take a live look outside...... san jose - communications good morning to you, and taking a live look outside, this is our view from san jose's communication hill, and you can see lots of blue sky there, no clouds. that means our blanket did not trap in the heat. microclimate weather alert in effect for you this morning, freezing temperatures all across the bay. thanks for joining us. i'm kris sanchez, along with vianey arana, who's been very busy this morning because we do

have that microclimate weather alert. i know we saw frost on some of the windshields in the parking lot. >> we did and we are expecting to see even colder temperatures tonight. so we are going to keep that microclimate weather alert as we continue to see those 30s and 20s for parts of tri-valley and even out near north bay. here's a look right now at walnut creek. we're seeing 30s all the way around, 36 degrees in san francisco, and out near san jose, also until the 30s at about 33 degrees. now, areas like walnut creek, we could be seeing those 20s drop even lower. we're taking 24, 25, so we are definitely going to want to keep an eye on that, which means that freeze warning that was supposed to be in effect until 8:00 a.m. today has been extended until 8:00 a.m. tomorrow. so if you have any plans that need to be covered or any pets that you typically have hanging out outdoors, you might want to bring them in. that frost advisory has also been extended and that is for

san francisco and of course san mateo. we are seeing that frost and the windchill, 33 to 39 degrees and we aren't expecting to climb above that. we are seeing that dry, cold air mass sitting over the area and that's what's keeping those temperatures nice and cold for us, at least through tonight. i will keep an eye on just how much we are expecting in termgz of a drop and i'll have an update on that coming up in just a bit. >> thanks very much, vianey. it is cold all around the bay area, but the south bay is the coldest spot and dangerous cold now prompting new warnings about how folks are going to try to stay warm. the warming center at the morgan hill community center will be open for people to duck in out of the cold. it's not an overnight place, though. but if you're trying to stay warm at home, pg and e reminds you to do it safely. if you're using a space heater, make sure it is on a hard surface, turn off the space heater when you leave the room. don't use your stove or oven for heat.

targeted and that the public is safe. >> the assailant ran up to him in the parking lot and fled in a vehicle and at this point, we have clearly a lot of potential witnesses, a large parking lot that may be the scene of evidence. >> the man was taken to a local hospital and is serious but stable condition right now. so far, no arrests have been made. a look at the cell phone video shows flames burning on the seventh floor of a 12-story building in san francisco. those are the parkmerced apartments in san francisco right near san francisco state. fire crews got it out quickly in just about ten minutes. >> our roommates said, it smells like smoke and there was actually smoke coming out of the door next to us. we just, like, kind of saw it and then we just -- >> we ran. >> got the dog and got outside. >> no one was hurt in that fire

but the red cross is now helping two people whose unit was damaged. firefighters say at this point, they don't know how the fire started. a horrifying scene at a crowded bus stop in san francisco's chinatown where a driver plowed her car into the lunchtime crowd, injuring ten people. at the top of your screen, you see in security camera video the moment that that bus stop was hit by that car on stockton street. the impact of the crash shattered that bus shelter glass and mangled the metal too. you can see it by daylight. witnesses told us the driver hit at least two cars before slamming into the people who were just standing on the sidewalk. >> i just saw the car. they ram on this, see this van, and the other van, that was really fast and hit the bus stop. >> i just jumped to the corner along the sidewalk and then i looked back, i saw the car crashed. >> police are investigating why the driver ended up on the sidewalk. emergency crews took ten people

to the hospital. four of them have serious injuries but all of them are expected to survive. we will continue to follow this tragic crash on air and online at nbcbayarea.com. we posted that raw video from the scene as well as photos from witnesses of the chaos after the crash. in the event that you saw something, you can report it to police. well, a judge has ordered two santa clara county correctional deputies to stand trial in connection with the beating of an inmate at san jose's main jail. phillip and tuan le pleaded not to beating inmate ruben garcia back in 2015. garcia is now a free man and he says the guards fractured his jaw. the guards are due back in court december 27. you may have seen it, the big smoke cloud in richmond coming from a junk yard fire during yesterday's morning rush hour. the fire started about 8:00 in the morning at deal au

