we're tracking heavy police activity in a san jose neighborhood as officers are pacing at what looks like an apartment complex. this happens as a car was shot with bullets blocks away. a very messy scene in oakland as a driver races through city streets, slamming into a total of four cars. what we're learning about a fatality from the scene. tracking rain that's still lingering this morning. the chance for isolated showers for many people on their way to work. we start with some chances for rain again today, rob. >> especially in the north bay, 24-hour rain totals, very impressive, a few spots in sonoma and napa, two and four inches and counting, where the rain continues to fly for the morning commute. you can see mount saint helena almost three inches. a few scattered showers further south around the peninsula. san jose missing out, no measurable rain right now. likely no more as we head into the afternoon. the trend of the day will be north bay rain, decreasing showers moving from south to north, upper 60s to low 70s. to see how the rain could impact your morning commute, here is mike. >> we've had scattered rain showers all around the south bay. you see it scattered throughout the rest. might find slicker roadways near the santa cruz summit. the slow lane is blocked, northbound 17 at idlewild, a

single car facing the wrong way. that usually indicates a spinout, possible slick roads there. we're also watching san rafael, look at the conditions on our camera. wet conditions over there. keep that in mind anyone north of the golden gate bridge. >> we're tracking breaking news out of oakland this morning where a car slammed into two police cruisers and also two other cars leaving at least one person dead. this happened off 35th and brookdale avenue. we're told no police officers were injured and the person who died was in the suspect's car. that car reportedly had five people in it at the time of the crash, but there could be more injury news to come. officers responding to an unrelated shooting at the time when the car smashed into the police cruisers. "today in the bay's" pete suratos is there right now gathering information and will bring us an update at the top of the hour. a well-known bay area filmmaker is under arrest accused in a deadly shooting.

the incident unfolded yesterday afternoon at a home in san francisco's glenn park. the man under arrest is documentary filmmaker and activist kevin epps who won awards for films on san francisco's hunter's point. the victim is identified as marcus polk, senior. we spoke with the victim's son yesterday who said his father would periodically stay at epps' home. he say the two got into an argument about a woman that quickly escalated. >> my dad made a lot of jokes at other people's expense. there was never any hostility. it was more like he was going to point out the uncomfortable truths. >> police so far saying little about the investigation. the exact charges against epps have not yet been announced. back to oakland now in new details about a shooting that happened over the weekend. we know oakland police officers were in the line of fire during that shooting. six police officers were shot at

while they responded to a shooting in west oakland. no police officers were actually injured, but seven other people were. this happened on saturday just before midnight on bancroft avenue and 73rd avenue. one victim remains in critical condition. the search continues for the people who dragged a man behind a getaway car in san francisco. you see it spotlighted there in that video. police are releasing this surveillance video. take a look. police say this video of a robbery earlier this month in the richmond district near the cliff house. the suspects jumped into a silver honda civic after they grabbed a camera from the man. the man tried holding on and he was dragged by that far for about ten feet. he finally let go. this video led to the arrest of one of the suspects you see right there. officials are looking for several other people involved. 4:34, breaking news we've been tracking overnight. police swarming a san jose neighborhood for hours now.

>> "today in the bay's" bob redell joining us live from the scene with what we know so far. this looks like it happened at an apartment complex. >> reporter: we just spoke with a lieutenant who filled in a lot of holes. you're looking down the street there where you can see san jose police have several officers including their crime scene van. this is an area that's a mix of apartment complexes and light industrial. just after midnight last night there were three san jose police officers on foot patrol down here. they weren't called out on a 911 call when they say one of their officers got into the squad car and a suspect in a silver isuzu suv rammed the police car, not once, but two times. the two other officers who were outside the car opened fire on this vehicle. you can see this vehicle here as it was being taken away with a

wrecker, that at least one bullet hole went through that windshield. after the suspect rammed the police cars, they took off and were found about a half mile away in mckee and el ron tomorrow verde. they found the empty suv and found the suss smekt outside. they took this person into custody. it turns out this person had outstanding warrant for misdemeanor resisting arrest and faces new charges after trying to ram a police car here just about a block from where we're standing at the intersection of trip and worcester. they don't know what the motivation was for this suspect ramming the police car. they said there was no interaction with this person before they started ramming the police car, it appears it was unprovoked at the time. bob redell, "today in the bay." >> happy to hear the officers are okay. thank you very much. a live look from bob's shot in san jose. the rain is coming. >> we're seeing rain around the

