one more chance of showers showing up later this morning. we'll have a look at the timeline on that. to see what's happening with your morning commute, here is mike. >> a nice way to wake up in the north bay. no delays or problems. over in the east bay we're tracking this continued evolution of this one crash over off the dumbarton bridge east 84 before you get to the 880 connector. waiting for the tow truck. a car? the bushes. no injuries reported. getting across the other bridges, just a little slowing, a few folks on the incline for the bay bridge. an update to breaking news we're following overnight. this is all that is left of a duplex in the south bay after flames just gutted it. live pictures from the scene in san jose this morning where it was just a mess. you see coaches pulled out. we understand firefighters had to rip off the garage door just trying to get inside the home to tackle those flames. this is exactly what it looked like just a few hours ago. those massive flames i was talking about shooting through

the roof and windows. it happened on cypress avenue not far from san thomas expressway and stevens creek boulevard. the good news, all three people inside were able to make it out safely with a pet. >> fairly well involved fire. upgraded to a second alarm and committed resources to search to make sure there was nobody still inside, and then control the fire to prevent nearby houses from catching fire. >> one pet survived as i mentioned. a second one is missing this morning. kris sanchez is at the scene gathering new information. she'll join us at 5:30. two people were hurt and nine are without a place to stay this morning after this two-alarm fire damaged three structures in san francisco last night. it happened in the ex-elseier neighborhood just before 8:00 on

brazil neighborhood. flames were knocked down about an hour later. we're told the two people hurt are expected to be okay. the red cross is assisting all the people who are without a home right now. a celebrated transgender who made national headlines back in the '90s is now accused in a gruesome triple murder. today she'll face a judge for the first time since being arrested. >> "today in the bay's" bob redell joining us live in oakland with the disturbing details of this case. good morning. >> reporter: good morning, sam and laura. in a few hours dana river is expected at alameda superior court in oakland where she could enter a plea in the charges against her. the d.a. has charged rivers, 61 years old, with a killing of three people at a home on dumbarton drive in oakland. when police arrived, they say they found the garage on fire and rivers covered in blood with a knife, brass knuckles and

ammunition. the charging document indicates rivers allegedly stabbed two of the victims and shot all three of them. terry mcsweeney discovered that rivers is licensed as a security guard and licensed to carry a weapon. law enforcement has not released a motive or explained what led up to those murders, because of the special circumstances surrounding this crime, rivers could face the death penalty or life without parole. >> achieved success everywhere in my life, but underneath it i was miserable because i hadn't come to terms with this piece of me. >> reporter: that was dana rivers from a number of years ago. she was born david warfield and used to teach school in sacramento. in 1999 she gained national attention when she was fired for explaining to students her gender reassignment surgery. nbc bay area spoke to someone who answered the door at rivs' address in san jose yesterday. this person said she is shocked

san jose city college. she says she's being targeted because she's a trump supporter. she carries pepper spray. the faculty is calling for students to treat each other with respect. students and faculty at an east bay college are weighing in on the subject of president-elect trump and his immigration policies. they're urging st. mary's college to become a sanctuary campus. that request came out in the form of this letter signed by dozens of students, faculty -- staff and faculty asking the administration what it would take to make the campus a sanctuary city. some students are in favor and others are not. >> i think it's just nice to have something that sends a message that we're in unity. we're together. >> we do not need to be offering a safe house to people who shouldn't be here in the first place. >> there should be another set of people here legally.

>> administrators responded to that letter by saying they take the safety of all community members very seriously. >> a fight not just on the field but at city hall. it's the 49ers versus the city of santa clara. last night the 49ers were put on notice. the mayor doesn't think the city is getting their fair share. the city could take over management of levi's stadium. the 49ers are working with a third party auditor to provide the documents. >> just look at the contract. give us what's required in the contract for the last 2 1/2 years. >> it has sensitive information regarding the security systems for the stadium that it is not appropriate to be in the public realm. >> the team says it does not want to make the documents public because of pro pry tear information and could cost the team and city revenue from competing promoters. happening today, opponents resume their battle to halt the

president-elect trump, it explains silicon valley positions on encryption and net neutrality. the obama administration is thinking about jobs and specifically how to find jobs for all the people leaving in january. president obama has asked linkedin and facebook to come in to the white house and recruit and explain the job market to outgoing staffers, and they are outgoing. the staffers leave with the president, not the cook and the garden ers but the office workers. the "wall street journal" reports the incoming president didn't realize that. the head of linkedin jeff weiner says he thinks 5 million jobs will be replaced by robots and technology by the year 2020. that's a little more than three years away. snap chat has filed the papers for an ipo. several news outlets are quoting insiders saying the company filed confidential papers with

