canine stabbed. the investigation under way following a deadly officer-involved shooting in the east bay. "today in the bay" starts right now. very good wednesday morning to you. thanks so much for joining us. i'm laura garcia-cannon. >> i'm scott mcgrew. sam brock has the day off. let's get a start with your weather with rob. >> seeing low clouds. this view in san francisco perhaps is how you feel after last night's game, a bit of a fog this morning. mid 50s outside. by the afternoon, 60s and 70s for the afternoon. check out the other types of clouds lining up in the pacific. that tropical moisture set to bring big rain, win and waves. let's check the commute. >> we have an issue with a car and fire down in san jose, a truck overturned in the tri-valley, both off the freeway. this off the bay bridge.

reported eastbound 80 heading away from the toll plaza. sounds like all lanes are clearing right now. we'll look at the bay bridge toll plaza shot. i did see a fire truck traveling west in oakland and the san francisco drive. the fire was reported in the eastbound direction. it should be right around this area. no lanes are blocked on either side. i don't see any problems. again, they're saying whatever little fire there was has been put out. back to you. a popular bay area walking trail has gone up in flames. this happened last night in pleasant hill, one of dozens of suspicious fires popping up in the east. "today in the bay's" bob redell live with the investigation into how those flames sparked, bob. >> reporter: good morning, scott. a contra costa county fire battalion chief says he's definite concerned, this is the 12th fire to have been started over the past couple months on a popular walking trail in pleasant hill.

the latest fire started just before 9:30 last night a little ways behind me along this east bay mud walking trail near oak park and 680. witnesses tell the fire department they did hear people out here but no one got their eyes on the situation. firefighters were able to put it out before it spread and caused any damage. >> another small fire in the city of pleasant hill during the night hour. even though it's a small fire, it could grow into something larger. definite a concern of ours and we'll definitely vase it to see if we can find out what may have started it. >> reporter: more than 30 fires have also been set along the iron horse trail in the neighboring city of concord. fire investigators has already declared those to be arson. not clear if they're connected to the ones in pleasant hill. live in pleasant hill, bob redell, "today in the bay." a san jose state water polo player accused of sexually

assaulting two fellow students is no longer in the country. we're told the school and san jose police have been investigating these accusations since the report first came in a month ago. the crime allegedly happened at an off campus party over the labor day weekend. police are not releasing the name of the player accused because he's not been arrested or charged. university spokesperson told nbc bay area the player is an international student. >> i feel like the school has failed and not notifying us. we should have been notified from day one. >> if you hear about it, you stay more on guard. i would have felt safer. >> school officials tell us the campus alert was not sent out because the student was already being interviewed and investigated by police. a live report coming up with more information in our next half hour. a police dog is recovering this morning after he was stabbed. the suspect was eventually shot and killed by police in concord. this happened yesterday

afternoon as police were investigating a stabbing z on crawford avenue. police eventually found the stabbing suspect in someone's back yard. that's when officers released a dog named jelle to capture the suspect. the suspect fought back, allegedly stabbed the dog with gardening shears. residents say they're stunned this happened in their neighborhood. >> i was in my living room, in my house, when i saw someone run into my back yard. i was like who is that? like, it happened so fast. >> the dog is expected to be okay after undergoing surgery last night. again, the suspect is dead. police have not released the identity of that suspect. happening today, the department of justice will release the findings of a ten-month review into the san francisco police department today. the doj launched that review in january following the police shooting of mario woods. according to "the examiner," san francisco police officers focus

too much on color, the force recommends uses tasers, something sfpd does not use now. in the meantime, the city is still searching for a new police chief. there are reports a selection may be announced this week. "the examiner" says the commissioner will narrow the choices down the three to five finalists during a closed-door session. mayor ed lee could choose someone from that short list. lawmakers approved $750 million in public money for a new stadium. the stadium would be used to lure the raiders to las vegas. that bill heads to the nevada state assembly. even if this bill is ultimately okayed, the nfl would still have to approve the move. alameda county leaders are working on their own plan to try to keep the raiders. you really can't sugarcoat this. >> not this morning, the giants and their fans still sund this morning after our season came to a crushing end.

