time off. vianey once again has weather and traffic on this last friday of the year. >> yeah. i think we are going to start seeing more cars on the road. i think it's because people are trying to get to their new year's eve destinations. if you're heading to southern california, you may want to pay attention. there could be some rain as you make your way down there. right now temperatures in the 40s. 42 for the south bay. peninsula 48 droes and the tri-valley had a chilly overnight, 37 degrees. but we are expecting these mostly clear skies to start seeing cloud cover increasing as we head into a later portion of the day. that's because we are tracking a storm system that is expected to bring the possibility of a few showers to the further southern counties like month ray. san francisco 46 degrees. right now here are today's highs. we will be climbing yet again into the 50s. enjoy the temperatures now because we have two cold snaps on the way for the first week of 2017. what that means is that we could have the possibility of seeing

record lows. right now temperature trend in the 40s. i'll a check of what you can expect in terms of your commute. right now out on the roads the map is looking pretty green which means no major accidents at the moment. now to a story that is developing right now. in the past few minutes, russian president vladimir putin condemned a new round of u.s. sanctions around russia, but said moscow will not be retaliating by expelling american diplomats despite the promise by his foreign minister. in the meantime president obama is sending nearly two dozen russian diplomats packing, including two in san francisco. edward lawrence is joining us live from washington, d.c. what are you hearing from capitol hill? >> reporter: exactly, sam and kira, this is all unfolding as you said. the russian foreign minister has said that he wanted to ban or expel 35 u.s. diplomats from russia and also ban them from

using two buildings. we know vladimir putin says he will not expel the u.s. diplomats out of russia. we don't know what further action possibly could be taken. the russians have said they will retaliate from this. >> reporter: president obama used an executive order to take sweeping action against russia for repeated hacks during the presidential campaign. security experts believes this sends a message. >> it will have ramifications not only for president putin but any other nation that tries in the future to interfere in our election. >> the obama administration expelled 35 russian intelligence operatives, closed russian-owned build deposition in maryland and new york and sanctioned russian intelligence agencies as well as businesses that provided support for russian hacking. the move has bipartisan support in congress. >> i think the sanctions need to go beyond what it is today, there's a need to name putin as an individual and his inner

circle because nothing happens in russia without his knowledge or approval. >> reporter: others question the timing, saying this action should have happened before the election. president-elect donald trump issued a statement saying it's time for our country to move on to bigger and better things. it goes on to say he'll meet with the intelligence community next week to get the facts. >> it's simply stunning to me that president-elect trump can publicly say we ought to move on with other looufs and in this age of cyber security nobody really knows what's going on. >> reporter: the russians dismissed the accusations and sanctions as a seen of aggressive u.s. foreign policy. live in washington, edward lawrence, back to you sam and kira. back here in the bay area, in u this morning, broken glass and boarded up doors and wind windows. this is our first look at a san jose cvs store after a driver crashed their car into a building and through that brick wall. this happened on the 6900 block

of almaden expressway. fire crews were called just after 2:00. it's still not clear if anyone was injured. now to a story you will only see on nbc bay area. a broez en robbery in san francisco leaves a jewelry dealer beaten and shaken up. it happened on utah street off the 101 freeway. the man you see being treated by paramedics was hit in the chest by at least three men as he was leaving the jewelry center. about $400,000 worth of diamonds and gold was stolen. >> they probably waited for him to go in, watched him and when he came out, they got ready, ran out and jumped him. >> fortunately the robbery was caught on surveillance tape. we are told the video was poor quality. a south bay pet owner is pushing for answers this morning after their 2-year-old dog honey suddenly died days after getting a haircut. >> "today in the bay's" thom jensen joining us live from san jose with the response from the

pet groomer which says they are not to blame. thom, good morning. >> reporter: good morning sam and kira. yes, the pet groomer says it was president their fall. the owners disagree. they say they brought their dog here to showtime pet grooming in san jose and when they got her home she was not in good condition. they say he and his wife don't know exactly how their healthy 2-year-old dog honey was injured causing her death. they took her to get a haircut last week at showtime pet grooming. peter says when he picked her up, she couldn't move her back legs. the next day her body was paralyzed. days later she passed away from what her doctors call a fractured spine. the groomers say surveillance video shows honey was limping when she came in and already was injured. >> i'm absolutely 100% certain that no one on my staff injured honey. i would never have anyone on my staff that would lie to me or

