balance of the court. >> reporter: the bottom line the democratic base is anger about president trump temporarily travel ban has turned up the temperature in congress making it hard for democrats to be seen supporting the president on anything. senator lynnzy graham if they filibuster gorsuch it would be a great disservice. he has his first meeting on capitol hill with majority leader mitch mcconnell. >> thanks. >> and for more on the president's pick and what's next let's bring in justice correspondent pete williams. good morning. >> reporter: good morning to you. >> clear the republicans are happy about this choice. what are they getting with this man? >> reporter: they're getting somebody who interprets the law like justice scalia did. it should be interpreted based on what they say not their intent. the constitution should be looked at in terms of what the founders had in mind. he approaches the law as scalia did and he's somebody who they believe will fit in well.

he has a nice temperament. he's not acaustic and he was a lerk to justice anthony kennedy. he will the first to sit on a justice that he wants clerked for. i think one of the thoughts behind this by conservatives was maybe that will make justice kennedy feel comfortable about retiring while president trump is still in office so he can put another justice on the court. >> any time you go through a confirmation hearing for a supreme court justice it's coninterrogation. it should be because it carries such weight and consequence but add in anger over the election, anger over mar rit garland, anger over this so-called stolen seat and even the first ten days of the trump presidency and what are we in for? >> reporter: it'll be several weeks for the confirmation hearing so that's a good thing for this nominee. i think you're right. remember the fight over garland the republican said it was about

prison pel now the democrats are saying the same thing. to a large extent this isn't about gorsuch, it's about the fact that garland never got a hearing so that is going to be a major issue here for the democrats. >> pete williams at the supreme court. pete, thank you very much. andy carr knows what it's like to take a supreme court nominee through the confirmation process. as president george w bush's through that same process, his picks. good morning great to see you. >> thank you. >> take me into the trenches you know what this is like when it comes to the bush white house, when it comes now to the trump white house, what can they control, what can't they control? >> first of all i think president trump did a good job. he took this very seriously. i was impressed with the list he put together way back during the summer when he was running for president of people that he would consider. i thought the people on the list were all credible. he's made an excellent choice and i think he rolled it out

particularly well. so he's done the right thing in terms of setting the stage for what will be a tremendous debate and yes, it will be all hands on deck trying to get this person confirmed as it always is for a supreme court nominee. >> do you think the democrats will be able to put idealogical and separate it from personal anger? >> i don't think they will be able to do that but they should work very hard. they should see this as a constitutional responsibility rather an political opportunity. this is a constitutional opportunity to do what's best for the country. president obama clearly when he nominated a nominee of the supreme court there were republicans that thought that it was a good thing to do and they wanted to see the process go forward. it didn't go forward. that's behind us. it wasn't done politically. it was done at the end of a term. that's not an unusual thing to have happen in the debate. i can remember for george w bush

not to put something on the supreme court because there was an election coming up. i do think this process should be very serious. i'm glad that the judge is going to go up to capitol hill and start his visits. the process is deliberative, slow. you have to develop personal relationships and answer questions but i hope that it will be done respectfully. this can happen. i think this is an outstanding choice. it's a choice for the future not from the past. i think it should be the democrat should be the president the benefit of the doubt and do their responsibility. >> it's going to take 60 votes for confirmation that means the republicans have to get eight democrats to come across. it seems they'll target red states democrat who are facing reelection. do you think it is possible if this goes very badly that mitch mcconnell in the senate will do away with that 60 vote threshold and go to a simple majority? >> well, i'm hoping that the

senators will recognize the responsibility is not to play partisan politics but to do the right thing. if that does happen i'm quite confident that there will be 60 votes to allow that nomination to go forward. if they don't, if politics is going to rule the day, then i do think the republicans should say, we're going to take advantage of the so-called nuclear bomb and change the rules but the nuclear option is not one that i would invite but it's one that the republicans should have in the wings if they need it. this shouldn't be a partisan issue. >> think about the position that puts mitch mcconnell in because if he goes to the nuclear option, he is guaranteeing four years of war in washington. if he doesn't, he faces the wrath of president trump. >> well, i'm hoping president trump will not exhibit wrath on the republican leader in the senate. mitch mcconnell has a tough job to do to lead the senate and do it on behalf of the president

