>> down ten. big comeback. they end it with a second remaining on the clock. we'll tell you much more about that game coming up in a little while. >> i sounded like i knew something about it. they're saying it in my ear. i didn't see it. >> i didn't see it, either. we're going to start on this tuesday morning with politics. busy day. president-elect trump stirring controversy request his newest hire, son-in-law jared kushner, as trump's first cabinet nominees face their first test on capitol hill today. the political team has it all covered beginning with national correspondent peter alexander. hi, peter. >> reporter: good morning, matt and meredith. jared kushner celebrating his 26th birthday today. 36th birthday today. to give you context, that's the same role that karl rove served in for george w. bush. david axelrod, for president barack obama. but the appointment of donald trump's son-in-law is certain to raise questions, testing the limit of the federal anti-nepotism rules.

with donald trump choosing his son-in-law to be by his side. like his business, donald trump's white house is increasingly looking like a family affair. the latest hire is ivanka trump's husband, jared kushner. he is a power broker, meeting with house speaker paul ryan to discuss tax reform. >> and he's very good at politics. >> reporter: as a son-in-law, kushner will carry a unique influence inside trump's white house. but it's raising questions about nepotism and potential conflicts of interest. to combat those concerns, kushner will step aside of his family's multimillion dollar business, and divest assets. as for the nepotism law, after jfk appointed his brother as attorney general, his lawyer says it does not apply to the white house. pointing out hillary clinton heading up her husband's health

care reform efforts. ivan ka trump is also stepping back from the family business, but her new role is yet to be decided. while kushner won't receive a paycheck and won't need congressional approval, today, the senate begins a speed round of confirmation hearings for the prgt president-elect's top cabinet picks. >> i think they will all pass. they are at the highest level. >> reporter: first up, the first senator to endorse trump, jeff sessions, in line for attorney general. but expected to face tough questions over accusations he made racially insensitive remarks decades ago that blocked him from a federalship in the '80s. and john kelly, trump's choice to lead homeland security. three on wednesday. including rex tillerson. and three more on thursday. >> several high, important hearings will fall on the same day, depriving senators and the american people a chance to properly participate. >> reporter: nbc learned that three picks have failed to pass

the ethics reviews. and while the transition team insists all forms have been filed, the ethics office calls the fast pace unprecedented. republicans dispute that. >> everybody will be properly vetted as they have been in the past. >> reporter: these confirmation hearings mark the first showdown between the incoming trump administration and democrats here on capitol hill. donald trump's team is confident the nominees will all be confirmed. they say they put the work in touting these numbers, including 70 hours of mock hearings, and say each nominee has been peppered with 120 practice questions per session. matt, back to you. >> peter alexander, thank you very much. jamie gorelick, jared's attorney. also deputy attorney during the clinton administration. miss gorelick, nice to see you. >> good morning. >> can jared kushner, who is a successful businessman in a wide range of businesses from real

estate to publishing, divest his direct interests in those businesses in time by next friday? and can he also separate himself from the appearance of links to businesses? >> he's going to do three things, matt. he is going to step away from his businesses. he's going to extricate himself entirely. that's number one. number two, he's going to divest many of his assets. and number three, for assets that remain, he'll follow the normal recusal procedures. and those are the ones that have been followed by scores of people over decades of experience. >> he's going to sell some of his interest to his brother. he's going to sell other interest and place it in a trust that's controlled by his mother, a prominent attorney, who used to work for rand paul. matthew sanderson says this sounds like a shell game. because you're taking an asset and just moving it to a family member. why isn't it a shell game?

>> he's in a family business, and consistent with all the federal rules, one can sell interest to another family member. he is not going to be a beneficiary of this trust. he's not a contingent beneficiary of this trust. i'm very comfortable that this arrangement is appropriate under the rules. the office of government ethics has given us advice and we followed it. >> there's a question of nepotism. how do you get around that? there are very real concerns. >> our view is two-fold. one, the anti-nepotism statute doesn't apply to the immediate office of the president, the so-called white house office by its own terms. and number two, after the anti-nepotism statute was pass in the late '60s, a decade later congress passed a law that said that the president can have total discretion over his immediate staff without regard to any other law, including the

