it is going to be soggy and we'll have more rain over the next few days. so just get ready. here's a live look outside. the golden gate bridge showing us some slick streets and mike has already been tracking spinouts. you want to be careful. here's a look at stormranger mobile doppler radar truck is picking up on scattered showers through the peninsula as well as the north bay so quite a bit of rain still going on after such heavy downpours yesterday evening. we'll continue to monitor this. another look at the radar coming up in seven minutes heading over to mike. more about that south bay spinout. >> the first one we talked about highway 17 cleared from the summit. it was second one going on for quite some time north 101 at bailey. we just got word that cleared. you see how quickly speeds are recovering. things were jammed up for a short period of time. sounds like there was a spinout and then motorcycle hit that car that spun out. i don't know extent of injuries but they were able to clear that and no major injuries reported for that area. smooth flow for 101 through north bay.

slowing through vallejo off interstate 80 for westbound 37. back to you. >> thank you very much, mike. 5:01 this morning, it's set to become a high stakes legal battle. president trump's travel ban was halted by a federal judge on friday and now ninth circuit court in san francisco is going to take up the issue and it could go to the supreme court. >> edward lawrence has more details on where things stand in the court system right now. it's been very confusing. break it down for us. good morning. >> reporter: very confusing, sam and laura, and moving quickly for the courts. this morning this was filed in the court case. this is from lawyers from the state of washington and minnesota and it outlines their case that you're going to hear today. basically in it says that if the travel ban is reinstated, it would unleash even more chaos onto the system. it also has in here a letter from other secretaries of state, former secretaries of state including madeline albright and

john kerry and a letter from susan rice, u.n. ambassador here. this is heading to a showdown for the supreme court. a guy who translated for the u.s. military in the iraq war was finally let into this country. he waited his two-year approval process, got a visa and was denied entry in the u.s. when president donald trump imposed the travel ban. the stay in washington state allowed he and his family to enter. house leader nancy pelosi says the ban was unconstitutional and immoral. president trump tweeting a judge put this country in peril. if anything happens, blame him. as soon as today, the ninth circuit court of appeals could overturn the ban on the ban. either way it could go to the u.s. supreme court and be heard by the eight members of the supreme court unless donald trump's nominee gets appointed. reporting live in washington, edward lawrence. now back to you, sam and laura. >> edward mentioned the family at the center of this here in

california. in the meantime, the judge's decision to block the travel had an impact on a family. >> a 12 year old walked into the arms of her 14-year-old sister last night at san francisco international. the girls and their family cried tears of joy. when her parents moved to the united states seven years ago, she had to stay behind and live with her grandparents. she received a visa last month. the travel ban postponed her homecoming eight additional days and she became stuck at the airport in yemen's capital. an immigration lawyer says it's a problem many people are still dealing with. >> there's about 240 people still trapped not able to board airplanes. she was able to only because of heroic efforts. >> her father traveled back to yemen this week to be at the airport with her until that ban was lifted. this morning the entire family waking up in their home. >> tears of joy there.

5:04 right now. house minority leader and bay area representative nancy pelosi is organizing a news conference today in washington. pelosi plans for zero in on what she believes is anti-worker agenda within the trump administration. on "meet the press" yesterday, pelosi voicing her displeasure over a tweet from president trump. the president wrote the opinion of this so-called judge which takes law enforcement away from our country is ridiculous and will be overturned. >> for him to say a so-called judge. it's one thing to criticize a decision. it's quite another thing to say a so-called judge. >> pelosi also says that the democrats are hoping to focus on job creation along with work and family life balance. 5:05 this morning. happening today, we are entering now into the second week of the emotional trial for the man accused of killing morgan hill

teenag teenager. good morning, kris. >> good morning to you, laura. we know as those jurors file into that courtroom on the fourth floor they are fresh off a three-day weekend. they needed that weekend. an intense week of questioning that first week was very emotional at times. the lawyer got one investigator to admit part of his police report was inaccurate and defense honed in on another of the sergeants at the scene who processed evidence there rather than at the headquarters. that evidence included sierra lamar's backpack, jeans and sweater. >> what they're trying to do is show the collection of the evidence was flawed at the outset so when the defense experts testify as to the dna issues, they're going to say

it's not reliable because of the way the evidence was collected. >> reporter: the prosecution took a different approach bringing in sierra lamar's high school friends. young women that were teenagers when their 15-year-old disappeared. coming up at 6:00, one of those mothers talked with nbc bay area and tells us what it was like for her young woman daughter to relive those moments and how it impacted their family as well. that's coming up at 6:00. in san jose, kris sanchez, "today in the bay." a 45-year-old man has major injuries after hit by a car while changing flat tire. the person who hit him is still on the run this morning. this happened just after 4:00 yesterday morning along i-280 in san jose. the victim got out of his van and started changing his tire when a toyota corolla came by

