that's okay. we're through one day already. >> you're not alone in that. >> just getting started. >> we've got halloween around the corner. a freaky forecast for you. we'll explain throughout the morning i.'s going to be a dry day. we have clear skies for the most part. chilly temperatures out there. a look at the maps, you'll notice we've got 40s across the north bay. we have 50s across the bay area. highs today more comfortable, warmer than they were yesterday. still cool at the coastline, 60s there but everybody today sees full sunshine. we'll talk about when rain returns and a look at the halloween forecast. we'll talk about your morning commute. >> looking at most of the bay. that's an as si drive and a clear view of the sensors in the green. anthony and i were talking a couple minutes ago. road weather index shows fog throughout the north bay. that's the orange highlighting here.

it's a lower visibility, but just plenty of room for you to see as you're driving. we have a major crash over here. this is highway 101 by the coast, much closer to highway 1. this is a deadly crash on sir francis street boulevard. for those details i'll head back to you, laura. >> that's the breaking news we're following this morning, mike, where three people were head. a late night high-speed crash in the north bay. it happened a little after mitd night on sir francis drake boulevard at the entrance to samuel p. taylor park. video shows a tangled mess of metal against the trees. authorities have not indicated if other people were actually in that car. it's hard to believe anyone might have survived. the chp has closed both directions of sir francis drake boulevard. "today in the bay's" pete suratos is headed to the scene and will join us with a live report at the top of the hour. a richmond man this morning also behind bars accused of murder. police say he ran down an employee who tried to stop him

from stealing wooden pallets. >> it happened yesterday at the chu world foods warehouse in san leandro near 880. the suspect was eventually caught. five hours later near 880 and high street in oakland. our nbc chopper was there overhead as both scenes developed. police say this white truck being towed away is a murder weapon. police have not released the name of the victim. they're still notifying family. it is a divisive message from a pro israeli group sparking a wave of controversy all over san francisco state campus. critics are calling this a message of hate after posters were put up last week targeted a professor, the posters claim she's collaborating with terrorists. the school quickly removed those

posters. >> it's pretty hateful. it's hard to believe people would do that. >> there's already enough bad going on. now us sfu students have got to worry about this. >> the university president issued a letter condemning what he called vandalism saying, quote, let me be clear. this is not an issue of free speech. this is bullying behavior that is unacceptable and will not be tolerated on our campus. the group behind that poster has targeted other teachers at campuses across california. it is 4:34 right now. an investigation is under way after two reported sexual assaults this weekend at uc berkeley. two women say they were at an off-catch pus fraternity when they were assaulted. investigators are still looking into the claims and haven't released much information. a student athlete who critics say is getting special treatment is going to make an

appearance in court. persky sentenced brock turner for sexual assault. opponents believe this case is very similar to the case. kim smith is a college of san mateo football player served a month in jail for throwing his girlfriend to the ground and beating a bystander who tried to get involved. since then prosecutors say smith has skipped out on community service. >> the fact that judge persky clearly sent a message that football was more important than violence against women. >> the attorney says since smith was a no-show for community service because he had a fastball game. he's complying, according to his attorney. an east bay arts display is generating a good deal of controversy, a 55-foot sculpture.

it's now opening at the san leandro technical pus. it sits near the san leandro b.a.r.t. station. it contains nudity. tonight's lighting ceremony is scheduled for 6:30. bold work of art may create a bit of a spectacle at a small san francisco park if it gets the green light. later this week san francisco's parks commission will review plans to place a large art installation in hayes valley. the sculptures, if approved, would be in place for a full year starting november 8th. >> three or four days of straight rain, now we've got the warmup coming to the bay area. angt any slaughter in this morning bringing not just the warmth of his personality. >> oh, you guys are so sweet. we're looking at warmer temperatures in the afternoon hours. clear skies from the golden gate bridge. we'll talk about your forecast as we get you into the weekend

a san rafael man--accused of trying -- ad well comb back everyone. we're getting more details about a san rafael man accused of trying and failing to detonate a bomb inside a colorado police station. police say david anbury left a backpack containing cell phones, wires and powder. he was arrested in chicago this weekend after surveillance video captured him buying the cell phones he allegedly used to try to trigger the explosive. turning now to decision 2016. hillary clinton remains off the campaign trail preparing for the final presidential debate with donald trump tomorrow night. >> trump is not sitting still. he's making the rounds in colorado while his wife melania comes to his defense. in an exclusive sit-down interview with cnn, she claims her husband's sexual comments

