investigation how this tragedy started. pete is live at the scene with a break down of what we know so far. we heard varying reports about what percentage of that building is actually searched. good morning. >> good morning. last time we were told by fire officials it's at 40% they've been able to search. there's been a work stoppage as of 10:00 p.m. last night. issues with some of the warehouse a safety issue for firefighters. they'll have engineers come in later this morning so they can determine how they are going to move forward. here are the latest numbers. 33 deceased inside of this building. the city notified at least eight victims, one of the eight victims is a minor. seven of those victims have been identified. officials with oakland fire and alameda sheriff's office and public works searched for those bodies. they've been using heavy equipment, bulldozers to remove

this debris out of the warehouse to get to those bodies. there's a lot of questions surrounding this warehouse. preefb yus complaints regarding debris in and around it. >> the interior building with multiple collapses we already have, we can't get under an unstable mezzanine or roof collapse and take any debris out of this area without risking a piano or large appliance coming down on our firefighters. >> we are looking at new video of a coroner ivan leaving the warehouse. a criminal investigation team is on site working with oakland police. we are expected to get a news conference from the same officials we see over the past weekend. that could be limited now that this work stoppage has taken place. >> thank you for the latest there.

as we get a closer look at the aftermath of this fire, we are learning more information about the founder of the so-called ghost ship. that's what the building was called with that art collective on the first floor. the man who ran the artist collective is on follow any probation. >> bob redell live in oakland where derek ion was last seen. what do court records reveal about him? >> we are trying to get an interview with derek ion. according to one newspaper report he's staying at the marriott here in downtown. seen here in a video posted to youtube is the man who founded and ran the ghost ship, the name of the artist collective that was located inside the warehouse that caught fire friday night. this is what the ghost ship looked like before it burned down. people familiar with the location say the space was crowded with wooden art projects which might explain why the fire

grew so large, so fast. nbc bay area has confirmed that he is on felony probation. a search of court records show he was convicted in january of receiving stolen property. for that, he spent two days in jail and will be on probation until 2019. he has angered a lot of people with comments he posted on facebook only saturday morning, just two hours after his art space burned down, killing at least 33 people. in the post he wrote, "confirmed, everything i worked so hard for is gone. blessed that my children and micah were at a hotel safe and sound. it's as if i have aweaken from a dream filled with opulence and hope in poverty and lack of self-worth." people felt it did not show compassion to the people trapped inside. one person who knows him says what life was like inside the ghost ship.

>> when there is a party to have, everyone pitched in and they created this beautiful space and then after the party, it slipped into madness. >> our investigative unit did reach out for a comment and have not heard back. we are going to try to reach him. we believe he is staying here at the marriott in downtown oakland. bob redell, today in the bay. >> thank you, bob. 5:04. we know some of the names of the people who perished in this tragedy. as we get a glimpse into the lives they lived. >> kris sanchez joins us live in oakland where a memorial continues to grow there with how people are remembering the lives lost. good morning. >> some of these flowers and other memorial items here are likely left by people who did not know the people who were inside the ghost ship as it burned. you can see it's a bit of a whimsical display.

lots of flowers. folks dropped off donuts, bread and other streets. the memorial is growing even as the alameda county coroner is working to identify all the victims. each an individual but with a common love of art and music. one victim was just 17 years old. here are the seven others whose families have been notified. 32 donna kellogg, travis hough, cash askew, just 22 years old. 24-year-old nick gomez-hall was administrative assistant by day. david clines. 30-year-old sara hoda was a teacher. a candlelight memorial is planned for 8:00 tonight at the pergola at lake merritt.

less than two hours ago president-elect donald trump is tapping former rival ben carson for a position in his cabinet. carson, a brain surgeon, has been picked to become the next secretary of the department of housing and you are want development. carson was the son ofç a singl mother in inner city detroit in his books and motivational speeches. trump said, "ben shares my optimism about the future of our country and is part of ensuring this is a presidency representing all americans." good monday morning. time is 5:07. dealing with dense fog across parts of the bay area. here is a live look outside in san francisco where you can barely see anything. it's dropped down to 52 now and visibility down to about 2 1/2 miles in oakland. some spots down to 1/4 mile in santa rosa. you can barely see in front of your headlights. slow down as you head out.