look at the north bay temperatures. 30s and low 40s into sonoma county. we'll probably see more of that in the tri-valley and areas south of san jose. on the radar view, coming around 11:00 this morning, a slight chance of scattered showers as we approach lunchtime. you see it offshore moving down the coast. partly cloudy skies, breezy and it will feel cooler outside as some of that canadian air conditioning. temperatures in the mid 60s around san jose, toward the tri-valley. peninsula temperatures in the low 60s, slight chance of a midday shower around the peninsula hilltops. san francisco low 60s and more low 60s in the north bay. let's move forward to the temperatures we expect tomorrow morning. here's to it in's lows. notice the better chance of 30s tomorrow morning which means pocci frost possible for your thursday morning commute. the weekend, a rain event. stay tuned to the forecast.

next time you're in vegas, it will cost you more for the hotel room. clark county leaders have approved a new hotel room tax to help fund construction of the football stadium planned for the raiders. the room tax is needed to cover $750 million in public financing. nfl owners have not approved the raiders move, but it may happen as soon as january. >> a lot of history, you can always expect the unexpected. one thing is a given between stanford and cal this weekend. the stanford band will not be on the field. it won't be in the stadium for that matter. ♪ >> stanford's band and its

"today in the bay's" kris sanchez joins us live from the scene with more on the frantic efforts from firefighters to try to douse those flames, kris. good morning. >> reporter: good morning, sam. the flames are gone. the firefighters just rolled out of here in the last hour or so. you can see the destruction that remains behind me. the roof is completely gone over

one of the two carports, connecting the two duplexes on cypress way. the fire burned through the roof. a classic car in there completely destroyed and both the homes are uninhabitable. this is what it looked like when the fire was first reported about 12:40 this morning. the san jose fire department says not only was the one duplex on fire, it thenned the other duplex on the other side, the structure in the back was fully engulfed and threatening another home behind. three people were inside at the time, likely sleeping. it was 12:40 in the morning, but they managed to get out along with a pet. >> thankfully, due to the volume of fire, the residents got out on their home. i'm hoping the smoke detectors played a part in that. >> reporter: there is another pet that is unaccounted for, maybe inside or perhaps got out in the chaos of the fire, but the fire department cannot say. there's a for sale sign out

here. we do know the owners had this home on the market. it was listed at around $800,000, so the timing very difficult for the owners of the duplex. also, the fire department says there's a good chance the reason these three people were able to get out with their lives is because their smoke detectors alerted them. they always remind us around the time we change our clocks to change the batteries in our smoke detectors. if you haven't done that, this may be a good time to try. >> thank you very much, kris. 5:33. new details in a grisly triple homicide about who is accused of committing the heinous crime. authorities identified a woman facing charges as a former teacher who made national headlines when she lost her job following gender reassignment surgery. authorities in oakland identified the suspect as 61-year-old dana rivers. police say she stabbed and shot three people at a home on dunbar drive. they say the garage was also set

on fire. rivers was once a sacramento teacher whose dismissal made national headlines in the 1990s. she's scheduled to be arraigned this morning. three men are under arrest in berkeley for allegedly trying to rob another man by the cal campus. berkeley police say they recovered this gun, you see it right there under the suspect's car seat. the victim says he was walking just south of cal's memorial stadium when he noticed a group of people get out of a parked car. the suspects chased that man who managed to call police. the men got back into the car, took off. but a responding officer pulled them over not far away. in san francisco where police reforms are under way, many undocumented immigrants say they're afraid police are round them up to carry out donald trump's deportation threats. a joint meeting at the police commission and board of supervisors, they say they're afraid of the so-called trump effect. >> i've been harassed because i

"today in the bay's" pete suratos joins us. this stadium is not a done deal. opponents claim the city could have broken laws in approving the proposal. >> reporter: good morning, sam. that group is the mission bay alliance, trying to put a stop to the new arena that would be

built with the golden state warriors. they're going to appeal the ruling later today. this group is made up of employees and well-funded donors affiliated with the ucsf medical center. they're claiming environmental and zoning laws were broken when they approved this proposal. it includes whether the proposed arena violating zoning. also can it acted date this new arena. the city refers to what they call contaminants being emitted from the proposed arena. the san francisco superior court back in july cleared the way for this project to move forward. that was after the project was already approved by the board of supervisors and even certified as an environmental leadership project by california governor jerry brown. if this all goes as planned, the 18,000-seat arena is set to open