but it's really bigger than the president. a nominee to the supreme court is much bigger an article 1 or 2 it's actually article 3 and this is the opportunity for article 1 and article 2, congress and the president to demonstrate the ability to work together to get something done so that article 3 has its full compliment of justices. i think it can happen and i'm hoping they'll do it. >> former white house chief of staff thank you. nice to see you. >> good to be with you. >> now to another major showdown in washington. democrats are taking steps to stall confirmation votes for several of president trump cabinet nominees. nbc hally has the latest. >> reporter: good morning to you. we know that supreme court nominee neil gorsuch will be making those meet and greets with members of congress today but that is hardly the only action on this end of pennsylvania avenue. democrats are set to take a stand again today against some

servant of this great country. >> he is currently a judge on the 10th circuit court of appeals. some democrats are vowing a tough confirmation battle. >> new fallout over the president's executive order on immigration on tuesday. democrats skipped scheduled votes for trump's picks for treasury and health secretary and delayed a vote on his attorney general nominee, senator jeff sessions but republicans expect that all three will eventually be confirmed. and there are reports that an internal memo at the state department protesting trump's order now has more than 1,000 signatures. and volkswagon has now agreed to pay more than $1 billion for buybacks and compensation to u.s. owners affected by its emission scapdal. the proposed settlement was filed last night and covers around 75,000 vehicles. another 500,000 smaller engines are covered by an earlier settlement deal.

==topvo== deadly shooting at a san jose good morning at 8:26 on your wednesday. i'm sam brock. police right now investigating a deadly shooting at a san jose strip mall. it happened last night at about 10:00 on quinnby mall. they found the unidentified man before 10:00 suffering from one gunshot wound. he died on the scene. at this point, police are not releasing a suspect description or possible motive. the investigation ended up closing a section of the road through the early morning hours. this marks san jose's fourth homicide of the year, and it comes on the heels of what was last year a 25-year high in homicides. mike is tracking some problems on bridges. one is better, but the dumbarton has a problem. >> san mateo better. dumbarton, disabled vehicle.

they're in a discussion group, they go around the circle or the room and say their name and their pronoun. so i thought, we're seeing something transformational happen here. i went to yale. i talked to young students there about sort of the new language of gender. there is an entirely new vo k vocabula vocabulary. i chris crorisscrossed the coun talking to people about this. >> you looked at the science side, as well. let's talk about the conversations. you talked to the parents of, i think, a 4-year-old. >> 5-year-old now. >> born as a boy who, i think, at 4, said to them, in my heart and my brain, i'm a girl. >> that's right. >> a lot of people hear stories like that, of a child at such a young age and they say, it is too early to know. >> i know. in fact, i really tried to put myself in the shoes of people who weren't that familiar with the topic. i visited with the fords, a wonderful family in washington, d.c. their son did, at four, say, i'm

a girl in my heart and my brain. these parent parents, i think n understands the struggle they go through. i asked, how does somebody know with certainty they feel this way? they get professional help and know their child. the fact of the matter is, some kids just feel that way. it is a social transition, by the way. they're not doing surgery or any kind of pharmaceutical intervention. >> right. >> in this case. but they see their child completely change when their gender is affirmed. 40%, matt, of transgender people attempt or commit suicide. so this is a matter of life and death for these families. >> let me go to the other end of the spectrum. a 5-year-old boy to a couple. they've been married for 45 years. linda's husband, bill, tells her he is transgender and goes by kate. i want to show a clip. >> i said, i don't know how to tell you this, but all my life, i've believed i'm a woman. that i'm female.

and that i am, therefore, transgendered. i looked at her. she started crying. >> and the reason why i was crying was more out of sadness for the struggle. >> i think people have a hard time? gener in general, understanding what it is like being transgender. and i think, linda, they have a hard time understanding the partner of someone who decides to transition. you are staying together? >> yeah. >> how do you explain it to them? >> the way i look at it is that we all are given challenges in life. and this is one challenge that i felt that i could deal with. >> it is an extraordinary statement. to say challenge, that is almost an understatement. >> i think it took linda some time. i've been fascinated when i hear about the partners remaining as a couple. and i thought, they're an

extraordinary couple, but she prayed a lot about it. you know, i think for those of us, of our age, who grew up in a very strict binary construct, it is very hard for us to wrap our heads around it. i, you know -- they're really happy. they're in love. and their children are also very supportive. >> you know, i think a lot of us think of caitlyn jenner and what she did in the last couple of years. but we're also of an age where we remember some of the pioneers in this area. you talked to some of them for the show, as well. >> you'd get a kick out of this, matt. i went golfing with rene richards, who loves golf. she, of course, is the tennis legend who was on the front lines of this. she got gender confirmation surgery many years ago. i talked to rene and a young trans model/actor. what is interesting, there is such a generational divide here, matt. 50% of millenials believe gender is on a spectrum.