tumbling as earning season got off to a disappointingtion start. alcoa stocks sank 11% after the numbers badly missed expectations. look for data on jobs survey and earnings from csx after the bell. the dow falling 200 points to 18128, the nasdaq sliding 81 to 5246. meanwhile, shares of samsung are sharply lower this morning now that it's been forced to halt production of its latest smart phone. the galaxy note 7 was supposed to be a bestseller in the run to christmas. some of the phones overheated and burst into flames. company losses could run into the billions of dollars. big cities beat smaller communities for happy, healthy residents as long as they offer sidewalks, parks and good public transportation. new york city, boston, san

flooding, historic floods around north carolina and around here we're about to see a big shift in our own weather. a lot of rain by october standards coming our way. the good news at least for today, no impact on your morning commute other than some fog around some spots. you can see some of that in san francisco, 54 degrees, low clouds over downtown san jose. overcast skies. partly cloudy skies outside sap center. around the peninsula, low clouds into palo alto. not too chilly outside because the clouds overnight acting like a blanket. daytime highs mid 0s around the south bay, 60s from the peninsula. north bay highs around 73. 74 in livermore and 73 in fremont. fast forward to friday. storm timeline taking shape. you can see the rain totals will be looking at most of this falling through the morning commute. one to two inches here in the north bay. lesser amounts in the santa clara valley.

higher totals around the santa cruz mountains. we could see three to five inches. this is the interesting part of the forecast. typhoon songda's moisture getting absorbed and that will power up another storm, bringing a lot of wind and rain. you see the moisture giving us round two from friday into saturday. wind and rain at times. big focus on this next storm for the start of the weekend. looks to be in wet earn washington. you can see a big impact on your weekend forecast as wind and rain will make a comeback again saturday afternoon. really friday morning commute, midday saturday and sunday with midday showers. forecast impacted by the weather. especially friday and saturday with a few more showers following us into early next week. mike? >> looking at an odd report this morning. the system is not odd, but odd reports in the system.

the south bay, san jose northbound at story road, the off-ramp closed. a car fire, a lot of smoke and activity. the story road off-ramp remains closed. you use tullie and take you to king or mclaughlin. light traffic throughout the south bay and most of the day. still okay taking the ought nat, adding a couple minutes extra into the area. the north bay, swb 101 south of the robin williams tunnel, a crash reported. there may be mud in the roadway. chp will give us an update. earlier truck fire cleared, the second issue for the morning. the third over in dublin. we talked about that onto eastbound 580. that's at hacienda. 92, no problems across the san mateo bridge. back to you. even though b.a.r.t. still years away from running to the south bay, a push is under way to prepare for its arrival.

sanchez is liveality san jose state. left the country, how does that happen? >> reporter: scott and laura, this young man was allowed to leave the country. he is an international student and was allowed to leave because he was not arrested nor charged after these two alleged sexual assaults on labor day weekend. he was also interviewed by not only the san jose police department but also university police which is the reason that the university gives for not immediately notifying students about the two alleged sexual assaults nearly a month ago. the two women who say they were assaulted by the water polo player are also san jose students themselves. we don't know where this off campus party where the alleged assaults happened, but it did happen sometime between september 3rd and the 5th. we do know the water polo team was in town. this is them playing a match in santa clara that saturday. it has been more than a month since then. >> i feel like the school has

failed, failed to notify us and it's concerning. we should have been notified from day one. >> knowing these kind of things happened around here, i would have felt safer. >> reporter: the university is not releasing the name of the student because he has not been charged. there was 19 water polo players on the 2016 roster, only three international students who are freshmen, only one missing a photo, so we have a pretty good idea of who we're talking about this morning though we won't reveal his identity either. the santa clara county district attorney is weighing whether or not to file charges. if that student returns to campus, he's not allowed add san jose state nor any team function. whether or not the district attorney can compel him to return to face charges is unclear. in san jose, kris sanchez, "today in the bay." >> today the department of justice is unveiling findings

