east day shopping center during business hours. this is new video this morning. the incident happened about 9:15 at the crossroads shopping center in pleasant hill. the windows of several businesses in that sthoping center were hit, but police say luckily no innocent bystanders were struck. investigators believe the shooter and the victim left the scene before police arrived. pleasant hill police say this is first shooting in that area in several months. "today in the bay's" tom jensen is heading to the shopping center and will speak with some of the businesses affected. a closer look at the damage left behind as well. we'll check in with tom for a live report. two people are locked up in connection with a stabbing death of a man inside a target store. the hayward store was packed with shoppers on christmas eve when witnesses say a 36-year-old man was involved in a fight with two men. he was stabbed and later died. police arrested two men in their 20s. this morning the search is

on for the chief who stole a menorah from a san francisco park. people are wondering was it a hate crime. people are other faiths are coming together in a show of solidarity gathering in washington square park to light menorahs, keeping the hanukkah tradition alive where someone stole a six-foot-high menorah. >> it is a hate crime for someone in such a public space to take a symbol that means just joy, they have had to be in such a dark space in their life. >> officers tell us they hope to find security video that will provide clues. a group called north beach neighbors say that will put a menorah in the park next year with additional security. this morning we're keeping an eye on new laws set to take effect this sunday, january 1st. one is specifically targeting distracted drivers. starting zwran air 1st, drivers

are not allowed to use their cell phones at all while driving unless they're using hands-free device or voice operated command. it calls for phones to be mounted to the windshield or dashboard if you plan to yous them when you're driving. those caught violating the law fats $20 for the first offense, $50 for the second. we are expecting bay area malls to be busy, some stores promising bigger deals than before christmas. experts say it was a record braking holiday season. people spend an estimated $1 trillion for guests. a huge year for online shopping. 15% more people shopped online this year, and according to the national retail federation, 10% of gifts are returned each year. those gifts are valued at $60 billion. >> really? just 10%? i'm a little skeptical about that. >> i will not return the gift you gave me, however.

then down to san ramon and pleasanton and also livermore, and napa as well as santa rosa and down 101 to san rafael. all those areas with freezing temperatures and then we warm up into the mid 50s today, 58 degrees in the north bay. and looking at or next chance of rain in the forecast showing that there will be some showers moving into parts of the south bay. this will be a storm system off to the south and east of us. so only a few parts of the bay area may see some of that rain. as we go into saturday, it will be very close by. something we'll put in the forecast just in case there's a shift in the direction of that weather system and then for the new year, it looks like we could see some more wet weather moving in along with chilly temperatures, but not showing a lot of rain here, showing the potential of up to a half an inch for most of us, and then a big chill may be ahead as we go into the first week of 2017,

cool air dipping in as high pressure sets up just to the west of us. temperaturewise, we are looking at some highs in the mid to upper 50s in san francisco and some spotty rain for the weekend. happy new year, we'll say that, with a chance of some showers moving in on sunday in the near term. we'll enjoy a nice warmup. up to 66 degrees on thursday inland. we'll keep an eye on that. let's head over to vianey for a look at what's happening on the roadways. >> i don't think anybody is in a rush to get to work this morning because the roads are looking pretty good out there. i think a lot of people might still be sleeping in from the holidays and that holiday eating. right now the roads overall looking pretty clear. chp was reporting slowing on your san jose 880. that's because there appeared to be a car that was actually traveling through the center divider and ended up blocking the center divider. we'll keep an eye on this right now. not showing any slowing down or any backup. of course, that could all change as more people begin to hit the roads early this morning.

let's take a look at the south bay drive times. if you're heading northbound towards the u.s. 101, about a 20-minute drive. northbound 280 towards 85, a short smut of about seven minutes. northbound towards highway 101 at about 21 minutes. more coming up in just a bit. now turning to wall street, markets reopen today after the holiday break. a few more days of trading left in the year. >> the push towards 20,000 continues for the dow. for that we turn to kate rodgers live from cbs's world headquarters. the dow taking another stab at leaching 20,000, after coming within 13 points last week. stock futures are higher. market value expected to be thin as many traders are on vacation. look for economic data on home prices and example confidence.

the dow rose 13 points 2019,333 while the nasdaq was up. the national retail federation says about 10% of holiday gifts are returned with the majority made at brick and mortar stores. that gives retailers a chance to clear unsold inventory. analysts say the week after christmas could account for 14% of total holiday sales. the strength of "rogue one" is helping push the box office to a recovered. hollywood projected to take in more than $11 billion. ad lib the cold it is 4:54 on your tuesday morning. perhaps some of that very light traffic out there this holiday week returning to normal this morning. we'll see in the hours ahead. one thing is for sure, it is very cold. the east valley area actually right now in a freeze warning. kari hall will have more on that. still awaiting word on the condition of a person rescued from a shrift in san mateo county. it happened last night at pillar point bluff. someonended up in trouble after

their boat capsized. it took them about an hour to pull off the rescue. the perp was then taken to the hospital. once again, we're waiting for an update on his condition. a followup on that massive sinkhole that opened up in a michigan neighborhood. crews have started pumping sewage into a river in the detroit area in order to prevent flooding. investigators believe the sinkhole opened up because of a sewer failure 60 feet below a home that partially collapsed. the sinkhole is 250 feet wide and 100 feet long. people in about two dozen homes were forced to evacuate after the sinkhole started forming on saturday. a child is dead after a dump truck crashed into a home in north carolina. workers were clearing a lot at the top of the hill yesterday loading debris into the truck. a worker thought the brake was on and left the truck unattended. the truck rolled down a hill and into a nearby home and hitting a child playing in the driveway.

police are still investigating but says it appears to have been a horrible accident. even by chicago's very violent standards, this weekend, virtually unparalleled in recent history. chicago experiencing dozens of shootings and death. police say a dozen people are dead and more than 50 others recovering from gunshot wounds just from the christmas weekend. this year's numbers are worse than last, and the violence is unrelenting. just this year nor than 4,300 people have been shot, almost 800 others have been killed. >> this is a sickening reality, it shows yet again that our penalties for carrying and using guns here in chicago are just not an effective deterrent against repeat gun offenders. >> for added context, you have to go back to 1998 to find more than 700 homicides in the city of chicago. in the next couple years, city officials plan to hire nearly a thousand new police officers.

they'll be targeting gang members authorities say are responsible for the majority of the bloodshed. >> happening later today, the japanese prime minister is joining president obama at joint bay pearl harbor for a historic visit there. prime minister shinzo abe's plane landed in honolulu yesterday morning. president obama is in hawaii for his christmas vacation. this will be the first time a japanese prime minister has visited that memorial at the site of the 1941 pearl harbor attack. the visit comes six months after president obama became the first sitting u.s. president to visit hiroshima to honor victims of the atomic bombing in world war ii. there is a major problem with garbage in the sierra. holiday travels packed into the park yesterday to go sledding. traffic was a mess. traffic wasn't the only issue. people left piles of broken