anti-nepotism law. and we have examples of this. and i think -- i'm a democrat, and i think that a president should be able to get advice from the person he wants to get advice from. >> we had andrew card on this show not long ago, he was chief of staff for george w. bush. he says when it comes to the staff closest to the president, that person should be able to speak truth to power, give an unvarnished opinion and you should be able to fire that person. doesn't that get complicated when that person is your son-in-law? >> that's between donald trump and jared kushner. i believe a president should be able to get advice from whomever he or she wants. if hillary clinton had been elected and wanted to have chelsea in her immediate staff giving her advice, that would have been right. this is the judgment that congress made in 1978. it said that the white house office is the purview of the president. he can decide.

she can decide. >> all right. jamie gorelick. thank you very much. >> happy to be here matt. >> appreciate it. moving on, we'll talk about today's confirmation hearings and the issues facing president-elect trump's attorney general, alabama senator jeff sessions. hallie jackson is at trump tower with more on that. hallie, good morning. >> reporter: hey, good morning to you, meredith. you're seeing a gop blitz to try to boost support for jeff sessions, who is expected to face questions, in particular, about his civil rights record. sessions has been a backer of donald trump since nearly the beginning. the president-elect clearly trusting him to be the nation's top prosecutor. the question, now, of course, whether he will get the senate's stamp of approval. after decades on capitol hill, jeff sessions will be squarely in the spotlight. the alabama senator set to face

serious vut scrutiny as donald trump's pick for attorney general. not that the president-elect is concerned about it. >> reporter: there are concerns about jeff sessions -- >> i'm not worried about it. i think he's going to do great, high-quality man. >> reporter: sessions facing fire from gay rights advocates, worried about his record. and high-profile muslim-americans, like keyser kahn. >> i'm not a racist. it not insensitive to blacks. >> reporter: that's sessions in 1986, defending himself, in a bid to become a federal judge. a bid, derailed by accusations of racism. senator patrick leahy voted against sessions then. and is still skeptical now. >> i believe in a justice system that represents everybody, no matter the color of your skin, no matter your sexual orientation. >> the senator has a long record of voting for civil rights, voting rights. and he'll be an attorney general for all americans. >> reporter: as attorney general, sessions' team said he would prioritize keeping crime rates low, fighting terrorism, and focusing on building relationships with law

enforcement. sessions, the first sitting senator to endorse the president-elect, winning praise from trump's top confidants. >> he's been the leader of this populist revolt against the political elite. >> reporter: sessions' hearing is likely to stretch multiple days. he's getting support now from, for example, the senate's only african-american republican and former secretary of state condoleezza rice, but democratic senator cory booker plans to take the unprecedented step of testifying against a sitting senator. also on the witness list, matt lewis. >> it's going to be a long week. thank you very much. also this morning, a massive manhunt is intensifying for a suspect who shot and killed a police officer in orlando, florida. nbc's jacob rascon is there. jacob, good morning to you. >> reporter: matt, good morning. hundreds of law enforcement officers have been searching all day and all night for this

person. a statewide alert has been activated, their searching for a fugitive for someone that is already on the run in welcome with another murder. a massive manhunt through the night, but no sight of markeith loyd that police call desperate and dangerous on the run after allegedly gunning down master sergeant debra clayton. >> she just wasn't about the blue, but she was about the black, white and the blue. we lost a guardian angel today. >> reporter: police say clayton, a 17-year veteran of the force, approached loyd after receiving a tip he was in the area ch. >> when he realized he wasn't going to be able to get around this officer, he pulled a gun and started shooting. >> we have one officer shot. >> reporter: loyd's criminal history stretches back two decades and includes a laundry list of felony charges and

convictions. he had been on the run for nearly a month after police say he shot and killed his pregnant ex-girlfriend. last month on what appears to be loyd's facebook page, he wrote, goals to be on america's most wanted. >> we're going to bring this dirt bag to justice. and he's going to jail. >> reporter: an orange county deputy searching for the fugitive was also killed when his motorcycle was hit in a traffic accident. deputy first-class norman lewis was an 11-year veteran. >> just a loving, wonderful human being. >> reporter: as sergeant clayton's casket was escorted from the hospital, officers fought back tears, remembering her as a wife, a mother and dedicated community servant. she volunteered in programs to help young people like brandon cunningham. >> she made me a better person. she was just so much more than a mentor. >> reporter: officer marlon mcclain worked alongside sergeant clayton. >> debra was one of those people that touched your heart. anybody that met her loved her. >> reporter: officials are pleading for the public's help.

