on thursday. the timeline coming up in a few minutes. >> green for almost everyone. a lot more slowing through hayward. the trouble is southbound 880 at a street we have a crash blocking at least your slow lanes, slow out of san leandro past 238 toward a street. there's another crash in the area, the tennyson road on-ramp. we're tracking that. hopefully have that taken care of. slowing in san pablo. no crashes, just cars. >> mike, thank you very much. a developing story, a chp officer is? the hospital and a suspected car thief is in critical condition after a chase led to a police shooting. all this unfolded yesterday on montana street in capital avenue near san francisco's ingleside district. police say authorities following a stolen car approached that driver and the driver struck the

chp officer and used the vehicle to drag him. another officer opened fire at that point. the injured officer suffered head and road rash injuries but is expected to fully recover. neighbors describe this chaos that was going on. >> i heard four shots, bam, bam, bam, bam. and then i heard it again, bam, bam, bam, bam, repeatedly right after it. >> at this point police have not identified the suspects, but neighbors say he grew up the area and was there visiting friends. "today in the bay's" pete suratos will have a live report in 30 minutes. a bizarre investigation out of the east bay. two firefighters are facing charges accused of fighting police officers in a drunken rage. >> "today in the bay's" bob redell live at the march yot where this allegedly happened. it reportedly after after a charity ball event there. >> reporter: good morning, laura and sam. two off duty contra costa county

firefighters and their female companions attending the firefighters ball. as the night went on, the foursome became more drunk and belligerent. in the early hours, the hotel called police because they refused to leave the hotel room. police say one of the firefighters resisted arrest and assaulted both of the responding officers. police arrested the woman for public intoxication and assaulting hotel security. here is what the fire department had to say. >> at this point because it's an investigation, we basically reserve any reaction that will come out during the investigation and we'll take appropriate steps if necessary once the investigation is comple complete. >> reporter: the contra costa county fire department has

placed both firefighters on administrative leave. live in walnut creek, bob redell, "today in the bay." >> 6:03. a major twist in a homicide case in san francisco. bay area filmmaker and community activist kevin epps has been released from jail. the d.a. is not following charges due to lack of evidence. he's accused of killing marcus polk at his home on sunday. polk's son says his father had been estranged from a woman living in the filmmaker's home. the two got into a heated exchange. the case remains under investigation. a bicyclist is hospitalized after being hit by a car at the intersection of giant road and trenton boulevard near highway 80 last night. the roads were closed down as a result for several hours while police were investigating. so far no word on the bicycle it's condition. >> this morning an investigation is under way after a plane

crashes killing the only person on board. there were reports the plane might have clipped power lines before crashing. it happened near kirker pass road a few miles east of the buchanan field airport. a student says he's the person behind racist graffiti found at an east bay school. the male student admitted to vandalizing the boy's bathroom at cal high school in san ramon. that graffiti said whites above one toilet and colored above another in the boy's bathroom. >> not okay. not tolerated in this area at all. i'm pretty shocked that that would be put in our bathroom. >> so far nobody has come forward with who wrote a racial slur inside the girl's bathroom. that happened on monday. >> 6:05. new details in the sierra lamar murder case and how attorneys for antolin garcia torres plan to defend him.

court lawyers suggest that defense attorneys may argue at trial that the morgan hill teenager ran away. her body has never been found. now defense lawyers say a young woman who lived with lamar at the time claims the teenager told her she was planning to leave home and showed her a packed suitcase. the trial starts in january. 6:06 on your wednesday. the problem is not with the water, but what could be added, fluoride. there were protests last night to get the message out. five years ago, here is the back story. the ut wahher district voted in favor of the fluoride proposal. the system is ready. in december residents will start receiving the water with fluoride. children with no access to regular dental care will benefit. >> county health has sum ported

to change tomorrow. >> meteorologist rob mayeda tracking the storm that's coming. >> we're seeing an impressive view on the satellite. what makes this storm different from others, it's got a real good tap to tropical moisture which will boost rainfall rates, but not today. north of sonoma and mendocino may see a stray shower or two. the burn areas around the loma fire and the soeb ran knows fire under a flash flood watch from thrgs afternoon into friday. that is thrthursday's forecast. 60s to low 70s from san francisco to oakland. the next storm systems comes in during the morning hours during friday morning's commute. another storm that comes in, probably more wind for sunday and halloween for now, fingers crossed, looks dry. there comes the next storm as you head into tuesday morning.