injure an animal. >> reporter: as we said, honey died just days later after she came home. a veterinarian told her, as we just reported, she had a broken spine. the owners do want help from the state legislature. they say they are taking their fight to the california senate. they want the senate to introduce and push forward a bill that will put stronger regulations on pet groomers. we're live in san jose, thom jensen, "today in the bay." >> awfully sad outcome for the family. thank you very much. appreciate that report, thom. bart service is back to normal after a person walking on the tracks ended up forcing a major delay. police searched the transbay tube near the embarcadero station for more than an hour trying to find that man. trains in the meantime were stopped in both directions. the man was finally arrested around 8:00. an attempt to keep drunk drivers off the roads this new year's eve, some bay area transit agencies are offering free rides to anybody who needs one. >> "today in the bay's" pete

suratos is in san francisco with details on that and the preparations under way this morning. good morning to you, pete. >> reporter: good morning to you guys. back in the newsroom and tomorrow night for new year's eve, a busy one for san francisco. here is important information you node to know if you're coming into the city, specifically if you're using public transportation. if you use muni, all rides will be free. all rides will be free from 8:00 p.m. tomorrow night through 5:00 a.m. all part of the ride muni-free special which has been in place for 17 years. here is important information for people using b.a.r.t. service extended until 3:00 a.m. service to and from the east bay will be split between embarcadero and montgomery stations. if you're coming from richmond or pittsburg bay and want to get to the fireworks show, after 8:00 p.m., you'll have to exit at montgomery instead of embarcadero. caltran has free service as well

starting 8:00 p.m. on new year's eve. sam tran will be offering free rides through 5:00 a.m. the fireworks show will be a busy one. last year sfpd said they expected more than 100,000 visitors. in san francisco, pete suratos for "today in the bay." a great public service there. there are a whole slew of new laws going into effect with the new year. let's take a look at some of them, shall we? >> yes, we shall. california's minimum wage is changing. it's going up to $10.50 for companies with more than 25 employees. companies smaller than that have an extra year before that increase. >> there are also some new rules for assault weapons, magazines holding mr than ten rounds, high capacity magazines are about to band. >> a new law is aimed specifically at law enforcement.

if officers are leaving their gun in the car when they're not in the car, they need to be stored in a trunk or a hidden lock box just like civilians. >> there are changes coming to sexual assault sentencing. probation will no longer be an option for people convicted of sexually assaulting someone who is unconscious or severely intoxicated. happening right now, snow is piling up across the country in the new england area. a fast moving nor'easter is making its way across the region. road crews are encouraging drivers to stay home. the snow is not all bad. ski resorts were packed yesterday. staff in one resort said the fresh powder came at the best possible time. good morning. waking up to slightly warmer temperatures across the bay area. we will one day again -- not one day again, today enjoy a little sunshine before we start seeing cloud cover into the evening and overnight hours because we're tracking two storm systems. right now in san francisco, 45

degrees. only expecting to get warmer, climbing into the 50s. yesterday we did see 60s across the bay area. san francisco also 42 degrees. a quick plan for your day. over the next couple hours, once again climbing into the upper 50s. by about 11:00 a.m., 52 to 56. the san francisco area climbing into the 50s by midday as well. by noon, we should be at about 54 degrees, topping out at 57 degrees. right before we get the cold snap this weekend, enjoy the 50s. we are expecting to see the return of the 40s as we head into next week. now let's get a quick check of the roads, but first a seven-day outlook. we are tracking the showers as we head into saturday. right now it looks like for the most part the further southern counties will get the brunt of it, landing in southern california as well. out on the roads right now across the bay area, we're seeing nice and green.