in 2019. the court hearing is 2:00 p.m. later today. live in san francisco, pete suratos for taish. >> thanks so much, pete. big changes could be on the way for renters on sites like airbnb. late last night lawmakers voted as to how long people can rent their homes, a maximum cap of 60 days a year a home can be represented. currently there's no limit if the host is there. the proposed law will only apply to new hosts who register their rentals with the city starting today. while the board voted to pass the measure last night, a second vote is needed before the proposed law is approved. airbnb tells us it's disappointed by the vote that says it will do nothing for the broken registration system for folks trying to rent out their home. a local favorite, but last call could be coming earlier for

a long-time bar in walnut creek. authorities say the crogan sports bar and crill has become a public nuisance with police responding to more than 700 calls in the last four years. that's more calls than any other bar in the city. earlier this year patron was shot and killed right across the street. detectives say interviews with those involved uncovered that people were coming to walnut creek because they could get away with bringing guns into the bar. >> because the other towns that they used to party at were now frisking and checking with metal detectors and the walnut creek establishments did not do that. >> just yesterday walnut creek held a special hearing to try to force crogan to stop selling alcohol admitted night and close at 12:30. right now they're allowed to stay open until 2:00 a.m.

the children's discovery museum of san jose is expanding. a groundbreaking ceremony will be held at 11:00 for bill's back yard bridge to nature. it's more than 27,000 square foot outdoor learning area. this doubles the museum's current exhibit space and is designed to help kids explore nature. there will be ten exhibit areas focused on science and environmental education, and that exhibit is set to open next june. at 5:39 this wednesday morning, clear skies. right now san jose 52 degrees. cooler into the north bay, 38 in santa rosa, 40 in napa. now seeing a little patchy fog trying to set up across sonoma and napa counties this morning. otherwise mostly fog-free down the coast into the bay for most of the morning. partly cloudy skies and breezy. 11:00 a.m. to 1:00 in the afternoon noon could see a stray shower. our temperature today feeling cool with the northwest winds, highs mid 60s around san jose.

burden on students and families and lead to more dropouts. u.s. senator barbara boxer filed legislation yesterday to eliminate the electoral college. this of course comes after hillary clinton won the popular vote by several million but still lost the presidential election to donald trump who amassed the most electoral votes. "the l.a. times" calls the attempt, quote, a long shot. voters chose to reform the death penalty on the election day, but the final decision could land in the hands of the court. proposition 66 is designed to speed up the death penalty by cutting through the normal appeals process. this week a civil liberties group filed a lawsuit to slow plans to eliminate executions. the department of corrections can currently decide the amount

it is hundreds of thousands of phones. we do know apple iphones are not affected, sam and laura. the big problem seems to be with android-based low cost phones, discount plans and burner phones. we're not talking about an app. the problem is baked into the phone itself. they are phones made in china. the secrets are then sent back to china. "the new york times" broke the news saying the phones send data to chinese servers every 72 hours. it's not clear if it's an accidental bug, maybe related to advertising. the company that added the software says it wasn't supposed to be on american phones. it was a mistake. we'll continue to watch. >> we've all had to deal with smudge gentlemen phones, fingerprints on the screen. it's annoying. scientists at uc san diego have run a fascinating experience. they asked a group of people not to shower, not to use personal

hygiene products for three days. it's not these people. these people are perfectly clean. after three days those people were allowed to use their phones and scientists swabbed the phones and discovered traces of common household products in the smudges. one test subject said she used things like tide and oil of olay, and traces of the chemicals showed up on the phone even after three days. obviously this could be use bid csi crews in criminal investigations. also, it speaks to how long chemicals, harmless chemicals, but chemicals stick around in your body. >> and how often you should wash your hands. by the way, the best word ever, schmutz. modern technology is helping a student. >> the virginia high school student never misses a minute thanks to what's called double

california's economy. law enforcement is stepping up its attack on insurance fraud. our investigative unit crunched the numbers and found from 2011 to 2015, district attorneys across the state convicted 3,400 people of workers' comp fraud. about 40 of them are medical providers. inspectors pegged one local doctor as a scammer after an undercover agent visited his clinic. the doctor says law enforcement got it all wrong. cases against him were dismissed. he says what happened to him is impacting other doctors, too. >> i can tell you that they're scared of seeing patients. they're scared of specifically seeing injured workers, exactly because of what's happening here. >> coming up tonight, the investigative unit takes you inside that doctor's arrest and dives into the reason he's now saying law enforcement violated his civil rights. that story tonight at 11:00 on nbc bay area. if you have a story for us, call