welcome back everyone. 4:44 this morning. >> this first 15 minutes has gone just like that. >> where has the day gone? >> the sun is coming later, too. >> warmer temperatures as well. as we head towards the next couple days, it will get warmer each and every day toward the weekend. we'll have warmer temperatures and sunshine. to rain for the weekend. let's start you off with this clear shot from san jose. you can see we don't have any cloud cover out there this morning. most of that is contained at the coastline. right now looking at 40s and 50s. 49 in santa cruz. 48 in gail roy. 50s for the most part in the bay and we'll see 70s replace those later this afternoon. stay cool at the coastline with 50s there. warmer temperatures for walnut

creek and livermore, back into the mid 70s there. this morning we don't have any rain as we saw this past weekend. we've got a few clouds right across the coastline and up towards the north bay. but zooming out a little farther, you can see we have rain across northern california and seeing rain across places like seattle and portland, dealing with a series of storm systems like we saw this past weekend. the next couple days temperatures will warm up. then we're waiting on our next storm system. this saturday. we have a system off the khost line. watch what happens by sunday into monday, this thing pulls back into place and we'll watch rain returning into the bay area. lots of sunshine the next couple days. temperatures inland today in the mid 70s, close to 80 for tomorrow, back into the 780s as we head towards thursday and friday. let's toss things over to mike and say good morning. what's happening on the roads. >> roadways look pretty good. all around the bay is green.

heavier traffic expected today than yesterday. we had a road weather index, maybe fog and patches throughout portions of the north bay. i cleared that from the map. this is sir francis drake boulevard. that's where there's that deadly crash. three folks have died as a result of this crash and it's closed the roadway. for folks familiar with the area, point reyes over here towards lucas valley, that's your way to get toward highway 1 if that's where you're going right now. locals may know a better route. that's the biggest i'm showing you on the map. heading over toward the pay bridge, you'reality the limit, a minimum speed of 13 minutes from highway 4 to the maze. the san mateo bridge, that crash earlier has cleared from the eastbound direction. back to you. amazon making it easier for family members to share photos, plus netflix is catching in. for that and the rest of your news before the bell, we turn to landon dowdy joining us

live from cnbc world headquarters. good morning. >> good morning to you both. wall street could start the day out in the green. futures are higher this morning and stocks ending mostly lower on monday on mixed earnings news and higher oil prices. you want to look for data today on consumer prices and housing, also earning from goldman sachs, johnson & johnson and intel. the dow falling to 18,086. nasdaq down 14 to 5,199. watch for shares of netflix today. they jumped more than 20% last night after the streaming company's earnings beat wall street's forecast. netflix adding 50% more new subscribers as it continues to expand in new international markets and on the popularity of original shows like stranger things and narcos. netflix plans to spend $6 billion on new shows next year. amazon is rolling out a new feature for prime members called family vault.

it allows users to share free storage and you can invite up to five family members or friends to share your account, as well as take advantage of another five gigabytes of shortage for video. >> thanks so much. samsung is taking an unprecedented step to help travelers, taking the problematic galaxy note 7 phones off flyers' hands after the flight was banned from air travel. passengers with the note 7 phones may borrow other phones from a samsung service counter. samsung reps are at sfo this morning from 6:00 a.m. to 6:00 p.m. travelers are able to get a loaner phone. more consumer issues here. a san francisco judge later today is set to hear arguments

on a $10 million payout to volkswagen owners. volkswagen is supposed to compare up to 500,000 vehicles. some car owners believe the settlement doesn't go far enough. at least two dozen people are expected to address the judge at today's hearing. at 4:50 this morning, a former federal investigator said his agency did its job, the problems inside wells fargo could have been exposed a long time ago. he's revealing to the investigative unit what went inside the whistle-blower protection program. the investigator says in 2010 his agency received a complaint from this woman after she was fired by wells fargo. the employee claims it was retaliation for raising red flags about the bank's sales practices. the investigator says after she filed her case, no one inside osha investigated.

governor of nevada there signing a bill to help publicly finance a football stadium for the raiders. the move still needs approval from three-quarters of the league's owners. that is far from a guarantee. that vote could come as early as january. yesterday mark davis was pushing this move to sin city. >> i don't think any other franchise would actually fit here the way that we do. >> oakland mayor libby schaaf responded with a statement saying, in part, the nevada vote and the governor signing is something we've expected. it doesn't mean it's a done deal. she says she'll continue to look for ways to keep the raiders here without spending public money. we might be able to cheer the fact that raiders could be staying here. the taste of the bay area at the white house later today. president obama's final state dinner is featuring three california wines. >> today celebrity chef mario

the men were wading near waterfn suddenly vanished.searchers loon two men were wading in a waterfall when family members say they vanished. searchers looked for the men but had to stop when it got too dark and dangerous. many are going hungry. a new survey claims thousands of university of california support workers are struggling to make ends meet. 70% of workers surveyed report struggling to put food on the table when 45% say they have gone hungry. the workers union in the university system have been in contract negotiations since april. 4:56 right now. when a young seattle boy had a
