couple days. things will change as we get towards next week, tracking more rain. enjoy the next couple days. we'll see a nice break from the rain. clearer skies in san jose and temperatures in the 50s. we do have 40s out there across parts of the north bay and a little fog as well. hightion later on this afternoon, top out in the 70s for inland valleys, warmer than it was yesterday. cool at the coastline with 60s, mostly sunny skies. that sunshine continues. i mention the rain as we head towards next week. in the meantime let's toss it to mike and track the commute. >> good morning, anthony. an easy drive for most of the bay. you see the speed sensors here. anthony talked about the fog. i also talked to him about this. the road weather index is tied together with our weather data. the orange highlighting shows vallejo towards the coast may have some fog. it should be all right for the drivers. we have an issue in this area. >> as we get closer to highway

one, we have closure for sir francis drake boulevard by point reyes. this is where we have the deadly crash, sir francis drake boulevard. sam, you have dramatic pictures. >> i do. this is about as gruesome of a scene you will see for a car accident. breaking news this morning. three people have died in a horrible overnight crash in the north bay. you see the car is found wrapped around two different trees near the entrance to samuel p. taylor park. >> "today in the bay's" pete suratos live with what investigators are saying so far. just a horrible scene out there, pete. >> reporter: without a doubt. good morning, laura and sam. we got the information from chp. i want to step out of the shot. we're at samuel p. taylor park. that's the tow truck there. according to chp, they say there were three young male adults inside a car heading westbound

in these lanes. that's when they crashed to the side of the road in the ditch knocking down a couple of trees and some polls. we're still waiting to get information on exactly the ages of these young adults. they appear to be at least around the ages of 18. still haven't notified the family yet. as far as the traffic conditions, we're being told sir francis drake boulevard should be opening in the next hour or so. this scene itself should be clearing out in the next hour. once again, we're waiting to get more details on exactly who these individuals were and the ages at this time. back to you in the newsroom. >> hard to see those cars wrapped around that tree there. thank you very much. 5:03. a richmond man is behind bars accused of murder. police say he ran down an employee who tried to stop him from stealing wooden pallets. it happened yesterday afternoon at the true world food warehouse in san leandro on williams street right near 880.

the suspect was caught about five hours later. our nbc chopper was there overhead as both scenes developed. police say this white truck being towed away is the murder weapon. 27-year-old kadim edwards is in jail without bail. police have not yet released the name of the victim. a divisive message from a pro israeli group sparking all kinds of pushback at san francisco state. critics calling this simply purely a message of hate after posters were put up around campus targeting ethnic studies professor rabab abdul had difficult. the posters claim she's, quote, collaborating with terrorists because of her sympathy for the palestinian cause. they refer to her with #jewhatred. >> it's hard to believe people would do that. >> there's already enough bad going on. now sfu students have to worry

about this. >> the university president initially responded issuing a letter condemning what he called vandalism. he said this is bullying behavior that will not be tolerated. palestinian students plan to speak out publicly against those posters later this week. an investigation is under way after two report sexual assaults this weekend at uc berkeley. two women say they were at an off campus fraternity. >> the two cases happened friday night and saturday morning. because investigators were looking at the claims. a student athlete critics say is getting special treatment after being sentenced by judge aaron persky is going to make an ap means in court this morning. if that sounds familiar, it's not the case regarding brock

turner, but opponents believe this is a similar case involving a man by the name of keenan smith who you see there, a college of san mateo football player. he served a month in jail for throwing his girlfriend to the ground and beating a bystander who tried to intervene and stop him. since then prosecutors say smith skipped out on community service. >> the fact that judge persky clearly sent a message that football was more important than violence against women. >> smith's attorney says smith was a no-show for community service because he had a football game at the time. his attorney says he's kplieng with his probation requirements. another 360 potential jurors will be screened for the murder trial of the man accused of kidnapping and killing morgan hill teenager sierra lamar. jury selection officially began yesterday. there was a loud gasp in the courtroom when they learned the death penalty trial may last six months. many potential jurors were

dismissed for hardship. the rest were given a 30-page questionnaire. they were asked about what they thought of dna if they watched tv shows addressing sexual assault and their views of the death penalty. potential jurors had to answer questions if they could consider someone dead even if there's no body. >> the prosecution is going to have to deal with the issue that they do not have a body. they're going to want to have to question these potential jurors, could they return a verdict of guilty when they don't have a body. >> sierra lamar disappeared while on her way back to school in march of 2012. we know yesterday we started off drizzly. the sun poking its way out. as we head towards the weekend, we have a warmup. >> the next couple of days into the weekend, and then we've got rain as we head towards monday of next week. we have clear skies this

