weather alert. the first major storm brings another batch of nasty weather. the news starts right now. good evening. thanks for joining us. we're on right now because of the football game. the wet weekend weather continues and tonight a powerful wind. let's check on these conditions. first the rain and now some unsettled skies. >> the peak in the north peak up to 56 miles an hour wind gusts and gatos saw winds up to 48 miles an hour and san francisco gusts of 40 miles an hour earlier this afternoon and the list goes on even for concord, napa wind gusts in the 30s. the rain has made it into the south bay and you can see rain from sacramento through the

santa cruz mountains. the rain right now, where it's falling, it's going to stall out over the next 12 hours. this is midnight, you'll notice rain falling across the east bay and santa cruz mountains. that's going to be the trend towards tomorrow morning as the rain stays over this same area we have flash flood watches that have been posted near the burn zones so keep that in mind if you live nearby. an additional one to three inches are expected tonight and we have another round tomorrow. a wind advisory is in effect for tonight. lots to go over in about ten minutes. the rain creating a lot of problems in san francisco tonight. >> nbc bay is live on treasure island with the impact the storm had on a popular music festival today. >> reporter: we did see some strong rain and wind move through here, but right now we

are getting a break from that on treasure island. we did see, though, a number of people leaving. they had ponchos as they were heading out because of the weather that moved through here while the festival was going on. music lovers were advised of the wet weather moving through and while the festival was happening. earlier the festival tweeted outperform answer delays were happening due to the weather and due to the high winds the pier was temporarily closed. there were reports of a minor injury possibly to a crew member after a tent blew down earlier today. the festival expected now -- in their last tweet they said they are working on an updated schedule. on the road and there are a lot of people still headed this way. reporting live on treasure island, nbc bay area news. >> thanks very much. the rain and wind causing problems at the airport.

at sfo 41 flights have been cancelled today and 234 more are delayed. no problems at the airports in oakland and san jose. the weather knocked out power for 180,000 customers. pg&e saying they will be able to restore almost everyone's power right now about 6,400 people are off line and half of them are in the east bay. roads are starting to flood in the north bay and we're hearing of road closures because of flooding around fort baker. chp says they're seeing spinouts and accidents because of the rain. stay connected with our nbc bay area app. that's where you can follow the radar and set weather alerts for your specific neighborhood. new developments in the case of a san francisco police officer shot in the head last night with no warning. sources tell us the officer is kevin downs. he's been with the department

for two years. during a press conference today the police chief said he's lucky to be alive. he's partially paralyzed down one side of his body. he was shot at about 8:00 last night when officers responded to a call about a man causing a disturbance. the suspect refused to surrender or drop his weapon. he was taken into custody without more shots being fired. >> they fired flash bang devices to take the suspect into custody. this is 21st century policing at its best. they did everything they could to make sure the subjected a fighting chance. >> this going on at the shore shopping anywhere. the suspect is in the hospital for treatment of critical injuries. a town hall meeting will be held next week for people who want to know more about the shooting. the names of seven bay area firefighters were added to the

memorial in sacramento today. this pays tribute to more than 1,300 firefighters who have died in the line of duty since california became a state. this year 29 more names were added, five of those were firefighters for the san francisco fire department and six worked for freemont fire and the seventh worked for cal fire in the bay area. this is the 14th year the public memorial has been held, it is touching for everyone, even bystanders. >> when you come to something like this and you see the memorial and the families and what they've lost and gone through, you realize the sacrifice they make to keep us safe. >> if you want to see the memorial, it is in capital park next to the state capital in sacramento. coming up next, bernie sanders back on the campaign trail and back in california. this time, though, of course with a different fight. he's talking about a california ballot measure and he is pushing hard. remember the old eastern span of the bay bridge, well

we are a few days away from the final presidential debate and both hillary clinton and donald trump are busy preparing. while clinton avoided the trail today to prepare, trump was back on the stump in new england attacking his opponent in ways that are raising eyebrows. it's been a dark week for the republican nominee. at least nine women have come forward accusing trump of inappropriately touching them much like he described on that 2005 access hollywood tape. donald trump says the election is rigged if he loses. today he returned to his claim that clinton lacks the stamina to be president and went a step

