this beginning with nbc's peter alexander. good morning. >> reporter: good morning to you. no matter what if anything new fbi agents find on that lap top, the fbi director's announcement has certainly put a jolt in this case. it remains unclear whether this will have any legal impact, but the political consequences are already playing out with donald trump hyping the news and hillary clinton and her allies criticizing director james comey's announcement as being overblown and wrong. after obtaining a search warrant over the weekend the fbi will begin pouring through a reported 650,000 e-mails found on a lap top belonging to anthony weiner and hess estranged waive whom who searching for e-mails related to the investigation in clinton's private server. with days to go before the election the fbi stunning announcement is igniting a fierce partisan brawl. the top democrat harry reid unloading on james comey in a

scathing letter. accusing him of possibly violating the hatch act that bars government official from using their position to influence an election. writing through your partisan,s you may have broke at any law attacking comey for having a double standard insisting he is in possession of quote explosive information about ties between trump, his advisers and the russian government. a claim trump and the russians deny. this is hillary clinton blasting comey for reviving the e-mail controversy providing few details in his letter to congress friday. >> it's the not just strange, it's unprecedented and it's deeply troubling. because voters deserve to get full and complete facts. >> reporter: former attorney general eric holder seems to agree writing in "the washington post" it's incumbent on comey or the leadership of the department to dispel the uncertainty he created before election day. sources tell nbc news the newly

>> america is tired of waiting, the moment is now. we're never going to have another chance. forget four years from now. it's not going to happen. >> reporter: the 21 million cast is a record. what is noticeable in some key states like florida and north carolina the early vote is up considerably, meaning it's likely one third of the expected vote has already been cast. back to you. >> peter, thank you. >> let's turn to pete williams working sources at justice. what can you tell us? >> reporter: good morning. fbi agents are beginning to sort through the newly discovered e-mails, it's a top priority for the fbi and while it could take weeks officials say there is some chance it could be over quickly. late sunday a federal judge gave the fbi approval to go through the thousands of e-mails written by huma abedin found on the lap top. they will narrow them to look at just those dating from the time

hillary clinton was secretary of state, and then they will weed out any that are not about government business. agents will use some automated software to search what is left for duplicates they have already found during the investigation of the clinton e-mail server, and any that remain will be checked for classified information. officials say there no way to tell how long this is going to take but if it does go quickly and in the event nothing classified is found, the fbi could say so within the next few days. it all depends on how many of the e-mails are duplicates and new to the investigators. the fbi faces new questions this morning about the time line for notifying fbi director comey about the e-mails. some officials say agents first noticed the e-mails earlier this month. and fbi officials says agents got weiner's computer to check for evidence of alleged sexting, then there was no urgency for that search, only recently the officials say that the potential significance of those e-mails became clear. >> pete williams with the latest

but in hours other leaks did that it's anthony weiner and huma abedin. did jim comey do more harm than good even if he felt what he felt and says was prudent. >> we're not ignoring you steve but to nicole you got to love washington, the very people, the democrats who are exstoling the independence of jim comey when he said i'm not going to prosecute are now saying shame on him, and the republicans trump who was ripping the fbi for its lackluster investigation now jim comey is a hero. >> why everyone says you want a friend in washington get one of the canine variety because they are the only ones that won't turn on you with the news. what we'll be tested. i know you'll get to this. what will be tested a week ago the same poll that has hillary clinton ahead by one had her ahead by 12. they are both wrong. she was never ahead 12, probably not in a one-point race. the polls will probably always about four to six points. what this is going to test is the durability of her lead going into the scandal. >> i'm going to get you up to

this week-long manhunt is over. this morning michael vance is dead, after police received a tip from a property owner that he had been camping out. as police feared he did not go down without a fight. overnight the manhunt for michael vance coming to a dramatic end after the oklahoma fugitive opened fire on police, not once but twice. >> about 8:30 this evening the sheriff of dewey county attempted to make a traffic stop on a white flatbed pickup. the vehicle stopped, the driver exited the vehicle and started shooting. >> reporter: the 38-year-old vance fled after that shoot-out and following a wild 25-minute car chase by patrol officers he exchanged in gun fire with police again. >> they confronted vance just north of here where there was a pretty fierce gun battle. ultimately vance was killed a it the scene.

