>> i saw some flowing westbound 24 approaching where there were two separate crashes reported. they had to close the off ramp. you'll move back at fish ranch road. another crash away from bay bridge. university avenue coming up. 5:01, back to breaking news since we've been on the air at 4:30 this morning, deputies surrounding a motel near gilroy outlets in their search for two fugitives escaped from the santa clara county main jail last week. >> we see those deputies swarming a motel in gilroy. bob redell is the first reporter on the scene. what have investors told you in the last 30 minutes?

>> they tell us they did not find the escaped inmates they thought might be here. they did take three people into custody, two women and one man. they've taken them into custody to question them, to see if they might have information about his whereabouts. the santa clara sheriff's office, they have pulled back their resources here. they did have that days inn surrounded since 4:30 this morning when they did execute that search and took into custody three people. the sheriff's office tells us they have received numerous tips as most recently as yesterday, placing elio chavez here in gilroy. he is one of the two inmates still on the loose. he's on the right side of your screen with that vertical tattoo that extends above and below his

left eye. to the left side of him is laron campbell who is also still on the loose. both escaped the jail wednesday night. they and two other inmates cut the window on the second floor of the main jail in downtown san jose and used bed she'ds to repel down the wall. other inmates were captured, but campbell and chavez are outstanding. that's why the santa clara sheriff's deputy surrounded this hotel briefly this morning. they are not here. 5:03. a scare for movie goers after gun shots sent people running for cover. >> this happened about 7:00 last night. police say a security guard shot someone following a disturbance

that began inside of the theater. people swarmed the outside of the building scrambling to get out. some took cover in a storage room. >> she's behind the door and locked. >> the victim shots were nonlife threatening injuries and police are treated him as a suspect. officers closed the theater the rest of the night. we are expected to find out if wisconsin can finish its recount before the electoral college deadline. the green party is challenging results in three states and the clinton campaign is joining them. donald trump is calling it a scam. tracie potts joins us live from washington with more reaction from both sides. >> good morning. first step, can wisconsin and these other states get it done?

we'll find out part of that answer in a couple of hours from wisconsin's election commission. they are holding a news conference to talk about the recount effort and whether they can get it done by the federal deadline december 13th. the green party is requesting recounts in wisconsin, michigan and pennsylvania. >> this is not about helping one guy and hurting another guy. this is about providing a system that we the voters can believe in. >> president-elect trump denouncing the effort on twitter, alleging voter fraud in states hillary clinton won. claiming without proof that he won the popular vote because millions voted illegally. he called the recount a fund-raising scam. the green party denies that. >> this is a total and complete distraction and a fraud. and something they should drop. >> hillary clinton's campaign lawyer says they found no evidence of hacking. they're not behind the recount, but will participate. meantime, there is dissension

inside the trump transition over possibly appointing mitt romney as secretary of state. >> people feel betrayed to think governor romney would be given the most significant cabinet post. we don't know if he voted for donald trump. >> after the death of fidel castro, there are questions about whether mr. trump will embrace or reverse president obama's renewed relationships with cuba. and there are questions about kellyanne conway, the senior aide you just heard there, senior advisor. trump is said to be furious that she came out publically on mitt romney. 5:06. closer to home starting today, ten south bay races will be recounted because each meets the recount criteria. the registrar's office recounts any race falling within a 0.5%

margin of votes. four council members are on that list. the county will certify its final results december 8th. 5:07. new details. muni investigating security breach by hackers. kris sanchez joining us live from the newsroom. gave some folks a free ride. >> usually that would be a welcomed thing but muni couldn't collect those tolls because of that computer glitz. that was the silver lining in the alleged hack. some toll taker booths had signs that said "out of service." this computer had a blank screen. other muni ticket stations across san francisco reportedly said "you're hacked, all data

enripted." you saw riders looking puzzled as they were waved through without paying fare. >> i thought maybe it was a holiday thing they were doing. >> a spokesman confirms the message implied a hack but says the muni staff is trying to get to the bottom of it. a news of a possible hack reached washington where we reached the congressional cyber security committee. this outage raises questions who is to blame whether it's a lone wolf hacker. >> muni is running normally today if that changes, we'll let you know here and via our nbc bay area app in case you're already on the go. kris sanchez, today in the bay. thanks, chris. 5:08. students in oakland returned to school the first time since a fire last week destroyed part of

the mosswood park recreational center. it contained a preschool and an arts facility and summer camp classes. firefighters were able to save the historic mosswood house. no word on the cause. santa clara is opening up its winter shelters. homeless will have access to 400 additional beds from sunnyvale down to gilroy. the shelter will be open as early as 3:30 this afternoon. 5:09. a quick weather system bringing in mist and drizzle and mostly cloudy skies. other than that, we are in for a nice day. 49 in livermore. palo alto 50. we have lower 50s elsewhere as you head to the east bay and parts of the north bay.