"today in the bay's" edward lawrence joining us live from washington monitoring the latest from the campaign trail. trump says the latest batch of e-mails reveals a scandal worse than watergate. good morning. >> reporter: good morning, sam and laura. that is exactly right. we'll be hearing the word quid pro quo a lot over the next two days, donald trump already says the process, the election process itself is rigged. now he's saying new e-mails show corruption. donald trump says newly released state department e-mails show a scandal he calls worse than watergate. >> the phish documents show undersecretary of state patrick

kennedy made the request for all three classifications as part of a quid pro quo, in other words, a deal. this is felony corruption. >> reporter: in one exchange with the fbi, the undersecretary asked to change the classified label on one of hillary clinton's e-mails when she was secretary of state. the state department would then reciprocate by allowing the fbi to place more agents in countries where they are presently forbidden, specifically iraq. the fbi and state department deny any wrongdoing. >> no quid pro quo, no exchange here. >> reporter: as part of trump's latest push to sway voters, his wife melania went on cnn blaming billy bush form trump's lewd comments about women caught on an open mike. >> he was lead on, like egg on from the host to say dirty and bad stuff. >> meanwhile, senator bernie sanders tried to reach out to trump supporters playing off his

"today" show host billy bush has officially been fired by nbc. bush had been suspended since that tape surfaced of he and donald trump and that vulgar conversation about women. the tape was from 2005 when bush was filming a segment for "access hollywood" with trump.

bush later says he was embarrassed and ashamed of the incident on tape. bush had been on the "today" show for just two months before being let go. in the east bay some are saying they're getting caught in the crossfire of a contentious election. one trump supporter in lafayette said he's scared to put a sticker on his car. he's gone through about 15 of them. he said he's received considerable backlash for showcasing his support. >> i would get the finger, vulgar words yelled at me. i have been tried to be thrown a off road, a bottle thrown at my car. >> in the meantime, a clinton supporter also says she's had all of her hillary clinton signs stolen from her property. she hopes surveillance signs in the neighborhood can catch the sign thief. when travellers show up, they'll be met by representatives of samsung. samsung wants to make sure their phones do not get on that plane. >> no, don't get on the plane

with a galaxy note 7. we've been reporting it's now against faa rules to carry a galaxy note 7 on an airplane even if it's turned off. samsung will meet travelers who either don't know about the rule or aren't listening to help them switch out their phones before their flight. samsung does not want to be responsible for an in-flight emergency or worse. as we reported monday, the buyout of virgin america airlines is taking a bit longer than we expected. alaska airlines says the process is moving forward and it's working with the justice department. the justice department looks over mergers and accusations to avoid monopolys and make sure the consumer is protected. a recent study by the journalism organization pro public found consumers have been hurt by recent airline mergers. you remember united bought continental. america bought us airways. in that case american became the

biggest in the world. in united's case, the justice department opposed the merger and then three months later changed its mind. in the last ten years we've gone from nine major airlines to five. if the alaska-virgin goes through, it will be the dominant airline on the west coast. the dominant business reporter on the east coast is landon dowdy live at cnbc world headquarters. good morning, landon. >> well, you give me a run for my money that's for sure. wall street could start the day in the green. futures are higher this morning, stocks ending mostly lower on monday on mixed earnings news and higher oil prices. you want to look for data today on consumer prices and housing also getting earnings in from goldman sachs, johnson & johnson and apple fell 523 points to 18,56. scott back over to you. netflix did as we expected, reported profits monday afternoon. what we didn't expect is what it

did with investors. it turns out subscribers are more than happy to pay those new higher prices to watch things like "stranger things" on netflix, growth overseas more than offset customers here at home who quit because of the higher prices. until now, long-time users had been grandfathered into that lower price. one thing we don't hear more about is the idea of allowing netflix to download onto your phone so you can watch on your flight. that's the next step. amazon has already done that. my prices went up this time. i had been grandfathered in. i wasn't done with "stranger things." >> somebody got a new contract. >> money bags over here. their content is so incredible. you talked about the fact yesterday that there was thought of subscriptions were going down. >> i thought it was going to be much worse than it was. netflix doing fine. watch that stock today. >> it will be one to watch.

