pete suratos in san francisco with the latest on that officer-involved shooting that sent both the officer and suspect to sf general. two firefighters are arrested after picking a fight with law enforcement. the rowdy behavior that led to an assault of officers at an east bay ho tell. >> durant for three. >> kevin durant rained jumpers all night long. unfortunately the warriors lose because they couldn't stop the other team from scoring. >> it was not the home opener that anyone envisioned. we're glad they're back. they got the first loss out of the way. now they can go on their big run. >> come on. it's a wlolong season. >> durant was raining jumpers. a lot of rain here, a break for the most part. >> we're seeing the rain that was in the north bay now starting to move away from the bay area. today we'll see a pretty mild day, temperatures across the bay area, mostly in the 70s outside. you may run into fog in san francisco this morning. high of 68 this afternoon. check out the south bay. san jose near 74 degrees as the rain has moved the north for now. it won't be staying there for long there. as the next storm takes shape, that's going to be coming in tomorrow as we head into friday. more details in a few moments. now to see your wednesday morning commute, here is mike. >> a great easy start. conditions are great for driving as well. the roadways have had a break and everything is dried out. maybe a little fog on the north side of the golden gate bridge. chp issued a fog and a wind advisory. i know it's early.

i want to let you know that mass transit isn't reporting any delays. leaving the central valley right on time. >> thank you very much, mike. chp officer this morning is in a san francisco hospital after being dragged by a stolen suspect's vehicle. it all started with the police chase in which the suspect was shot. >> "today in the bay's" pete suratos live where the officer and suspects are being treated right now. good morning, pete. >> reporter: good morning, laura and sam. that chp officer is described as having non-life-threatening injuries. the same can't be said for the suspect in all this. here is one witness describing what she heard when this shooting took place. >> i heard four shots. bam, bam, bam, bam. and then i heard it again, bam, bam, bam, preetdly, right after it. >> looking at footage from our nbc bay area chopper from that scene yesterday afternoon on the 200 block of montana street. according to sfpd a san mateo

car theft task force was following a car to this ingleside neighborhood. as officers approached, police say the driver struck the now-injured officer with his car. sources telling nbc bay area that the officer was even dragged by that vehicle. that's when another officer opened fire. at this time it's unclear if the suspect was unarmed. while police haven't identified the suspect, friends and family of that suspect tell us his name is notorious dickerson who grew up in the ocean view neighborhood. they say he was just there yesterday to visit his friends. >> when i looked out the vehicle, i seen the police shooting at this car. >> he stole a vehicle, and that's wrong. he's not the type of person that deserves to get shot. he's not going to hurt nobody. >> that chp officer has minor head and road rash injuries. that suspect is here at sf general and described as being

in critical condition. sfpd will handle this investigation moving forward. we're live in san francisco, pete suratos for "today in the bay." >> pete, thank you very much forgetting us updated. in the meantime belligerent behavior and picking a fight with cops. those are the accusations against two east bay firefighters who tangled with the law quite literally over the weekend. walnut creek police say they were called to the marriott hotel early sunday morning after two firefighters and female companions were drunk and refused to leave after attending a firefighters ball. police say when they arrived, one of the firefighters attacked and injured two officers. both firefighters and their female guests are facing charges. a plane crashes near concord killing the only person on board. the faa says someone reported seeing a plane go down about 12:30 yesterday afternoon. there were reports the plane might have clipped power lines before crashing. it happened near the concord

pavilion, a few miles east of buchanan field airport. things should be returning back to normal at the dmv branches throughout california today after a computer meltdown caused major problems systemically for the dmv for the last few days. dmv called it catastrophic computer failure and not a hack. the problems was so bad that crews spent all day and night trying to rebuild the computer systems at locationless across the state including several here in the bay area. >> warriors fans, you've got to shake it off. it's only game one. but the dubs got beat in the season opener. kevin durant looking good, scoring 27 points to lead the warriors. as a whole, it may take time for the team to gel. the closest the warriors got was in the second half down ten points. the leading players chalked it up to experience. >> we can't win a championship right now, so we wouldn't have been celebrating if we would

torres plan to defe hi new details in the sierra lamar murder case and specifically how attorneys for antolin torres are planning on defending him. reports are that lawyers may argue the trial that the morgan hill teenager ran away. to this day her body has not been found. authorities rejected the runaway theory shortly after lamar vanished in 2012. defense lawyers say the young woman who lived with lamar says the teenager was planning to leave home and even showed her a packed suitcase. the trial starts in january. a mid flight mystery illness forces an emergency landing. investigators are trying to figure out what caused a british airways crew to get sick after taking off from sfo yesterday morning. they were headed to london.