department is vowing to resolve this growing anger over thousands of national guardsmen being ordered to pay backbone news they received for reenlistment. some of those have been forced to repay tens of thousands of dollars. in many cases military recruiters may have known the soldiers were ineligible when the bonuses were given to them. one south bay soldier who received a $7,500 ben news in 2007 was asked last month to pay it back. >> show me, show me something in writing that shows, in fact, that california -- the california guard couldn't do this. i just want an explanation. >> as do a lot of folks. well, president obama weighed in yesterday asking the pentagon to speed up its probe. congress is also now launching an investigation. >> now to the latest fallout from the wells fargo fraudulent account scam. another bay area agency is cutting ties for the san francisco bank. this time it's the east bay's

largest water district. east bay mud voted yesterday to suspend some but not all of its activities with wells fargo for at least a year. the water board asked the banking giant to rescind bonuses for employees who were responsible for the scam. wells fargo says it values its relationship with east bay mud and will work to rebuild that partnership. despite the release of new chip and pin credit cards designed to keep us safe from scammers, numbers show fraud is actually skyrocketing right now. "today in the bay's" tracie potts live in washington with the details. we're learning criminals have found a back door on the internet to try to steal people's information. >> reporter: absolutely, laura. those chip cards that we're used to using in stores now don't really make a difference at all when we make purchases online. you can verify them the same way. fraud seems to be moving from physical stores much more to

online. new numbers show about $4 billion in fraud expected this year. that could jump to over $7 billion by the year 2020. it's hitting merchants, too, because merchants are losing about 7% of their revenue to fraud. so a couple of things happening here, the new chip cards work, they work fine. it's just that they don't have a mechanism to work online. the industry is looking at things like online tokens instead of entering a different number that you would enter associated with your card, as opposed to entering your actual card number which can be swiped so easily. they're also looking at providing more information so there's more information to verify those online purchases. but for now, the experts say there are a few things you should do. do not save your card number on store sites. it's convenient. we all do it, but it could put you at risk. they also say be sure to sign out and log off when you're purchasing something online and never make online purchases when

you're using public wi-fi, if you can avoid it at all. that's one of the easiest ways criminals can swipe your number. >> all good advice. tracie potts, thanks. a second ago you were talking about wells fargo, it copped to creating public accounts. the public is looking for punishment. first on the list of targets, former ceo john stumpf. >> many investigators want to claw back his pay. >> claw back, the financial term used to describe getting money back from someone who maybe didn't deserve it. stumpf's critics have a powerful ally in congress, senator elizabeth warren. she's taken wells fargo under her wing, the issue. she told stumpf to resign. eventually he did resign. there's a new ceo. a lot of observers think the new ceo of wells fargo, his time is probably limited as well.

"new york times" op ed is asking how this man, tim sloan, will fix things, considering he was there during the scandal. meantime sloan appeared to employees on a closed circuit all employees' meeting where he reportedly told workers you should expect more tough headlines, adding, i need to make it safe to talk about the problems that got us here. one of the main criticisms is management knew about the cheating and, in fact, required unreachable sales goals, all but condoned it. stocks were mildly lower tuesday. futures call for another loss on the opening bell a little less than an hour from now. you watch apple stocks, the company announcing declining sales of its iphone. now, as we watch apple and the iphone again, they could have sold more of those iphones. they say if they had made more of the bigger version of the iphone 7. that's apparently what people who had to give up their exploding samsungs wanted to buy, but there weren't enough of