further. he said clinton looked to a future where trump fades to the background. >> at the beginning of her last debate she was all pumped up at the beginning and at the end it was like take me down. >> if we do our job in 25 days donald trump will stop being on the news every single day. >> the latest nbc news map shows donald trump with a narrow path to victory. hillary clinton is leading in nearly every battleground state, but still much analyzing here of the numbers. bernie sanders back in california on the campaign trail, this time a fight against the high cost of prescription drugs. nbc bay area shows how the former presidential candidate is using supporters in the state to win the latest battle. >> reporter: sanders back in california and it's not about his former campaign, but about finishing a proposition, a

proposition to voters this november. >> what you do here in california will echo across the country. >> reporter: bernie sanders on the war path, this time fighting the nation's drug companies. sanders saying big pharma is price gouging against those needing life saving medications. an approval on the proper wi wi allow the cost to be negotiated that would allow prescription drugs to be put at a price at or below the office of veterans affairs. >> stand up to the greed of the industry which is charging us the highest prices in the world for prescription drugs while they're making tens of billions of dollars in profit every year. >> reporter: sanders fight for prop 61 is part of a commercial, but those against the prop feels it is hurting veterans by

increasing prices. >> the department evaluated 61 and they figured if it passes they could be on the hook for up to $3.8 billion in higher costs. >> reporter: she called the prop deceptive and saying 61 wouldn't apply to 88% of californians. >> i understand people are frustrated and worried about drug pricing, but prop 61 isn't the solution. it's badly flawed. >> reporter: sanders says voters will be with him and this will be an item on the ballot that will turn a victory on election day. sanders says he will continue his tv campaign for the prop up until election day and those on the other side of this proposition. in san francisco, nbc bay area news. still to come, an open house on the bart platform. >> get tickets for fleet of the future. good evening. ocean beach was packed today with lots of folks at the beach.

promise to keep the lawmakers open up the road for the raiders to move to las vegas and the team's owner is renewing the promise to keep the raiders in oakland for a little while. the team will play at the open colosseum for the next two seasons, if the team gets the green light to leave. yesterday the nevada legislator voted to use public funds to build a new stadium for the raiders. the governor is expected to sign off on that plan on monday, but the final decision belongs to nfl owners. look at this implosion in the san francisco bay. i love it.

cal tran collapsed one part of the old bay bridge today before 1:00. this is part of a year's long project to destroy the old east span part of the bridge. cal tran says because the blasts are contained, this project does not harm marine life. crews more than 8,000 pounds of explosives to collapse the stru structure, destroiing it in less than 40 seconds. >> i was imexpressed the first time i saw it. the test train for the new fleet for bart was at an open house today for people to go by and check out the new trains. they were invited to hop aboard and wander around the test train. the cars are designed to be quieter and cooler and more comfortable for passengers and easier for beginners to use. there are several more open houses coming up, including one tomorrow that will take place at the mcarthur station from

11:00 a.m. to 4:00 p.m. we like to share what is right with our community, our bay area proud series is a reminder of all good things that happen here in the bay area. >> we have up dates on some of the people we have profiled in the past. >> reporter: later this month we will air our 100th story and that's a lot of good people. we like to keep you up to date since the story first aired. the most watched story online is the one about chris and his dog with the unusual name of everything. we shared how chris was devastated when everything passed a couple of years ago and as a way to remember him dog, he posted on instagram that he'd send a tennis ball to anyone anywhere that wanted to play

with their dog. the response was overwhelming. we just heard from chris again. he said after some personal tragedy, he just needed the companionship of a new friend again, so there's a new dog in his life a foster called skooby. in 2014 we shared the story of ed who said he never understood the power of art until he donated some, a sculpture to a medical facility. the notes of thanks ed got from patients who were touched by the beauty inspired him to do even more. so he pledged $12 million to help build a new art and art history building at his al alma mater. tomorrow morning that building will be dedicated and ed plans to be there standing under yet another beautiful consusculptur.

