5:00 right now. i'm laura garcia-cannon. let's check the forecast right now because everybody wants to know when they're going to get wet. >> north bay throughout the day. this is the first storm, we've seen two to four inches around the area. likely will be the case, but san francisco to the east bay across the bay bridge, the golden gate bridge and the richmond-san rafael bridge bridge. a little rain into the north bay. you can see how the focus continues to be mainly areas north of san francisco and another storm starting to lurk offshore. the trend upper '60s. central bay to north bay transitions to the north heading into the afternoon. a rain combined with wind. likely to see reports of trees down. other debris in the roadway. so far most of the bay moving well. that has cleared from the chp report. no problem for the nimitz. we had slowing showing up

northbound north of san pedro. the southbound is where chp reports a branch in lanes at north san pedro. we have a camera right there. we don't see anything disturbing the flow of traffic. we'll update you. back to you. back to breaking news we're covering this morning. a patrol car rammed leading officers to open fire in a san jose neighborhood. still a very active scene this morning. that's where we find "today in the bay's" bob redell this morning. you just talked to officers, tell us where you are right now and what's going on. >> reporter: good morning, laura. san jose police lieutenant tells us within the past 30 minutes that three of his colleagues, three officers were on routine foot patrol about a block where where we are, patrolling an apartment complex right down there near the kellogg's plant, not far from the intersection of tripp avenue. it was around midnight when one

of the three officers was getting into his squad car when a man in an suv rammed his vehicle. the suspect then backed up and rammed the squad car a second time. >> it was just after that that the two other officers were on foot, ended up using their service weapons to shoot at the suspect vehicle. the suspect vehicle fled and was later found unoccupied about a half mile away. >> police found that silver i isuzu suv abandoned about a half mile away. you can see where one of the officers' gunshots pierced the windshield. officers found the suspect a short time later, not far away. it turns out the suv was stolen and the suspect already wanted on a prior warrant for resisting arrest. he was not hurt and is now in police custody. the officer whose car was hit was remarkably uninjured as well. police don't know why this man rammed the police squad car, no

interaction or contact prior to to night. it appears the attack was unprovoked. live in san jose, bob redell, "today in the bay." bob, thank you very much. let's go now to oakland where we have more breaking news. a car speeding down an oakland street slammed into two cruisers there, killing at least one person. pete suratos is live at the scene. what's the latest? we can see it's very active behind you. >> good morning, sam. i want to point out no officers were injured through all this. we're on 35th avenue in east oakland. i want to show you the car we're talking about that was involved in this crash. we'll stay on this shot and explain the timeline. we're being told that car was involved in a high-speed accident when they crashed into three patrol cars. >> reporter: here on the scene for another incident around 10:00 p.m. that's when a few hours later you have the vehicle traveling at a high speed crashing into a

few oakland pd cruisers as well as nearby cars. no officers were injured. inside the car you had five people in there. we're being told that one person died according to oakland pd and the others have been transported to a hospital for their injuries. the car involved in this accident was unrelated to the scene that oakland pd was already attending to around 10:00 p.m. i'm being told that oakland pd will wrap up this investigation in about an hour and the scene will clear pretty soon guys. >> all right, thank you, pete, bringing us the latest. active morning out there. well-known bay area filmmaker under arrest, accused in a deadly shooting. relatives of the victims say it started with a dispute. the incident unfolded yesterday afternoon in san francisco's glenn park. the man under arrest is documentary filmmaker and activist kevin epps who has won awards for films on san francisco's hunter's point. the victim is identified as marcus polk, senior.