temperaturewise, it is very cool in napa. 36. 39 in santa rosa. 53 in san jose and morgan hill. this afternoon, we are looking at highs that will be reaching into the upper 50s. a mix of sun and clouds. it will be a nice start to the week with some mild weather but it gets really cool over the next several days. i'll talk about that in less than 10 minutes. mike takes us to the tri-valley. >> you talked about fog in the north bay, napa. santa rosa, 1/4 mile visibility. showing up over towards the bay bridge. i'll show that to you in a second. we have this blotch through livermore for 580 westbound through dublin. slower driving and now slowing appears here. this is just before you get to the dublin interchange with lower clouds drifting through. this could be more complicated. slowing right now as crews do

santa clara will be at 9:0050 degrees. reaching into the upper 50s today with mostly cloudy skies. i'll talk about the complete microclimate forecast with the big drop in temperatures coming up. we are not really looking at a drop in speed though lowering out of the altamont pass. >> it was a beautiful and amazing and creative space that was our chosen home and chosen family. >> we were a family. we all looked out for each other. we helped each other. it wasn't just like, that's my roommate. this is my friend. >> you just heard from two women who lived in that oakland warehouse gutted by fire friday night. we know there are 33 victims, at least to this point confirmed deaths.

that number could rise significantly in the hours and days ahead. officials say they have identified eight of the victims. one of them was a minor only 17 years old. live pictures of oakland where that warehouse is in the distance. we are expecting an update from officials this morning. a news conference is planned for 6:00 a.m. this is a look at the podium. the media has been gathered for quite some time we've been covering this story extensively since the fire broke out friday night. we'll bring you that live right here on "today in the bay." work has been halted at the site so far so engineers can check the structural integrity of the building. there are fears large appliances, pianos could fall on some of the fire investigators trying to get through some of this massive debris that remains at the warehouse site. 33 victims, eight identified, one being a minor this morning, continuing coverage live all morning long. >> it is the front wall of that

building they are trying to stabilize before they can continue the recovery efforts. 5:14. two firefighters recovering after a fire in redwood city. according to san jose mercury news, the house in the emerald hills community caught fire. all three stories of the house were engulfed in flames and nobody was home. it took almost three hours to put out. two firefighters suffered minor facial burns. one of two inmates recaptured after escaping from santa clara county's main jail is scheduled to be sentenced on previous crimes. authorities last week captured le ron campbell after he escaped from jail thanksgiving day the other inmate chavez was arrested the next day in san jose. each could face more than a year of additional prison time on top of lengthy sentences they face for previous crimes. campbell will be sentenced for a

series of home invasion robberies. dozens of sexual assault cases and convictions are in jeopardy due to the accuracy of a certain type of forensic test. "mercury news" reporting that they continued using p-30 in some sex crime cases. other crime labs stopped using that long ago due to concerns of inaccurate results. the county's lab director raised concerns about false convictions and a chance some cases may be reopened. turning to business news now, the markets continue the recent roll, futures looking higher. >> for more on the rest of our news before the well, let's check in with kate rogers live from cnbc world headquarters. good morning. wall street set to start the day in the green. u.s. futures higher as investors eye william dudley's upcoming speech.

they aren't expecting the fed to hike interest rates and dudley could offer up some clues. back to you. >> thank you very much. we are going to get to weather and traffic. you mentioned it was foggy. >> i would say coming in from san francisco you saw fog covering the highway. starting in redwood city down through mountain view. we've been looking at our cameras. we have a decent view of san jose behind us. >> it all depends on where you are. south bay was clear. socked in by cloud cover keeping is warm. a look at that traffic and the forecast. >> the start of the week is looking pretty good. as you get up this morning, just make sure you get ready faster so you can get out the door sooner. especially if you're in some of these areas revealing dense fog. that's in san francisco. you can barely make out what this is. those low clouds rolling across

and also slowing things down as you get this day started. 52 with a high today up to 60, and we see the visibility much lower in spots like oakland. napa down to 1/2 mile visibility chopped down to about 1/4 mile in santa rosa. that means you just can't see much farther than right in front of your car. make sure you allow extra time to get there. it's 44 in concord. 50 in half moon bay. palo alto 52. after this mild start, we'll have an afternoon with fairly average temperatures reaching the upper 50s to right at about 60. there will be changes on the way. we are talking about much cooler air moving in. even though we won't see any rain near term, it will be wednesday when we start to see the showers moving back in. that combined with cool air and gusty winds, that will be the end of the week we'll have rain at times, very heavy with cool