this story we shared of story of a young san jose woman with special needs who spent years creating art in her san jose bedroom. it wasn't until a businessman happened to see a painting she made of one of his buildings that he asked to display it. her world has been opening up ever since and last night she got to go to her first ever shark's game. joe heard she had done a painting of him and he just wanted to meet her. that's just a few of the updates we have for you. i have more updates. i'll be posting them to my facebook page. >> i remember each of those stories, especially the tennis ball story. >> because it involved dogs and you are a dog lover. >> that's right. anthony is here with the top story of the day. the weather effecting us all. the rain is still moving

through. i want to start you off with the rainfall totals. they were impressive just today. the north bay in some spots another inch of rain after yesterday you picked up an inch of rain. that's two inches in two days. napa a little bit less than half an inch. san francisco about half an inch to ocean beach and to twin peaks a little more than a quarter of an inch. the east bay a decent amount. more than half an inch in dublin. across the peninsula we're starting to see the rain lighten up, although we did get an decent amount in some places and the rain just started to fall across the south bay, but more than half of an inch in just the last hour or so. there's the rain on the radar right now. it's still making its way through the east bay and down towards the santa cruz mountains and gillroy is starting to see

the rain right now. while we're seeing the right now in the east bay and south bay, that's where it's going to stay tonight. not much movement as far as south or north. it's going to go over the same area tonight. that's why we have flash flood watches posted for the burn areas and all the way down to monitor ray. we are expecting heavy rain which could lead to flash flood and an additional one to three inches of rain, especially along the santa cruz mountains. sko scotts valley, an inch and a half just tonight. this is the place we want to watch for debris flows or mudslides. look at the rest of the bay area, just about a tenth of an inch in the east bay. as we round out sunday we are talking about another couple of rounds of rain for the morning and afternoon hours.

it will be 67 degrees for san jose and 65 for san matteo. the seven-day forecast shows dryer conditions. inland valleys will climb back into the 80s, but san francisco, kind of gray, cool and damp. another round of rain pushes in and that will linger through tomorrow night. monday we'll clear out and that will leave comfortable weather for san francisco. mid 70s by thursday. >> you're talking one to three inches, the three inches up in the mountains. >> yes. that's where the flash flood watches are posted. >> that's good. obviously they really need it. >> just not all at once. >> it is coming in quickly. thank you. still to come tonight as the bay area battles the storm, a much more intense battle in other parts of the state. firefighters are still

threatening hundreds of homes forcing a state of emergency. >> i want to continue to urge residents to heed the warning of our firefighters. >> reporter: the 3,500 acre out of control little valley fire has so far damaged or destroyed 22 homes and at least 17 other structures. 20 hours after the fire sparked overnight containment remains at 5%. to the south the so-called emerald fire forced the evacuation of 500 homes. >> we are in a serious situation. we have serious days in front of us with serious weather. >> reporter: conditions fueling the wildfires raging in the west. steve patterson, nbc news. the death toll issi rising north carolina. search crews found two for bodies today. this is in the eastern part of

the state. you can see how high the water is. almost to the rooftops here in some neighborhoods. the death toll in north carolina is 26 from this hurricane. nationally 46 people have been confirmed dead. several towns in that area do remain under water. next week the north carolina governor is expected to release new recovery plans. he says the state still has many more rough days ahead. nbc bay area responding to a santa clara man who faced a serious predicament. take a trip to the site of a recent terror attack or cancel his trip and pay the penalties. >> he choose the safer route leaving about $1,000 in limbo. >> this is a story about the nagging questions in the back of a vacationer's mind. how much money will i lose. amen owns a small limo

companies. he loves escorting parties around the bay area, he scheduled some time to park it about a year ago. >> my wife and i wanted to go to europe. we wanted to go to paris and rome. perfect timing in november. >> reporter: three days before they were supposed to leave terrorists attacked paris. amen says news networks were warning people to avoid france so he did. he cancelled his lodging, tours and flights. the airline was easy. it refunded his nonrefundable ticket immediately. >> no questions asked. they knew what happened and it was understandable. >> reporter: but his lodging, booked on air b&b was a different story. he tried to get his money back from the host in paris but the host in his second stop in rome didn't offer a refund either. the dispute festered for months. he probably made a mistake here.

he tried to negotiate directly with the hosts. air b&b offers horefunds to hos who request them. emergencies fall in the extenuating circumstances policy. by the time amen went to air b&b his time to apply closed and then he reached out to us. we explained to air b&b how he thought he should work things out and it agreed to gave him a full refund just shy of $1,000. >> i talked to you and within days i go the my money back. you are doing a great job. >> reporter: we wondered if air b&b would recoup the refund from the hosts and air b&b said no.