we spoke to the victim's son yesterday who said his father would periodically stay at epps' home. he said the two got into an argument about a woman that quickly escalated. >> my dad made a lot of folks at other people's expense. there was never any hostility. it was more like he'd point out the uncomfortable truths. police so far are saying little about the investigation. the exact charges against epps hs not been announced. as the storm moves in, work will continue to remove this huge tree that toppled into an apartment building in berkeley. the 50-foot tree fell over about 3:30 yesterday afternoon. fortunately no one was hurt. there are reports of a few branches damaging cars. one person we talked to described the crash as feeling like an earthquake. one city staffer suspects wind was the cause. more sign of that, laura, in santa cruz as well. strong winds and rain took down large trees there in the santa

cruz mountains. in some cases homeowners were on the wrong side of bad luck. in one case a 90-foot oak tree crashed down on a home in boulder creek. we spoke with a homeowner who said it could be a lot worse. the tree struck another tree on the way down. >> if it slowed down its speed which was good, it also changed its trajectory. otherwise it may have come right through the bedroom and the bathroom. >> wow, could have been a direct hit there. today homeowners should have a bit of a chance to recover before the next round comes in tomorrow. >> when is that next round coming? let's take a live look outside right now. you see the golden gate bridge there on the top of your screen. san rafael as well. a wet start to our tuesday morning. how long is it going to stick around? >> depending on where you are, it looks like the south bay not seeing a lot. san rafael and north bay seeing quite a lot. wind speeds 20 to 30-mile-per-hour gusts. san jose missing out on the

rain. but the rain from san francisco to oakland into the north bay and the trend will actually be to take that rain band and push it further north as we move into the afternoon. hour-by-hour of the forecast. another quarter inch to half inch of rain while virtually nothing through the day in san jose. we'll see highs in the upper 60s near 70s today. trying trend coming tomorrow as the next storm rolls in on thursday. we'll have a closer look at our storm timeline ahead. now to see what's happening with the morning commute, windy out there especially across the bridges. >> the bridges moving smoothly as far as traffic is controlled, but advisories for the san mateo bridge, the bay bridge as well as richmond-san rafael bridge. work includes the santa cruz mountains. we got word the slow lane has been cleared. likely it was a spinout, but whatever the case, no injuries. again, those lanes cleared just

seconds ago. we want to show you the travel times approaching the area, coming down through the tri-valley. a little slowing out of the altamont. you're clear through livermore and dublin. a look at the north bay. we didn't find anything, so we took it all the way to 180 and back up. there's your slower drive and slick roads. thank you very much, michael. down to the wire, both presidential candidates starting to feel the pressure with the election just two weeks away. the make-or-break state they're vying for this morning. a rough night at the museum ahead in business and tech. a tragic scene out of pakistan where dozens of people have died and more than 100 are injured after an attack at a police academy. what group or groups authorities think are behind it.

we're tracking more rain for your morning commute. the bay bridge showing light rain falling, 63 degrees. periods of rain and breezy conditions through midday. >> we're watching the roadways as well with those conditions

changing, the speeds haven't changed a lot. 14 minutes from highway 4 to the maze. down the peninsula, no delays from venice and san francisco down to sfo. we have a 12-minute drive. breaking overnight, at least 59 people have died and more than 100 injured when gunmen stormed a pakistani police training academy. more than 200 trainees were at the facility when the attack happened. some of whom were taken hostage for up to five hours. most of the dead are police cadets. so far no group has claimed responsibility officially, but authorities are blaming the taliban and al qaeda-linked groups. we are now exactly two weeks away from electing a new president. right now hillary clinton leading most national polls. donald trump says those polls are rigged. >> "today in the bay's" tracie potts joining us live from washington, d.c. this is a very important time for both candidates.

them either, even in those high heels. >> is that heightism right there? >> i'm making a comment that we're not all the same height. >> i'm standing right now. >> number one comment we get, how tall are you in real life. my question is we're reaching high, the north bay impressive so far. >> that's where we've already seen two to four inches of rain there. around oakland, good news for the warriors home opener, looks like the showers will move on. should be in the 60s, should be dry outside oracle arena. let's talk about those rain totals right now. still adding to the numbers in the north bay. 61 degrees, 62 in san francisco, but 66 and still dry in san jose. look at the totals there from sonoma county, point saint helena almost three and close to an inch in san rafael and kenlt field. not much to show for it in san jose.