auto wrecking. the flames torched rows of old cars and spent smoke into the air. people in richmond and el cereito were told to stay inside but the advisories were lifted. people who live nearby describe how it sounded. >> i don't know if they had gas in those cars but they were boom, boom, boom. you know, like every ten seconds, one was going off. >> the contra costa fire marshall says the city inspected the junk yard back in march. inspectors cited it for unsafe oil storage and blocked aisles. another inspection in may found the junk yard had fixed those issues. still ahead on "today in the bay," president obama promising to retaliate against russian hackers, so what's behind the attack other than the election? we have an expert weighing in on that. and a constitutional showdown, the decision that could change history or send a local electoral college voter to prison.

take a live look at the golden gaelt bridge. if you look to the right of the bridge, you see the flag there. it's not waving because it's very still out there and very cold. those temperatures are going to stick around for a while. and it's dangerous out there. we're going to talk to vianey in just a minute. work begins next year to install a controversial suicide barrier on the golden gate bridge. it is an argument that has stretched for decades. critics of the barrier say it will distract from the iconic design of the bridge but mental health advocates lobbied for a way to stop suicide attempts there. building the barrier will take about four years, two years longer than it took to build the bridge itself back in 1930. well, uber might be picking up a legal fight with the dmv

over its self-driving cars. we first told you about this story on wednesday. uber began testing self-driving cars in san francisco, but the dmv shut it down, threatening legal action if the company kept testing without permits. yesterday, uber said that the self-driving cars don't need permits because human drivers were still behind the wheel. the dmv shot back that if uber didn't get a permit, the state attorney general would get involved. it has been a particularly bitter winter for much of the nation and we're not just talking about ourselves. this weekend, though, no exception for the rest of the country. right now, parts of 35 states are under weather warnings thanks to a big storm stretching from coast to coast. in new jersey, it is cold enough that people find themselves shopping for a little more warmth. i had to go to the store, get some long johns, go into the mcdonald's, put the long johns underneath and i was good then. >> yeah. storms in southern california created problems, heavy rain, flooded freeways in boston, the

frost froze fire fighting equipment there too and even the firefighters themselves. experts say the latest cold snap will probably continue all the way up to christmas and could complicate holiday travel plans, so you're going to watch the forecast, want to watch the forecast for that. we've been talking about the cold here. now it's not like that. we're not seeing snow. >> but we are feeling the cold temperatures and thankfully, those storms that we saw the past two days, well, they've hopefully melted and it's now going to create as much of a hazard. last night, though, there could have been the potential there for some black ice, especially up in the santa cruz mountains. here's a look at the south bay peninsula and the tri-valley. if you notice the south bay and the tri-valley really seeing those colder temperatures, 36 degrees, 30 in the tri-valley, and for the peninsula in the 40s. out near san francisco, 42 degrees, partly cloudy skies and out near the north bay, also into those 30s which means, yes, we will remain under that

microclimate weather alert as we continue to see those freeze warnings. originally, they were scheduled to expire at 8:00 a.m. today but they are extended to 8:00 a.m. tomorrow. we could see temperatures out near the protected valleys and we are going to keep an eye on those overnight lows as they are expected to get even colder tonight. a frost advisory is also going to remain in effect until 8:00 a.m. on sunday for san francisco, san mateo, this dry cold air mass will keep those chilly temperatures in the forecast tonight and early tomorrow. if you do have an early morning commute, please wait until that frost melts from your windshield before hitting the road early this morning. we did see some of that frost windshield on there as well. 52 degrees in santa rosa, san francisco, 51. mnl in the 40s so those afternoon highs are going to remain very chilly. check out near los gatos, 49 degrees, palo alto at about 53 and san jose in those 50s. we are not going to be feeling

very summer-like or very california-like for this saturday. thankfully, those winds not really a factor in your focus so you will not be feeling any windchills today. we are going to see these pick up just a bit overnight but nothing to concern yourself with. let's look at the temperature trend. if you notice, we're going to star in the 30s, right now in san jose, and as we head into about 9:00, 10:00 a.m., we're not really climbing by much. may hit an average high of about 58 but it's very unlikely, more than not, we will remain around 56 degrees by 12:00 noon we are seeing those temperatures climb into the 50s but not much warmer. here's a look over the san francisco area and they were also expected to see those 40s right now, currently 41 degrees and the temperature trend as you head into the lunch portion of the day remains in the 50s. we are expecting to see a couple of changes as we head into the next seven days but tomorrow, we are going to keep that freeze warning and those freeze advisories in effect because we will be waking up to chilly