>> reporter: wellston police officer james hampton was among the first to encounter vance a week ago taking target practice on tvs close to homes before turning his gun toward officers. >> i was thinking about a lot of things. >> like what? >> family. you know. i didn't know if i was going to see them again. >> reporter: vance shot hampton in his foot and another officer in the leg before police say he took off in a stolen truck and posted this taunting video live to facebook. >> this ain't a joke, this ain't a prank. >> reporter: he is accused of carjack jag a woman and murdering his aunt and uncle. police say vance had been acc e accused of sexually assaulting a child and that may have sparked his anger. >> it's a huge relief. not only for us but i'm sure for the public as well, this guy has been on a pretty bad crime spree

for the last several days. >> reporter: we are told this morning that that final gun battle with police was fierce lasting 20 to 30 minutes, the sheriff who was injured is expected to be okay. >> blake mccoy, thank you. italy's prime minister promising to rebuild after the most powerful earthquake to hit that country in more than three decades. the 6.6 magnitude quake struck about 100 miles northeast of rome on sunday, toppling historic landmarks. aerial footage shows the widespread destruction at least 20 people were injured, the region already struggling to recover from a series of quakes including one in august that killed nearly 300 people. frightening scene in virginia, 22 people were hurt when a car plowed through a crowd of fans leaving a nascar race a. driver was attempting to pass another vehicle and post-race traffic when it struck the crowd of people. nine people had to be taken to the hospital with non-life threatening injuries. and the driver of that car was

almost a week stranded and alone. what they do know is that the couple who found her probably saved her life. >> we've got a female. >> reporter: frantic calls for help. >> i don't know how she got up here but she's elderly woman trapped in a truck. >> reporter: a terrified samaritan calling 911. moments after spotting a woman trapped inside a flipped hummer, dangling near a cliff. >> the truck is half-way rolled down a hill and it's only being held there by a couple of boulders. >> reporter: firefighters raced to the scene, quickly realizing that woman had been trapped there for almost a week. >> the vehicle's been here for five days. the vehicle doesn't appear to have moved. >> she was in serious condition and she needed to get to the hospital as soon as possible. >> reporter: according to police, 69-year-old barbara mcfarren was driving through the mountains of san bernardino on october 23rd when suddenly she used her car's navigation system to contact 911. >> we're trying to make access

now. >> reporter: after an air and ground search came up empty, she was reported missing. that is, until five days later when a woman and her boyfriend spotted the overturned vehicle with mcfarren pinned inside. >> i mean in truth, if nobody found her, who knows what would have happened. i can't really speculate, but in the area that she was in, who knows how long it would have taken to find her. >> reporter: she was airlifted to the hospital. her life intact, thanks to strangers who called for help and the first responders who pulled her to safety. mcfarren remains in the hospital this morning in serious condition. but her niece tells nbc news she will go to rehab when she leaves and that her aunt has an amazing will to live. >> i would say so. that's incredible. >> amazing that they found her. morgan, thank you very much. now, al has a check of the weather. >> all right, guys. we've got snow to talk about in parts of california. this is the sierra.

harry reid doing battle, accusing comey possibly breaking federal law by telling congress so close to the election about new e-mails related to the inquiry into hillary clinton's private server. part of a complicated story that intertwines some of this year's most explosive political plot lines. here's the latest development. the fbi today has a warrant to go through e-mails found during a separate investigation into anthony weiner accused of sexting an underaged girl. the e-mails come from a family computer that weiner shared with his estranged wife, huma abedin, one of clinton's closest aides. the clinton campaign sees comey's move as purely political. >> you believe this could cost you the election? >> i don't think so. >> reporter: now clinton is demanding comey share more, to show these new e-mails aren't bombshells, but duds, maybe even duplicates of what the fbi already knows. republicans want comey to give more details, too, for a different reason -- to confirm their suspicion clinton did something wrong. though right now, nobody really