by him. when his trials happened last year, the school required at least a 4-1 decision to find a person responsible. since then the school has changed the structure to a three-person panel and the decision must be unanimous. stanford says this is to avoid wrongful judgments. critics say it's stacked against victims. the number of people living without a home in santa clara county has been going down, but the amount of homeless deaths has skyrocketed. more than 120 people have died? santa clara county this year. that's almost double the figure last year. the highest number in at least the last six years. "san jose mercury" news says a doctor from the county coroner's office has started analyzing those deaths trying to figure out the patterns or trends for the last six years. a new city ordinance is trying to keep the huge rent spikes in richmond at bay. the richmond fair rent just cause for eviction and homeowner

protection ordinance goes into effect today. a city councilwoman said rent in richmond is rising sky high, and if they keep rising, people will be forced out of the city. a similar measure was supposed to g into effect last year. some people living in richmond say it was blocked by the california apartment association. a new law was voted through on the november ballot. it turns out unlike other holidays, christmas, hanukkah, for example, americans aren't planning to spend a lot of money on this new year's eve. >> frugal. for that and the rest of the news before the bell we turn to landon dowdy live at cnbc world headquarters. good morning, landon. >> sam and kira, that's right. they've got to save up. a quick check of wall street. wall street could start the final trading day of the year in the green. futures are higher this morning. the dow is going to need a nice rally to get to that 20,000 mark before closing out 2016. stocks falling. they are positive for the market.

s&p 50 up 8%. the top sector of 2016, energy, on pace for its best year since 2007, that's thanks to a 45% surge in oil prices. unlike other holidays, americans may not spend as much as new year's eve. wallet hub says 83% of people will spend less than $20. among the top resolution, a third of people want to pay down debt and save more money. uber drooifrs will be busy on new year's eve. the company expects to provide more than 15 million rides across the 450 cities that it serves. that is three times as many as last year. uber is reminding users to plan around the most expensive times, that's midnight to 3:00 a.m. unlike past years, uber ships you the cost of rides up front. just into our newsroom this

south bay. peninsula 48. in the tri-valley 37 degrees as well. as we head over to the san francisco area we are seeing 40s in the forecast. they actually have been slightly warmer all morning long. i think it is because they aren't expecting to see a big drop in the temperatures, at least not until next week. san francisco in the nice 40s. looking ahead to today's highs, we are expecting to be in the 50s and lower 60s as well for the bay area. by the afternoon, yes, we will start seeing some increase in cloud cover, and that's because we are tracking that subtropical moisture that is expected to bring rain to so cal this weekend just in time for new year's eve. if you do have a commute and you're making your way down to southern california, listen up, you may be catching some raen. tonight heading into tomorrow as well. i would say the worst travel commute time will be in the evening hours. that's when they're expecting the majority of the raen fall. here is a look at rain totals. l.a. expected to get the

majority of the rainfall. for us in the bay area, we aren't expecting much chance of rain tonight heading into saturday. if anything, maybe the furthest southern areas might see spotty showers. your new year's eve plans, a quick rundown of what we can expect. new year's eve by 10:00 a.m., the storm system begins to make its way through the southern area up into the south bay as well. 44 degrees as we head into the 4:00 hour, 51 degrees. by midnight, 40 degrees. it's still going to be chilly, but not expecting rain. thankfully that rain is expected to clear out just in time for all those celebrations. here is a quick look right now at your new year's day forecast. by 10:00 a.m., 43 degrees. the beginning of 2017 is going to be off to a very cold one as we head into the 8:00 hour. that cold snap comes in and a second storm system makes its way in from the north. that's going to drop our temperatures down into those 40s. look at this.

of louis road. that's off 101 in welcome back. we have breaking news on the peninsula. a home is on fire right now in palo alto. they received the call about 5:00, just 25 minutes ago on the 2100 block of lewis road between embarcadero and the oregon expressway. it's not clear if everyone made it out safely. we have two crews heading that way. we just received word there is a possibility that one person is trapped inside. we will bring you a live report as soon as our crew arrives on scene. in the meantime, a heartbreaking situation. it started out that way for a brazilian family visiting the bay area. then it took an unbelievable twist thanks to the generosity of one of our viewers. >> it is incredible. the brazilian family just landed in san jose tuesday night for their first trip to the u.s. they stopped at an applebee's to eat. that's where thieves broke into their represental car, stole

