good saturday morning to you. it is 7:00 and we're taking a live look outside of communications hill in san jose. a very different scene here than what parts of the bay area are seeing this morning. scattered showers, but what do we have on the way this weekend? thanks so much for joining us. i'm kira klapper. vianey arana is here with a look at our microclimate forecast, a scene of the microclimate forecast, the sun shining in san jose and yet we see rain and drizzle on the golden gate bridge right now.

>> overcast, breezy to windy conditions if you're anywhere near the golden gate bridge, probably driving through that within the next half hour, but it is scattered and spotty. periods of rain here and there and it kind of calms down, tapers off and kicks up again, but these temperatures are not too bad. south bay, scattered clouds, peaks of sunshine. 52 degrees. the pa nins wil seeing overcast skies and a little bit of that scattered rain as well as 40 degrees at tri-valley 53 degrees and san francisco at 54 degrees and north bay, 53 degrees. take a quick check of that doppler radar. here it is. you can still see a lot of that green on that map, and those are the areas that are seeing it as of now. half moon bay, san francisco seeing a little bit of scattered showers, and also near the santa cruz mountains, also expect to see, a few scattered showers over the next half hour. should be tapering off by mid-morning. maybe by the 11:30-noon hour it's going to calm down and then

it picks up again. so we're going to see kind of it picking up and calming down throughout the early morning afternoon but tapers off through tonight. a look ahead, because we are tracking another storm. is it going to affect your super bowl plans? >> a weather roller coaster. stay tuned for that. vianey, thanks. now a major legal fight over president trump's travel ban. a federal judge in seattle yesterday issued a temporary restraining order calling the ban unconstitutional because it's directed at the muslim religion. for now the judge's ruling effectively overturns the ban from travelers of muslim from seven predominantly muslim countries. this morning the white house is preparing to fight back saying the department of justice will file an emergency stay of the judge's restraining order. we don't know when that will happen. meantime, previously banned travelers with valid visas are being allowed to board planes heading to the u.s. among them, this girl, a 12-year-old, the yemeni girl

stuck in gentlemdjibouti waitin join her family here in san francisco. even with yesterday's court ruling there is still concern about that travel ban. stanford student hadil is hoping the ban is lifted for good. a 21-year-old plaintiff in a federal lawsuit filed yesterday in san francisco by the aclu. the aclu argues that the travel ban is unconstitutional. if the restrictions are not lifted permanently, she won't be able to go home to yemen and see her husband and family while she is here pursuing her education. >> i cannot imagine to wait and not see them for one year let alone four years. >> the stanford student is in the u.s. on a student visa. she says she is proud to fight for equal treatment. again, the white house this morning saying the justice department will stunt the judge's ruling.

part of the white house statement -- "at the earliest possible time the department of justice intend to file an emergency stay of this order and defend the executive order of the president which we believe is lawful and appropriate." no word when that action will be taken. meanwhile, today in san francisco, there is a no-ban, no wall march planned. organizers say it will be a peaceful protest against the presidential travel ban, scheduled for three p.m. at civic center plaza. yiannopoulos is long gone but pressure remains in berkeley after wednesday night's violent protest, many want answers. who's responsible and what are the consequences? the berkeley mayor is defending the police department saying it did its best to keep the peace. he's also responding to president trump's threat to cut federal funding to cal. >> just because you disagree with the views of berkeley residents doesn't mean it gives you the right to bully us and to cut funding for not only

research but education. >> yesterday the starbucks badly damaged in the protest reopened. cal campus police say they have extensive video from the attacks and are working to determine who's behind those masks of the black block protestors. the president had more words, or tweets, rather, about the cal protest. trump tweeted, "professional anarchists thugs and paid protestors are proving the point of the millions of people who voted to make america great again." in other news this morning, police detectives are confirming the cause of death for a berkeley couple found dead in their apartment last month. roger and valerie moreash died from acute carbon monoxide poisoning. their two cats also found dead in their apartment. tenants in the building tell us they're now concerned about where the carbon monoxide poisoning originated saying police told them they don't know the source. >> the problem is that we are in

the first line of hazard and we're not being informed of what's going on. >> neighbors tell us the couple worked from home and that they often smelled fumes coming from a generator inside the couple's apartment. a disturbing note found on a car in san francisco is now being investigated as a hate crime. we've blurred the words due to the extremely offensive language. police say the note was grlued o a car parked at 23rd street. the owner found it thursday morning and police say that victim doesn't want to talk and police don't want to release anymore information until they investigate further. now to what police are calling one of the largest seizures of opium poppy pods in california history. and it happened right here in the heart of silicon valley. more than 3,000 dry poppies were found in a mountain view storage locker and this morning a couple is behind bars.

