good morning. the creepy saying a guy is expected of doing to a teenage girl in this neighborhood. what will freak you out the most is where this happened. i'm rick boone in pacifica. that story just ahead. still smoldering, a live look at what's left of an apartment complex in oakland after massive flames ripped through it yesterday morning. the investigation now under way to find out what sparked the fire. plus a break in the case. the suspect is now behind bars, accused in the brutal killing of a disabled homeless man nearly two years ago. >> i'm sam brock. yesterday was monday. that's in the books. tuesday, post halloween. kind of a slosh she start here. it's starting to clear out here, rob. >> seeing the last part of the storm come through. for the south bay and parts of the peninsula, still seeing a few showers crossing from northwest to the southeast. there's a few of the showers crossing to the peninsula and a few more leaving san jose heading down 101 to morgan hill in the next ten minutes. you see not much behind these two lines of showers as we see clearing skies as we head through the second part of the day. high today, mid to upper 60s, a much drier forecast ahead. a closer look at that in a few minutes. rain traveling through the south bay, so we will have the wet roadways damp, in most parts wet where you see the green highlighting likely slippery conditions. a fender better at 87 merge with 101. the spin out on highway 17 looks like it's cleared to the

shoulder as you head toward the summit. 13 minutes westbound off highway 4 to the maze. eastbound that spinout has cleared. scary moments for a young girl on the peninsula after a man reportedly tries to force her into his car. >> "today in the bay's" rick boone live in pacifica where it happened close to sequoia high school. i understand authorities are trying to find the suspect. >> reporter: they don't even know where this guy is at this hour. hopefully this report we can help track this guy down. it happened right where i'm standing at fire crest and hickey. as you said, near sequoia high school. this teenage girl tells us this guy was bold and aggressive, trying his best to get her in that car, and he did. this girl, it began with her walking down the street. he drove alongside of her and began honking his horn at her. he yelled at her to get in the vehicle. she didn't comply. so the suspect got out of his vehicle, grabbed this girl and forced her inside. the girl was able to run away

thankfully. we have information on the suspect, described as an indian male, 30 to 40 years old, 5'6", thin build with a trim beard. his vehicle, very detailed information here. a black volkswagen, newer, four-door sedan with tipted windows, very distinctive here, the car -- this volkswagen had texas license plates. i hope that some of this is ringing some information in people's mind. if you may have seen this guy. a big salute to that young lady, that teenage girl, she remembered all this. she remembered the texas plate, she remembered the vehicle, she remembered the description. so really good props to her and her family for teaching her how to have a good memory. that's what you need to do if you're in a situation like this. i did try to see whether or not there were officers around this area. not yet. certainly this is an area under alert. we don't know of any cases similar to this this morning. the search for the suspect, they need to know where he is.

they need to lock him up. live in pacifica, rick boone, nbc bay area news. >> no doubt there was a good description. thank you, rick. 5:04. breaking news we're following out of baltimore. take a look at this, a devastating sight. a crash involving a school bus and city bus. within the last half hour we learned there are at least three people dead. initial reports were that there were no students on that school bus. it's not clear at this point what led up to the crash. as you can see, there's so much damage to those buses. we will, of course, update you when we learn more. federal alcohol, tobacco and firearms agents are assistings oakland arson investigators as they try to get to the bottom of what caused yesterday's raging fire that destroyed an apartment complex under construction near lake merritt. we brought you the whole story as breaking news all morning long on "today in the bay." a live look at the damage that's been left behind in the wake of that fire, and the question now is did someone start the fire intentionally?

some neighbors oppose such a large development amid so many smaller complexes and family homes around lake merritt. others say that people who lived in the former property suffered a bad experience on their way out. >> a house of artists, performance artists, painters, people that have deep roots in the community and they are kicked out of that place. >> the $6 million, 41-unit complex was about 80% completed when this fire broke out and destroyed it, obviously burning to the ground yesterday. 5 k:05 this morning. two men in jail accused of beating a homeless man to death two years ago. 20-year-old joseph stull and david peters were arrested yesterday. they're both 21. stull was arrested in idaho after dna evidence from another crime linked him to the killing in san francisco. peters was arrested in stockton. they're accused of beating 67-year-old tai lam to death two years ago as the homeless man

slept in front of a store on sutter street. we spoke to the owner of the store. >> i'm just hoping that they catch them, because they were -- they were having fun killing a person. >> horrible. peters and stull are now facing murder charges. they're expected in court later this week. it's 5:06 right now on your tuesday. six teenagers have been arrested for a string of robberies that happened in antioch and brent wood. police say the robberies began after 8:00 on sunday night by a group of 16 and 17-year-old boys in ski and clown masks. police say the boys were armed after robbing a pizza delivery man. then they robbing a woman outside their home. that woman saw the license plate and called police. as an officer drove after the boys, they were tossing items out. the officer stopped the car and arrested all six. this woman has been dubbed the head band bandit.

