>> watching the rain in the north bay. right now the biggest impact in the east bay, moderate rain closer to oakland and the east bay. the focus, central bay to north bay will start to drift from south to north heading into the afternoon. areas near santa rosa may see another half inch of rain. santa clara missing out with the storm. highs today upper 60s to low 70s. a drier forecast on wednesday. a look at the storm coming up in a few minutes. now to see how the rain is impacting that east bay commute, here is mike. >> a great note for drivers. the road weather index shows the green. the damp roadways that remain from overnight rain in many parts of the bay. more active approaching the bay bridge. the slowdown for the upper east shore, 22 minutes from highway 4 down to the maze. some of that due to the volume. the live look at the bay bridge toll plaza shows you the droplets falling opt the lens,

the backup forms. keep that in mind as you drive through oakland. oakland hills maybe gusty winds as well. >> an update to breaking news we have been tracking since we first came on air at 4:30 this morning. a san jose neighborhood turned crime scene as police opened fire on a suspect they say rammed their police cruiser. "today in the bay's" bob redell has been live at worcester and tripp avenues all morning long. bob, they say that this suv driver plowed his car into their cruiser. >> reporter: good morning, sam. police lieutenant tells us that last night three fellow officers were doing a routine foot patrol at an apartment complex about a block from where we're standing at, down worcester avenue. this apartment complex, if you're not familiar, next door near the kellogg's plant. around midnight one of the officers was getting back in his squad car parked along the curb.

that's when the man in the suv rammed his vehicle, then backed up and rammed his squad car a second time. >> the two off officers used their service weapons to shoot. the suspect vehicle fled and was found unoccupied about a half mile away. >> reporter: police found the vehicle abandoned about a mile away. you can see where one of the officer's gunshots did pierce the windshield. turns out the suv was stolen and the suspect already wanted on a prior warrant for resisting arrest. he was not hurt and is now in police custody. the officer whose car was hit was remarkably uninjured as well. police don't know why this man rammed police. there had been no interaction or

contract prior. it appears the attack was unprovoked. reporting live in san jose, bob redell "today in the bay." >> 6:03, more breaking news, this time in the east bay where a car slammed into two oakland police cruisers and two other cars leaving at least one person dead. it happened just a couple hours ago. the scene is still very active this morning. "today in the bay's" pete suratos joins us live near 35th and brookdale this morning with an update. pete? >> reporter: good morning, laura. activity picking up in the past half hour as the cars involved are being towed away. just behind there in the distance, that's the car that was involved in this accident that we're talking about. here is what we know. we talked with oakland police off camera. they're saying two police cruisers on scene last night around 10:00 p.m. for another incident. we're told it was a non-fatal shooting. then a few hours later, you have the vehicle that we're showing you traveling at a high speed here on 35th avenue and

brookdale crashing into those two oakland pd cruisers, and also another patrol car in the area. no officers were injured in this process. but in that car we're talking about, there were five people. one person died according to oakland pd and four others were transported to the hospital. the folks in that vehicle, at least at this time, are being told were not connected to the incident they were tending to. this investigation has wrapped up for the most part. right now they're just towing away the cars and soon enough this scene will clear out. >> a lot of work to do there. 6:05. new this morning, a south bay business will be cleaning up after an early morning fire that caused heavy damage. firefighters say it all started at about 2:30 in a building on monterey road in gilroy right across from the caltrain station. residents in a neighboring vilding were evacuated. we're told they're back in their homes. the cause of the fire is under investigation.

a well-known bay area filmmaker is under arrest accused in a deadly shooting. relatives of the victim say it all started with a dispute. the incident unfolded yesterday afternoon at a home in san francisco's glenn park. the man under arrest is kevin epps. the victim is identified as marcus polk senior. we spoke to the victim's son yesterday who said his father would periodically stay at epps' home where the shooting occurred. he said the two got into an argument about a woman that quickly escalated. >> my dad made a lot of jokes at other people's expense. there was never any -- there was never any hostility. it was more like he was going to point out the uncomfortable truths. >> police so far are saying little about the investigation. the exact charges against epps have not been announced. a father and son landlord team from east palo alto find themselves behind bars this

morning. the accusation, they were intimidating den nantz. they owned stanford gardens apartment homes off woodland avenue. investigators say the owners are pushing tenants to move out so they can move in newer residents to pay higher rent. police say one suspect went so far as to break car windows and destroy personal property. the two are now facing criminal charges. >> these are bullies attempting to gain a benefit financially for themselves at the expense of people who no question, from what i've been told, wouldn't have been able to afford to live elsewhere. >> we reached out. the landlords did not answer our calls. according to the d.a., the landlords were released from jail and pleaded not guilty. let's switch gears on this tuesday morning for you. you know who is back in action? it's going to happen right there at or akal, ahead of tonight's highly anticipated season opener, warriors taking on the spurs at 7:30. tonight's game will debut warriors newcomer kevin durant.