tod "today in the bay's" chuck coppola has details. >> we had already suspected something. >> reporter: one neighbor who did not want to be identified was not surprised when mountain view police arrested this 34-year-old and his had 45-year-old wife after police say they found 50 pounds of opium poppy pods and $30,000 in cash in the couple's apartment. >> late at night random cars would come -- sorry. they would come through here and pick up stuff in brown bags. or, like, small boxes. >> reporter: more than small boxes. police found nearly 4000 pounds of opium poppy pods in a nearby storage locker way street value of $400,000. >> the shipment came from great britain. beyond that, we don't know where the poppies were coming from. >> reporter: three moss of surveillance and a big break this past tuesday. >> leaving with a box of opium powder, was stopped and said he just bought it from the suspects. >> reporter: in addition to drug charges the couple is charged with child endangerment.

"today in the bay" michelle roberts went to the mall in san jose for a look at why the chain says it's making this move. >> reporter: a nordstrom spokesperson says every year the company cuts ties with about 10% of the brands it's carries. ivanka trump shoes, clothing and accessories have all been cut. >> i don't really wear her shoes. doesn't really matter to me but glad people are boycotting. >> reporter: a spokesperson for nordstrom says the decision was based on poor sales performance, not politics. however, the announcement comes two months after activists began the so-called grab your wallet campaign, aimed at boycotting donald trump and ivanka trump merchandise. the campaign organizer based in san francisco spoke with us via skype. >> i'm particular ly -- to see consumers flexing consumer power. this is a huge win for them and for grab your wallet. >> reporter: she went on to say the campaign isn't over yet and hoping people will boycott trump

just a few minutes ago we showed you the sun and clouds over san jose and now this -- overcast, drizzle, clouds and fog over the golden gate bridge. very different microclimates in the bay area this morning. showers will taper off as the morning progresses, and we have a dry day ahead, but it will remain gray and dreary. heavy snow is in the sierra. it's a common sight this year and as you see with this camera, caltrans camara on 80. now some businesses are saying there's too much snow. at this ski shop, the snow is keeping customers away. >> we need all the water we can get. you get snow levels as low and heavy as it's got, people can't come up and enjoy the snow. >> one business is benefiting. gas stations. people lining up to stop, escape the traffic and put chains on their cars. >> what the heck? that's a boulder! >> look at that.

here at home that large boulder gave drivers quite the surprise on highway 152 in dinosaur point outside of gilroy and it was big. the chp says the boulder weighs between 5,000 and 6,000 pounds and came tumbling down the hillside. three cars hit including a box truck which caught fire. deputies say two people were taken to the hospital with serious injuries. well, as we said, showers this morning will give way to a dry but gray day today. another storm is headed our way tomorrow night, and that's expected to cause more problems like this. cell phone video showing this tree crashing down in cap cola yesterday. the ground below it saturated. luckily, no one was hurt. "today in the bay" has more from the santa cruz mountains including another trouble spot. >> reporter: crews hired by santa cruz county are scrambling to shore up and protect what's left of bear creek road near

boulder creek. the road is too important for residents to shut down, so a new traffic light regulates traffic on the one repaining lane. workers say it will take weeks to make significant repairs. travis tree professionals working around the clock lifting huge fallen trees off properties and many times off of homes and the looming storm has crews nervous. >> right now it's pretty scary. some of our heritage oak trees are -- just heavy and the ground is so wet. it just -- they're falling everywhere. >> reporter: storms still a plus for a region suffering so long from the drought but water district officials are keeping a close eye on the brimming reservoirs to make sure this next storm isn't too much of a good thing. >> we're monitoring levels downstream as well. we make sure that, if we think there's additional storms coming in with potential flood flows we're notifying communities doinstream to be on the watch as well. >> reporter: here in the santa