area. this is the san matteo bridge. you can see the rain on the lens and on the road and cars. there's a look at those wet conditions drivers have been facing all day long. we shot this video a couple of hours ago along 280. it was coming down. anthony is tracking the latest conditions. >> we saw strong winds earlier. we saw winds up to 48 miles an hour, even the alt ta mont pass 41 miles an hour. san francisco had gusts of 41 miles an hour. you can see the flag is still blowing this evening across the golden gate bridge so we're not done with the winds yet. we have a wind advisory in effect for the hilltop and coastal ranges until 2:00 this morning. it's because of this cold front that's made its way in and it

brought the showers and it will continue to bring the rain into the overnight hours. around midnight you'll notice the rain still across parts of the santa cruz mountains and that's where it will stay overnight. we get another round of it for tomorrow morning and round three comes in for tomorrow night. we'll talk about all of this rain and how much we're expected to get and a flash flood watch for the fire burn zone. we'll talk about that coming up. >> thank you so much. we're talking about the second round of storms creating concern for homeowners who live near where the loma fire burned. they are concerned right now. we continue our coverage live from the santa cruz mountains. i understand there's a flood watch there? >> reporter: the national weather service has issued a flash flood watch so that means people who live in the loma fire area and decide to stay in their homes tonight need to be

vigilant about possible flash flooding and debris. an accident and major backup on rain slicked northbound highway 17. fire crews responding. in the santa cruz mountains roadside puddles are growing and the big concern is how the rain will impact more than 4,000 acres left barren by the loma fire. cal fire crews did a preliminary inspection looking for the most vulnerable spots. they say with heavy rains mudslides are a possibility and they could impact as many as 20 homes. >> i think there's going to be some places out here that are going to require some immediate action. >> reporter: fire crews hope post fire seeding and early warnings will prevent the rest. earlier today at pick of the patch pump kins families rushed in to have their kids get in some prerain fun. >> we were going to go after

dinner, but then the rain is supposed to be 60% by 6:00 and 7:00 so we decided to meet up at 4:30 instead. >> reporter: the sandbag station had no visitors, but with the rain coming down that could change tomorrow. once again, the national weather service has issued a flash flood watch in the area of the loma fire, which as you know burned more than 4,000 acres in the santa cruz mountains. cal fire says they're not sure how much rain we'll need to get before they might see mudslides, but we need to get breaks in the rain. the more rain we have over a long period of time, the harder it's going to be and the more likely we will see mudslides. reporting live in the santa cruz mountains, nbc bay area news. >> thank you. those mudslides always a threat off of 17. the bay area being hit by a second round of storms right

now. this is westbound i-580. san francisco has had dozens of flights cancelled and in the mountains there's dangers of mudslides. in the north bay roads are starting to flood. some roads are closed. the message from the chp, please take it slow. drive extra cautiously tonight. as we track this storm, do stay connected with our free nbc bay area app. the high price millennium tower is still sinking. >> jackson explains how secrecy surrounding the sinking tower may have benefited a local consulting firm. >> reporter: there were plans to

build a new transby terminal in free throw, the publicly funded project since next to the millennium tower. that tower is tilting and has sunk 16 inches. >> as i recall, and i'm kind of sure, we were not told about the seriousness of the settling of the building. >> reporter: in 2008 or tez and members of the board approved what she thought was a standard agreement between the transbay authority and the millennium tower, but she says she doesn't realize that part of the deal committed the transbay authority to pay up if the tower started to sink. >> it would have raised serious concerns and the implications would have gone beyond the building, so yeah i would have liked too have known that that was happening. >> reporter: by 2010 it was clear the sky scraper was sinking worse than anyone had

predicted and authorities were trying to get out of their deal with the developers. an investigation found documents related to the sinking were initially kept secret. >> there was no information that i recall one way or the other to show that either there were problems about to happen or that there were preexisting conditions. i don't think any of that information ever came across to our meetings. >> reporter: tim works for the san francisco chamber of commerce. he chaired the panel charged with informing the public about the project. >> five or six years acgo durin this time i recall nothing about the building sinking nor do i recall anybody telling us that they had concerns about the building. >> reporter: treadwell was one of the apparent beneficiaries of the con official alt agreement. back in march of 2010 officials assured the official that the tower sinking data was not for public release.