"today in the bay's" edward lawrence is live in washington watching all of this unfold. edward, what are you hearing on capitol hill? pardon me, this is pete suratos with a live look at what's going on in san francisco. pete, as we just mentioned, two diplomats being kicked out of the city. what are you hearing locally this morning? >> reporter: good morning to you, kira. a federal source is telling nbc bay area at least two russian officials have been ordered to leave the consulate you see behind me here in san francisco by this weekend. of course, this is a part of the heavy sanctions on russia being handed down by president obama. it's being called a forceful response to russia's cyber attack on the u.s. the intelligence community claims it influenced the past presidential election. the president wants 35 russian diplomats including those in cities like right here in san

francisco and in washington, d.c. out of the country by this weekend. employees at the consulate in san francisco -- wouldn't comment on plans to leave only calling the order, quote, unfriendly. but some are worried about escalating tensions. >> it's a small planet. it takes very little time to fly around the planet. so we have to find ways of being in peace. >> that new development you mentioned is that ruks president vladimir putin responding this morning saying he's not going to retaliate in response to these sanctions by expelling american diplomats but says the sanctions are, quote, a provocation aimed to further undermine russian-american relations. many here hope the situation can be deescalated by president-elect donald trump. we'll keep an eye on new

developments this morning. >> from the russian consulate. pete, thank you very much. 5:35 on your friday morning. a story you'll only see on nbc bay area. a family's dog dies and now there are questions about whether a recent trip to the groomer played a role. the 2-year-old dog went for a haircut and five days later died. the groomer says it's not their fault. they say they have proof. later she passed away from what her doctors called a fractured spine. the groomers say surveillance video shows honey was limping and was already injured when she came to their shop. >> you see honey walking away from the camera, her legs seem stiff and eventually cross. that's a very unnatural position for a dog. she definitely looks like she's in pain. >> reporter: honey died just after she came home. a vet naern told the cruzes her spine was broken. she died from that injury. now the owners are talking to the state legislature, wanting the california senate to introduce and help pass new legislation that will better regulate groomers. in san jose, thom jensen, "today in the bay." now to the christmas eve stabbing in an east bay target store. yesterday cameras were allowed in the courtroom, but the of the ds never appeared. attorneys for those co-defendants, jesse archuleta and her brother frankie waived their right to appear in court.

the two are accused of stabbing tyrone griffen when he was shopping with his 4-year-old son. witnesses say it happened after griffin asked the archuletas to turn down what he considered inappropriate music for them to be playing in the toy section. one defense attorney said it would be inappropriate to have his clients appear yesterday in front of the media. >> when this case does end up going forward, i expect he'll be fully exonerated and he was acting in self-defense. >> according to the police report, the victim, griffin, grabbed a wine bottle off a shelf and hit frankie with it. griffin's widow, however, doesn't believe that, saying she will wait to see any surveillance video of the fight and tells us show hopes the investigation will be thorough. 5:38 right now. for the first time we're hearing from the family of a 14-year-old san jose boy who was killed by a suspected drunk driver, just a devastating accident on christmas morning. there's a picture of what it looked like afterward. andrew nguyen died christmas

morning when the car he was riding in with his parents was hit on capital expressway after the driver came over the median and collided with his car directly. now the family of the evergreen valley freshman released a statement. the family is devastated but will celebrate andrew's life. they also wanted to thank the first responders who were at the scene of the deadly crash and ask for privacy. to keep drunk drivers off the roads this new year's eve, many bay area transit agencies are running special schedules tomorrow. samtrance and ac transit are offering free service on all bus lines from 8:00 tomorrow night until 5:00 a.m. sunday, new year's day. caltrain rides also will be free after 8:00 p.m. that's when caltrain will start running on a special schedule. those rides will end around 2:00 a.m. sunday. b.a.r.t. rides aren't free new year's eve night, but there will be special tranes running on a schedule from 8:00 p.m. to 3:00 a.m. b.a.r.t. will also have extra