temperatures tomorrow. we are expecting a high of about 51 degrees in san francisco, which means tonight we could say be seeing below freezing temperatures. now as we head into monday and tuesday, those temperatures start to warm up slightly as high pressure begins to build in the area. right now, we do have a dry cold air mass and that's what's going to keep those overnight lows really, really code. as we head into wednesday, we are expecting to see a trough that could bring the possibility of more rain but that's pretty far out. we will keep a close eye on the possibility of seeing more rain in the bay area. inland, i do want to remind folks, we are going to see some early patchy morning frost especially for areas in the south bay so please make sure to take some extra time before hitting the roads. a high of about 55 degrees as we head into monday and just start warming up just a bit. that sunshine and that high pressure will let us climb into those 60s before wednesday night when we're tracking that trough that could bring rain chances by

thursday and we could see a possibility of those temperatures dropping yet again as we head into friday and saturday. but for now, bring your pets indoors, bundle up as it's going to be a cold saturday and really a weekend across the bay area. kris, i'll send things back to you. >> thanks, vianey. much more ahead on "today in the bay." 20 years and counting. a holiday tradition in one of san francisco's roughest neighborhoods and why it means so much to the children. time of giving.

"today in the bay's" joe rosato jr. shows us how for two decades a man in san francisco has used a christmas tree to inspire others. >> i think it's really cool. >> reporter: the holidays are a time of tradition, large and small.

wayne standerwick is a fan of holiday habits. in his own spin on tradition, every december, standerwick drags a christmas tree to san francisco's civic center. >> it's a giving tree. it's about giving. >> reporter: this tradition started 20 years ago. >> there was a tree in front of my house and i was like, well, i want kids to decorate the tree. >> reporter: so standerwick made some ornaments and called up local schools to send some kids to decorate it. but as so often happens in life, ideas can outgrow their roots. >> here are all the ornaments and you just put them on the tree. oh, yeah. that's a nice one. >> reporter: so years ago, standerwick got a permit to put his annual tree across from city hall. and invited local kids' organizations to stop by. >> this is the children's community tree. >> it looks nice. >> reporter: the homemade ornaments come from school kids

in far away places like nepal, japan, and brazil, where standerwick spends the year doing volunteer work. >> i go to schools, learning facilities. myself and the kids make them. >> who's next? >> reporter: the decorating parties include a lesson in energy making. >> look, it's on now. >> some of the kids don't get to experience having christmas trees at home so this gives them a chance to actually decorate a tree. >> reporter: the tree is standerwick's gift to a plaza that for some is a public living room. >> this is where the majority of the homeless congregate and they deserve to see a tree too. >> a lot of people have cried because they haven't put on an ornament for years. >> when you're out here on the streets, it's hard and even if you have a memory that makes you happy for five minutes, that may make someone's day. >> reporter: now each year, about 1,000 kids visit the tree to learn a lesson in sharing and giving. so, right now, we're going to pick books. as a part of standerwick's tradition. >> shrink man.

tomorrow for parts of the north bay and of course out near san jose, those temperatures dropping down to about 27 degrees overnight. they could get even chillier tonight. now a freeze -- excuse me -- a frost advisory in san francisco is in effect, and that's because those temperatures are in the 30s, below freezing and below 32 degrees, so frost advisory will remain in effect out there as well. satellite radar showing a lot of activity and that's because we traded in the rain for a dry, cold air mass that's going to sit over san francisco, keeping those chilly overnight temperatures and i do have some changes as we head into the workweek ahead. a look ahead at your sunday as well coming up in your full forecast. all right, i slept with some very fluffy socks last night. the coldest spots on vianey's map were in the south bay and a dangerous cold warning is now prompting warnings about how folks try to stay warm. the warming center at the morgan hill community center will be open for folks to duck in out of the cold. but if you're trying to stay warm at home, pg and e wants to