a war of words is brewing in a conflict between workers and management at the peninsula humane society. animal control officers showed video they say was shot two weeks ago showing a bloody pit bull trying to escape from its cage in the shelter in san mateo. the dog is fine but they accuse management of not adequately inspecting the kennels. the peninsula humane society calls the claims union tactics in the midst of contract negotiations that includes anger over the firing of workers last year after a dog was mistakenly

euthanized. >> we're not happy about any of them. but we feel like there's reasons why they occurred. >> another dispute involves the death of a dog that overheated in a kennel truck. that worker was also fired. union workers say there are simply not enough people on staff to do the job. police in the north bay are reviewing surveillance video to see who spray painted political and prejudice graffiti at an elementary school. this happened in the city of wind sore north of santa rosa. vandals paepted the word trump around the school and said, quote, build the wall higher. the school rushed to get those messages painted over before students returned to class. many parents and kids had already spotted what was done there. >> it's a big shame. i don't upped stand why they had to come to a kid's school and do this. it's not okay. >> right now police do not have any suspects in custody. 4:41.

live look from the north bay from our traffic camera in san rafael. seeing some wet roadways across the bay area. a soggy start to the week.

rob mayeda will have more in just a moment. with the rainy season a few weeks off, people in the north bay can get a head start for the possibility of flooding. marin county is holding flood preparedness there starting at 10:00 a.m. at the hilton embassy streets on mckenneth parkway. >> so far, if the early season is any indication, we should be prepared for a lot of rain. we're seeing 500% of where we were last year? >> compared by october standards and the rain, it could be 200 to 5%. it's normal for parts of the north bay. especially you can see where we think we'll bring the least rain of the three we're tracking into the weekend. already parts of sonoma county and napa county, two to four inches around the county. notice what happens south of san francisco. nothing in san jose. just enough to wet the ground in oakland and sfo. that same trend is continuing this morning as we have rain at times across the north bay,

showers around the peninsula and san francisco. just some clouds around san jose. it is breeze sir again this morning. south winds, midspan in the bridge, san mateo and bay bridge. mike will be tracking that as well. gusty outside this morning. the radar shows santa cruz mountains starting to see rain. but from san francisco to the east bay hills and especially north of the golden gate, you can see the rain, moderate at times into the north bay and the transition we'll see today is rain, scattered showers for most of the bay area drifting more northward during the day. it will be the north bay where we'll see the rain totals adding up. really not a lot expected in san jose. the futurecast has nothing. you see north of san francisco, you could see another half inch around santa rosa. highs today upper 60s and low 70s. upper 60s and low 70s. do want to fast forward to thursday because this system looks like it's going to bring a lot more rain.

as you can see here, the futurecast brings in a lot of orange and red at times. that will be the wettest storm in the series coming in thursday, maybe into friday morning. we've got one more system coming in for sunday into monday. maybe there's some good news. trick-or-treat time towards monday evening does look dry. we'll continue this stormy pattern off and on as we go through the weekend. that sunday system will be a little cooler which will have snow levels in 9,000 feet, dropping closer to 6,000 feet by monday. >> watching that rain possibly on monday. as far as the speed sensors, the green highlighting throughout the bay indicates where the road weather index says based on rob's radar activity, you'll have wet roads. we may have the issue northbound 880. we see slowing north of fremont boulevard, reports about 3:00 in the morning of a crash, two vehicles on the shoulder and a light pole down. there may be a crew that's arrived to address that. no lanes reported blocked

through that area. if you drive on the upper eastshore freeway, 13 minutes from highway 4 down to the bay bridge toll plaza. keep in mind the east bay hills and upper eastshore freeway, the rain traveling through that area as well and gusty winds across the bay bridge, the richmond-san rafael bridge. buckle up. the polling showing hillary clinton pulling away. it is now crunch time for donald trump in the race for the white house. he's focusing efforts right now on florida. that state could make or break trump's presidential hopes. mr. trump continues to insist, however, that the polls are rigged. >> it's called voter suppression because people will say, oh, gee, trump is out. folks, we're winning, we're winning. yesterday as early voting began in florida, donald trump was in tampa. he spent more time talking about the vetting system than a bombshell from the white house that confirms some obamacare

