we're looking at the closure southbound toward harry road, the next major intersection. the two southbound lanes are closed. they hope to have one southbound lane reopened. northbound toward 85 is open. over here looking at 2r568 times in the north bay. eight minutes from highway 37 to the richmond-san rafael bridge. breaking news overnight as flames were touring over the castro district. a fire broke out overnight at an unoccupied building and quickly spread to two adjacent homes. several people were living in those homes. they're now out of a place to stay. >> "today in the bay's" pete suratos joins us live. we understand some firefighters were hurt trying to fight this fire. >> reporter: good morning, laura and sam. there were three firefighters injured altogether. they're being called non-life threatening injuries. you've got three structures affected. one with an elderly couple

inside, the one in the middle unoccupied, and then on the right two adults and a child. we want to queue up the video that was tweeted out by san francisco fire. altogether they're saying seven folks were displaced. none of the folks were injured and are receiving assistance from the american red cross. there is a missing calico cat. we're also being told that the cat may have gotten away safely. one of the firefighters has a possible fractured arm. the others have cuts and bruises, all have recovered in the hospital. here is more information. >> they were separate injuries so they didn't happen at the same time. they span from musculoskeletal injuries and cuts and possible bone injuries. >> reporter: a range of injuries there. once again, none of the folks inside were harmed. that fire was first reported around 12:00 a.m. before crews got it under control a couple hours later around 2:00 a.m.

there's still no word on the cause of this fire. as you can see here on hattie and market street, you have fire crews continuing their investigation trying to determine exactly what caused it. live in san francisco, pete suratos for "today in the bay." >> thanks for the latest there, pete. developing this morning, police are investigating a deadly shooting last night near a san jose elementary school. police say a man walked into regional medical center with a gunshot wound a little before 9:00 at night. police later figured out the man had been shot in a car near dove hill elementary school. you see the car with bullet holes in it. the victim drove that car filled with bullets to the hospital where he died a short time later. the victim has not been identified. from everything i see, has no respect for this person. >> well, that's because he'd rather have a puppet as president. >> no puppet. you're the puppet.

killed a co-worker on monday as he tried to stop edwards from stealing wooden pallets. edwards took off in that white pickup truck. the family of a palo alto teenager once kicked out of school has taken his case to a federal court. the teenager who prefers not to be identified was clicked out of classes three years ago. a voluntary screening indicated he carried the gene for cystic fibrosis. while the student never showed symptoms, the school acted over concerns by other students who actually had cystic fibrosis. >> sort of feel like i was in a way betrayed. >> specifically the student's case revolves around the school's disclosure of medical information. it's being heard in an appeals court after being tossed out of district court. the district refused to comment on the story citing privacy

concerns. this has been a week of major bay area anniversaries, a significant one again today for a tragic moment. this marks 25 years since the oakland hills firestorm where 25 people died trying to escape that fast-moving inferno. it rapidly burned through 1500 acres of land and destroyed only 3,500 holmes in oakland and berkeley. that fire was triggered by the embers from a grass fire the day before that firefighters thought was out. switching gears now, looking for a new furry friend? starting today contra costa animal services doing free adoptions, giving dogs and cats away until sunday to try to avoid some major overcrowding. pets can be adopted in two locations, at their adoption centers in martinez and pinole. >> i think you and i have our share of furry friends. for those looking for one, please adopt. it is freezing in parts of the bay area. >> you need a good coat. >> talking 40s across parts of the north bay. you can see positions from

summerside drive and mclaughlin avenue last night. the victims are expected to survive. no word on what caused that crash. crime fighting tool or invasion of privacy? license plate readers are being installed in danville after a rash of home burglaries. >> it's on going. the most recent one happened on monday night. surveillance video shows the suspect right here that police are looking for. the police department is working with city leaders to install 13 license plate readers throughout danville. the devices have long been controversial for privacy concerns. police say they need them as a new crime fighting option. >> we wanted to come up with innovative ways of combating the property crime problem. police say those devices are going to be up and running by december. >> speaking of privacy, yahoo! is asking the federal government to release more information about demands that yahoo! scan your e-mails. >> scott mcgrew, yahoo! wants off the hook. >> it wants the government to say, hey, we told yahoo! to look at your e-mail and they had no

