voters head to the polls to determine who will be our president for the next four years. a live look at chappaqua, new york, where hillary clinton is expected to vote any minute now. she has just walked in saying hello to some of the election workers there and some of the folks excited to see her vote for herself clearly. >> obviously former president bill clinton by her side as well, hillary clinton going to the polls shaking some hands this morning before actually casting her ballot. again, this is in chappaqua, new york, about an hour north of new york city. it's where mrs. clinton's primary home is. she's doing her civic duty as millions of americans will today as well. big day. a lot of polls starting at 7:00 eastern time, 4:00 our time. >> she is going to be joining millions of others who will watch the results coming in. donald trump is watching from new york as well. we expect 4i78 to vote a little later this morning.

we'll bring that to you live, hopefully it will be possible to catch him in the moment. >> both candidates at this point, they've laid out their cases, made their arguments. we have team coverage before you head to the polls this morning. let's start with nbc bay area anchor raj mathai in times square. >> reporter: it is super tuesday in a big way. good morning to you on this election tuesday across america. we're coming to you from times square. now, just like the bay area here in new york city you can feel the excitement. you can feel the apprehension and anxiety. no one quite knows how this election is going to turn out. here is what we do know. later today hillary clinton will check into her headquarters for the night. that's the javits center a few blocks from here. since 1944 both presidential candidates are based here in new york city. it's pretty interesting because politically speaking hillary clinton and donald trump are worlds apart. but geographically they are just a few blocks apart.

the incident was reported to the athletic director before being turned over to police. since we're talking about minors, the names are not being released. >> they're still looking into that, the number of terp praters and victims, they're still investigating that. >> reporter: we got a statement from the berkeley unified school district and they said, quote, we take good sportsmanship and behavior seriously but cannot comment on any specific case of student discipline. the spokesperson went on to say they might release more information on the case later today. we're live in alameda, pete suratos for "today in the bay." a turf war is brewing the south bay. santa clara is reportedly suing san jose to stop plans for developments near santana row. chuck coppola is there live with more on what this is all about. >> good morning, kris. behind me you can see the likes

of santano row, they want to expand by building a million square feet of office space and six new buildings that would completely take out the old century 22 and 23 theaters. we have renderings of the development. however, the city of santa clara has filed a lawsuit to block it citing traffic concerns. san jose city council says there are millions built into the plan to improve transportation routes. that's important because, as most of us know, this is a very congested area already between stevens creek and moorpark. there may be more to this about retaliation, about a different development, a development in legislator according to rich robinson quoted in the "mercury news." retaliation he says for a lawsuit filed by san jose to block santa clara's city space development by levi's stadium. san jose says the $6.5 billion

project would have office space for 25,000 workers but only housing for about 13% of that. a common problem in the bay area. a lot of places to work, not a lot of places to live. live in san jose, chuck coppola, "today in the bay." at 5:09 we're seeing temperatures in the 50s, even as warm as 60 to start the day in oakland, mainly clear skies except into the north bay. santa rosa visibility down due to patchy fog. 76 in san jose and low 70s from san francisco to oakland. the trend will corporate as we go through the next two to three days, friday increasing clouds and a slight chance, looking at light rain showers, mainly far north bay. that's going to be late friday night. and then saturday and sunday temperatures rebountd again for the weekend. mike? >> an easy drive right now, nothing stopping folks from getting to the polls, but the polls aren't yet open. we'll keep track of it.

the forecast for american canyon, patchy fog slowing things down at times for the morning commute. >> looking at the tri-valley, a little build of traffic out of the altamont, 23 minutes from grant line to 680. the north bay, patchy fog but no slowing, eight minutes from novato down to the richmond san rafael cutoff. election day is here, decision 2016. we have you covered. two measures on the ballot that involve plastic bags. proposition 65 would redirect the money collected by stores when you purchase the bag, and that money would go into a special fund to support environmental projects. supporters says this prevents grocers from profiting off those bags. opponents say it is designed to confuse voters and distract from the real issue which is to phase out plastic grocery bags altogether. prop 67 would approve a state-wide ban on single-use plastic bags which many of our

communities already have. supporters say it keeps communities cleaner. opponents say consumers will have to pay more for the bags. more of our election day team coverage in just a moment. in the meantime, cutting the cord in lieu of video streaming services may soon cost you more money. >> you thought you were getting this good deal. there could be some a added taxes involved, this is referred to as a netflix tax. some cities including chicago have already approved them under the amusement tax umbrella. the "mercury news" reports almost a dozen are considering a variation of the tax. some internet advocacy groups continue to question the legality of those kind of taxes. in the meantime you will be able to get netflix on cable. >> scott mcgrew, the opposite of cord cutting. >> it is. it starts next week for comcast xfinity customers. we've flown this is coming for a

