $1,000 per day if they allow unregistered users to continue to post their rentals online. airbnb fought back slapping the city with an 18-page lawsuit that accused san francisco of violating the company's first amendment rights of commercial speech. airbnb also argued it would be a significant burden to verify whether all of its users are registered with the city. the new penalties were supposed to take effect in july, but san francisco put that on hold after the lawsuit was filed. >> this is the first time we have ever taken a step like this. >> reporter: david owen heads policy strategy for airbnb and says the city's registration process for hosts is too

complicated but when users fail to register, san francisco wants companies, including airbnb, no get stuck with financial penalties. owen disagrees. why do you believe that's so unreasonable? >> it's really just not that simple. this is a new activity. it's a new economy. and the city can and should be able to develop a simpler, much more innovative process to enable folks to rent out their home for a few nights out of the year without going through a process that takes six, eight wekts. >> reporter: the city says registering only takes about half as long. if people get to ignore city laws they simply just don't like, sthant a recipe for disaster? >> i think it's unfair to say that. we have been at the table and spent significant amount of time identifying issues, working on solutions, and being part of a dialogue, and, in fact, are committed to continuing that process. the current rules simply don't work. >> reporter: our investigative

unit went undercover this past summer to show you how easy it is to find and rent out homes on airbnb that are not registered with the city. last year san francisco found that nearly 2,000 homes were taken often the market permanently in order to be advertised as short-term rentals on airbnb. if they're able to get parts of this ordinance thrown out, what do you think that could mean for san francisco? >> it's the very future of san francisco. at the crux of the housing crisis is this question of will san francisco continue to have a middle class? >> reporter: you think this one lawsuit could carry that large of an impact? >> absolutely. i think this can open the door for other industries, especially around the sharing economy, that would essentially allow other industries of other companies to say, we have no responsibility when it comes to the impact that our business has on society. >> reporter: it's unclear just when the judge will issue a decision in this case, but if you plan on recentinting out yo

anticipation than the last. political analyst larry gerston joins us to give us an idea of what to expect between donald trump and hillary clinton tonight.

tonight presidential candidates ando welcome back. tonight presidential candidates hillary clinton and donald trump will meet in the second of three campaign debates. the town hall format will allow a group of undecided voters to question the candidates directly. nbc bay area's political analyst larry gerston is here to break down all that's going to go on tonight. the town hall will offer such a different format. >> you're absolutely right. unlike the first debate where each candidate stood behind the podium, almost protected behind that podium, tonight is going to be different. each will sit at a bar stool. they will have a handheld mike. members of the audience will ask questions on any topic, making it very difficult for the candidates to respond with those canned answers or cute

one-liners we often see. no doubt, we know it's coming, someone will ask trump to account for his lewd remarks about women in that now famous or infamous 2005 tape released friday. many observers believe that his behavior has just jeopardized his opportunity to win the presidency. maybe this is just one time too many. >> all eyes are on trump. he's offered an apology already, but what can he do, if anything, to help himself in this case? >> yeah. look, trump needs to provide responses that really match up with the questions instead of going off topic and saying whatever he wants to say. if he's asked about the tape, he needs to apologize sincerely and without any ambiguity or blame on clinton at this point. he hasn't done it. just hasn't so far. but in addition, he has to control his anger. he has to control his frustration. his body language is very important here. believe you me, people will be watching the way he acts as much as what he says. third, trump has to find a way

to present his vision. it's just not enough to berate clinton and all the, quote, disasters he associates with her. he's got to show in detail how he really will make america great again. >> and hillary clinton has responded on twitter only saying that she's disgusted by this tape. but what do you expect from her. how do you think she'll handle all this? >> you said it right, twitter-only. assume she's asked about the trump sex tape, she has to keep her remarks to a bare minimum. the tape speaks for itself, and she has other people speaking for her. she has to also avoid that robotic appearance that she's known for. answer the questioner as if they're having a person-to-person conversation that will make her feel more authentic. and finally as the front-runner, she has to avoid that gaffe. it sounds simple enough to do so, but believe you me, if she's too stiff, on the other hand,

that won't be good either. she has to be sincere but at the same time don't make that gaffe. can't do that. >> a couple weeks ago we were watching the first debate. we thought that was a big deal. now it seems this is even bigger than the first. how important is this debate? >> the stakes, michelle, are so much higher than they were 48 hours ago. that's for sure. clinton can absorb a loss here, she can, because she would have the opportunity to come back. for trump, it's really almost do or die. he has to do well to stay in the game. a repeat of 12 days ago could all but seal his fate, and given the downward trajectory of the last two weeks, he has to act and he has to act in a very, if i can use the word, presidential way. he really does. and remember something very important here. people are already voting. they're already voting in seven states. they will start voting in california soon. they'll be voting in 11 states at the end of the week. the bottom line is time is

running out. >> and he's still in the race. >> he's still in the race. >> many people are asking him to step down or move out of the way. >> the national polls show him three, four, five points, but, remember, it's not the national polls. it's all those battleground states and we're seeing those battleground states move decisively toward clinton, but tonight is his opportunity. >> should be fascinatinfascinat. thanks for joining us, larry. much more ahead on "today in the bay." and it's not the burglar they were expecting. it's not as hot for you and we have rain on the horizon. we're back with details, your weekend forecast, plus a look at the next seven days.

welcome back. 7:54 is the time on this sunday morning. want to start you off with our sky cam network. you can see from every location this morning we're waking up to sunshine, chilly in the north bay at 57. clear skies across the entire bay area all the way down into the south bay. look at hour high temperatures late they are afternoon. km comfortable for most of us. the tri-valley up to 86. even the south bay will reach 85. but san francisco comfortable at 77 and then this afternoon it gets a little breezy and we do have a beach hazard statement from the national weather service today. also for tomorrow for the coastal locations. if you're going to be headed to the beach, keep it in mind we will have rip currents moving along the coast line today and tomorrow along with sneaker waves and large shore breaks. keep that in mind if you're

headed to the beach for today and tomorrow. a quick update on hurricane matthew. still packing winds at the center of 75 miles an hour. they're seeing light to moderate rain from boston to new york, even washington, d.c. the good news, they're pretty much done with matthew. it will continue out over the open sea. this morning still dealing with heavy rain across parts of the atlantic coastline. here back west you can see we've got clear skies this morning as our sun is coming up. storm track well to our north, about you that is about to change as we head towards this upcoming week. we're tracking a series of storm systems that are going to move in for the weekend. here is wednesday. that system though, that's going to the north, but the system behind it for thursday night into friday, that's the one that's going to impact the bay area. first for the north bay, thursday night, and then it will move into the bay area for friday morning into friday night and even bringing more sierra snow with it as well. again, this will be the first of a series of storm systems that moves this way. so friday's rainfall decent but,

again, not going to be what we're -- not going to be done with the rain just then. but you'll notice maybe half an inch for some of the higher amounts even across parts of the north bay. round two comes in on saturday into sunday and that's where we could get more than an inch total with both systems for the north bay and three-quarters of an inch for san francisco and maybe, just maybe, more than half of an inch in the south bay. so something we'll be watching very interesting. this could be the most rain we've seen all season. of course, we haven't had that much, but this is a nice welcome sign if this comes through. enjoy today. it will be comfortable, a little warm but that last summer air looks like it's going to be felt this week but once we get into this weekend and next week the temperatures cool off even in san francisco. low 60s by next weekend. so nothing like we saw yesterday of 86 degrees in the city. a big change coming our way over the next seven days, michelle. >> i welcome the cooler temperatures. >> me too. you have to see this.