choice. yahoo! sent a letter to national security director james clapper asking to declassify the order so the silicon valley company can show what really happened. in the letter yahoo! was mentioned specifically in news reports and we find ourselves unable to respond in detail because the order itself was classified. one of reuters top reporters broke the story that yahoo! is scanning every inbound e-mail into its mail service. and, in fact, yahoo! had written the software to do so at the request of or the demand by the nation's spy services. we've grown used to reports of the nsa and other agencies tapping into our communication. those were supposed to generally stop after edward snowden blew the whistle. chinese company lieko launched in san francisco yesterday. they announced two phones, a virtual reality headset, a seven-foot television, bicycles

and a self-driving electric car. one reporter said it was like being on the taping of hbo's silicon valley. you're just not sure if it's real. we'll talk a lot more about them in the next couple years, but we also will coming up. and the fact it wants to hire 10,000 people in the bay area. for the rest of the news before the bell, let's turn to landon dowdy live at cnbc world headquarters. good morning. >> good morning to you as well. wall street will try to make it three straight days of gains today. futures are higher this morning. stocks rising yesterday led by the energy sector. oil prices jumping to their highest level in 15 months following data showing another decline in u.s. crude supplies. you want to look for reports today on unemployment and home sales, also earnings from verizon, revenues falling short of estimates sending those shares down about 2%. you get microsoft after the bell today. the dow rising 40 points to 18,202. the nasdaq up two to 5,246.

sam and laura, scientists waiting patiently for word from a martian spags probe. it definitely landed on mars yesterday. we know it landed. the question is how hard did it land? did it touch down nice and gently on the surface or punch a multimillion dollar hole into mars. they say it's not the fall out of the atmosphere that hurts you. it's the sudden stop. the mission launched by the european space agency and the russians include an orbiter that is behaving as expected. one of the problems with mars is the atmosphere is super thin. parachutes generally don't work very well, the way they would on earth. getting something on the surface is very, very difficult. >> very interesting. >> isn't mars full of holes already? >> they may have one more. we should know in the next few hours whether it's another hole or another probe. >> created another crater. how about another mars?

pacific. comes out of the south. this one for wednesday, that should linger with us for thursday. we've got a series of storm systems for next week coming our way. the first couple look to bring us about an inch, maybe more across the north bey and lesser amounts across the east and the south bay. wherever the system stalls out, that's where we see the heavier rain. this past weekend we got a whole foot of rainfall across the santa cruz mountains. not expecting anything that intense, but several days of rainfall could add up starting on monday, even in san francisco. temperatures falling back to the 60s over the next couple days. >> we have live pictures right behind me here from atop our mass camera, a shot of this power pole that's down. we talked about pg&e being on almaden expressway. the southbound lanes are closed because of the power pole situation. let me show you video, also. the crash happened early overnight. a lot of flashing lights.

you saw the power pole down and a vehicle there with pretty serious injuries. you see the vehicle on its side over there off to the side of the road. they continue to work on the situation right now. the big issue is the power pole across the lanes and it will get you out to the map here. we'll show you southbound almaden expressway from reykjavik down toward o'grady. the road work already had a detour getting you off the roadway. that will remain in place until they can reopen one of the southbound lanes. that's it as far as traffic goes. northbound heading toward 85, that side is clear. the rest of the bay is clear. coming up next, calming concerns about voter fraud and election reading. a show and tell that went on in the south bay yesterday. he rents a car for just one day, but winds up with a $500 bill. i'm consumer investigator chris chmura. happening today, san francisco police are going to answer questions about a deadly police shooting last week. last friday officers shot and killed a man who fired at police officers near the lakeshore shopping center. it comes in the wake of one of those officers being seriously injured. police then shot the man who did it. he later died from his injuries.

today's town hall meeting takes place at the scottish rite masonic center at 6:00 p.m. sharing a car for the day is supposed to be cheaper than owning a vehicle. a one-day represental left one san francisco man in a $500 lurch. >> he called "nbc bay area responds." chris chmura shows how he had to tackle this surprise charge. >> good morning. bertrand pell again's represental was unevent 68. a few weeks later enterprise sent pick toews of damage to the car. the company held him responsible for $500 in repairs. he tried to prove he didn't wreck the car, even requesting footage from the garage's security cameras. enterprise wouldn't budge. so he called us. when we contacted enterprise, the company concluded it shouldn't have pursued bertrand anyway because it couldn't prove the car was picked up without