temperatures even this weekend we'll have a chance of rain possible. again, next week. looks like we are heading into a period of soggy weather and potential of an inch of rain. east bay looking like closer to two inches of rain between now and sunday morning. san francisco close to 2 inches. look at the north bay. we could have over 3 inches of rain over the next several days. san francisco will be cooler. highs only reaching low to mid 50s for the end of the week. after today reaching 60. we'll see that in the inland area. clouds moving in and breezy winds. a very soggy end to this work week. as we head over to mike tracking the fog all around the bay area. >> we are looking at no delays for the south bay. peninsula all right. having been through foggy areas, san mateo, redwood city. be careful out there. fog drifting through. we are see it registering on our

road sensors. over here as you're approaching the dublin interchange, a lot more slowing. there is a disabled semi truck and trailer blocking your flow in. that is an issue. we take a live look out there. there are low clouds hovering around. earlier was tough to see the roadway. you're on the deck here. should be better for speeds and awareness as you approach that 580 interchange. we are going westbound 80 approaching the drive to east richmond. we have one lane blocked, as well. there is a truck fire reported there. no injuries, but may be quite a spectacle. that is early slowing for that upper east shore freeway. we are showing a smoother drive for the maze. 20 minutes from highway 4 down to the bay bridge toll plaza. your visibility improved smooth

that figure has been stable since yesterday. partly because of access to get into that building. officials identified eight of the victims. one was a minor only 17 years old. a few minutes ago we got an update. crews searched 40% of the building. they stopped their recovery efforts at about 10:00 last night due to stability issues in the building. at 6:00 there is a press conference planned. there was a victory at the dakota access pipeline. fireworks foming the news that the u.s. army corps of engineers would deny the final permit for the pipeline to pass through land protesters considered sacred. for many the celebration was months in the making.

some protesters admit this fight might not be over. >> we are still getting there winning this thing but there will be a few battles we have to go through. happening today, supporters in san jose will be rallying at city hall at 11:30. 5:26. a peninsula law maker will use political muscle in a new push to access to a popular beach. visitors to martin's beach have been denied access there. in 2008 a venture capitalist bought the surrounding property. that appears to be illegal. jerry hill will introduce a measure to introduce money from california's general fund to acquire the area surrounding the road through eminent domain. our live team coverage on the tragic warehouse fire in oakland continues.

to move forward. at about 6:00 a.m. we are going to get another update. that could be limited because now we know this work stoppage took place at 10:00 p.m. they were about 40% complete in their shirt. the latest numbers we know. 33 deceased bodies were found. eight victims have been notified by the city. one of the eight victims is a minor. they identified seven of those victims. we'll have officials with oakland fire and public works working together. they only searched about 40% of the building so far. we know that area they can get into is where 25% of where the fire load is. yesterday they were talking

they will get the official identity from the coroner's office. we know thousands of people said they will gather in remembrance of the victims here later tonight. folks have been leaving flowers and candles and sweet treats as a memorial for these victims. it's been growing even as the coroner is working to identify those victims. each an individual but with a common love of art and music. one victim whose name will not be released was just 17 years old. the other families have been notified including 32-year-old donna kellogg in culinary school. brandon chase wittenauer, travis hough also a musician. cashç askew, nick gomez-hall a david clines was a u.c. berkeley graduate. 30-year-old sara hoda was a

teacher. that candlelight memorial is planned for 8:00 tonight at the pergola at lake merritt. thousands of people have said they will attend. a lot of folks trying to find a way to heal and move forward. kris sanchez, today in the bay. 5:37. we are hearing harrowing stories of survival. >> two women tell us about the frantic moments right after the fire broke out. >> the power went out and i then just jumped off the loft which is 10 or 11 feet. grabbed a head lamp and used it to grab my cat, my phone, grabbed my keys. i'm not sure why. then just tried to get out of my gate and out the door. people at that point were trying to push their way through. >> this is our home.