they are charged with felony assault. a revelation in the investigation into the deadly warehouse fire in oakland. we now learned that the owner of the building had a business license for more than two decades that should have triggered a city inspection. "today in the bay's" elyce kesh ner tells us now about growing fears about eviction. >> reporter: we spoke with several people living in similar warehouses to this one who say their landlords are already evicting them. many are artists who lost friends in this deadly fire and say they barely had time to grieve. now they could end up homeless. >> it's mass gentrification. >> >> reporter: a community meeting to address questions about oakland's housing crunch. >> we haven't even had a second to grieve because there's all of this work that we have to do. >> reporter: artist sofia kim lost several friends two weeks ago when fire ripped through the so-called ghost ship warehouse

killing 36 people. >> and they cared deeply about this community. a lot of them were activists and would not want to see what's going on right now. >> just because you sign something -- >> reporter: now, other artists who live in similar living spaces are being evicted. >> they're using opportunities to kick people out. >> reporter: it comes as city officials confirm fire inspectors never inspected the warehouse to make sure the building was safe and up to code. even though the owner had a business license for two decades. >> and that theoretical should have triggered an inspection. >> absolutely. >> reporter: why was there not -- >> that's the question that needs to be answered. >> reporter: oakland city council member says now the challenge is making sure other warehouses are inspected without gutting what he calls the soul of the city. >> we don't want you to throw people out the door, but we're willing to make adjustments on the timing issue or whatever support you may need to get your building up to code. >> reporter: he says to address other warehouses that have turned residential, the city is working on drafting a plan to

legalize inlaw units similar to what san francisco did last year. but he says that could take some time. he's trying to work with the mayor to schedule an emergency meeting to prevent more evictions. in oakland, elyce kirj ner. >> a california lawmakers want to make it a little harder for new riders to hit the road. assemblyman of oakland is calling for extending the lebt of a provisional license. a provisional license bans drivers from being on the road from 11:00 at night to 5:00 in the morning. right now, the law allows young drivers to get their license after driving with a permit for six months but if fraser gets his way, young drivers would not be able to get their licenses until they're 21 years old. he says that would reduce the amount of crashes involving those drivers because more fatal crashes -- or rather young drivers are more likely to crash. good news for electric car owners. pg and e got the go-ahead to

open 7500 new charging stations in california, more than 1100 of those are going to go into low income communities. community activists say the new charging stations should help to promote more clean air vehicles in those neighborhoods. still ahead on "today in the bay," helping kids do positive things thanks to bikes. why these unique rides have gotten the attention of a warrior star.

good morning, bay area. we are waking up to a microclimate weather alert and that's because we are tracking cold temperatures. that will be today's main event and they'll be sticking around through your weekend. right now, the south bay having some pretty chilly temperatures, 36 degrees, out near the peninsula and the tri-valley, seeing those colder temperatures in the 20s overnight. san francisco is in the 40s but we aren't expecting to climb by much and that's because we do have a dry, koeltd air mass that's going to keep those chilly temperatures, which means, yep, those freeze warnings will remain in effect until 8:00 a.m. tomorrow for parts of the north bay and the tri-valley and of course the south bay, which means those temples will be dropping to about 27 degrees overnight,

maybe even colder, which is below freezing temperatures. now there is a frost advisory for areas like the san francisco area, the peninsula, san mateo, out near fremont as well. they're also expecting to see those 30s and our temperature trend for today is going to remain very winter-like, especially for california. today's highs will be in the 50s but the 40s for areas line the half moon bay, 49 degrees, palo alto, fremont and san jose in the 50s. yesterday's highs were at about 54 degrees so those highs that you felt yesterday are going to be very similar to today, but maybe just a little bit colder. out near san francisco, 51 degrees, the good news, though, is that we are expecting mostly clear skies so no rain is expected in the forecast for this weekend. and in terms of the winds right now, not a big factor. they could be picking up for parts of the north bay to about 10 to 15 miles per hour into the later part of the evening which could kick up some windchills but for the rest of the bay area, not really a major concern other than those dry cold temperatures, the temperature