cruz mountains for nbc bay area news. >> perfect timing to check in with vianey arana with a look at the forecast. rain, then a break, then rain again? >> looks like more rain for next week. >> wow. >> you really do need to keep that umbrella in hand and preparing ahead of time with any sandbags or anything to protect your home, it's always a plus. staying ahead of the game. right now, if you're just waking up you'll notice it's not too cold outside, but it is overcast and foggy. especially if you live in san francisco, on the peninsula and for the north bay as well. south bay right now, 52 degrees. we're seeing a mix of clouds and sunshine, but for the peninsula overcast skies are dominating the tri-valley also in the 50s, and san francisco right now at 54 degrees. east baste y 54, and north bay, degrees. warming up just a bit, however, will keep the dark cloudy skies, because look at the doppler radar right now. a few spotty showers are pushing

through the area right now. but it is expected to start tapering off by mid-morning. over the next half hour, a couple hours really we're expecting to see periods of on and off again rain. right now the north bay is seeing rain. san francisco, half moon bay as well along the peninsula and areas near the santa cruz mountains we're also seeing showers. now, we will expect to see these showers push through to the richmond area within the next half hour. vallejo also expecting to see showers and los gatos, expect rain within the next 20 minutes as well. san jose right now, we're in a bit of that rain shadow the next half hour, but we're still going to be in the path of another storm that is expected the to arrive tomorrow. now, today's forecast, here's a quick check what we can expect. along the coast, keeping cloudy overcast skies and along the bay, a mix of sun and clouds inland also expected to see some sunshine. san jose a high of 62. half moon bay, high of 57. palo alto staying in the 50s at

59. here's a quick check of what we can expect with that arrival of a new storm system by sunday night. so as of now it looks like it's going to be making its way in as early as 5:00. now, as far as rain totals, it's not going to be anything over two inches. anywhere between a half inch to just over an inch in areas near the north bay, like santa rosa as well. an hour-by-hour look, the next couple hours. by 7:00 a.m., right now seeing a couple of those showers, but fast-forward through 1:00 and we keep those dark overcast skies for the majority of the bay area. napa could still see, a few lingering showers. but by about 2:00, the majority of showers taper off to the east leaving behind a majority of cloud cover and overcast and which means by 12:30, if you have an early morning commute have to drive late at night, expect to see low visibility on the roads and still expecting also to keep the road conditions as well. it slick road condition.

fast-forward through sunday. look at this. by 4:00 we see that third storm, rather, pushing its way in. a new storm. from the coast all the way through, fast-forward through 7:00. santa rosa, napa, san francisco, santa cruz mountains, expect periods to moderate to heavy rainfall. continue through until about 10:00, elrchin and into the overnight hours into monday. which means if you have a super bowl party planned you may want to do it at least under a patio or under some sort of tent, because it's still going to be cloudy and skies are going to be a little overcast but we will start off dry and here it is. fast-forward through 4:00, you really start to see a change in the weather pattern with the arrival of that storm system and unfortunately as you fast-forward through 9:00, rain dominates in the forecast, and, yes, we are expecting to see more rain heading into next week. so i'll have a closer look at the next seven days coming up in just a few minutes.

for san francisco and along the peninsula, and for the north bay as well. fast-forward to about 12:00, 1:00, climbing up into the upper 50s topping out into the upper 50s, were ut if you're in san jose, you may notice a combination of sunshine and clouds. 52 degrees right now. fast-forward to about 1:00 and we'll be climbing into the 60s. we will be expecting for this rain to kind of taper off as we head into the early afternoon hours. so here's a live look right now. using doppler radar and those are those scattered showers that san francisco is seeing now. half man bay seeing scattered showers around the santa rosa area. san francisco expect to keep the scatters showers over the next couple hours as well. richmond seeing, if you have showers, and santa cruz mountains making its way towards los gatos over the next 20 minutes also expect to see a few more of those spotty showers here and there, and catch a little break in terms of the rainfall and then it will start picking up again until that rain