before the start of the season durant took to reddit to ask which bay area holt spots to clerk out. going out to chrisrissy field, checking out am me da records, riding b.a.r.t. he posted this site sght seer. >> who would ever notice him in a b.a.r.t. car. as the storm moves in, work is continuing to remove this enormous tree that toppled over onto an apartment building in berk wli. a 50-foot tree fell over about 3:30 yesterday afternoon. fortunately no one was injured. there are reports of a few branches damaging a car there. one person we talked to described the crash as feeling like an earthquake. no official word on why that tree went down. one sit stay staffer suggests

wind might be the cause. >> a lot of trees having lost all the leaves, the leaves can act a bit like miniature parachutes when the wind gusts are strong and gets trees toppling over. saturated soil has help for that, too. for the last 24 hours, that's where most of the rain is right now. quarter inch around some parts in oakland. this is the north bay, two to four inches. still adding to it. notice how the rain line will move from south to north headed into the afternoon. some late day clearing around san jose where we'll see mild temperatures for low 70s around the tri-valley. 60s in the forecast today around santa rosa. we wait for round two. a lot more rain expected with the thursday storm. a third system due in around sunday with more wind and rain.

here is a view of your emeryville commute dealing with light rain and wind out of the southeast at 14 miles per hour with more rain expected in the central bay and north bay for the rest of the morning commute. >> travel times building for the upper eastshore freeway highway 4 to the maze. general slowing from richmond to the berkeley curve. a new crash for 24 around fish ranch road. in the south no major delays. thank you very much, mike. it's 6:14. authorities have identified a south bay teenager shot and killed in a robbery last week. police say someone shot into a car wednesday night near dove hill elementary school in san jose. the victim, 17-year-old hum bare toe solas was driven to regional medical center where he died. investigators san jose salas and another victim were robbed and the other victim was assaulted. police so far have made no arrests. there are new signs this

morning that bay area rents have hit what is temporarily kind of a ceiling. the "mercury news" citing data showing rents last month in san francisco, san jose and oakland all nell year over year. in san francisco and san jose those dropped 3%. oakland fell less than 1%. rents nationally with up year over year about 2%. a question that might explain why rents might be dropping is the san francisco economy starting to slow down. more talk of lay-offs on market street. >> scott mcgrew, you saw these coming. >> we talked about these on friday. bloomberg says this morning twitter will cut as many as 300 workers very soon before it reports its earnings on thursday. also notable that earnings report was supposed to come thursday afternoon after the bell. now it is happening before the bell. companies do not release sensitive financial information

a very important warning right now. still seeing rain coming through right now, rob, particularly in the north bay. >> the north bay totals well over an inch of rain. some spots more than four inches around san jose. meantime san jose, we're waiting to see the ground get a little wet. nothing in the santa clara valley. the numbers there, mount saint helena, north bay more than three inches, northern sonoma more than three inches. as you drop south of san francisco, there's really not much to show for it. most of the rain in the santa cruz mountains, nothing for san jose. if it wasn't for the rain, you almost don't need a jacket. it is windy. the winds are up to about 25 miles per hour around oakland along with some of that rain. again, san jose not seeing much. you're seeing rain around san francisco, the golden gate bridge into the north bay, marin county and into sonoma and napa county. that's where the rain will hang out for most of the day, the central bay watching that rain

go from south to north as we head into the afternoon and then by the evening, late day clearing we think later on today around san jose. another half inch possible in the north bay. 60s and 70s in the south bay. mid 60s for san francisco. we'll catch a brief dry break on wednesday. then thursday into friday, it's the second system that has the potential for high rainfall totals around the bay area. one more on sunday. for halloween, things right now are trending drier. seven-day forecast brings in the second storm thursday. midway through the weekend wind and rain on that sunday system and temperatures trending cooler which means if you're going to head to the high country, we could see snow levels down to 6,000 feet by the end of the weekend. >> we have our eyes on the changes. but still we have green highlighting where you might find damp roadways in the east way. nothing unusual in the south bay. the east bay and tri-valley, what you'd expect. we have the rain coming through. it might slow you down a bit. we did just learn about this

the terms and conditions are pretty clear here on travelocity. it says we will credit or refund to you the difference in price if you find a lower rate any time up to two days before check-in. yes, sir see filed a claim when his hotel rate dropped by $10 a night. but he was denied. we couldn't figure out why so we contacted travelocity. a spokesman did some research and found that jesse asked to change the reservation at the same time he filed for the refund based on the low-price guarantee. changes are not allowed. together we worked it all out, based on his stay, jesse got a $40 refund. travelocity spokesman got back with us and told us we were happy to get the situation figured out and get the refund that mr. tannenbaum was due. jesse said i got such a run-around and i'm glad you fixed it in such a quick time. thank you again for all your help. these rate guarantees are common these days.