a motel there following up on a series of tips about the inmates who escaped from a santa clara main jail last wednesday night. this search now entering its fifth day. there was the thought this at least one of them could have been inside that days inn motel. they did not find any sign of those men. they have been missing since last wednesday night. developments this morning. swarming of a local motel in gilroy but no success. we'll bring you updates as we get them. 5:15. many unanswered questions in the case of a california mother found alive three weeks after she disappeared. chp found sherry papini. she disappeared while jogging found 150 miles from home. experts call it a bizarre case. >> hours and weeks of

investigation that lay out there and the victim of course is the best witness. she can help break this case wide open. >> investigators say they still only have a hazy account of her abductors. they were two armed hispanic females driving a dark colored suv. surveil yns video from where she was found yielded no clues. 5:16. shots fired inside of a bar. two people are recovering and police are looking for the shooter. take a look at these surveillance photos. you see the man circled in red is the guy police are looking for. this happened inside the bar early sunday morning. you see him pulling out a weapon. an argument broke out first then the man pulled out a gun and started firing. the two men hit will be okay. 5:16. happening today, jury trial scheduled to begin for a dog groomer accused of animal

cruelty following the death of a dog in his care. they arrested him in may after a dachshund named henry had difficulty breathing and suddenly died. x-rays revealed he had a punctured lung and two broken ribs. he is facing felony charges. 5:17 on your monday. it is back to work for most people after a big shopping weekend. >> pay for it all now. the shopping trends are changing. >> they are indeed. the first change was going to scores to doing it online. the next was blurring all these sales days, black friday, cyber monday, these days are becoming more and more irrelevant as retailers start sales early and continue through the holidays. the next big change we only just saw this year was this rise in mobile shopping, doing it on your phone this year when mobile shopping hits $1 billion in one weekend, that's amazing this according to estimates by adobe

which tracks retail behavior. walmart says 70% of online shopping was on mobile. it is cyber monday but many stores have been running these cyber monday deals for days. a company called stripe just got new funding. that gives stripe a value on paper of $9 billion. first of all, $9 billion is amazing. secondly, i bring it up because of the two founders, two brothers, kids who created a company in ireland while still in high school and came directly, do not pass go, directly to silicon valley after passing their final exams in high school. they are immigrants that went from zero to $9 billion in five years. let's check your markets this morning with landon dowdy at cnbc world headquarters. >> good monday morning.

wall street could start the week out in the red. futures are lower this morning. stocks are coming off a third straight week of gains that saw the dow, nasdaq and s&p 500 hit record highs. the cartel needs to reach deals to cut back production. look at home prices, consumer confidence and monthly jobs report. dow rising 68 points on friday to 19,152. nasdaq up 18 to 5398. ticket for the next "star wars" movie went on sale a few hours ago. there are still tickets available on opening day at my favorite movie theater in saratoga. "rogue one" takes us inside the death star in the years before luke sky walker and all that. it's a prequel.

a pretty good amount of snow. here we will get some clearing skies as we go through the next several days. that snow winding down in the sierra. still clouds lingering in parts of the south bay by 4:00 this afternoon. as far as the rain is out of here for a little while. tomorrow we'll have some clear and chilly conditions, then on wednesday, we start to see the cloud moving back in, spotty showers here, there, but doesn't look like a lot of rain. the forecast for the next several days. san francisco highs reaching upper 50s. rain once again wednesday. just a little bit there. overall, temperature trend will be for things to warm up. this weekend is looking really nice. something to look forward to. but probably not looking forward to facing a crash on 24. >> that is closing one off ramp. we saw chain requirements for

the story has garnered national headlines. >> the search in its fifth day. bob redell was the first reporter on the scene. what have you learned? >> reporter: sheriffs surrounded this motel off highway 101 in gilroy based on a tip that might have placed elio chavez here. around 4:30 this morning, those deputies executed a search on the hotel. though did take him to custody. two men and one man. they are going to question him to see what keep of relationship, what type of information they may or may not have.

they took away a white suv related to those three people taken into custody. they did not find chavez. one of those tips placing him here as recently as yesterday. still no sign of him. it was chavez and laron campbell. they with two other inmates cut through a window on a second floor. used a bed sheet to repel down the wall. those other two inmates were recaptured, while campbell and chavez still outstanding. santa clara sheriff's office saying they have received numerous tips about chavez. bob redell, today in the bay. >> thank you, bob.

5:34. san mateo deputy recovering after being injured during a drug smuggling bust. they notified i.c.e. about three suspects trying to smuggle drugs into the park. deputies assisted in that bust. the suspects were in a boat similar to the one you see in this file video. those boats are often used by suspected drug smugglers. the deputy was injured but details are not being revealed about that. we do know the deputy is expected to be okay. new information that could be revealed in a shocking crime that rocked the north bay. a father accused of drowning his 4-year-old daughter is expected to face a judge once again this morning. pete joins us live from santa rosa superior court with what could be revealed about his mental state. good morning.