they believe the suspect is somebody whoo grew up here, likely had help with people hiding him. those people could face serious criminal charges. officials are offering a $60,000 reward and say it doesn't matter where he is, we'll track him down to the ends of the earth. matt and meredith? >> jacob, a really difficult day for law enforcement down in orlando. meantime, another major storm is taking aim at the west where days of rain and snow have already swamped parts of california and nevada. and there are new fears of mudslides and flooding. miguel almaguer has the latest. >> reporter: we're in another band of steady rain. the damage has been done. the river is still rising and there's even more rain in the forecast. overnight, more misery for water-logged california. the state crippled by drought,

now being punished by a deluge, a deadly, steady storm washing away roads. bringing down trees across the west and coating a region in ice with a brutal deep freeze. the roads turn dangerous quickly. too many spinouts to count. in washington, one family, including this 4-year-old girl, rescued by firefighters. with dozens of rivers swollen above flood stage, hundreds of evacuations were ordered in reno, nevada, while homeowners in again gernville, california, are losing ground. it's not just the river rising. mountains are crumbling. mudslides, leaving many homeowners on shaky ground and nerves on-edge. >> a mudslide, probably coming from a couple miles up the hill. came back with a vengeance, started this morning. >> reporter: this storm system

could dump as much as ten inches of rain and nine feet of snow. already in lake tahoe, 33.6 billion gallons of fresh water is poured into the lake. and even more is headed downstream. though california has suffered through a five-year drought, this is simply too much rain too quickly. we need the snowpack. but so much of the rain rushes into rivers and right into the ocean, causing millions in damage in the process. matt and meredith, back to you guys. >> miguel, thank you so much. and back from california, mr. roker. >> they're going to get more today and the areas that have been inundated, not getting the same moisture levels they had. but anything they get is going to be tough because it's already ground. you can see, we're seeing heavy showers and thunderstorms, pushing in today. this is the next round of rain and snow. flood threat, potential landslides and mudslides continuing. that's right on into wednesday afternoon. rainfall amounts, some areas

could see upwards of five to eight inches of rain. flash flood watches for 13 million people. snowfall amounts, we're talking some areas five to six feet on top of what they already got. blizzard warnings for the sierra nevada. if there's any silver lining to this, the reservoirs are overtopping right now. lake shasta, 120% of average. lake oroville, 102%. and these are reservoirs over 100% average. we're going to get to your local forecast coming in the next 30 seconds. can go back to work. or school. and that ordinary jar can make an extraordinary difference.

the embattled ceo will resign from the board of directors. if verizon's sale goes through later this year. this was not part of the original plan. last summer, after verizon announced it would buy yahoo! she said, i would stay. it's important to see yahoo! move to the next chapter. the resignation came after she rocketed to the top of silicon valley. at 37 years old, she was the youngest fortune 500 ceo. handed the herculean task of turning around an aging pioneer. falling behind google and facebook. >> she did come in as a rock star, with big dreams of turning yahoo! around. >> reporter: mayer banned her employees from working at home. after giving birth, just two weeks later, she returned to

intense fear she felt during the robbery. >> they're going to shoot me in the back. >> reporter: now word that the raid may have been an inside job. 17 arrested this week. including her french chauffeur, according to a law enforcement source. most of the suspects in their 50s. one in his 70s. and three women, a spokesman tells nbc news. detectives busting into a paris apartment and raiding the house. tracing the suspects through dna. an official source confirms. kardashian, thrilled by the developments in the investigation, her french lawyer says. >> on our way to givenchy. >> reporter: in paris for fashion week last october with her sisters, had $10 million in jewelry stolen. including a $4 million engagement ring from husband kanye west.