knows what the e-mails show and may not until well after the election. that hasn't stopped donald trump from trying to capitalize. >> now the fbi has found -- you're not going to believe this one. this one just happened. another 650,000 e-mails. i think that's called the mother lode. >> reporter: to his campaign, it's an october surprise that's surprisingly helpful with the race getting tighter in battleground florida, starting to catch up to clinton nationally just eight days out. and new this morning, a law enforcement source familiar with the investigation says abedin and her attorneys have told the fbi she didn't know these e-mails were on that computer. so will any of this move the needle with voters? we're taking a look at a new online "politico" poll taken entirely after the story broke that shows clinton with a three-point lead over trump, the same margin as before. so the bottom line -- this race is tight, but not dramatically

altered by this story. at least not yet. matt? >> hallie, thank you very much. a week long manhunt is over for a double murder suspect in oklahoma. during the night officials say michael vance shot and wounded an officer and then fled and led police on a half-hour chase in western oklahoma. he was later killed in a shoot-out. vance had been wanted on multiple charges, including the murders of two relatives and the wounding of two police officers. a week ago he had streamed live video of his getaway on social media. a desperate rescue effort is under way to reach 33 miners trapped deep underground in southwestern china. a gas explosion ripped through the shaft where they were working. their condition is not known. at least two other miners have been rescued. many of china's mines are outdated and are among the deadliest in the world. and an unusual moment from the nfl yesterday. this one is getting a lot of attention on social media. it happened during the saints/seahawks game down in new orleans. seahawks safety earl thomas

==vo== a massive fire thatestrod a development underconstruction in breaking news we've been following all morning. a fire destroyed a development that's under construction in downtown oakland. the fire started a little after 5:00 this morning at a building on lester and hannover avenue not far from lake merritt. at its peak, the flames could be seen for miles. some 200 neighbors in the surrounding area were evacuated. we just learned from firefighters that one neighbor injured their hand in that fire. so far that is the only injury that is reported. firefighters say it's too early to figure out what caused the fire. let's take a look at your traffic picture. >> good morning. as you said, that fire off lake merritt and freeway 580 was showing slowing as we saw smoke.

things calmed down as far as that spectacular flowing, back to typical commute, southbound, building slower speeds, past lake merritt, that's the fire off 580, park and mcarthur open, no affects on the major road but with all those evacuations we track that. across the bridges, slowest bridge bay bridge toll plaza has back-up. once you get towards san francisco, san mateo bridge looked better than earlier. the crashes, plural, have all cleared. back to you. >> thank you. more news coming up in half hour.

the dry ice will go around that. add bowling water to the dry ice. there you have it. >> how about the worms factor? >> worms, anything sort of gummy thing to make it spooky. gummy spiders are good, too. these are my favorite. homemade butterfingers. with candy corn. this is actually candy corn that you melt in the microwave for like 60 seconds because you don't want to burn it. if you need more time, do in 15-second intervals. now add peanut butter. i am not kidding, this tastes exactly like a butter finger. you just kind of go et this all mixed together. put it in a parchment lined baking sheet and let it harden in the fridge. once it is hardened, you cut them into little pieces and there they are right there. >> when do the chocolate chips go in? >> we'll melt the chocolate chips also in the microwave,

same thing, 30-second intervals so it doesn't burn. i like to use two forkses so then you don't get your hands all messy. you sort of flip them over. i'm not kidding, these are butterfingers. >> i got to try one of these. that's hard though. >> these have been in the fridge too long. if you don't put them in the fridge, they'll be kind of soft and choosey. >> can i have my tooth back? it's in there. >> then there is a slime cake also. it's basically just a boxed chocolate cake mix with pudding. that's the slime on the top. neon green food coloring. it kind of just gives off that oohy gooey slime feel. >> super cute. >> is there ever a holiday that's better for food coloring sales than halloween? >> i don't think so. >> siri, thank you so much.