and hit him and didn't stop. they found the bumper at the scene. they're looking for a 2006 to 2013 red corolla. a person dead after being shot in vallejo this weekend. shots fired before 1:00 yesterday afternoon. when officers arrived they found a person who had been shot. the victim later pronounced dead at the scene. no word on what led up to that shooting. in the meantime in oakland, a suspected arsonist who set a car on fire this weekend is now behind bars. the chp tweeted this picture out of a car engulfed in flames. they say officers arrested a 20-year-old man with the help of witnesses. investigators say the suspect is a transient. a motive for that arson has not been released. four years legendary wisdom is is that joe montana is the greatest quarterback of all-time. we're not saying that's true. there are some fans in the

looking at the tri-valley bottom of your screen. top of your screen 580 slows down. more coming in. all right. there is no hangover for the new england patriots this morning who won what many are calling football's most thrilling comeback ever. certainly on the largest stage in the sport. we take a live look at nrg stadium in houston this morning. new england patriots defeated falcons 34-28 in overtime yesterday in case you didn't see it or watch it but you probably did. this was the first super bowl in the history of the competition to go into overtime. pats come down after being down by 25 points in the middle of the third quarter. this comeback never happened before. victory parade scheduled for tomorrow morning. mvp tom brady and head coach bill belichick holding a news conference later today. this is patriots fifth nfl championship. that's the most ever for a coach and the most ever for a quarterback. there's also some intrigue this morning surrounding the super

bowl. it has to do with the most valuable article of clothe iingn by the most valuable player. >> that's tom brady talking with robert kraft in the locker room. braid brady had to call in security to find his jersey. unfortunate that someone did that. >> i wonder how they'll authenticate it without revealing they stole the jersey. >> it seemed like everybody loved lady gaga's halftime show. it was pretty amazing. scott, it started out with drones. >> many wondered how they did that. they were hundreds of drones designed in santa clara by intel. right there. the red and blue are actually flying in the sky.

each one is about the size of a volleyball. mostly just a big light with propellers on them but made amazing effects including that turning into the american flag. here's a closer look at the actual drone. one pilot can fly all of the drones. the drones talk to each other to maintain their distance. you can see them in disney world in florida as well. an old rule says if a team from the afc wins the super bowl, we have a down market. wall street looks to build on friday's gains following the solid jobs report. dow had the best day of the year friday. ironic considering it had its worst day of the year last week as well. oil prices are up. on friday, the dow up 186 points. nasdaq up 30. more than 100 companies, many of them from high tech filed papers with the ninth circuit court of appeals last night.

those companies which include google and apple support the decision made by a federal court judge in washington state. he stopped the implementation of the controversial immigration ban. the trump justice department appeared which is why we find the case in the court of appeals this morning. the companies say trump's actions deprive the united states of some of the best and brightest needlessly break up families and betray our basic american tradition. >> notable absence was oracle. they publicly supported president trump and sits on transition team and on business team as well. sam and laura, video from the science palooza over the weekend where hundreds of kids from san jose's east side high school district won amazing awards. i'm not on the podium at this point but i've been emceeing that for many years. science palooza is older now than the kids who attended.

>> nice to see you participate in that. >> and yet 8 and 9 year olds can do -- >> reading off awards -- yeah. welcome to silicon valley. >> great minds are born here and bred here. 5:19 right now. let's get back to microclimate weather alert this morning. there is a winter storm warning in the sierra. these are conditions near castle peak. areas above 6,000 feet expecting another one to two feet of snow. chains required this morning not surprisingly. it will be in effect through tonight. already so much snow up there getting even more taking us skiing for quite some time into the spring no doubt. >> other thing we have to watch for is the warming temperatures in the sierras so that may be an issue farther down the line. we'll keep an eye on that and more rain for the bay area. it's looking great here over the

next few days. more wet weather. and it makes it hard to get out of bed this morning. we already see there's a lot of people moving. go ahead and join in. we'll see wet roads and spotty showers moving in. much of the rain that we see now is fairly light and moving through the north bay. we're also starting to see that rain near san francisco and parts of the south bay as well. a closer look on storm ranger giving us hd view. mobile doppler radar is able to be moved anywhere. we're getting the best view on san bruno mountain and we're seeing some of the rain moving through the north bay, parts of sonoma county and marin county with coverage down 101 and over toward 580 as well. we're seeing showers moving in. on the peninsula just some light rain that is quickly moving through redwood city and moving closer to palo alto. for south county area, rain