"today in the bay's" pete suratos live in san francisco with the impact this could have. good morning, pete. >> reporter: good morning, scott. that investigation was started by the department of justice back in february. it was called on by many city officials and members of the community really wanting them to look into the use of force policy with the apartment, and this comes on the heels of a number of deadly officer-involved shootings involving sfpd. that's cell phone video of woods being shot and killed last year. i want to point out this investigation is voluntary and will be done at the department's community oriented police services division. that's important to note. today's news conference will not end in any court monitored settlement for the police

department. the justice department held a public meeting in san francisco explaining what this investigation will entail. >> policies, procedures. we interview people both on the department. we bring in experts to drill down. we drill data. we go in ridealongs, training, hiring, a very rigorous process. >> reporter: plenty to look at. since this investigation has launched, sfpd replaced the police chief. but the "san francisco examiner" is reporting that mayor ed lee may announce a new police chief some time this week. we're still going to wait to hear on those recommendations which will be announced by the department of justice during that news conference today at 11:00 a.m. we're live in san francisco, pete suratos for "today in the bay." 5:35 right now. a shakeup within the san francisco police department. we've learned a commander has been stripped of his position

ama amid accusations of sexual harassment. sources tell nbc bay area that ken lombardi was notified friday that the department is investigating the sexual harassment allegations that came from a former subordinate. we attempted to reach lombardi but he did not return our calls. this is the latest harassment scandal to hit the san francisco fire department. we told you about allegations, intimidation and hazing targeting a female firefighter. that is still under investigation. today community members will honor officer ken zink was killed last month when his motorcycle crashed into a truck. he was on his way to work. today's celebration of life will be held at the father hill church in vacaville. officer zink had seven children. a popular walking trail may be the latest target for a

serial arsonist. firefighters were called just before 9:30 last night. about a dozen small fires started on walking trails around contra costa county in the past few months. investigators have been trying to figure out why and who are causing all these fires. only on nbc bay area, the bay area school board member who is the victim of a violent crime is sharing her horrific ex-peermt. carol brown was shot in the hip and arm in front of her orinda home last month by two masked men. the suspects were trying to rob the 70-year-old and her husband. he was pistol whipped. a bullet is still in brown's body. brown did not want to show her face on camera, but shares how close she came to losing her life. >> i was literally an inch away from having that bullet penetrate my lungs and i would have been dead immediately. >> yesterday the contra costa district attorney office charged

six men in with a connection of home invasions and armed robberies. they believe two of those suspects also attacked brown and her husband. a shooting left one man dead and a family running for cover. it happened late monday night at lemoyne pausch. police arrived to find two men shot and bleeding on the sidewalk. 21-year-old eric brown, a local mechanic died at the scene. in the crossfire a bullet hit the bedroom wherein dough of a nearby home. the woman inside was grateful she wasn't hit. >> i was praying my rosary. i heard the sound. i was scared. the blessed mother saved me, the blessed virgin mary saved me. police are looking for the suspect and motive. >> 5:38 right now. 57-year-old south san francisco man is in jail for an alleged sexual relationship with a teenager who was his co-worker at safeway.

michael anthony lopez was arrested yesterday at the grocery store in burlingame. the alleged victim is just 16. her mother turned lopez in to authorities. a scary ordeal for a north bay teenager. police want to warn the community after a man tried to lure her into his car. this happened around 9:00 a.m. yesterday on dover avenue in fairfie fairfield, close to gordon elementary school. police say that teenager was walking when the man tried to convince her several times to get into his dark gray sedan. after she said no, the man drove off. a bizarre discovery in the east bay. a little girl's abandoned bike and clothing found right next to a reservoir in livermore. the items were discovered monday at the bethany reservoir at the edge of a boat dock. divers went into the lake and found no sign of a child. there have been no reports of a missing girl. an update on the boat that capsized saturday in the san