begins to taper off by the early afternoon. here are your expected highs for today. a combination of overk569 skies for the coast. sun and clouds for the bay and inland. palo alto, 59 degrees. napa also 59 and half moon bay, 57 degrees. now we do have that other storm system that is expected to arrive for tomorrow. so let's take an hour-by-hour outlook. if you notice, the next hour or so, the majority of that line of showers will be moving east leaving behind, really, the most part, just a lot of cloud cover and a lot of these overcast skies. so unfortunately we're not going to get too much sunshine today, but at least we do catch a break later tonight. we dry out through the overnight hours into early sunday morning. if you do have a commute tomorrow morning, expect to still see wet roads out there, but fast-forward until about 5:00, if you have any plans to have a late-night party or anything of that nature after the super bowl, this is exactly what you're looking at.

pollution could be causing big rigs to burst into flames putting public safety at risk. senior investigative reporter vicky wynn has more on what she's uncovered. >> reporter: we share the roads with these trucks every day. now the drivers tell us there's a hidden danger on their truck that could spark a fire on a highway you drive. >> it tells you regen required. 39 years driving a truck. >> reporter: miles spent crisscrossing california roadways everything from solid waste to soda pop a. good education. got all my kids through college, paid for my house, all my toys. >> reporter: last february he could only watch as his beloved truck burned. >> i timed it. eight minutes, that truck was burned to the frame. that's all it took. >> reporter: you could have been inside that truck. >> could have been sitting in there when it caught on fire.

i do feel fortunate that i was out of it, didn't get burned. trying to save the truck. you know. it's your truck. it was something to me that could be completely preventible. >> reporter: now running the family trucking business in eureka. >> scared the crap out of me. in there, talking about a crime scene. >> reporter: jason, like many other truckers we spoke with, believed the fire was caused by a diesel particulate filter or dpf. california started requiring the device for all diesel engine vehicles in 2007. roughly a million trucks in this state are equipped with one, and those trucks travel the country. the filter trucks 99% of the soot produced by diesel trucks cutting air pollution captures small particles from a truck's exhaust before they get into the air. keith says his truck fire ignited while the filter was undergoing a cleaning process calmed regeneration. burning all the captured soot

into a fine ash. the cause of the fire is undetermined but insurance investigators suspect it started somewhere in the exhaust treatment system. the report notes the company investigated several similar fires, but pinpointing the cause is difficult, because "the exhaust gets so hot that evidence is consumed." >> the filters are expensive. they are dangerous. and they don't work. >> reporter: bud caldwell owned a petroleum company, and formed an alines for california business to challenge the rules requiring filters. the group points to a series of filter failures, including two recalls for filters linked to three fires, including a 5,000 acre fire in washington that destroyed 29 homes. >> these were not ready for primetime when they were put forward. >> reporter: caldwell's group and the daniels family are suing the state asking for restitution for drivers with damaged trucks and an independent review of the filter's safety. >> these particular filter doss

not cause fire the. >> reporter: todd sachs is the chief of enforcements at c.a.r.b.s. >> no link between the diesel particulate filters and fires but in your report you investigated 13 fires and found 3 were linked to the filters and issued two recalls. >> true we issued two recalls. >> reporter: sachs acknowledges some of the initial filters put on the market were linked to fires, others to expensive repairs but is confident newer trucks with filters work safely. c.a.r.b.s. investigated roughly two dozen fires since 2009, we don't see any evidence between the filters on the road today. >> reporter: they haven't found a connection between fires and newer filters agency data reveal as high failure rate from the dpf made from 2007 to 2011. those faulty parts are still used on trucks today. why hasn't c.a.r.b.s. come down

stronger and rescued sooner because they're failing? >> a number of hoops we have to jump through, things to prove in order to force the manufacturers to take action. in this case we're essentially not able to do so. >> reporter: what happens to the truckers and businesses and these folks in between? while all that's happening? >> well, like i said. these trucks are safe to drive. if they have problems with the truck they need to repair them. >> reporter: as for keith daniels, lifelong trucker hopes the issue will be resolved and soon so other drivers won't have the same close call he did. >> you think you can go out, do your job, come home safely. you know? >> reporter: the alines for california business first sued the state unsuccessfully in 2015 but say the new lawsuit contains new fires including keith's. meanwhile, c.a.r.b.s. is, would go to force manufacturers to fix