pete, tell us how the confrontation unfolded. >> reporter: good morning, sam and laura. the officer and suspect here for their injuries. we're told the chp officer has non-life-threatening injuries. that suspect is in critical condition. here is what one witness had to say at the scene yesterday. >> i heard four shots, bam, bam, bam, bam. then i heard it again, bam, bam, bam, bam, repeatedly right after it. >> reporter: you take a look at footage from our nbc bay area chopper from the scene yesterday afternoon on the 200 block of montana street. according to sfpd, they say a san mateo car theft task force was following this stolen honda from san mateo to the ingleside neighborhood of san francisco. as officers approached that driver, police say the driver struck this now-injured officer with his car. our sources tell nbc bay area that the officer was even dragged by that car. that's when another officer

opened fire. while police haven't identified the suspect, we did speak with friends and family of the suspect who identify him as notorious dickerson who grew up in the oceanside neighborhood. they say he was there yesterday to visit his friends. >> when i looked out the window, i seen the police surrounding a car, shooting this car. when i came outside, he was on the floor. >> yeah, he stole a vehicle and that's wrong. but he's not the type of person that deserves to get shot. he's in the going to hurt nobody. >> reporter: that chp officer has minor head and road rash injuries. the suspect is listed in critical condition. sfpd will be handling this investigation moving forward. we're live in san francisco, pete suratos for "today in the bay." >> thank you very much, pete. 6:33. an east palo alto landlord and his son who prosecutors say bullied their tenants is scheduled to appear in court. prosecutors say the pair tried

to force lower-paying representers out of their rent-controlled apartments to raise the rate to market rates. on numerous occasions, investigators say tenants had car windows broken and personal property damaged. the two are facing felony charges. two suspects accused of spray painting racial insults on an antioch home and lighting it on fire are expected to enter pleas in court today. police arrested roy sew varry and christianne mcdaniel last month. surveillance video shows one of them throwing three molotov cocktails at a home. police believe the attack stems from a dispute between the suspects and one of the people who lives in the home. belligerent behavior and picking a fight with cops. thoegs are the accusations against two east bay firefighters who tangled with the law quite literally over the weekend. walnut creek police say they were called to the marriott hotel early sunday morning. two firefighters and their female companions were drunk and

they refused to leave after attending a charity ball, a firefighters ball there. police say when they arrived one of the firefighters attacked and injured both officers. both of those firefighters and their final maim guests are now facing charges. at 6:35, new details on a story we first brought you as breaking news yesterday morning. to are the first time, body-worn cameras will provide key evidence in a police shooting in san jose. when an officer tried to pull over a stolen suv on monday night, investigators say the driver rammed the patrol car. it happened near mckee road and highway 101. two other officers opened fire, but the suspect got away. >> it helped us really set the stage as to what transpired and how it transpired and what happened after. obviously it was our first officer-involved shooting with our body-worn cameras and they'll be extremely useful in the future. >> the driver apparently was not hit by gunfire. police later arrested a different suspect wanted for a different crime.

the police chief says the body cam video is not being made public. it's 6:35 right now. one of the east bay's most courageous canines is back to work. jelle reported for duty after being stabbed in the face two weeks ago during a chase of a stabbing suspect. she was back in the squad car yesterday and ready to roll. concord police thanked people for the outpouring of support. groundbreaking on a major project to transform a shuttered mental facility into public schools. the santa clara unified school district and the city of san jose joined forces the buy the property that includes the developmental center. the 81-acre site is on anchor road in north san jose. it includes a school for k-8 students as well as a high school. work is expected to take five years. decision 2016 now less than two weeks away from electing a new president.

the candidates blitzed florida yesterday. historically whoever wins that state wins it all. both candidates are vying for votes in the sunshine state. donald trump spent the day hammering hillary clinton on the affordable care act after news that premiums are skyrocketing. >> she wants to double down on obamacare and make it even more expensive and worse. >> clinton certainly admits the rising premiums are a problem and so are her e-mails. while we're talking about the politics of this, the latest wikileaks release suggests president obama knew about miss clinton's private e-mail server sooner than he admitted publicly. clinton held her last fund-raiser last night. the gloves are certainly coming off in a prime time between former house speaker newt gingrich and fox news anchor megyn kelly.