moving through now off to the east and cameras moving cars moving through on some very wet and slippery roads and light showers coming down in the north bay. it's 54 degrees. at 10:00, still seeing some showers moving through. much of that in the north bay. and that's where the heaviest rain will be in some of the highest rainfall totals. next round of widespread heavy rain moves through the bay area late tonight and even through early tomorrow morning. still bouts of heavy rain where we see yellows and pinks and reds. that shows the most intense downpours and along with that we'll have gusty winds. wind advisory continues into early tomorrow morning. looking at when those winds will pick up by this afternoon winds coming in along the coast at 25 miles an hour. then look at how much it gusts later on tonight. up to 41 miles an hour in inland areas. 25 to 30 miles an hour. that may cause issues, mike. we're seeing what it looks like

now in the tri-valley. >> the san mateo bridge chp said overnight gusty conditions there. we expect more as winds pick up. over here speeds are picking up for highway 84 cut down through construction area. looks like whatever was really restricting traffic aside fro the fact they add the divider and moving lane, we do have a smoother flow of traffic. extra construction overnight looks like that cleared up. more slowing off 580. typical pattern there. no problem getting over toward the maze as far as roads go. i want to show you travel times toward bay bridge. 17 minutes from highway 4 to bay bridge. b.a.r.t. has a delay. it's coming out of san francisco station maybe up to ten-minute delays. keep that in mind as you travel through the area. no problems across the spans. watch for wind. back to you. >> thank you very much. coming up next, what's blamed for uptick in the flu this year. nbc bay area responds

vimin-c intake experts saythe welcome back. you may want to ramp up vitamin c intake. flu season is peaking right now. the cdc says the flu virus is spreading at its highest rate in all but ten states. it's not only higher than last year, it's also more widespread. so far california is experiencing what experts are saying is moderate activity. but washington state is on track for its worst flu season in seven years. >> the most important thing people can do to prevent them from getting influenza is to get vaccinated. >> the cdc says more than 12,000 flu cases are being reported each week and that many adults who get the flu never get counted because they're not going to see a doctor. >> at 5:26 this morning. a new push among doctors to have children as young as nine years

old receive human papilloma virus vaccine. in the past they've been recommended for 11 to 26 year olds. new research suggests that it's most effective in preventing some cancers if it's administered before the age of 15. if children under 12 receive it, only two doses are now recommended instead of three. the vaccine is considered controversial due to potential side effects and because it may force parents and children to discuss sexuality. a lot of us felt the wind shaking last night and saw rain in spots. it will be a wet week all week this morning just the beginning. >> you can see all three of these storms lined up in the pacific and that first one moved through yesterday. still some lingering rain today. we'll talk about the time line and what else to expect coming up in the microclimate forecast. >> reporter: a police officer shoots and kills a man here in the east bay. the reason law enforcement says the officer had to draw his

this is the kind of weather you'll see pretty much all week long. i guess we better get used to it. this is also causing problems on the roadways. a crash in the tri-valley. >> there we go. all right. we got it. my fault. my fault. i was running around making sure that we had all of these things covered. spinout was one of the issues in the south bay those both cleared from 101 and highway 17 in this section where we have construction zone, a crash now over there in pleasanton on the edge of livermore so an additional problem for folks off the dublin interchange and in addition to wet roadways throughout oakland may cause slowing and crash at old tunnel road westbound 24 outside the tunnel but we're tracking this as more folks head over toward the bay bridge and backup at the metering lights. slowing for b.a.r.t. system out of san francisco. possible ten-minute delay with equipment problems around glen

park. getting that taken care of but not in recovery mode just yet. back to you. thank you very much. more problems for commuters. road crews this morning at the scene of that washed out road in los gatos. more video of the damage this morning. an area where the wildfire burned last fall. chp reported a tree down after midnight. residents are being allowed through. 5:33 this morning, a possible supreme court showdown. president trump's travel ban was halted by a federal judge on friday and now this morning the ninth circuit court in san francisco is going to take up that issue. >> "today in the bay" joining us now. pete, it's a national conversation playing out in our own backyard. good morning. >> reporter: good morning to you. there's a couple things of note. so the ninth circuit court here denied that imagine stay request by the department of justice to keep this travel ban in place.

they're asking for legal briefings on both sides of the appeal process can move forward. we saw a number of nationwide protests in response to president trump's travel ban including here in sfo and president voiced his displeasure after the ban was suspended on friday. he called the judge a so-called judge in a series of tweets. the ninth circuit court here in san francisco is considered to be by far one of the most liberal courts in the country. we spoke with a legal expert about this on exactly what to expect. >> they would have to show that there's good reason to think that this order is constitutional. they would also have to show that the states are not going to suffer irreparable harm while awaiting a final decision by the trial court. >> reporter: a three judge panel from the court will be selected randomly to make the final court decision expected to take place some time this afternoon. this is expected to go all of the way to the supreme court. live in san francisco. >> we'll continue to follow.