ortiz says three months later they were awarded a seven year deal. she says she didn't know the firm was responsible for the foundation or the tower sinking. >> it was not disclosed to us that they were working on the millennial tower so we just -- we just approved the contract because that got the highest score. if i had known there was a conflict in there, i don't think i would have approved it. >> reporter: terry was an engineer who served as a consultant before the millennial tower was built. he says he still can't believe that treadwell ended up with any consulting contract given its history with the transbay authority. specifically a project that experts feared could sink. the project was scraped. today he wonders what the

screening committee knew when it selected the firm. >> it's conceivable that the committee didn't know about some of the history, certainly treadwell and rollo is not going to outline that history. >> reporter: they won't talk to us, but the $650,000 consulting deal is still in place. ortiz says the more she learns, the more she's troubled by what happens. >> i think anybody on that board would have raised concerns too. what would have been the solution? i don't know. >> reporter: nbc bay area news. >> we reached tout transbay officials about the consulting contract. they say no issue related to the millennium tower is within the scope of the contract. if you have a tip for our investigative unit give us a call at 1888966 tips. we are following developing news out of las vegas where a house party turned into the

scene of a mass shooting. the details are unusual. the home is being used as a makeshift restaurant. it was filled with people last night when an argument broke out. as many as three people left the scene and came back with guns. three people were killed and another 12 were wounded in the shooting. at one point there were at least 50 people running from the house. two people have been brought in for questioning and police are looking for a third. a hazy future. >> how pot growers are bracing to sell legally in california and why they say they're not sure it's a good idea. they prey on our children, spending billions.

24 days from now voters will decide whether to legalize marijuana for recreational use in california. it would create new taxes and regulations. so is this a good thing for local pot farms?

>> i was born and raised on this land so i was raised up here in these hills. >> reporter: you could say he was born to farm these hills where the family farm produces tomatoes and beans and greens. >> it's green right now. >> reporter: but he earned his green thumb for another local crop. >> you come into the county and you see a big sign that says wine and wilderness and waves and we thought they ought to have added weed on there. cannabis is a unique thing. >> reporter: every year he grows marijuana plants for the medical market. >> this is a first cutting. >> reporter: after years of toilg away beyond the law farmers like him have gone legit under the marijuana regulations. >> it feels good to start to move out of the closet. >> reporter: this november california voters will be asked

to bring marijuana out of the shadows. prop 64 with legalize recreational marijuana in california. although he has mixed feelings about the measure, he ultimately supports it. >> it's hard for me to stomach the idea of voting against legalization. >> reporter: small cannabis farmers fear it will open the door for government to move it. they have formed agricultural co-ops to compete against well funded competitors. this man is organizing pot farmers. >> we have to find a way within this market to exist and survive and embrace this new future of cannabis. >> reporter: near the town of willis this couple grow 40 different strains of medical marijuana on a scenic mountain

top. >> this blue power looks incredible. i hope this community doesn't tear itself over the ballot measure. >> reporter: they believe the legalization measure is coming too soon to california, still he'll roll with the voters' decision. >> we're not trying to think about whether it happens or not, just deal with the consequences. >> i lean towards hoping it doesn't pass yet. we could use more work. >> as long as the smaller farmers are kind of grouped together and working as one, there should be a lot of opportunity. >> reporter: he says regardless of the outcome of prop 64, he will continue to do what he has always done, harness nature and the earth and grow. >> it's a powerful and magical thing. here is a good resource for you. go to nbc bay area.com and put in your zip code to learn more about the issues and candidates

specific to where you live. i know the north bay was getting rainfall. when i pulled into work really big clouds. >> in the north bay they're done with the rainfall, but the rainfall totals were impressive. coming in just a day after we saw an inch, you got another inch today. santa rosa got close to getting another inch of rainfall and napa just over a quarter of an inch. in san francisco the range was a quarter of an inch. across the east bay, about a tenth of an inch. head over to the bay, we got about three quarters of an inch. you'll notice the peninsula not as heavy rainfall amounts because of that rain shadow effect, but you get on the other side of the mountains we had close to half an inch. now that rain shadow effect in full effect across the south bay

where we got less than a tenth of an inch, but it is still raining now. the mountains taking the brunt of it this evening and they're going to continue to take the brunt of it overnight as this rainfall stalls out where it is right now. we will continue to see rainfall around midnight tonight over the same locations down towards the mountains and down towards monitor ray. look at how the ray falls over the same area all night long. we have a flash flood watch in effect for the loma fire burn scar. tomorrow morning scattered showers and tomorrow afternoon we'll still be dealing with heavy rain all the way through really the next 12 to 24 hours for that same location. tomorrow afternoon we'll get a secondary round of rain that will push on through and that will linger for monday morning. so we've got another round of rain headed our way, the same one that's with us right now and another round tomorrow evening. that's why we have the flash