according to officials, five armed robbers hit her hotel. authorities say two of the masked men, bound and gagged kardashian. pointing a gun at her head. kanye, cutting short a performance in new york. >> i'm sorry. there's a family emergency. i have to stop the show. >> reporter: last week, kardashian posted a video of her family together, as french police apparently closed in on her alleged attackers. and the french prosecutor's office tells us that the french judge has until friday to charge or release those suspects. it's not clear if kim kardashian herself will have to return to france to testify. matt? meredith? >> keir, thanks very much. mr. roker is back and you're using the "b" word. >> blizzard. we have blizzard warnings that have gone up out west. and it's going to be interesting to see what happens with this. we are watching, now, blizzard warnings that include lake tahoe, into truckee, and into reno, nevada. we are talking blizzard warnings until thursday.

democratic senator, debbie st stabnow, who said these are long leads. >> i'm not a big fanatic when it comes to cars. but the self-driving cars, when do we see them on the road? >> reporter: probably on this floor by 2019 and 2020. and in the dealerships by 2020, 2021. they talk about them as autonomous cars. there's four stages of autonomy. we're in the first stage, where cars can park themselves. they can avoid collisions and things like that. but a stage four autonomous car can drive in a congested city and a steering wheel without brakes. a driver doesn't do anything. that seems to be a reality upon us in three to four years. the issue is regulation and how much insurance it will cost to have one of these things. the car manufacturers say one thing. cars driven by computers will

the weather channel. mr. lauer? >> mr. roker. a big wild card, health care expenses. a 65-year-old couple will need around $260,000 to pay for unreimbursed medical expenses in their retirement years. that does not include long-term care, something that seven in ten people will need in their lifetime. how do you plan and pay for it? jean chatzky, good morning. >> good morning. >> last week, we did a segment on retirement. the last tip you had was stay healthy. now we know why. >> that's right. long-term care can cost you anywhere from about $44,000 to $96,000 a year, depending on what kind of care you need. you need a plan to pay for that. >> let's talk about the plans. there's traditional, long-term care, insurance. who is this good for? >> this is good for people who have more than $500,000 in

assets, less than a few million in assets. >> that's a lot. >> and that's not including your house, by the way. and the reason for this, and it's true of all long-term care policies we're going to talk about today, if you have less than $500,000 in assets, you're going to spend down. and you're going to, at least the way things stand right now, qualify for medicaid, which will step in and help pick up the slack. if you don't spend down your assets, you need to cover it yourself. traditional long-term care insurance, covers care when you need it. >> but -- >> not cheap. >> a policy for a 60-year-old couple, looks like it's going to cost about $2,000 a year. and it's limited. it's not going to pay for every single year you need care. it will cap out about three. >> that's one option. there's something else a hybrid plan. who is this good for? >> the same people, over $500,000 in assets, but you pay for it in a different way because it leaves something to your heirs.

the things that people don't like about long-term care is you pay thousands of dollars a year, if you don't use it, the money is sunk. it's like traditional insurance. you can use the benefit to pay for your care. you dip into the death benefit. if you don't use it, it's there for your heirs. but it's a more heavy up front cost. >> i can see people trying to remember what you said about long-term care. put them side-by-side and see how they stack up. >> right. with the traditional policy, like i said, you have a premium a couple thousand dollar a year, to start. with the hybrids, we're looking at $10,000. but you'll only pay the premiums over ten years. or you can pay it at once. the use it or lose it is the downside of the traditional policy. here, if you have unused money, it can go to your heirs. and there's a death benefit with the hybrid policy as long as you don't eat it up.

>> we're talking about things that will happen in your retirement years. when do you start shopping for this? >> you want to start about age 50. and ramp up your shopping quickly. by age 60, chronic conditions start to set in. and that's when the insurance either say, it's going to cost you more money or we're not going to cover you at all. you want an a-rated insurance. you want to shop around. >> you mentioned earlier, some of the options were for people with $500,000 in options and above. a lot of people haven't been that fortunate. haven't been able to save that kind of money. what do you say for them? >> first of all, you got to look at medicaid and what you do to qualify for that. longevity insurance. you put money away to buy yourself a paycheck at age 65. if you have a paid off mortgage, you can look at a reverse mortgage. complicated. we should do a segment on them. it's an option. you can pay for care yourself. or what most people do is rely on friends and family members.