yellow today. lots of sunshine in store. >> we're going to see temperatures climbing maybe close to 80 degrees which, if we can match that in some cases, that would be as much as 15 degrees above average. right here in san jose, clear skies. we'll be watching for patchy fog forming in a few spots around the bay area. not seeing much around the santa clara valley. the exact same temperature for now. 57 degrees. san francisco, seeing temperatures in the upper 50s, a few high clouds and speaking of clouds, it's the low-level variety. we're watching in santa rosa, visibility, down to about a mile. in between now and 7:00 this morning, we'll watch with the patchy fog, especially in the north bay valleys and we'll see if it comes back around the south bay later on. strong storms to the west not bringing rain, but all the winds in the storms pushing through. arriving today into wednesday. friday looks like another surge heading towards the coast. what it means these temperatures warm up and you want to enjoy some of the sunshine. use caution.

we'll see wave heights approaching 15 feet offshore which should mean breakers at 20 feet or higher around tiller point and points northward through the day tomorrow. now highs today will be in the mid to upper 70s around san jose. high clouds at times. 76 in san jose, 78 in los gatos. campbell will see numbers in the upper 70s. danville upper 70s, walnut creek similar temperatures, 75 around antioch for today. you'll notice clouds on the en crease as we go through the day on friday. this is our next rain chance and a pretty weak one at that, friday night into saturday. most of the computer models have pulled the rain off the board. what we'll get on friday will be en creasing clouds in your seven-day forecast. a bit of a cooldown, especially in san francisco as we approach the weekend. notice those temperatures rebounding again. that one chance of rain looks not so much right now. we'll see a few sprinkles early saturday morning. now the weekend mostly dry and trending warmer early next week. >> rob, you're the bearer of good news. a nice flow of traffic.

who has been trying for six years to claim some unclaimed property. >> consumer investigator chris chmura helped her out. he's here now to say how he did it. >> donna rolfe randomly claimed an unclaimed property side in 2010 and discovered she was owed money from her deceased father's wells fargo account. she contacted the bank. it told her the check was september years ago. she never received the check and asked for a copy of it, a copy she says she never received. donna has tried for six years to collect the money with no luck. that's when she called us. we reached out to wells far go and donna received the $570 she should have received from her dad years ago. in a statement wells fargo did not explain what went wrong. but it did say we are pleased we were able to resolve the issue for ms. rahlfs. if you have a consumer complaint, you can call us. the number is 1-888-996-tips or visit nbcbayarea.com/responds.

extra time in case there is a long wait. there was yesterday. this was the scene yesterday in san francisco, and further south in san jose early voters waited in long lines, some for as long as 30 minutes in the south bay to cast their ballot to ma-- th u.s. department of justice sent out more than 500 civil rights monitors to 67 jurisdictions in 28 states. this includes locations here in alameda county and up north in napa county. again, polls open at 7:00, they'll be open until 8:00 tonight. check the back of your sample ballot you received in the mail for your polling location. if the polls close, you can vote as long as you're in the lien by 8:00. if you're a registered voter but your name is not on the list, you have a right to vote. you have to use a provisional ballot. they'll be counted once officials confirm your

polling place. now it's really up to the voters. we wait to see donald trump whose headquarters, by the way, is just about 20 blocks from now. he's going to be voting later today. today it's over in terms of the campaigning. they wrapped it up last night. clinton in north carolina, trump in michigan tuesday set to make a difference in this campaign. now they youft have to wait probably on pins and needles to see what the voters have to say. you were talking about the justice department being out there, spanning out across 28 states to make sure when people show up, the voter i.d. laws are applied appropriately, they're given those provisional ballots and they have allowed to vote if they're standing in line when the polls close. we'll be watching them close on the east coast, moving across to the west coast when your last voters get a chance to exercise their rights and hopefully before the end of the night on this stage and across town, we'll either see a concession speech or a victory speech, one

or the other. >> got to go one way or the other. thank you very much, tracie. from the clinton campaign to donald trump's campaign in a little over an hour, he is expected to cast his vote. he's going to be in manhattan. that's where we find "today in the bay's" sarah rosario. after a frantic day of campaigning, trump made his final bid to energize support. what do you think? did it work? >> reporter: we'll see. we're told donald trump is expected to be voting here in the next couple hours. you would think he would be resting after campaigning in five states yesterday alone, ending his campaign early this morning. but here outside of trump tower we have police officers and countersecurity terrorism officers blocking off the street all in an effort to make sure people stay safe. meantime, trump ended his campaign in michigan early this morning. michigan is a critical state

charged with killing the 21-year-old. jodi hernandez was the only reporter in the courtroom as the two faced a judge for the first time yesterday. investigators say the couple stabbed her and set her on fire at park in oakland. according to court documents, rogers confessed that she planned that killing for several days. prosecutors say her boyfriend admitted to helping her, but the motivation here is unclear. both suspects are being held without bail. new details in the stabbing death of a homeless man in san jose. these two men are now behind bars in connection with the death of jeffrey cooper back on october 10th. randle sandoval and alvarado are from san jose. police say they found the victim unconscious near a lowe's home improvement store. he later died. investigators are piecing together the details. . good tuesday morning. 5:39.