>> reporter: good morning. the 42-year-old will be back in court in just a few hours. this is the second appearance in just about a week. this is after authorities allegedly say he drowned his own daughter inside a catholic church. you see him sitting in a wheelchair sobbing as he faced the judge during his arraignment this past monday. criminal proceedings were suspended after his own lawyers raised doubts about his mental state of mind. today we are going to hear a doctor's evaluation on his mental competency. he is accused of allegedly drowning his 4-year-old daughter in a baptismal font. then he carried his daughter to the police staying, he was naked

and screaming for help. they claim he was on drugs when all this happened. >> the 4-year-old girl died at a local hospital and her dad is facing murder and felony charges. his wife is pregnant and they have three more children together. court date set today for 3:00 a.m. such a tragedy there. it's 5:37 right now. follow-up to a story we first broke friday. support now pouring in for a south bay islamic center that received a threatening letter. the letter was sent to the evergreen islamic center in san jose. it called parishioners children of satan and said trump is going to cleanse america of muslims. it was signed by "americans for a better way." this weekend some parishioners arrived to find this at the

islamic center, flowers and notes filled with well-wishes. two other mosques received that threatening letter. thousands are preparing to pay tribute to fidel castro. the 90-year-old dictator who died friday. tens of thousands are expected to visit havana's revolutionary square to honor the revolutionary leader. jay gray joins us live from havana with more on the mixed reaction we are seeing from castro's death. mixed reaction in the states there are obviously a lot of cuban americans exhilarated by the death of fidel castro. here in havana, it's been somber, quiet, very different than you would normally see in this vibrant city. the lines have formed here as they begin what will be the first of several public memorials over the week for fidel castro.

live pictures from dublin this morning. in the first six hours, they made 179 arrests. the extra support ended midnight overnight. but they are still on the look out for bad behavior. controversy followed 49er quarterback on the field in miami. had nothing to do with his performance. dolphins fans heavily booed kaepernick. he got into a spirited debate with a cuban-born reporter when he asked kaep why he wore a shirt that featured fidel castro. kaepernick clarified why he supports his vision about some things. >> i agree with the investment in education. i agree in the investment in preuniversal health care and trying to push the false narrative i was a supporter of the oppressive things he did is just not true.

camera lens. you can tell that the roads are wet. that's what we are dealing with. windshield wipers on in some spots as you head out. 51 is the current temperature in the city. 57 will be the high today. a weak weather system is moving through. now moving off to the east and bringing even more snow to parts of the sierra where they had up to two feet of snow in the higher elevations over the weekend. now we do still have a lot of humidity and moisture with patchy fog. in san martin, visibility down to about three miles. it's not really thick but something to watch out for. upper 40s to low sifts. morgan hill, 47 degrees. highs reaching 59 and generally upper 50s. right at about 60. there will be clearing as we go hour by hour in the south bay still holding on to those clouds later on today. a chilly morning tomorrow with sunshine. then on wednesday, we get ready for more clouds and spotty light rain to move back in.

jury selection starts in the federal trial of dylann roof. ==vo== rf 5:56. happening today, jury selection starts in the federal trial of dylann roof. roof is the 22-year-old man charged with shooting and killing nine black parishioners at a church in charleston, south carolina, last year.

jury selection was originally set for november 7th but stopped after roof's lawyers questioned his ability to understand the case against him. last week a judge cleared the way for jury selection to restart today. this is one of two death penalty trials that roof faces. a 21-year-old man is charged with homicide after a teenager boy was shot and killed inside a fire department in pennsylvania. this is video from the scene about 45 miles outside pittsburgh. the shooting happened last night. firefighters confirmed the victim was a 16-year-old junior firefighters who was a sophomore at a local high school. investigator have not said what led up to that shooting. 5:57, san francisco mayor ed lee is visiting south korea. mayor lee is in seoul talking about trade and cultural opportunities between the two cities. he is celebrating the 40th anniversary of the san francisco seoul sister city relationship.

millions of americans are back home after the long thanksgiving weekend. things went smoothly at the nation's airports with delays of 15 minutes or less at most of the major airports. the tsa anticipated screening about 2.5 million passengers, about 500,000 more than the typical week day. an estimated 48.7 million americans traveled over the weekend. we are following breaking news out of the south bay. bob redell will join us with the latest on the search for two fugitives still on the run. why deputies had a moat knell gilroy surrounded.

kind of a drizzly start. >> you notice there is a little bit of mist in the air, drops on the windshield. get this day started, we'll have clearing out this afternoon. live look out at san jose. it's cloudy as this weather system moves on through. it's not going to bring a lot of rain. it's cool so wear a nice warm jacket. we'll look at the microclimate forecast coming up. >> a number of early crashes. most completely cleared.

we are looking over toward hayward where we do have an issue. the build coming off the castro valley, that was a quick build for west 580. there is extra slowing. no incidents there. we have a stalled 880 at 92. more details. in the south bay we have a little bit of slowing 101 typical around 680. 15 minutes from 85 to 87. >> thank you very much. we are following breaking news out of the south bay this morning where police surrounded a motel near the gilroy. >> we were the first to break the story on thanksgiving morning. our crews were the first at the scene of that motel as well. >> bob redell has been there since 4:30 this morning talking to investigators. what updates do you have for us, bob? >>