the agency says she robbed a wells fargo in the laurel heights neighborhood of san francisco at gunpoint last thursday. she took an undisclosed amount of cash before running off toward california street. another postponement in the sierra lamar case, addressing whether she may have run away. lamar disappeared on her way to high school in morgan hill four years ago. antolin garcia torres is accused of murdering her and hiding her body which has never been found. he's linked to her disappearance through dna. his attorneys claim she was a run away. prosecutors claim the notebook was taken from lamar's school locker after she disappeared. yesterday the judge post poped ruling on the notebook until next month. bill cosby appears in court this morning. janice baker kinney of petaluma says she first met the legendary comedian bartending at a reno

hotel. she adds that cosby invited her and a friend back to a house he was representing. it was there that kinney claims cosby gave her drugs and sexually assaulted her. now kinney is among 13 of the roughly 60 accusers that prosecutors are preparing to testify. cosby's lawyers say none of the whoim who filed police reports at the time will ask the judge to keep them off the stand. toxic algae could be affecting bay area sae seafood. high levels of blue-green algae in mussels around the bay. they say the bacteria is still being found in the bay in some locations as many as three-quarters of the mussels are testing positive. researchers say the algae is enough to make people sick but they're more concerned about what it means for animals who eat shell fish.

good tuesday morning. time is 5:08. 60 degrees in oakland, seeing showers. part of your eastbound commute south of downtown oakland, a few more clearing san jose approaching morgan hill here. this is the last in the line of showers which came through right around trick-or-treat time. not much behind these two lines of showers. the trend certainly drier as we go through the day. still a chance of a lingering showers around the hilltops. after that, partly cloudy skies and temperatures climbing into the mid 60s in san jose. 64 closer to san francisco. the trend ahead is actually drier and warmer now for a change into the week. san francisco close to 70 degrees. valley temperatures climbing into the mid 70s, by friday, next chance of showers early on sunday. >> we've had a lot of smaller crashes over the last hour after that rain system comes through. be careful at those transition ramps. that's where the green highlighting most likely will find the wet roadways.

year. more than a half foot, more rain has fallen in the north bay compared to last year. catching a bit of a break. north bay 55 degrees. you can see the showers passing san francisco over to oakland, parts of the peninsula commute and earlier around san jose, mountain view had good downpours, that crossing to the southbound towards morgan hill. highway 17, heading off to the south and east. by around noon, notice the hilltops. still enough moisture we could see showers south of the sunol grade and around highway 17. by the afternoon, clearing skies and temperatures today climbing into the mid to upper 60s. so early morning showers shutting down as we go through the day. from here the forecast is actually going to trend much drier, high pressure making a comeback wednesday, thursday and friday. warming temperatures through friday. next chance of showers showing up late saturday and sunday. the rain totals not nearly as much as we've seen for the recent storms of the last two weeks. the forecast moving forward, san

pocket. >> consumer investigator chris chmura describes how she did and how you can, too. courtney resnick wrote us after her trip was delayed 27 hours. the plan was to fly from sfo to iceland and land saturday. that flight was canceled. courtney didn't arrive in iceland until sunday. she and her husband then had to eat more than $3 o 00 in prepaid lodging, plus $78 on extra leg room seats because the airline swapped planes. european union rules require compensation for flight disruption. she filed a complaint, but it went nowhere. so she called us. after we wrote on her behalf, that claim was approved. courtney's compensation totaled $1434.66. here is why it was so much. airlines that are based in the eu must pay passengers as much as 600 euro, up to $650 each when flights aren't on time.

agency. train number one no longer has a status listed. three reports on time. if you take ace train, check with your ride. there may be something going on. back to you. thank you very much. we go to breaking news this morning out of baltimore, maryland, a story we've been following since we came on air at 4:30 this morning. in just the last few minutes investigators on scene of a horrific crash as you see there say there are now six fatalities in the crash that happened between a school bus and a city transit bus. they're also saying there were no children on board that bus. it's not clear at this point what led up to the crash, but as you can see, there's a lot of damage sustained to both vehicles there. we're still monitoring news conferences out of baltimore. we're told the baltimore police department is going to be updating the media. we'll have more information as soon as we get it. >> a really horrific crash. 5:32. continuing coverage of the story we've been following.