>> "today in the bay's" bob redell joins us live with the latest. >> reporter: good morning, laura and sam. it appears the murder victim drove themselves several miles from the location where they were shot to the emergency room here at regional medical center in san jose. they pulled up to the er entrance around 8:40 in what appears to be a mercedes sedan, one window shot out, two bullet holes in the side of the car. the person's wounds were too severe and they ended up dying a short time later. police arrived and processed the car for evidence. the shooting took place we believe sometime after 8:00 last night at dove hill park which is about seven miles south of here, situation atpolice have yet to tell us what let up to the shooting, drugs, gang activity or something else. this is the city of san jose's

deadly officer-involved shooting. police say the man killed had a violent struggle with police officers days before the shooting happened and had to be september for mental health treatment. police say the subject threatened to kill everyone inside a home and tried to attack police officers with a metal rake. after they tried to use tasers to subdue him, officers shot the man. police say the four officers involved have been placed on routine administrative leave. a parking crunch in one peninsula neighborhood which has led to nasty notes that authorities are investigating. many believe the problem starts with not enough parking spots near oak avenue and cleveland street in redwood city. someone leaving notes saying, quote, no more illegal aliens parking on the street and also too many of you are here. we spoke with police who say this is certainly derogatory. while it might be a freedom of speech issue, they've identified the woman they believe is

leaveing these notes. funeral services will take place today for be loved elderly woman killed in a home invasion robbery. mourners will honor miss flo at the st. paul baptist missionary church. she died 12 days ago from injuries suffered four weeks earlier in a robbery at her home. 19-year-old zachary cuen is now facing murder charges. he lived near douglas. investigators say cameras caught him using her credit cards and driving her car. today's service is scheduled for 11:00 a.m. the search is intensifying for the suspects who shot four students at a san francisco school who still have not been apprehended. the shooting happened in the parking lot of june jordan school of equity on tuesday. police believe the four men who were not students at the school walked up to campus, specifically targeted the victims and then fled. a all of the victims are

relentless rain and driving winds overwhelmed smaller villages in the philippines. the storm made landfall as a category five. the strongest in three years. communications and power have been cut off in many towns. so far there are no reports of any major destruction. some are saying the number of casualties could have been a lot worse. a former california college student is going to prison for trying to buy someone a one-way plane ticket to aid terrorism. he was sentenced by a santa ana court to 30 years in prison yesterday. his crimes include conspireing to aid a foreign terrorist organization. authorities say the 25-year-old lent his debit card to another man who was going to fly one way to the middle east. his plan there was fighting for the islamic state. lieutenant governor gavin newsom is getting on board what some have called a financial boondoggle. he changed his opinion on the proposed california high-speed rail project.

in sacramento yesterday he said he's no longer against the projected $68 billion effort. newsom withdrew his support two years ago, criticizing the ever-changing business plans and ballooning cost. now he says he will 100% look for a funding source for the train if he's elected governor in 2018. we always hear about all the stakeholders in the process. it's not just politician, raiders fans are directly getting involved in the final's proposed move to las vegas. they've e-mail a survey asking if the fans would support the team's proposed move to vegas. this is going on while the owner is in houston attending a critical nfl owners meeting. he says he wants to move the team to vegas. nevada has pledged $7 '50 million 234 public funding for a new stadium. >> it's unfair to keep bringing up what if oakland does this,

what if oakland does that. las vegas has already done what they're supposed to do. >> as the cities have a tug of war over the raiders, oakland mayor libby schaaf says she won't enter into a bidding war but will work to try to keep the raiders in town. while we're talking about the nfl, something that hasn't been said in a long time, fewer people are watching games this year. ratings are down. the first six weeks of the season, the nfl saw an 11% dip in viewership compared to the same time in 2015. after doing business with wells fargo for more than 25 years, santa clara county is officially cutting ties. the board of supervisors unanimously voted yesterday to end business with the san francisco-based bank for a period of two years. the company will continue to use wells fargo for day-to-day stuff, but not financial investments. attorney general kamala harris has launched a criminal investigation. the bank admits its employees set up thousands of accounts without customer approval. wells fargo ceo resigned last