weekend. get ready for some night weather. north korea nothing like we saw this past weekend. waking up to a little coastal fog. a lot of that south and north of the golden gate bridge, down near half moon bay and the north bay. from the golden gate bridge, we don't have much in terms of fog. there's the visibility i was telling you about, half moon bay down to four miles for visibility and in the north bay three miles for napa. everywhere else looking at clear conditions. later this afternoon under full sniechb we're going to warm back into the 70s for places like oakland, even fairfield, up to 77 degrees. santa rosa at 73 degrees, 73 as well for san francisco at 64. clouds positioned across the coastline. that's about all we have out there this morning. we still have rain across northern california, seattle and portland still dealing with showers from weekend. as we head to the next couple

between the two because of a deadly crash. i'll send it over to you for the rest of the story. >> this is a horrifying scene to look at unfolding right now in the north bay. this happened a little bit after midnight. three people have died in a wreck so severe, as you just saw there, it literally ripped the car in half with one side on one tree, another a few feet away on another. we're learning more details about the victims. "today in the bay's" pete suratos at point reyes station with more into the investigation of how this happened. what have you learned about the victims? good morning. >> reporter: good morning, sam. we do know they are three young male adult ts. we just heard from chp along sir francis drake boulevard through samuel taylor park. they're saying this road should open up in the next hour or so. let's get to the video that we have. here are the details. it's very limited at this time. we do know according to chp it happened roughly around 12:00

a.m. three young adults inside a toyota corolla driving westbound on sir francis drake boulevard. at that point they crashed into a ditch on the eastbound side. as you mentioned, sam, the car splitting in half. very disturbing images there. we still don't know what caused the car to crash in the first place. i talked to chp to see if dui may have been a factor? >> it's unclear. we're still investigating, trying to figure out what exactly happened and determine what caused the collision. they did leave the roadway at some point and struck a tree. we're still looking into that right now. >> at this time chp has not identified the individuals in the car because they still have to notify the next of kin. we're live at point reyes station. pete suratos for "today in the bay". >> thank you, pete. 5:32. changes could be coming to san jose state. the president says she's now looking to improve communication

after students complain they weren't informed early enough following two alleged sexual crimes on campus. she released an open letter expressing concern about when to alert students about reported sexual assault. the administration plans to evaluate protocols to determine when alerts should be issued. students say they're happy their issues are being addressed. >> it's good to hear feedback from the administration, that they're taking steps to investigate further and deal with it. >> a community meeting is set to take place soon to address additional concerns. in the meantime, there's new criticism for a controversial south bay judge. organizers with the campaign to recall judge aaron persky now say there's another case where he was too lenient. this time it involved a football player. "today in the bay's" bob redell joins us live from palo alto with details on this particular case. good morning, bob. >> reporter: good morning, laura. keenan smith is a sophomore who

plays football at the college of san mateo expected at a probation hearing later this morning in palo alto to answer the question as to why he missed one of his required community service days. smith seen here in a football recruiting video posted on hudl.c hudl.com. the judge who sentenced smith to about a month in jail is judge aaron persky, the same judge who sentenced former stanford swimmer brock turner to six months in jail for the sexual assault of an unconscious woman. the people behind the effort to recall judge persky believe the smith case is just another example of judge persky going light on college athletes. >> the fact that judge persky clearly sent a message that football was more important than violence against women. >> i feel like my client has

been caught in the crossfire because of the political nature of everything that's going on with the recall effort. >> reporter: smith's defense attorney tells us her 20-year-old client is complying. but she admits he has a no-show for a community service work day and that was due to a football game. because of all the attention surrounded by the brock turner case, judge aaron persky has requested he be moved over to civil cases. live in palo alto, bob redell, "today in the bay." a bizarre twist in what police have called a premeditated ambush. it appears to a suspect connected to a police shooting is also linked to a 2-year-old child shot hours earlier. adam powell can be seen on surveillance footage walking into a starbucks. investigators san jose he intended to shoot and kill two

police officers who were inside. his weapon appeared to malfunction. he took off running afterward. police say the officers shot powell about a block away as he tried to unjam his weapon. just hours earlier at this home, powell's 2-year-old son adonis somehow got ahold of a loaded gun and shot himself in the n k neck. this morning he's in intensive care in oakland. the family says they are utterly devastated. >> he's smart, he's just the best little boy that you can imagine having. he's like my best friend. >> again, adam powell, the boy's father is listed right now in stable but critical condition. we have some more answers this morning about the police shooting in san francisco. we now know the identity of the man who shot an officer in the head. 26-year-old nicholas mcwherter of pacifica shot that san francisco police officer. then he was killed in a shootout by police later that evening.

sources tell nbc bay area mcwherter had a history of mental issues. last friday officers responded to report of a man acting erratically. they say when they arrived mcwherter fired at them, critically wounding officer kevin downs. downs remains in stable condition. we're getting more details about a san rafael man accused of trying and failing to detonate a bomb inside a colorado police station. police say david ansbury left a backpack in front of a police station outside of boulder. he was arrested after surveillance video captured him buying the cell phones he allegedly used to try to trigger the explosions. the bodies of two san jose men who drown in an arizona creek were recovered. they were wading in a waterfall north of phoenix when family members say they suddenly vanished. searchers looked for the men but had to stop when it got too dark and dangerous. an autopsy is expected at some

point tomorrow. new this morning, hundreds of residents in one solano county neighborhood are being told to boil their water following a water main break. it happened near vallejo. people who live north of green valley road and reservoir lane are being told that the break caused a loss in water pressure which can impact water quality. a lot of people would like to freeze the raiders moving to vegas. it's starting to look one step closer for the raiders moving to las vegas. owner mark davis among the people clapping there as the governor of nevada signs a bill to help publicly finance the football stadium o for the raiders to the tune of $750 million of public taxpayer money. that move still needs approval from three-quarters of the league's owners. that's far from a guarantee here.

