well. >> an unsettling crime. a man followed a child with down syndrome into the rest room then proceeded to sexually assault him. >> pete, we are learning new details about this suspect this morning. >> b.a.r.t. police are telling me the suspect is a 38-year-old who was arrested for allegedly sexually assaulting this special needs teenager. he followed this teenager into the bathroom on saturday night around 10:00 p.m. i'm getting details from police. the mother was with the teen before he entered this single stall bathroom. at the time she was unaware if this was a single stall bathroom. that's when the suspect followed the teen inside around 10:00 p.m.

she flagged down an agent who contacted police and police arrested this suspect shortly after around 10:00 p.m. this is a busy b.a.r.t. station talking about here at pittsburgh bay point. we spoke to passengers who say it came as a shock because it's such a busy hub. >> they always have a police person or two at the exit. >> weird at this b.a.r.t. station. mind your own business. go home. >> the 38-year-old suspect was booked yesterday and faces felony charges. the victim was taken to a hoch for nearby evaluation. live in pittsburgh, pete suratos. 5:02, investigators believe a fire that destroyed an abandoned east oakland home my have been intentionally set. this started last night at about

7:30 on 47th avenue. firefighters said this is the second time that particular house caught fire. neighbors in the past noticed squatters going in and out of the house. >> video shows a man getting kicked off a san francisco cable car because of his pit bull. the woman who posted it says the dog is a service animal. the video was posted saturday to facebook, showing an unidentified man arguing with a police officer about the dog being onboard. a spokesperson confirmed they are investigating what happened and that service animals are allowed onboard. cable car operators have a duty to keep passengers safe. >> the operator did not feel it was a safe situation for the passengers onboard or for themselves and did ask him to

leave. >> it's not clear whether the dog was a service animal or not. dogs are allowed on cable cars. if they are not a service dog, they must be on a leash and muzzled. east bay police sex scandal. richmond city manager decided to fire four of the department's police officers. they're all accused of exploiting a teen who claims she was underage when some officers allegedly had sex with her. officials are not releasing the names of the officers being fired. dozens of officers from across bay area have been linked to the same scandal. one of those officers allegedly involved is expected back in court day. leroy johnson is set to reportedly face a judge. he is charged with failing to report officers were having sex with the underage girl. a pivotal hearing set for tomorrow may have a major impact on what jurors hear in bill cosby's sexual assault trial. tomorrow prosecutors will

present 13 of some 60 cosby accusers to establish cosby developed a distinctive pattern of drugging and assaulting women. the judge will determine if the testimony can be presented in the criminal child. the cosby trial is not expected to take place until next june. continuing coverage now on a story we have been following involving the 49ers and city of santa clara. the team is due to hand over documents at the center of a stadium contract stalemate. those papers must explain how the 49ers spent taxpayer money. independent auditor told nbc bay area taxpayer funds may have been used to recede the field several times, which is illegal based on the terms of the contract. city of santa clara threatened to take over stadium operations. 49ers released a statement "the mayor's accusations that money is going from the city's general fund into the stadium are false

contracts. the pentagon told congress it was not qualified enough to bid, but bloomberg speculates the dispute may have started when they made a sales call to the inner ring of the pentagon underdressed, wearing open-neck shirts at the headquarters of the most powerful military in the world. the problems for wells fargo continue to get bigger. illinois latest not to do business with the san francisco-based bank. u.s. senators want to talk to wells fargo auditors to figure out why auditors couldn't figure out millions of fraudulent accounts existed. former employees who claim they were dismissed after they warned their bosses are discovering in some cases wells fargo warned other banks not to hire them. let's check the rest of the news before the bell with landon dowdy. >> good monday morning. markets could start the weekend in positive territory.

futures higher this morning. stocks coming off a mixed week. dow ending higher while the nasdaq finished in the red. there were big springs friday afternoon following the news that the fbi was resuming its investigation of hillary clinton's e-mails. personal income and spending and manufacturing. on friday dow slipping eight points to 18,161. nasdaq down 25 to 5190. bay area astronaut kate ruben is back on earth after her soyuz capsule touched down. she got her ph.d. at stanford studying cancer. she will return home from napa. i'm sure there is some debriefing involved with being

closed. we were surprised to find it was closed. >> cute pumpkin in her arms there. >> many of these families are worried they are going to need backup plans because rain could interfere with trick-or-treating. >> i've been to that farm for years now. i found that little window to take the kids. even their field trip was canceled friday. that's tough business. especially when you compare to last year. in some cases we are seeing almost half a foot more rainfall than the same time last year. try start to the rain season last year. thanks to that rain we saw friday in the south bay, 205% to 249% of average. the wettest october since 2009. the wettest october we've