then all 22 cabin crew members and pilots started to feel sick. the plane made an emergency landing in vancouver. the entire crew was rushed to the hospital. most were treated and released. no passengers were affected. a mother accused of kid happening her own baby has been found along with her child. hannah ashley and her 7-month-old son were both found yesterday about 100 miles northeast of sacramento. an amber alert was issued after ashleigh took her son from his grandmother's home. the grandmother is the baby's legal guardian and ashley has since been arrested. voter registration deadline was midnight on tuesday. how many people signed up to vote? we'll break down the numbers. new faces to greet you at mineta san jose international airport. bright robotic faces. we'll meet these high-tech employees next.

today. the next is taking shape offshore. as we go through the day tomorrow, our next timeline for tomorrow morning's commute, you'll begin to see a few showers. thursday evening into friday morning looks to be the heaviest round of rain. you can see as the system comes through, might have thundershowers in the mix. today, no worries about the rain. late thursday into friday, you can see how the rain totals will begin to add up. for the thursday evening commute, at least one to two inches in the bay area. seven-day forecast still has plenty of chances of rain as you saw thrgs into friday. number three comes midway through the weekend right now. looks like halloween should be dry. showers as we approach midnight and more rain due in on tuesday. mike? >> we'll keep our eyes on that, especially the trick-or-treating forecast. in the peninsula, the only activity showing up on the chp reports. i'll show you what we find here.

we had a crash northbound 101 at oregon expressway. our cameras by university, i took a chance and swung it around. i couldn't see that, no slowing past the scene. it seems like it's getting over toward the shoulder where there may be debris as well. but look what i found? i found this car in the center divide. it disappeared. there was a pt cruiser right there. chp was circling the area. good stuff. no problems southbound 101 at university and no delay west 580 from grant line road over to 680. just 22 minutes, mild slowing out of the altamont pass. in high school i had a pt cruiser. >> you did? >> never lived that one down. thanks for the memories, mike. in business news right now we are closely watching apple stock as iphone sales drop. >> google laying off skplees and scaling back on a major project. for more on that we turn to

susan li live at cnbc world headquarters. good morning. >> good morning to you. wall street could be starting the day in the red. futures pointing lower at this hour after stocks fell yesterday following a report showing a drop in consumer confidence this month and lackluster earnings. today watch out for data on new home sales, offer more earnings from the likes of bowling to ro cola and comcast. the dow falling to 18,169. the nasdaq also lower down 26 points to 5283. you're right. watch out for shares of apple because so far they're lower in pre market trade after the company reported its third straight quarter of falling iphone sales. apple forecasting slimmer margins during the holiday season even though as it projects record iphone sales. apple says it's really impossible in their views to know if it's actually gaining any market share from samsung at

growing outrage aer thousas of national dsme nchts welcome back. the defense department is vowing to solve the growing outrage after thousands of national guardsmen are ordered to pay backbone news, some ordered to repay tens of thousands of dollars. in many cases military recruiters may have known the soldiers were actually ineligible for the bonuses when they signed up. one south bay soldier who received a $7500 bonus back in 2007 was asked last month to pay it back. >> show me something in writing that shows, in fact, the california guard couldn't do this. i just want an explanation. >> president obama chimed in yesterday asking the pentagon to speed up its probe. congress is also now launching an investigation. in east palo alto a landlord and his son who prosecutors say bullied their tenants are

scheduled to be in court today. they're charged with forcing representers out of their apartments. investigators say on numerous occasions tenants had their car windows broken, personal property damaged. the two men are fashioning felony charges. unsafe for the roadway. that's what investigators are saying about the tires on a tour bus that crashed over the weekend. it was one of the deadliest crashes in california history. 13 people were killed including the bus driver. federal investigators say the treads on half the tires were worn down to an unsafe level and the bus should have been taken out of service. it's still not known if that was a factor in the crash. this is not exactly the way a fire hydrant is supposed to work. in fact, it looks like a pop-up geyser. it's touring over the homes. this happened last night in el cajon. fortunately crews shut the water down before it was able to flood any of the neeb homes.