premiums are about to double. the news won't help hillary clinton who has been a supporter. clinton and trump have scheduled events in florida over the next 24 hours. alameda county is the only place in california that will see federal election observers this year. back in 2012, the department of justice sent observers to 17 jurisdictions in 13 states. this year the feds will only put observers in seven jurisdictions. nbc bay area investigative unit looked into what was behind the cutbacks. a 2013 supreme court decision stripped the department of its ability to identify areas where there might be voter discrimination. now the agency can only send observers to places that are under a federal court order for violating the voting rights act. in alameda county, they accused the county of failing to provide language assistance or translation for spanish and chinese speaking voters. for more information, you can head to our website,

nbcbayarea.com, where you can read up on all the candidates and the propositions appearing on the november ballot. click on the election tab. no landon dowdy this morning, no problem. we've got it as we take a look at wall street and futures. the street looking to add to monday's gain. stocks are rising but they did close off the highs of the day. they were boosted by a surge in merger news including at&t's mega $85 billion deal for time warner. later today you can look for data on home prices and consumer confidence and plenty of corporate earnings from the likes of 3m, cat pill hear, dupont, gm, procter & gamble and locally apple. more job cuts right now at twitter. it could happen this week. bloomberg news reporting that nearly 300 jobs could be cut, 8% of twitter's overall workforce. this comes as twitter continues to look for a buyer after years of financial loss o. we reached out to the kpen but the san francisco-based twitter is not commenting about

potential cuts. a computer glitch kept shoppers at whole foods from checking out. the problem popped up in several states. shoppers texted and tweeted about closed registers and the company's vice president confirmed there was a log-in issue. the problem has been resolved. no word on the cause. so far there's no sign hackers were behind that problem. a walmart halloween makeup kit crossed the line according to mental health activists and they pressured walmart to stop selling it. a suicide scar wound makeup kit has been pulled. the company stopped selling it and answered one critic on facebook. it admitted the makeup kid was appalling and said it was unacceptable for third party sellers to list it on walmarwal marketplace. for years foreign automakers have dominated the industry's reliability surveys. but this year an american brand

is also right near the top of the list. you see toyota and lexus finished in the top two spots, but buick ranked third, marking the first time an american brand has finished in the top three in decades. also topping the list once again as we mentioned, toyota and its luxury brand lexus. it's not your grandmother's buick. all those commercials. >> there have been a lot of buick commercials. girl scout cookies but now for breakfast. girl scout cookie cereal. >> general mills announced it will debut girl scout cookie cereals next year. they will sell two flavors, the most popular, thin mints. the most popular flavor out there caramel crunch inspired by samoa's flavor. the cereals will hit the shelves in january. i feel like my teeth are already hurting from all the hug gar.

>> but that's okay. two teams holding the longest drought records in baseball suit up and prepare to batter up. preparations for the start of the world series first game coming up. that is one of the most exciting world series in years. we're following two breaking stories this morning, first in san jose, officers open fire on the suspect after the suspect rams a patrol car as the officer was getting into a squaurd car. that happened at worcester and tripp avenue. the suspect was not hit but was ultimately taken into kufrt difficult. in oak lapd, one person has died after a car slams into two opd cruisers and two other cars on the street. we have crews at both scenes reporting the latest information on our twitter page. a boycott of ivanka trump's clothing line, using the #grabyourwallets. we'll be back in just two minutes.

an amber alert remains in effect for a 7 348d boy. authorities in sonoma county says the boy's mother, hannah ruth ashley kidnapped him. she does not have custody and took him from his grandmother's home. she's believed to be driving a silver subaru for res center, 5jkz255. the long awaited plan to revamp busy van ness avenue has now started to expect delays. the makeover will include construction from aquatic park to mission street. more work will happen on weekdays from 8:00 a.m. to 4:00 p.m.

the project is expected to take three years to complete. so be patient for that project. so be patient for this. i say these baseball fans have been waiting for quite some time. this is the day cubs' fans have been waiting for, for what? 71 years? >> 71 years to make the world series, over 100 for the koubs to win the championship. that's the cubs side of things. also the cleveland indians, tonight the two teams are squaring off in game one. you probably know the back series. the cubs haven't won a world series since 1908. they last played in one as laura just mentioned in 1945. the indians have the second longest world series drought. these are essentially the two sorriest teams officially in baseball. the indians last won in 1948. stubhub is listing tickets at those prices starting about 700 bucks for tonight.