tracking breaking news. on your left an officer-involved shooting scene in san jose and on your right, a live look at a scene of a deadly crash in oakland involving at least two police cruisers. thank you for joining us. i'm laura garcia-cannon. >> i'm sam brock. much more on those stories in just a minute. first a quick check of your weather with rob who starts off in san francisco. we're seeing rain and wind there. >> we're seeing a combination. we're seeing around the bay area, breezy conditions, winds out of the south at 25 miles per hour in oakland. you're seeing rain and those southeast winds. 62 degrees. you see the moderate rain across the peninsula and more into the north bay where the rain will be hanging out for most of the day. not so much around the south bay as you can see over the next 12 hours. another half inch of rain possible for areas north of santa rosa. during the day today, temperatures in the upper 60s and low 70s. so a mild day today with another storm due in on thursday. more on that coming up in a few minutes. now to see what's going on in your east bay commute in orinda,

"today in the bay's" pete suratos live in brookdale gathering information. he has an update now. pete? >> reporter: good morning, laura. we're here in east oakland where

that accident took place. they just towed away a police krugser and also a car involved in the accident. there's still a tow truck because that car hit nearby vehicles. let's show you guys this scene. what we saw just about a few hours ago. according to oakland, police are telling me these two police cruisers on the scene are here for another incident last night when a few hours later you had a vehicle traveling at a high speed crashing into the cruisers and nearby cars in the area. no officers were injured through all of this. but inside the car traveling at the high speeds near 35th avenue and brookdale, there were five people inside. according to police, there was one person who died as a result and there were four other people in that car that were sent to the hospital. oakland police say the folks in the vehicle were not connected to the incident they were investigating at the time of the cash. it looks like they'll with wrapping this up shortly. they're clearing out the cars momentarily.

pete suratos for "today in the bay." in the meantime, more breaking news, this time in san jose where police opened fire on a suspect they say rammed a police cruiser. "today in the bay's" bob redell has been live at that scene near worcester and trip tripp avenue all morning. >> reporter: they say the attack appears to be unpro voekted. they don't know why this man rammed one of the police cars with the suv. there had been no contact prior, no interaction with this person. this happened down there on worcester avenue about a block away from the intersection with tripp avenue which is where we're standing right now. three san jose police officers were doing a routine foot patrol of an apartment complex located next to the kellogg's factory. around midnight a man in a silver isuzu suv rammed a squad car parktd along the curve as the officer was trying to get into the car.

the suspect backed up and rammed the car a second time. that's when officers opened fire. the suspect drove off, fled. police did find that suv abandoned about a mile away at mckee and el rancho verde. turns out the vehicle was stolen. they also found a man who they believe was their suspect a short time later. turns out he was already wanted on a prior warrant for resisting arrest. both hee and the officer whose car was rammed were not hurt during last night's altercation. live in san jose, bob redell, "today in the bay." 6:34 right now. breaking news overseas. four people killed in an accident at a popular theme park in australia. police say two men and two women died today when something went wrong on a river rapids ride in queensland. it was a malfunction and two people were ejected from the raft while two others were somehow caught inside the ride. the park is closed during the investigation. we have new details in

oakland about a shooting that happened over the weekend. we know oakland police officers were in the line of fire. six officers were shot at while responding to a shooting in west oakland. none of the police officers were injured, but seven other people were. this happened on saturday just before midnight on bancroft avenue near 73rd avenue. one of the victims remains in critical condition. the search continues for the people who dragged a man behind a getaway car in san francisco. that man was trying to get back his camera. he says the suspects grabbed it from them. police just released this surveillance video. take a look at that spot. you see him running in the background of the video. the suspects jumped into a silver honda civic after grabbing the camera. the man tried holding on to it. he was dragged by the car for about ten feet. finally he let go. this video helped police to locate the getaway car and ultimately led to the arrest of one of the suspects. they're still looking for several other people involved. 6:35.