our main weather concern, high surf. powerful storms causing a high surf advisory. wave heights now eight feet, but those could couple as we head into the evening. breakers 20 feet possible late today into wednesday. high temperatures mid to upper 70s in the range for the santa clara valley. more or less, not much change temperaturewise through thursday. we'll get more clouds friday, but less in the way of raindrops. a weak looking weather system there, may bring a few sprinkles tipt north bay friday night and skies clear for the weekend. the bay bridge toll plaza we have the backup because the metering lights are on. over here we have reports of a disabled vehicle westbound 24. it's been there for just about six or seven minutes. haven't seen any slowing, so in problems off the walnut creek interchange. a note for folks headed towards the caldecott tunnel. from 880 to marina boulevard, nine minutes into downtown.

supporters say it would address income inequality. opponents say it leaves unanswered questions including when they have to notify those employees about available hours. voters also deciding on a tax increase today that would provide vital services to the city. measure g would change the city's business tax. the base tax would increase from $150 te $195 starting july 1st. that would raise an additional $12 million every year for police services, emergency response and pothole repairs. >> continuing coverage of the killing of a young man whose body was found buried on the sonoma state university campus. this is what his bicycle looked like. investigators are looking for it. it is a white man's 2001 cannondale quick mountain bike. police say the bike belonged to 18-year-old kirk kimberly, the victim, who was found stabbed to death and buried on the sonoma state campus last week.

anyone with information about the bicycle is asked to call the sonoma county sheriff's department. >> after a very disturbing scene yesterday, three people hit by a driver outside an east bay court are expected to make a full recovery. this is cell phone video from the scene there. police say a woman ran down her estranged husband and his two friends as they were leaving a family court in martinez yesterday. the woman then threw her car into reverse and hit one victim again. she then drove to the benicia bridge and took her own life. we're hearing from family members of one of the two men killed in a double shooting in hayward. we first brought you this story yesterday as breaking news on "today in the bay." now we're getting more information. this shooting happened at the intersection of rancor place and main land avenue. a woman who says she's the niece of one of the victims says she tried to save them. >> i was saying don't go, please just stay awake, don't close your eyes. we're all here. wait for the ambulance, please

just breathe slowly, but it was no use. >> there's a lot we're still working to try to confirm at this point. police have not released the nams of the victims. new this morning, san jose police are taking steps to boost safety on the roadways in the south bay. according to the "mercury news," the police department was awarded $a $300 grand to reduce traffic collisions over the next year. a lot of that money will help police boost staffing at dui check points an increase street enforcement. some of the money will also go to education safety campaigns at schools for younger drivers. caltrain passengers can give input on bike parking issues this week. you can take an online survey starting tomorrow and give your opinion on different bike parking options at caltrain stations. this is part of caltrain's bike parking management plan. the goal is to make it easier for cyclists to use caltrain. back to the elections, here is a reason to go out and vote today, the new escape alcatraz

for two rounds of high surf, one coming in today into wednesday and another one on friday. what it means is a high surf advisory gets under way. wave heights eight feet. those could double as we head towards this evening, breakers again could get above 20 feet at times late today into wednesday. in terms of cloud cover, patchy fog, not much going on during the day. towards sunset increasing high clouds in the south bay and coastal low clouds making a comeback west of the golden gate. high temperatures today santa clara valley mid to upper 70s, lots of sunshine, increasing high clouds later on. danville, 79 degrees. you can see in pleasanton 78, 76 in concord. peninsula temperatures in the mid 70s and around downtown, san francisco, could see low 70s south of downtown into the north bay, patchy fog for the morning and low to mid 70s this afternoon. so the next chance of rain we're talking about unfortunately looks weaker. there it goes friday night into early saturday.

tied to t tied. no charges will be filed against a ucsf surgeon arrested on drug charges. christopher owens was arrested on suspicion of prescribing and selling opioids. yesterday prosecutors say the case is still under investigation. he worked at the university affiliated veterans affairs medical center until ucsf fired him last week. a new discovery in the case of a man now linked to seven deaths in south carolina and a grisly kidnapping case. authorities say a third body has been found on the south carolina property opened by todd kohlhepp. he's accused of killing a man and kidnapping his girlfriend who he kept kidnapped in a shed for weeks. he's been charged with the deaths of four people at a motorcycle shop 13 years ago.