technically we haven't seen any rain yet and we're not adding to it right now. just a doughnut hole on the radar. we're not seeing any rain around the santa clara valley, in the north bay is where the rain is right now. midday the rain will be held up across the central bay. the rain heads into the north bay and then by the evening actually exits the north bay as we head through the next 24 hours. so much of the rain totals today adding up north of san francisco. may see another half inch into parts of sonoma county. highs today 60s to low 70s. peninsula temperatures in the upper 60s. low to mid 60s where the rain will be going on for most of the day in santa rosa. pleasanton and livermore highs in the 70s. this is thursday into friday. more widespread and heavy rain into the bay area. a break on friday and saturday. our next storm arrives on

sunday. here is good news as we head towards halloween. things looking relatively dry before another storm comes in heading towards next tuesday. the seven-day forecast, a few breaks between the rain, we're about to get into one late today and tomorrow. thursday, the next round comes in. notice halfway through the weekend, storm three arrives. technically storm four coming in next tuesday. >> yikes. a lot to look forward to. over here we're looking toward the commute. we also see the green highlighted on the maps. not the speed sensors but the green highlighted. that weather data means it's likely to be slicker roadways as well. fog registering to the north. none reported by chp but we'll keep that in mind as well. a smooth flow of traffic. chp issued a wind advisory for the golden gate bridge. that's unusual because the direction of traffic, keep that in mind we'll look at the san mateo bridge where we have the wind advisory over here as you come over from hayward to the

"today in the bay's" bob redell is live at the scene. this whole thing appears to be unprovoked? >> reporter: correct, sam. police lieutenant with san jose police tells us they don't know

why this man rammed one of his fellow officers. no contact with him prior. it was very sudden. this happens around midnight, about a block down worcester avenue, about a block from tripp avenue where we're standing right now. three san jose police officers were doing a routine foot patrol of an apartment complex located next to the kellogg's factory. around midnight a man in a silver isuzu suv rammed one of the squad cars parked along the curve as the officer was trying to get into that car. the suspect then backed up and rammed the car a second time. that's when the two other officers opened fire on the suspect. you might be able to see where one of the bullets pierced the windshield of that suv. the suspect drove off, fled. police found the suv abandoned. the vehicle was stolen. they found who they believe to be the suspect a short time later. he was wanted on a prior warrant for resisting arrest. both here and the officer whose

car was rammed were not hurt during this morning's altercation. live in san jose, bob redell, "today in the bay." thank you very much, bob. we're also tracking breaking news out of oakland this morning where a car smashed into two police cruisers and two other cars leaving one person dead. "today in the bay's" pete suratos live at that scene for us. >> reporter: good morning, laura. i want to point out that no officers were injured throughout all this. but let's get to it. we'll show you that car in the distance. that's the car that rammed into those two police cruisers they were talking about. police are saying those cruisers were on the scene here for another incident. that's when that car crashes into them around 1:00 a.m. inside of that car we're being told there were five people inside of it. one person died as a result and there are four people who were transported to the hospital. i want to point out the folks inside that car we can't confirm

if they were related to the incident that police were already on the scene for. we're told they'll probably clear out this investigation in the next hour or so. live in oakland, pete suratos for "today in the bay." >> pete, thank you very much. 5:34 right now. a crime spree in the east bay, it's over. two men in jail. police say jason lee and eli mahoney both from oakland are responsible for four robberies in san leandro last monday. officers say the suspects robbed a deli, also grabbing thousands in cash, lottery tickets and tobacco products from two different gas stations. they also allegedly stole four cars from a volvo dealership. the search continues right now for the people who dragged a man behind a getaway car in san francisco. police are just now releasing this surveillance video. take a look at the spot shadow. police say this is video of a robbery earlier this month in