police in the north bay releasing surveillance video to see who spray painted controversial graffiti over the weekend. it happened in the city of windsor. vandals painted the word trump around the world and the phrase "build the war higher." the school rushed to get the messages painted over before the students returned but many parents and kids already spotted the words. >> it's a shame. i don't understand why they had to come to a kids' school to do this. >> people clearly upset. right now no suspects are in custody. decision 2016. two weeks exactly from today voters are heading to the polls to elect the next president of the united states. today both candidates hillary clinton and donald trump are looking to make some headway in florida as they look to convince undecided voters there to jump on their team. early voting already under way in the sunshine state. recent national polling shows

clinton with about a five percentage point lead over trump. trump insisting the polls are wrong. >> it's called voter suppression. people will say, oh, gee, trump -- folks, we're winning. we're winning. >> in the meantime, if you're not registered to vote, you are officially out of luck. midnight was the deadline to register out of the november election. officials say this year's race fueled a surge in last-minute registration. in contra costa county they processed close to 10,000 applications just yesterday. the county expects to exceed 6,000 registered voters in total. election ballots are being cast. state laws allow county election offices to accept and process mailed in ballots ten business days before an election. san francisco's department of elections will start opening and

sorting those today. bam lot counting starts on thursday. results will not be tabulated until the polls actually close on election night. all right. a bit of a messy scene the last day or so from the north bay. a live look from san rafael where you see traffic ticking along. a lot of people have their windshield wipers on as we say rain on and off. parts of the bay area got a soggy start to the week. there's more expected before week's end. rob mayeda will have much more in just a moment. with the real rainy season a few weeks off, people in the north bey can get a head start on preparing for the possibility of flooding. for the second time, marin county is holding a flood preparedness fair that takes place on saturday in san rafael at 10:00 a.m. at the hilton embassy sweets on mcginnis parkway. we saw the rain coming down. rob has a look at the radar right now, where it's falling. >> speaking of the north bay, we've been seeing totals up to three inches plus around mounlt saint helena, kentfield and

petaluma. you can see the rain across the north bay, some steady rain. rain across the golden gate bridge into san francisco. not much right now in the south bay, and the trend we're seeing now will hold up for the first part of the day and then the rain line begins to move to the north as we head into the afternoon. best chances of additional rainfall today into the afternoon will be north of the golden gate bridge. highs today 60s to low 70s, a mild finish to the day with partly cloudy skies in san jose. round two with more widespread heavy rain expected on thursday. then a third system drops in on sunday with cooler temperatures we hope in the sierras for snow next week. damp and wet roadways so use caution. the south bay shows the traditional build. we'll talk about that in a second. no delays for the peninsula drive. that's great. we still have this crash in lanes west 24 at fish ranch road.

the radar shows not too much impact on your morning drive in san jose. towards san francisco, oakland and richmond, that is where the rain is flying and more rain into the north bay. plan on a sog difficult drive from the central bay into the north bay for the rest of your morning commute. >> toward the bay bridge, slowing at the eastshore freeway as the rain comes through. 35 minutes from highway 4 to the maze. also the crash at fish ranch road remaining in lands. more slowing out of orinda. capital corridor announced delay systemwide due to an obstruction on the tracks between emeryville and oakland. we're checking that out. no delays for the ferry system. >> thanks for the update there. 6:44, the man accused of setting the devastating fire in lakeland county. daymond pausch lick has pled not guilty. close to 200 homes were destroyed in the fire back in august. today a judge is expected to set a pretrial hearing day for pausch lick. cam ross were rolling as a

the rain line retreats out of the north way and away from the bay area as the next round of rain comes in on thursday. highs running mild. upper 60s, low 70s around the south bay. mid 60s to upper 60s around the peninsula. mid 60s in east bay. access to more moisture, heavier rain with that system and a third dropping in on sunday. behind it it looks like we could get some clearing for halloween. so good news there in your seven-day forecast. you can see thursday making a comeback. friday a break and more rain due in on sunday. and then transitioning to showers for halloween. i do want to show you the seven-day outlook for rainfall across northern california, north bay included. this is very impressive. 200 to 500% of average between now and monday. sonoma county northward. even though snow levels are high, by monday, could be talking about halloween snow

rammed his suv into a police car twice overnight. officers opened fire and the suspect drove off, but he was found a short time later and arrested. police say the suv he was in was stolen. neither the officers involved or the suspect was injured. >> in oakland a car slammed into two police suvs and two other cars, leaving at least one person dead. this is happening off 35th and brookdale avenue. that happened overnight. the cars have since been cleared. we're told no officers were injured and the person who died was in the suspect's car. officers were responding to an unrelated shooting when that car came down the road and splamash into the cruisers. an early morning fire caused heavy damage. the fire started in a brilding on monterey road in gilroy across from the caltrain station. residents were evacuated but are now back in their homes. the cause of the fire is still