that vote could come as early as january. yesterday davis was pushing this move to sin city. >> it seems to fit. i don't think any other franchise would actually fit here the way that we do. >> oakland mayor libby schaaf responded with a statement saying in part, the nevada vote and the governor signing is something we expect. it does not mean this is a done deal. mayor schaaf went on to say she's going to look for ways to keep the raiders here without spending public money. 5:39 right now. anthony slaughter in for kari this morning still out on maternity leave. >> i actually met with her. her baby is so adorable. so calm. >> she's keeping me awake. >> her baby does not cry. i'm just saying that. i was with her for like an hour and the baby didn't cry. at the golden gate bridge, you can see no problems this morning. if you have crying babies at home, i know, i sympathize.

i've got two at home as well. in half moon bay down to four miles. right now temperatures in the 40s, later this afternoon a nice warmup back into the mid 70s for our warmest valleys. temperatures get warmer over the next couple days. you want to get those screaming kids outside if they're not in school because i know with halloween coming up, we'll talk about a tricky forecast as we get closer to that. mike, what about you? you got the kid's costumes yet? >> working on those. the bay moving well, folks able to get to work without any major issues. chp has two separate issues reported, southbound 880 at dixon landing road and one just past 237. both have almost identical information. both say they're blocking bsz the slow lanes. neither showing slowing on our

sensors. the rest of the south bay showing a typical pattern, slowing north 101 north of 680. both 101 and 85 showing the 20-minute drive, and the bay bridge shows the backup. the metering lights are on. you're talking to computers. this is something that concerns commuters. a san francisco supervisor wants more b.a.r.t. muni stations all over the city. lieutenant governor gavin newsom pushes for pot. the reason he says recreational marijuana should be legal in california.

late yesterday flooding roads. lightning destroyed a large tree. pieces of wood ended up flying into people's homes. luckily no one was seriously hurt. washington stacity council taking on the right to buy. the bill would allow terminally ill patient to end their life with the help of the doctor. five states including california have made physician-assisted deaths legal. the election a couple weeks away. already early voting is starting in georgia two weeks before election day. at this location lines are out the door and deep into the parking lot as you see, just winding around there. voters even brought their umbrellas to avoid the hot sun. >> today a group of bay area women will rally against donald trump over things he said recently about women. the rally is called when they go low, we go high which has been the theme of first lady michelle

obama's speeches. that rally is happening this morning in oakland. one of the hottest topics on the california ballot is prop 64. if approved, the bill would legalize marijuana recreationally for any californian over the age of 21. supporters gathered in san francisco led by lieutenant governor gavin newsom who was there addressing concerns that legalizing marijuana might lead to an increase of people driving under the influence of drugs. >> i'm not sure the evidence bears that out, nor has it bared it out in california, oregon, washington. >> prop 64 only needs a simple majority to pass, and the most recent polling suggests it will. san francisco supervisor scott weiner what's the city to build subways to improve transportation. now we're getting our first look

earthquake. the usgs says a 72% chance that a 6.2 magnitude quake or larger will strike the hayward fault sometime in the next 30 years. a new study shows how the business world will be affected. >> such an earthquake could affect 101,000 businesses, 1.5 million employees and annual payrolls totaling $150 billion. >> a lot of money there. the bureau of labor statistics says a large earthquake could severely impact jobs in health, manufacturing and the tech industry. >> hard not to look at that video and not remember where you were in the bay area during that time. >> powerful. two san francisco supervisors want the city to end all business with its own hometown bank wells fargo. >> the city has already started to punish the bank. >> that's right. supervisors john avalos and jane kim says it doesn't go far

enough. the two will hold a press conference this morning calling for the city to cut ties with wells fargo. the bank as you well know got caught faking accounts for millions of customers in order to run its numbers up. the ceo quit, but replaced by an insider. many critics say that is not enough. visa is based in the bay area, but the ceo lives in new york city. you think your commute is tough. this morning the ceo of visa says he's going to step down. it's one of those rare cases where the ceo says he wants to spend more time with family and it's actually true. no scandals at visa. everyone seems to think charles sharp has done a good job. he serves on microsoft's board of directors as well. he said i think to do this job properly, you need to spend more time in san francisco. given my personal situation, i don't feel i can do that right