trend is not going to change by much over the next couple hours. by 9:00, 10:00 a.m., those temperatures climb into the 40s, looking at the lunch hour, we're talking a 50s, peaks between 3:00 and 4:00 to about 55 degrees in the san jose area. now, out here san francisco, 41 degrees right now. and over the next couple of hours, those 30s are going to turn into 40s and those 40s are going to remain in the 50s so very cold temperatures in the forecast throughout the remand over your day. so make sure to bundle up and please bring your pets indoors. i know i have a little puppy myself and i went ahead and bought him a sweater. i got to make sure he's nice and warm, especially when i take him out to use the restroom early in the mornings. on sunday, we are waking up to those chilly temperatures and that frost could become an issue for their wind capitchill. turn on the heater and hang out in the carn, until that melts away. by monday, those temperatures remain in the 50s and we are going to see some cloud cover

but as high pressure begins to dominate as we head into tuesday and wednesday, those temperatures start climbing into the 50s and by wednesday night, we are seeing a trough that could bring the possibility of seeing some rain in san francisco and that could also bring the slight chance for some rain in the inland areas. now, those icy temperatures are expected to remain into the 20s and 30s, especially for areas like the south bay, once again, the tri-valley, dropping down into those 20s so it's going to be really important that you stay indoors if you can. 59 degrees by monday and tuesday, that high pressure building us back up into the 60s for some nice warmer temperatures. by wednesday, we see the trough make its entrance which could bring a slight chance for rain. i'm not going to rule it out entirely, though. as we head into next weekend, we are going to see drops in the temperatures yet again but today's main event, it's going to be cold out there. so, you've been warned. kris, i'll send things back to

though, again, you're going to want to bundle up wherever you are. nbc bay area responds to two senior citizens who hit a roadblock with a return policy. they spent six months fighting for thousands of dollars, unsuccessfully. they were concerned they'd never see that money again. so, they asked consumer investigator chris to help them get their money back. >> reporter: let me introduce you to carol and al. >> we met online. >> online dating. >> reporter: as young as this boyfriend and girlfriend might feel, they're dealing with the realities of aging, including loss of their hearing. >> my children are always after me, you can't hear, mother, you can't hear. >> my hearing, i think, started when i was in the marine corps. >> reporter: so they visited this miracle ear location for his and hers hearing aids. the invoices they showed me list a price of $4,500 each. carol says the sales person assured them with a moneyback guarantee. >> i'm sure we can bring them back within 45 days, oh, yeah,

no problem. >> reporter: since there was no risk, carol and al took out a line of credit inside the miracle ear office and bought the hearing aids but within a month, they weren't fitting right and weren't improving their hearing enough to justify spending $4,500 each. >> it was a little bit better but not much better. >> reporter: carol and al tried to return the hearing aids but they were astonished when a manager refused to take them back. >> i said, look, why don't i just take these hearing aids and i'll put them on your desk and you give me a receipt. he said, no. i said, i'll put them back on the hood of your car. >> reporter: they told me they made calls and sent letters and got nowhere and then the 45-day return window expired so they contacted us. >> just let us return them. like you said in the agreement, let us return them. >> reporter: first we checked with the california department of consumer affairs. it told us the 45-day return policy for hearing aids isn't a miracle ear bonus. it's part of state law. the song/beverly act says if

consumers aren't happy within the first 45 days, the seller must make adjustments. then, if the consumer still isn't satisfied, give them a complete refund. so what happened at miracle ear? we called the company that owns this miracle ear franchise. it declined to discuss the case, citing hipaa, the health privacy law, though the next day, carol and al told me they were invited to return their hearing aids. >> you finally put a little pressure on miracle ear. >> reporter: next we asked miracle ear whether carol and al will get a refund. the franchise ceo sent me an e-mail saying all parties signed a confidentiality agreement. for any of us to discuss this with anyone else would put us in breach of our agreement. after that, carol and al told me they could only say they reached an amicable resolution, which they are confident we brought about. >> thank you so much for your help. really appreciate it. >> reporter: perhaps it's time for these kids at heart to celebrate. >> we do some dancing out here in the parking lot.