probably seen in the last 10 to 15 years. outside, a brief break. seeing patchy fog in the north bay where your halloween forecast will bring in rain as early as this afternoon. by 3:00, you'll see the rain into the north bay. san francisco we are thinking towards the evening. for the south bay, less rain this time around. by 8:00 tonight, we'll begin to see lighter rain showers in san jose. of all the locations, trick-or-treat around the south bay looks to be relatively speaking the driest. santa rosa, 1/2 mile visibility. watch out for patchy fog. given all the rain, patchy fog will be an issue for the next few morning commutes. >> rain showing up by mid afternoon into the evening. by 7:30, starting to race through the south bay and eventually tomorrow morning, maybe lingering showers. after this system, the forecast is actually trending much drier. in terms of rainfall, not nearly as strong as the last few systems. by 7:15, enough to wet the

ground here. sunset time at 6:11. even though we are talking about rain coming in, it does not look all that heavy. there is good news. not a lot of wind. for the sierra, we are expecting more halloween snow showers. 3-6 inches possible along interstate 80. if you're heading to the high country, watch out for a chance of snow showers. highs in the low 60s and north bay. mid to upper 60s to the south bay. today probably one of the coolest days we'll see over the next seven. skies clear tomorrow afternoon. patchy fog probably the main thing slowing down the morning commute. afternoon highs around san francisco. even 70 by friday. a much drier seven-day forecast. mid 70s by the end of the week after this last system clears through later tonight into tomorrow morning. very pleasant on the roadways. the roads are damp in some parts. not any problems on the freeways. you expect to see that early slowdown.

5:25 on monday morning. two san francisco supervisors plan to go to a rally for workers. it involves immigrant workers who have been told their last day will be november 7th. they work for hertz and say the rental car company plans to outsource its car shuttlers. the new company may or may not retire hertz workers. nbc bay area responds to a north bay man who feels ripped off by a kick starter campaign. >> our consumer investigator

joins us with this story. >> ron phelps invested money in a kick starter project developing a new headset called sound band. the campaign secured nearly 4,000 backers like ron and raised more than $500,000. sound band head sets were supposed to be delivered to the backers by yearened. problem is that was three years ago. they never received their sound band. ron is asking where did all that money go? >> the money for sound band, we have no way of accounting for it because nobody will tell us anything. >> we tracked down the creator of sound band. the $500,000 was spent legitimately and delays are due to personnel issues. tonight at 11:00 we'll go deeper. it stands on research and refunds which might surprise you.

>> speeds are not a problem. everything is normal. southbound 87. earlier crash i told you, one lane may still be blocked because there was an oil spill there. we are going to call that block because they do little slowing. back to breaking news right now we are following out of redwood city where we are getting reports of a business fire there. we are told firefighters on the scene of a two-alarm fire right at the intersection of brewster avenue. el camino is shut down in both directions right now. we sent a crew to the scene to gather more information. we just launched our nbc chopper. we'll bring you a live report in a moment.

schools across the country and here in the bay area are on heightened alert this halloween after several creepy clown sightings. one local school district is banning the costumes completely. kris sanchez with a precaution they are taking this year. >> good morning. you know as a parent we generally get notices in the backpacks about halloween costumes and guidelines, but this is the first time i can recall having gotten a notice that clown costumes are now on the banned list along with fake blood and weapons that are part of a costume. across the nation, police departments have been investigating incidents, people dressing in scary or creepy clown costumes approaching children or grown-ups. the union high school district sent a letter specifying there have not been specific verbal confrontations with clowns, but because there have been

inappropriate and sometimes threatening posts on social media, they banned clown costumes outright. san jose unified school district has done that in some of the schools. costumes have to be appropriate for school, but no clown costumes, no fake blood, no weapons. nothing extremely gory. parents have gotten notices. we know a lot of parents are talking about this. even the san jose police department responded and said steer clear of those clown costumes to be on the safe side. kris sanchez, today in the bay. 5:33. a man shot by police officers is still in the hospital. he used an rv to try to run down officers. there is some of the dramatic

video captured the moment officers fired on that man saturday night. investigators say it began when the driver had some sort of altercation with a park ranger who called police. police say the rv slammed into a row of cars during that chaotic moment and officers fired the suspect which happened to be near a house party that sent guests running for cover. >> we heard a screeching, a car screeching. my mom turned out the lights because she got scared. >> police expect the suspect who hasn't been identified yet to survive injuries. no police officers were injured. 5:34. wi with auto burglaries on the rise, police plan to be more visible. at least seven vehicles were robbed on tuesday night alone. burglars appeared to have been committed by the same person. police are asking the public not to leave valuables in their car. follow-up to a double homicide in sonoma county.

