well through cupertino. mass transit experiencing no delays. 19 trains on time. i'm watching for any delays. not for the coupe or or tino crash. breaking news we're following from overnight. at this hour, several roads shut down near the east ridge mall. san jose police are investigating the story's fourth homicide. >> kris sanchez joining us live with the latest on the search for a suspect. kris, good morning. well, good morning to you, sam and laura. in the last 45 minutes or so, the coroner did come and remove the victim from the scene. he is in the grassy area just to my left-hand side of the strip mall that you see in the distance. the victim is a man who was shot at least one time just around 10:00 last night. he did not sur his injuries long enough to make it to the hospital.

we are a block be from quinnby roads. it has a vision center. a cash for gold shop. and across the street is a mcdonald's restaurant. we don't know that san jose police -- we can tell you san jose police are not releasing a motive at this point. the victim's identity will not be released until a family is notified. and the crime scene investigation out here will impact traffic on actualry road in one direction particularly if you're on 101 in this area. if you drive past the mall you should be okay. mike will help us track this traffic flow in the area. kris sanchez, today in the bay. 4:33. more testimony expected in the high profile murder case can of he sierra lamar.

yesterday it was said deputies did not follow protocol, hinting deputies may have tainted it. and no visible hair found in the trunk of garcia's car. lamar's body has never been found so dna evidence will be critical. >> it wasn't properly analyzed, not properly collected. it can undermine a case where there is no crime scene and no body. >> prosecutors called the first witness yesterday. the sheriff's deputy who responded to the first call when sierra lamar disappeared. it will be another busy day on capitol hill. we are now in day 13 of donald trump's presidency. there's on the agenda.

the next storm system set to move in late don't. it may start out with light rain. this system moving west to east. the coastline will see showers and a wide swath of cloud. here's the center of the storm. still well to the west of us. it will will take a couple days before it works its way in. more unsettled weather in the forecast. looking at the timeline of this, may start to see light sprinkles for the north bay. that's it for much of the afternoon. later on on, more rain filling in. it looks like it may take a while before it makes its way to the ground. spotty showers 8:30 tonight. much heavier rain moving in. we'll have coverage of it all as we see gusty winds and times of rain early tomorrow into the afternoon.