week. >> california attorney general kamala harris is looking into whether criminal charges should be filed. >> it's one of the situations where the criminal investigation will be aimed at a company, the same way, for instance, it was aimed at pgi, rather than a particular person we believe. it would seem former ceo john stumpf is not entirely out of the woods. it's likely investors will demand further claw-back, that is, taking back money given to the ceo in the past. you'll recall stumpf told congress management never knew about the cheating. wells fargo blamed and then fired thousands upon thousands of minimum wage workers. as our investigative unit has documented, lots of workers blew the whistle. you can watch that investigative piece on our website, nbcbayarea.com. npr's planet money reporters found a former teller who tells the story of an elderly man who came into wells fargo's main

branch in san francisco confused why he didn't have enough money in his account to buy his morning newspaper. it turns out the elderly man had eight accounts, seven of which he did not know about and wells fargo was deducting fees from all of them. the teller for ghaef the fees, then used money in her own savings account to put her rhyme. chinese company lee echo had its official debut in san francisco, launching two phones, a seven-foot television, virtual reality gear, movie service, bicycles with lasers and a self-driving car. it was in just about every tech reporter's opinion the most epic product launch ever. they describe themself as a combination of netflix, tesla, google and apple. the products it makes, seven-foot tv $4,000. samsung sells a similar one for

redwood city up to 80 this afternoon. even santa cruz and san francisco, half moon bay, mid 70s. that is a little warm for this time of year. hey, we don't get that that often. high pressure in control. that means we'll continue to stay dry and clear for the next couple of days. the storm track is expected to tag a little south over the coming days. by this weekend, sunday night, the first showers are expected to push into the north bay. by monday, that's when i think the rest of the bay area will see the storm system push through. it hangs around for tuesday. then we get ready for the next storm system for wednesday. looks like the next system may come wednesday night into thursday. the first system looks like .25 inch for most of the bay, maybe in the north bay an inch for places like santa rosa. you'll notice each and every day, a rain chance for sunday evening, monday, tuesday, even wednesday. in the north bay, higher than 50%. if you're a betting man, those are good odds. the rain looks like it will

return to the bay area. in the meantime, all about the sunshine. grabl the shades because you'll need them. let's talk about the morning commute. >> a good bet if you saw things going smoothly on the peninsula. the south bay has the one issue on almaden expressway. in hayward, we see speed sensors improving south of a street, a crash blocking the left two lanes at 92. the speed sensor changes, that may mean that the lanes have cleared. we will continue to follow that. the other issue we're talking about is the closure of southbound almaden expressway from reykjavik way. a crash scene, a car went into a tree on the side of the road, took down a pole, took three hours to get the person out of the car. thatperson was alert when they took him to the hospital. still the southbound lanes are closed. the power pole and the power lines, pg&e says no one has power disrupted.

portnd... =ura/1xvidbox=at least when a gaexploon rocked the city's northwt district. the blast destroyed o buildiand at least eight people are hurt from a gas explosion yesterday. this morning they're assessing the area. the blast destroying at least one building, damaging several others. no one died but at least five firefighters and three others were hurt. firefighters are still investigating how that gas ignited. we have new details now of a deadly officer-involved shooting in santa cruz. police say the man killed had a violent struggle with officers only days before the shooting and had to be sent for mental health treatment. police say the suspect allegedly threatened to kill everyone inside a home and tried to attack police officers with a metal rake. after they used tasers to try to

subdue him, officers shot the man. the family of a palo alto teenager once kicked out of school in a case some call medical discrimination has taken his case to a federal court. the teenager who prefers now to not be identified was kicked out of classes at jordan middle school three years ago. the student never showed any symptoms of cystic fibrosis. the school acted out of concern for other students who had cystic fibrosis. >> sort of feel like i was in a way betrayed. >> specifically, the student's case revolves around the school's disclosure of medical information and is being heard at an appeals court after being tossed out of district court. the district refused to comment citing privacy. when a child misbehaves at

school, whose job is it to handled the punishment? the aclu finds that california teachers are increasingly using police officers to discipline children instead of educate irs. the study comes in the wake of our year-long investigative series that exposed serious concerns over how bay area schools use campus officers. we showed you how students can be left with criminal records before they even hit puberty for what some describe as childish misbehavior. the aclu study found police often arrest students without a warrant and question them without a parent or guardian present. as our investigative unit first reported last year, schools are more likely to call police on minorities than students with disabilities. the aclu study says it perpetuates what it calls the schools-to-prison pipeline. to see more, logon to nbcbayarea.com. right now at 6:00, breaking news we've been following overnight. >> reporter: pete suratos in the
