bay we're tracking a line of showers. that's the view over downtown san jose. the rain just starting to clear away from downtown. you see it on the radar view. this is the last line of showers passing through the bay area affecting the santa cruz mountains and south bay for the morning. high today mid to upper 60s. so far this morning, pretty good downpours on highway 17 near the summit. >> traffic and weather. what happens weatherwise, you see the green highlighting, wetter roadways, south of the san mateo bridge south of 92. towards the santa cruz mountains, southbound 17 reports of a spinout just came in. single car involved. no major injuries from what we understand. there's the slowing down toward the santa cruz side. travel times across the bridges. right now at your minimum times. 4:31. continuing coverage on a story we've been following since it

broke yesterday morning right here on "today in the bay." a fire still smoldering this morning. fire investigators stayed on scene overnight trying to figure out what smashed these massive flames. >> of course, those are the images from early 5:00 hour yesterday. "today in the bay's" pete suratos joins us. when the fire was at its highest, you were out there. now we're learning more about the apartment complex that burned. >> good morning, sam and laura. as you mentioned, still have crews here near lake merritt. here is the structure we're talking about, the five story unfinished structure that went up in flames. we'll show you that video from yesterday. you saw that structure up in flames. plenty of folks were outside. pieces of scaffolding and even embers falling onto nearby struck toors. the developer had plans to finish this project soon and it was about 80% complete. it was the security guards at

that complex that called the fire in, specifically there to keep squatters away from the building. we're also learning some residents in the area weren't exactly fans of this high-rise complex, claiming the prior tenants were moved out unfairly. >> a house of artists and performance artists, painters, people that have deep roots in the community and they were kicked out of that place. >> reporter: the city records we obtained indicate that the developer got the green light to build this five-story 40-plus unit building back in 2015. no word on where they go from here. we still have an oak lapd fire engine on site. they'll be in and out throughout the day. there's also federal agents with alcohol, tobacco and firearms that have been brought in to help out the arson investigators to find out what caused this massive fire. live in oak lapd, pete suratos for "today in the bay." we'd like to get to breaking news out of baltimore, maryland.

as you see from a distance, fire trucks on scene. this is a bus crash, a crash that involved a school bus and city bus. there's the aerial shots from earlier this morning. about 7:30 eastern standard time. you see a school bus which basically ran head on into a computer, driver's side front part of that commuter bus and everything crumbled. we know at least three people have died as a result of that crash. there have not been any students seen on the school bus, but it is not clear at this point what led up to the crash. as you can see, there is plenty of damage to both of those vehicles. again, a head-on collision from the school bus into the driver's side of that mta bus. and there is a local how self, mt. saint joseph college prep a couple blocks from where this happened. we're looking into the extent of the injuries. three people have been confirmed killed.

we'll update you when we have more information. 4:34. two trick-or-treaters are recovering this morning after being hit by a car while trick-or-treating in santa rosa. wet roads could be to blame. it happened about 6:30 at the intersection of rain dance way near meadowview elementary school. two young girls who were crossing the intersection were hit. one of the girls had to go to the hospital but is expected to be okay. two men are in jail this morning accused of beating a disabled homeless man to death in san francisco two years ago. a warning to you, some of the video you're about to see is graphic. 21-year-old josef sole and david peters were arrested yesterday. stole was arrested in idaho after dna evidence from another crime linked him to the killing in san francisco. peters was arrested in stockton, accused of beating 67-year-old ty lam to death. the homeless man was in front of a store on sutter street. we spoke to the owner of that

store. >> just hoping that they catch them. they were having fun killing a person. >> peters and stole are now facing murder charges. they're expected in court later this week. 4:36. we go to pacifica where police are looking for a man they say tried to kidnap a girl there. police say it all happened about 5:00 last night near hickey boulevard and fire crest avenue. that's right by sequoia high school. police say a young girl was walking when a man drove up right beside her and tried to force her into his car. she was able to run away. the suspect is described as an indian man in his 30s driving a black volkswagen with a texas license plate. political news, the election is officially one week away. the fbi right now working overtime not just on the hillary clinton e-mail scandal, but the fbi is also investigating donald trump's former company manager and his ties to russia. >> on the campaign trail trump

continues to hit hard on mrs. clinton's e-mails. the fbi director says more were found on a laptop belonging to top aid huma abedin and her estranged husband anthony weiner. so far no word on whether any of the messages are actually from secretary clinton. >> we can be sure that what is in those e-mails is absolutely devastating. >> why in the world the fbi would decide to jump into an election with no evidence of any wrongdoing with just days to go. >> in the meantime sources confirm the agency is also taking a preliminary look at the foreign business ties of donald trump's former campaign manager paul man ford. he denies receiving more than $12 million in cash from pro-russian politicians. despite the recent controversies, the latest nbc poll shows mrs. clinton's six-point lead remains virtually unchanged. we have something for drivers heading out on the roads. still a little slickness out

it has been a familiar sight, a comforting sight for so many people in the south bay for so long. now a san jose staple closing its doors for good. >> mel cotton's opened in 1946 when it was known for renting out tents to people. spending the last 60 years in san carlos and ray street. the owner says the building needed massive renovations. >> it's been in the family since i've been a kid. it's hard to see it go. we've been working at it hard, now it's time to shut it down. >> the owners say they plan to close sometime before the end of the year. i heard there's good deals there. i've represented many skis there, purchased jackets.

heading out across the bay. there you see the showers now leaving downtown san jose. the trend is drier, still a few lingering showers possible as we go through the morning. really not adding anything to the rain gauge the rest of the morning, but enough to wet the roads around the peninsula and south bay. gradual clearing today. a few hilltop showers possible around the south bay through about lunchtime today. the sky ts clear and our temperatures will be climbing into the mid to upper 60s. splooiz and the trend will be drier and warmer for the second half of the week. there we go. san francisco, close to 70 on thursday. the next chance of rain coming in we think late saturday night, early sunday. a weak weather system. we could see a few scattered showers saturday night into sunday. but a big pattern shift after all the rain we've seen, the next few days across the inland valleys by friday. mike, the morning commute, especially highway 17, santa cruz mountains seeing quite a bit of rain.

>> we had a spinout southbound 17 heading toward the summit. looking at the rest of your bay and the green highlighting you will still see for a bit. that is where the road weather index says there's going to be more slippery conditions over there. damp roadways throughout the bay area. a second spinout over here away from the berkeley curve. there was slowing off westbound 580 opt eastbound 580 -- eastbound 580 toward the berkeley curve. looks like they cleared everything to the shoulder. it will be an issue for folks, the slick transition ramps. drive times, 25 minutes out of the altamont pass toward the dublin interchange. we've got a live look at the san mateo bridge where we still have wet roadways, the sheen right there. just be careful. >> very good advice. >> wells fargo is agreeing to pay up and a pretty penny at that, all this to settle a racketeering lawsuit, accusing the bank of overcharging

charging thousands of homeowners after they defaulted on their mortgages. the customers were not aware because the higher fees were listed on their statements. banks can charge people for appraisals if they default. the suit claims they charged up to $120 when a standard appraisal for 50 or less. >> not an easy time to work in pr for wells fargo. guacamole fans, plan to pay up if you're planning on serving eight the world series parties. an avocado shortage is tripling the price from a year ago at this time. labor strikes in mexico and the o avocado off season are causing the surge in prices. hundreds of workers blocked roads in mexico to stop shipment. the workers claim that packing facilities pay less than $1.00 to pack it and more than $0.00