francisco bay. a chaotic rescue was captured on camera when divers plugged underwater fuel leaks on the 34-foot boat as they now prepare to raise it up. police also released an image of sonar which shows the boat sitting upright on the bottom of the bay. it's the image in the center. investigators say the boat might have sunk because it was overloaded. they'll know more when they get it back to the surface to examine it. let's check your micro climate forecast this morning with mike. good morning, rob. >> good morning. the only concern we have weather wise for now, low clouds, fog, a little mist on the coast in san francisco. you can see the view, 54 degrees with the haze over downtown right now. highs approaching the low 60s. visibility to the north bay, about four miles in santa rosa. eight miles in half moon bay. next two days, weather very similar. 60s in the coast. low to mid 70s inland. big changes in the weather coming up for your friday

reunited with her family. love to report happy news. this is one with a happy ending in florida. a missing 4 yard girl reunited with her family. rebecca lewis vanished saturday setting off a massive search. she was rescued in memphis two days later after nurses at a hospital recognized her.

investigators say her abductor who was arrested is a former family friend. they're not saying why he took the little girl. luckily she was not physically hurt. quarter to 6:00. warriors star draymond green can navigate the course but can he code? he'll do programming with kba area high school students today, part of a program called warriors code, bringing commuter science education to underrepresented students. green will be coding at the oakland high school later this morning. good news for south bay hikers, the popular san jose trail will reopen on halloween. the "san jose mercury" news says the trail has been closed all summer for a million dollar restoration and a first for downtown san jose, a dog park, harts dog park opened yesterday, it's on santa clara between san may dough and al men dean. the secret service is

opening up with the help of bay area tech giants. you can get a taste of life on twitter, facebook and youtube, the social media blitz comes as the agency works to improve its image after a string of bad press about security breaches and agent misconduct. tripadvisor announced it will no longer sell tickets to attractions with endangered animals. the company says it's banning tickets to attractions including elephant rides, swimming with dolphins and petting of species like tigers. tripadvisor is the first travel booking site to limit access to these kinds of tourist attractions. you play have to leave your comfort or service animal at home the next time you fly. animal advocates say the pets help with unseen ailments and help them cal undown on airplanes. the tsa says the number of animals coming onto planes is skrie rocketing. 100,000 animals a year now t. tsa is working with advocates and airlines to limit which

main event with the first of two storms, wind, rain and big waves heading to the coast. scattered showers to follow as we head into friday afternoon. rain totals very impressive for the north bay. one to two inches o of rain there, about an inch from san francisco to oakland. look at the santa clara valley, a classic rain shadow where all the rain hits the santa cruz mountains. the valley might miss out for the most part for friday morning. another storm will come in as we head into the weekend which will continue to add rainfall total for parts of northern california, may approach three to five inches from mendocino county northward. the extra component is the tropical moisture being drawn in by the weather pattern. this is tapping into moisture from a weakening typhoon. as that gets absorbed into the westerlies and fired in towards the west coast, that will help to power up the second storm developing into saturday. a lot of wind and we think more rain heading back into the bay

area. as the rain gets started on friday, we'll see another storm ramp up the rain totals for saturday afternoon into sunday. notice the seven-day forecast, it will keep the rain going into early monday morning. four days with big weather impacts as we head into the start of next week. >> we've had a number of issues around the bay where we have some slowing. they clear up and we'll give you the updates. 580 affecting the on-ramp for hacienda. looks like it will employee by about 6:15. the freeway itself in the tri-valley is moving well. recovery after the earlier crash. the traffic breaks have been cleared, also, from southbound 101 around the robin williams tunnel. the earlier issue here with the um in ber of vehicles on the shoulder, westbound 80 off the bay bridge, those are all gone, no more slowing and nor more distraction, only the bay bridge backup out of oakland and towards san francisco. in the southbound, northbound 101, reports of the story road off-ramp being closed. it has reopened after an earlier

two townhomes exploded near chicago last night. two workers with the gas company were hurt. they were fixing a gas leak when this all happened. we don't know how serious those injuries are, but nobody else was hurt. today prosecutors plan to announce charges against a man accused of shooting two palm springs police officer. john felix is expected to be charged with the murder of jose gilbert vega and leslie brennan. felix opened fire on the officers as they responded to a domestic disturbance. the suspect will make his first court appearance tomorrow. decision 2016 and just in overnight, the u.n. human rights chief says, if elected, donald trump would be, quote, dangerous from an international point of view. meanwhile trump says the shackles are off.