degrees. in san jose, mostly clear skies in your hour-by-hour forecast crossing 70 by lunchtime. mid 70s in the forecast today around the south bay. a mild wednesday. any shower chances staying north of the north bey heading into the afternoon. 68 in san francisco, 72 in oakland. speaking of rain chances thursday to friday, storm three arriving saturday night to sunday. if that's not enough. there's storm four coming in for tuesday. the good news, the way these are spaced out right now, it looks like halloween trick-or-treat time is dry before the next round of rain rolls in early next week. >> a chance for the meteorologists to breelgt between storms as well. no surprises for the is south bay. the peninsula looks great as far as the speeds go. it's the east bay that had problems. after earlier crashes cleared from hayward, we have this going through oakland. the activity still blocks the slow lane and the 90th avenue on-ramp. use 66, and that will get you on to the freeway north of there. through the area, 238 toward the downtown oakland area, we have a

investigators are trying to figure out what caused a british airways crew to get sick after taking off from sfo yesterday morning. they were headed to london. but then all 22 cabin crew members and pilots started to feel sick. the plane made an emergency landing in vancouver. the entire crew was rushed to the hospital. most were treated and released. no passengers were affected. 6:45 right now. more than 100 people are suing a peninsula hotel after they say they became violently ill after eating there. this happened at the sophie hotel during an naacp conference. they say video shows attendee z as young as 5 got sick in the lobby after eating salmon. there's even one report of someone going into a coma. >> this was terrifying. i never felt like this in my life. i thought i was dying. >> attorney john burris says he has medical records that prove his client's illnesses were tied to either norovirus or food poisoning.

he says he'll be seeking compensation for medical treatment. the hotel released a statement saying, we respect the client's right to pursue legal action even though we're confident their allegations will not hold up in court. when it comes to autism, a new study finds early intervention has lasting effects. a team of doctors used a simple treatment to help parents interact better with young children. they have parents watch videos of parents interacting and gave feedback. it enhanced how parents responded to their children's communication pat terns. that had lasting positive effects on the children's social skills. breast cancer treatment services will be expandings for sutter health. a $4 million donation will help boost cancer treatment. google's plan to expand in san jose is being put on hold.

google's parent company, alphabet, is stopping operations and laying off employees in a number of cities where it once wanted to bring high speed internet access. google's original plan was to bring better access to eight different cities including san jose by installing fiberoptic networks. today dmv offices across the state expected to be up and running after a massive computer hardwa hardware failure. the dmv says it was not a hack, just a system glitch. online services were not affected. r2d2 can't be too farr off from mineta san jose airport. >> the airport rolling out new customer service agents made with bay area technology. they come with a 32-inch touch screen and speak six languages. it's the first airport to have

first developing ws out san francisco. good wednesday morning. welcome back. let's get you caught up on the top stories on nbc bay area. >> a chp officer in the hospital this morning and a suspected car thief in critical condition after a chase that led to a police shooting. it unfolded yesterday on montana street and capital avenue near san francisco's ingleside district. police say authorities following a stolen car a approached the driver. that's when the vehicle used his

vehicle to strike and drag a chp officer. another officer opened fire. the injured officer suffered head and road rash injuries and is expected to recover. police have not identified the suspect. neighbors say he grew up in the area and was visiting friends. a bizarre story out of the east bay where a drunken fight happened with firefighters initiating it against police officers who were responding to reports of their belligerence. walnut creek police were called to the marriott hotel early sunday morning. the two firefighters and female companions were drunk and refusing to leave after a charity ball at the hotel. police say when they arrived, one of the firefighters attacked and injured two officers. those firefighters and their female guests were all arrested. a major twist in the homicide case in san francisco. bay area filmmaker and dmunity activist kevin epps has been released from jail. the d.a. is not filing charges due to lack of evidence. epps was accused of killing marcus polk in the glenn park neighborhood on monday. polk's son tells us his father