the mission district by the cliff house. the suspects jumped into a silver honda civic after they grabbed a camera from a man and the man was trying to hold on to that camera and he was dragged by the car for about ten feet. he foomly let go. this video helped police locate the getaway car and led to the arrest of one of the suspects that you see right here. they're still looking for several other people involved. 5:35 right now. police in the north bay are reviewing surveillance video to see who spray painted controversial graffiti at an elementary school over the weekend. it happened at a spanish language emersion school north of santa rosa. vandals painted the word trump around the school and the words "build the wall higher." many parents and kids say they already spotted the words. >> such a shame. i don't understand why they had to come to a kid's school and do this. it's not okay. >> right now no suspects are in

custody. a live look at the north bay. this is our traffic camera in san rafael where lots of folks there are seeing raindrops on their windshield as they make their way to work. parts of the bay area got a very soggy start to the week. there's more expected before week's end. rob mayeda will have much more on that in just a minute. with the real rainy season a few weeks off, people in the north bay can get a head start preparing for the possibility of flooding. for the second time, march rain county is holding a flood pairedness there. that's saturday at 10:00 at the hilton embassy suites on mcginnis parkway. rob has a look at the forecast. >> we're seeing steady rain in the east bay. you can see the darker green showing moderate rain occurring right now into the north bay. some parts of sonoma county north of santa rosa have received two to four inches of

rain. a completely different story in san jose. no measurable rain so far. likely none that come today. you can see the santa cruz mountains taking what little rain we see. santa rosa may see another half inch as the rain line moves from south to north heading into the afternoon and evening. mild temperatures today, we have morning temperatures in the 60s. we'll finish the day with the upper 60s and low 70s. south bay temperatures in the north bay. heavier rain bay area-wide. another system follows late saturday into sunday. flee storms over the next seven days. >> good things for us as far as the rain measures. the wind is the factor. the golden gate, bay bridge, the san mateo bridge, the dumbarton bridge, gusty winds there. we'll talk about traffic flow in the south bay.

we'll talk about the travel times -- i changed my report up. 20 minutes from 101 or 85 from san jose across -- that's the breeze as well. we'll look at the travel times as far as transit systems. you'll be at your standard schedule on all these rail systems. >> it's all good, mike. new signs this morning that bay area rents have hit what at least is a temporary ceiling. a rental research firm shows rents last month in san francisco, san jose and oakland all fell year over year. for san francisco and san jose the drop exceeded 3%. oakland's fell less than 1% even as other surveys found oakland's represents still rising. rents nationally are up year over year more then 2%. up next, helping those who defend our country. the way lawmakers want to aid national guardsmen who are being told to repay thousands of dollars in loans. another apology from san francisco's biggest bank. we'll take a look coming up in business and tech.

washington state building on fire at the time explodes. take a look. just an eruption of smoke and flames. you hear the shattered glass there. it was a very close call for that cameraman. the two-alarm fire was in arlington, washington. fortunately everybody was okay. 5:43 right now. the driver of this bus that crashed into a truck near palm springs on sunday has been sued before. the driver was killed in that crash along with 12 other passengers. he's been sued in the past for other crashes, but he wasn't behind the wheel during those wrecks. he was the owner of the bus company. in the enamine time ntsb investigators say it will be months before they determine the cause of the crash. 5:43. the search continues for a north bay mother who disappeared with her 7-month-old baby. authorities in sonoma county say

hannah ruth ashley kidnapped her son on sunday morning. they say she does not have custody and took him from his grandmother's home in guerneville. she's believed to be driving a silver subaru for res center, 5jkz255. today the san francisco board of soup voice source are expected to make a final decision on homeless shelters. they'll be in industrial and mixed use districts. a final vote is expected on a temporary navigation center for the homeless on a vacated property. a lot of people up in arms over this next story. several california lawmakers are calling on congress to take action after thousands of soldiers were ordered by the pentagon to repay enlistment bonuses. they were california guardsmen who were offered $15,000 in student loans to enlist and fight american wars in iraq and afghanistan. now the d.o.d. is saying that was an error and the agency wants the money back.