this fire burned yesterday morning but still smoldering this morning. fire investigators stayed on scene overnight trying to determine what sparked the massive flames in oakland. "today in the bay's" pete suratos was there when the fire was at its highest. now we're learning more about the apartment complex that burned. pete, what can you tell us? >> reporter: good morning, laura and sam. a much different scene almost 24 hours later when folks were lining the streets as this unfinished structure went up in flames, roughly around 5:00 a.m. just yesterday morning. we have video of the flames. you can see the pieces of scaffolding and embers falling opt the sky and nearby structures. we have learned some things since yesterday. the dwoerp had plans to finish this $ million, 41-unit project fairly soon. it was about 80% complete. also, there were two security guards at the complex who called the fire in, specifically there to keep squatters away from this

building. we're also learning that some residents in this area weren't exactly fans of the high-rise complex that was proposed to be built, this es denl area in oakland, complaining that prior tenants described as local artists were kicked out unfairly. still this fire proved to be too close for comfort for residents in hereby homes. >> i felt the heat, it was like a hot summer day. >> reporter: city records indicate that the developer got the green light to build this five-story structure in 2013. no word exactly on where they go from here. as you can see right now, taking a live look. an oakland fire crew has been here for the past 24 hours. alcohol, tobacco and firearms have been called in to help arson investigators to determine the cause of the fire. live in oakland, pete suratos for "today in the bay." >> pete, thank you very much. now a developing story. there's always concern for parents on halloween night e

specially in the rain. those concerns were realized last night. two trick-or-treaters were hit by a car in santa rosa. the wet roads could be to blame. it happened about 6:30 at the intersection of rain dance wayne and tucks horn drive. two girls were hit, one girl has to go to the hospital but is expected to be okay. 5:35. in pacifica police say a man tried to kidnap a girl about 5:00 near hickey and fire crest avenue near sequoia high school. police say a young girl was walking when a man drove up beside her and tried to force her into his car. she was able to run away and get a suspect description, an indian man in his 30 's driving a blac volkswagen with a texas license plate. police say they now have two of three suspects in custody

after this brutal killing of a disabled homeless man in san francisco. "today in the bay's" chris chan chez is live with what led authorities to those suspects. kris? >> reporter: good morning, sam. it isn't what those suspects did on camera and captured on video that led to their arrest. it is something that they left behind at the scene. as you mentioned, it is gut-wrenching video that september san francisco liss on the trail of them. the video was released in search of clues nearly two years ago. three men beating tai lam to death as he slept on a san francisco street. when the suspects left that disabled man to left on the street, they also left behind their own dna. that was a match with a theft case out of idaho. that dna connected 21-year-old joseph stull and 21-year-old david peters. the arrest is a relief both for those who knew the victim and

those who did not. >> i just hope they catch him. they were -- they were having fun killing a person. >> it did not matter that he was homeless. this is someone's son, someone that had a family, someone that was unjustly killed at the hands of others. >> reporter: investigators are still looking for a third suspect. the two men in custody face murder charges along with a long list of other crimes. they are due in court tomorrow. kris sanchez, "today in the bay." >> thank you very much, kris. 5:37. an east bay police department will be starting a year-long program to try to prevent traffic related deaths and injuries. the pittsburg police announced they received a $70,000 grant from the california office of traffic safety. the grant will help fund special traffic enforcement and crash prevention. the number of people killed and injured in crashes has slowly been rising since 2010, especially with bicyclists and pedestrians. the battle is still brewing

on whether the 9ers are going out of bounds, so to speak, to skirt reimbursement for the city of santa collar rah. the team may be breaking city law to use taxpayer money for public safety cost at levi's stadium. the mayor wonders if the city is getting its full share on events like a recent taylor swift concert. the team insists it is playing fair and yesterday handed over budget documents requested by the city with more on the way later this week. >> is it supposed to be two million or ten million that the city is receiving from the stadium? we don't know until we see the upped lying financial documents which they have failed to provide for 2 1/2 years. >> if those bills have not been managed properly, then they need to send us a new invoice and we will pay it just like we pay every other bill that comes to us. >> you heard from santa clara mayor lisa gill moore who says the city is preparing to take over the management of the stadium if the team doesn't promptly hand over the

documents. bad news for people trying to save the willow glen trestle. the california supreme court just announced it will not look at the case. last month the trestle was denied eligibility to become a historical site. the case will head back to the trial court. good tuesday morning. right now 5:39. san jose, wet roadways, not from the rain that's falling right now, but what fell within the last half hour. you can see the rain now moving down towards morgan hill and a few scattered showers into oakland, really the last weather system. between now and noon, south bay hills, still a few isolated showers. the trend, though, clearing with partly cloudy skies and highs climbing to the mid to upper 60s around the south bay. high 68. 65 santa cruz. 64, and the trend ahead is dry

scattered showers through 12:00. as drier air comes in, that will help clear the clouds, temperatures climbing to upper 60s around walnut creek and san jose. about 65 degrees in santa cruz. big pattern change for the second half of the week. notice the high coming back to california. that's going to lead to warming temperatures. it will weaken some by saturday and sunday which may bring us a chance of mainly light rain showers very briefly saturday night and sunday. in the meantime, after the morning showers clear, the rest of the workweek looks dry and warmer. certainly across the valleys, going back into the mid 70s by thursday and friday. then the clouds roll in with a few light showers heading through next weekend late saturday into sunday morning. mike? >> all right, rob. despite the damp and slick roadways in some patches, a calm morning after the earlier crashes all cleared up for the most part. we had some spinouts. the issue here is not a spinout in san jose, but a minor crash are southbound 101, typically an easy drive. right at tullie we see the