one of the residents was standing in the doorway with the smoke pouring out with his phone trying to light the way for people trapped inside. >> and pulled people. >> he saved people's lives that night. he was trying to get people out of there. at some point whether you got out or you didn't. that timeline was under 10 minutes. when the fire started to when there was no chance for you getting out. that had to have been under 10 minutes. >> we heard so many accounts of people having to witness loved ones and friends trying to rescue them and not able to do so. this is so tragic. many are stopping by to drop off notes or candles. folks from the bay area and the country are offering their support. >> we have a full list of where to donate at nbcbayarea.com. our coverage of this deadly fire continues on our website. we are updating all our digital

three states. former ambassador to china jon huntsman and admiral james. >> more than four. who knows how many final lists? >> also today. >> mad dog. >> former announcement of general james mattis plus dr. ben carson has decided to accept the offer of hud secretary. that could be announced today. mr. trump continues tweeting out his foreign policy defending a call from taiwan's president that angered china. >> the waters seem like a tempest in a tea pot. >> warning american businesses that move jobs overseas, they may be making a very expensive mistake. tracie potts, nbc news, washington. 5:45. a uc berkeley student is at the hospital recovering from sexual assault. police say the assault happened over a week ago. the student was leaving a b.a.r.t. station in downtown berkeley when a man attacked her. he had the intent to rape, but

the student managed to fight back and get away. the attacker is described 6'2", white male in his late 30s with light brown hair and had a muscular build. anyone with information should call police. not something you're accustomed to seeing in downtown palo alto. a daring burglary at the apple store there. they drove a rented suv straight inside the store. the burglars stole several phones and computers but ditched them with the rented car when they were trying to get away from police officers. investigators say eight to ten people in total were involved. four of them are in custody. here is a look at two of the suspects who were arrested. both from oakland. 5:46. >> this comes after a series of thefts at apple stores across the bay area. this is from san francisco's marina district which was robbed

twice last week. >> a follow that broke on our twitter feed. we learned generosity from the community has a charity back up and running. thieves helped themselves to food, clothing and medical supplies that were supposed to be given to the homeless. the chan ministry's mercy mobile was burglarized. supplies will be begin out later today thanks to the generous donations from the community. >> trying to restore our feelings of faith in humanity. very busy morning. >> and kind of a calm morning. we have rain later in the week. >> and chilly temperatures starting to moving in as we

speak p. we get a live look outside over san jose. visibility clear there. los gatos will be at 50 at 9:00, reaching upper 50s today which is right on par for average for this time of year. then we head over to dublin. visibility is getting much lower. livermore visibility about six miles, which is not bad. visibility in oakland was down to about a half mile. now about 2 1/2 miles. we are seeing that change as we go through the morning. it will be changing as you're driving on the road. allow extra time to get to where you're going. it's cool in the north bay. only in the mid 30s. we have low 50s elsewhere. our highs today reaching the upper 50s. once again that's about average. then much cooler than average air moving in. tomorrow you'll notice the difference. it will be windy not seeing much in the way of rain until late

wednesday into thursday. it will be a soggy weekend as that cool air stays in place. we'll have times of rain off and on. we are looking at potential for an inch of rain where it will be lighter. go up toward the east bay and rainfall totals may reach close to two inches. napa over two inches of rain. santa rosa anywhere from three to four inches of rain. it will be very soggy for the weekend. starting out once again late wednesday night. in the near term we enjoy our drive weather with mild temperatures reaching 60 today in both in san francisco and inland areas.

>> another issue besides the fog and low clouds, we have a disabled big rig that was cleared about 15 minutes ago. we see good recovery. the commute is building more slowly now for 680 heading down toward the sunol area. looking at a smooth flow of traffic. recovery was the car trailer on fire. it's cleared from the roadway. and clearing by richmond. look how easy the drive is. they are getting over past the earlier scene to the bay bridge toll plaza.

metering lights are on. no problem for the north bay. >> thank you very much. let's stay in the east bay right now. we have really seen our local sports teams step up this weekend in light of the tragedy in oakland. a live look at the coliseum this morning. a day after the team honored the victims of friday night's deadly fire. raiders held a moment of silence and the team joined the oakland athletics in donating $30,000 each to families of the victims. as for the warriors, they are extending their support financially. the team announced on twitter they are donating $50,000 to the online fund-raiser. that money will go to the unity council in the fruitvale district. 5:51. one of san francisco's busiest traffic corridor may lose one lane inç each direction. transportation leaders are mulling over the idea of dedicated bike lane through san