iraq veteran and purple heart recipient christopher van meter was ordered to pay $46,000 back. >> in the end my wife and i made the decision, we're getting the point that $1300 a month is an awful lot of money to pay back. we ended up refinancing our house to make it go away. >> more than 10,000 soldiers have been ordered to pay the money back. hillary clinton is calling on congress to pass legislation to fix the problem. at quarter to 6:00 right now, new this morning, california election officials will be beefing up poll monitoring on election day on november 8th. it's in response to allegations made by donald trump that the' is rigged against him. there's no proof of that. state election officials are reassuring voters that there will be no voter fraud or intimidation on their watch. mail-in ballots are rolling in. so far more than 64,000 ballots

have been returned. 33,000 of those were from democrat voters, 13,000 from republicans, 15,000 from those with no party preference. a total of more than 600,000 mail-in ballots were september out. party guests will be given new guidelines about what consent means when they enter parties. every house also has to have three sober members at all times, and hard alcohol has been banned on campus. we spoke to those there at cal who say they were told not to speak with the media. but still we spoke with one student who asked us to hide their identity. >> kind of a bummer that they are imparting restrictions for people who do not -- who aren't doing anything wrong in this situation. >> the council that represents the greek culture at cal made the rules, and it's not clear how long they'll last. a warning to commuters in san francisco.

a long-awaited plan to revamp busy van ness avenue has now begun. so expect plenty of delays. that makeover will include construction from aquatic park to mission street and redesigned bus stops down the middle of van ness. most of the work will happen on weekdays from 8:00 a.m. to 4:00 p.m., crunch time for commuters. that project is expected to take about three years to finish. extra muni trains coming to the morning rush hour in san francisco next month. two one-car trains will run between embarcadero and west tortal stations. it comes after trains were added to the end of the line next month. they're trying to reduce overcrowding there. a warning to honda owners this morning, get takata air bags in your car replaced now. more than 300,000 hondas have yet to get the air bags repaired despite warnings from the automakers and regulators. the air bags have a high chance

of rupturing and causing injury or even death. one death was reported last week. about 69 million inflaters have been recalled. >> trying to establish their regret and remorse. wells fargo once again apologizing, this time on commercials on national tv. >> this as the bank worries it's losing customers. >> a lot of customers. the ads are running on the "nbc nightly news" and on sunday morning shows like "meet the press." >> wells fargo is making changes to make things right. first, all customers who have been impacted will be fully refunded. second, we'll proactively send you a confirmation for any checking, savings or credit card account you open. third, we've eliminated product sales goals for our retail bankers to ensure your interests are put first. >> at the same time on monday, a management consulting firm took a look at what people think about wells fargo and said 14% of customers are already leaving the bank for other banks, and

the suspects still on the run this morning. we'll get to that story in just a moment. 5:56 right now. new this morning, shining a concerning light when it comes to the safety of millions of

drivers on the roadway. the insurance institute for highway safety released new safety ratings. the results are not good. among the 11 large and small pickup trucks evaluated, only the honda ridge line earned a good rating. that was on on vehicles with the most expensive trim levels. all four pickups earned the poor rating as was the case for three large pickups. new details on the police ride-along that ended in gunfire in central california. a woman was riding with a madeira police officer when a suspect fired back at them. this is what that patrol car looks like this morning. you can see two bullet holes in the windshield. a third one hit the back passenger tire. the police department says the suspect fired at least 14 shots at them. the officer was not hurt and the woman suffered a few cuts from the broken glass. >> by the grace of god and the man above, typical injuries are

basically none. she obviously had some scratches or minor injuries from the glass shards, but other than that, the physical ailment ts, there are none. >> the suspects are still on the run this morning. police say they do have some leads in that case. moving on to decision 2016 this morning. two weeks from today, voters will head to the polls to elect the next president of the united states. today both candidates, hillary clinton and donald trump are looking to sway undecided voters in the swing state of florida. early voting is already under way there. recent national polls show clinton with about a five percentage point lead over donald trump. but trump insists those polls are wrong. it's called voter suppression because people will say, oh, gee, trump -- folks, we're winning, we're winning. >> in the meantime, if you're not registered to vote, you're officially out of luck.