investigators are now releasing pictures of two suspects in this case. robert randolph and maria lebron are believed to have returned to the philadelphia area following that shooting. october 15th, the pair went to a house on highway 116 to buy marijuana after flying here from the east coast. at some point during that transaction, randolph allegedly opened fire and killed two people, injuring a third. 5:35. the sexual assault of a boy with down syndrome in a busy b.a.r.t. station. overnight police identified the suspect as a 38-year-old. police say it happened saturday night in a rest room at the pittsburgh bay point b.a.r.t. station. the man is accused of following the teenage boy inside the rest room and assaulting him. the boy's mother is credited with noticing something was wrong and alerting police who quickly responded and detained the suspect. other b.a.r.t. riders were stunned something like that could happen. >> it's weird at this b.a.r.t.

station. >> police say the victim was taken to a nearby hospital for evaluation. b.a.r.t. is reminding riders who use the rest rooms to lock the door and be aware of their surroundings. a richmond teacher accused of molesting several young boys is heading back to court. opening statement for ronald ginto's trial begin today. he recruited while he was teaching at a charter school in richmond. he was fired for making waves and fired at another school. he started planning an unauthorized trip to yosemite with new students. running for kate. a memorial race was held to honor the lives of kate steinly. steinly was shot and killed in san francisco last year by an undocumented immigrant in a case that prompted a national debate on immigration and anti-deportation policies. yesterday benefited two

in oakland near lake merritt. here is what we do know. this fire is burning around hanover avenue and leicester avenue at a construction site there. it is a three-alarm fire burning by lake merritt. here is another look here from our chopper of that fire. >> our chopper is just arriving to the scene getting closer to the site. it sounds like a construction site. as to what they were building, we don't know yet. that is an area you want to avoid right now. mike is checking to see how this will affect surface streets in that area.

remind you of safety tips to keep you safe this halloween. be careful with decorative contact lenses. many contain bacteria that can cause eye infections and business problems. some are made with lead-based materials absorbed directly into the eyes. you should not wear any contacts without a prescription from an eye doctor. if if you plan to use face paint with your costume, test them out ahead of time. dermatologists say many products contain fragrances and dyes that cause allergic reaction. apply a smaller amount to the inner arm. be safe when it comes to halloween candy. american association of poison control centers is reminding parents to inspect their children's candy before allowing them to eat it. throw away anything unwrapped or has tears or holes in the packaging. back to breaking news in oakland. this is a distant look at a massive fire by lake merritt. this is our coliseum camera.

we are getting more images from the helicopter as you see water and resources being poured down. we don't know what they were constructing there. looks like business, apartment complex, we don't know who the builder was. look at how it started is a mystery, as well. investigators on the scene of this one. firefighters try to tackle this from above and on the ground. mike, talk over this picture if you can. hanover avenue and lester off the beaten path? >> they are about two blocks away from lakeshore drive which is along the edge of lake merritt. this is not a residential building.

this is a big distraction because we were able to see it from quite some distance over the coliseum. this is west 580. let me take you to the maps and show you travel. light rain. what you expect everywhere except right there. you see that lake merritt mark there. that exclamation point is lester and hanover not far from 580. 580 on the closer side traveling away from the bay bridge. top of your screen would go in the commute direction. no real problems but this is a couple of blocks off lakeshore  drive. that will be an issue for folks in the area. as things get more crowded, will be a congestion point with smoke and activity. we'll track that. >> it's amazing to see how it's grown in the last few minutes we've seen there. take a look at the direction of the smoke as well. what do you think about that? >> we are seeing a bit of a southeast wind in oakland and

lake merritt. temperatures in the upper 50s. no rain but winds at times about 5 to 10 miles per hour. what smoke is moving away from this fire is heading off to the north away from that site. southeast winds close to 6 miles per hour. >> we are watching this develop live. thick black smoke right now at this construction site by lake merritt. at this point, it's a three-alarm fire. that could change. we are looking to get more information on the resources at play. how many agencies are responding here. this is a fire that has been going on for at least a half hour. we have just got on scene within about the last 10 or 15 minutes. we are keeping a close eye on the situation. >> we are hoping no one has been injured because it is a construction site. we don't know that anyone was actually living there. that is a tough fight for the firefighters out there. >> no doubt about that.

michigan will recee new water pipein light ofhe recent watrisis. it's expected 5:57. 00 homes will see new water plants. students at wayne state university will be testing the water at home before and after the pipes are replaced as part of a study funded by the national institute of health. california water agencies are trying to figure out if paying out the water basins has been worth the hefty cost. they spent $350 million over the last two years getting homeowners to cut water usage and remove lawns. water experts and utilities are gauging the effectiveness to learn how many water-dependent lawns have been removed and how much water the city has saved.