thank you very much. now to this developing story we also are following this morning. deadly officer-involved shooting. a popular road in fremont shut down for hours. it finally reopened. bob redell is live with what happened and where. good morning, bob. >> reporter: good morning to you, laura. this happened on mowry avenue. that road is reopened in time for this morning's commute. it was around 4:15 yesterday afternoon that an officer with fremont police department was responding to a fight that took place between at least two people. this was at or near a business on mowry. the officer found the suspect a short distance away on mowry at sutter. fremont police say this man got into a physical altercation, that's how they describe it, with their officer who is also a man. that's when the officer shot the suspect. pd says officers responding to the scene provided medical care until paramedics arrived and they declared the man dead at

the scene. the officer was treated at a local hospital and released. they did notify the district attorney's office about the shooting, which is normal when an officer is involved. reporting live here outside free month police headquarters, bob redell, "today in the bay." >> bob, thank you very much. everything is okay now but some tense moments in san jose yesterday as police searched for a suspect considered to be armed and dangerous. this all started about 1:00 sunday afternoon when officers tried to pull over a car they thought belonged to a man who was wanted for brandishing a handgun. that driver allegedly sped off and got out of the car and started running near walnut grove. they set up a perimeter around the area and were able to eventually arrested suspect. a handgun was also recovered. pleasanton police say a fight over the weekend led to one man being stabbed several times. a man showed up at a hospital saturday night and is expected to survive. this happened about the time officers were responding to a

fight near a home. officers found the suspect at the scene and is facing assault with a deadly weapon charge. a dance competition after party in vacaville turned violent over the weekend. hundreds of college students from several universities were at an event on orange drive early sunday morning. these are photos vacaville police posted to social media. police were told about fights breaking out and spilling out on the streets. then just before officers arrived, someone pulled out a gun in the parking lot and started shooting. police say they did an extensive search but couldn't find victims or the gunman. back to our microclimate weather forecast as we take a live look outside everything all calm and easy at the bay bridge. shimmering bay there. we do have changes here. >> changes in the works. let's turn to kari hall now for a look at the forecast. >> more rain will move in. now at 5:37, some spotty showers and some light rain as you head out the door.

still some wet weather after having to deal with such a very wet weekend at times. as we get a closer look at american canyon, vallejo, you see the rain moving in. also for fairfield and for much of the north bay a little bit of slight rain here and there in spots. mill valley, tiburon seeing steady downpour at this point. we're also seeing some rain right there over oakland, west oakland at this point and down through the peninsula, alameda park and south city seeing rain moving in. a look at the bigger picture, we'll see more showers. also for the south bay. and a look at microclimates and temperaturewise mid to upper 50s. more rain in the forecast for the rest of the week. we'll talk about when you'll see the heaviest rain coming up. mike has b.a.r.t. delays. >> minor b.a.r.t. delays out of san francisco into the east bay

at&t pebble beach pro-am golf tournament in monterey. pros will play alongside their favorite celebrities like bill murray and mark wahlberg who was at the super bowl last night. >> i saw him in the stands there. chp officers have found a car they believe was used in a deadly hit and run. investigators say a man found dead on highway 101 last thursday was a victim of hit and run. the victim's name has not been released. chp says the car involved, however, has been found. it's a silver nissan. but the driver has not been located. san mateo county getting a lot of cash to keep sam tra trans buses running. the money will be used to fix traffic lights. buses have priority. santa clara county is expected to get a similar system. more possible business

doubt on the economy ahead citing dissension in washington and growing realization that president trump really will go forward with new tariffs and taxes. nasdaq was up 30. more than 100 companies many from high tech filed a friend of the court briefing with the ninth circuit court of appeals in san francisco late last night. they supported a judge's decision to stop the trump travel restrictions against immigrants. google, apple, twitter, uber, yelp, square space, spotify, paypal, microsoft, netflix, you get the idea. three judges from the ninth circuit will look at the case today. if they agree with a lower court decision, the trump administration could appeal the thing to the supreme court. now, in the midst of all this, republicans are thinking about breaking up the ninth circuit, which many think are too liberal

anyway. it covers all of these states. there is talk of redistricting the ninth to just be california, oregon and washington giving the remaining states out here a separate federal court. president trump's politics and behavior caused a lot of angst with corporate leaders. you recall the head of uber resigned from trump's business panel. elon musk still meeting with the president and did so on friday. musk says activists should push for moderates to advise the president. more moderates and not fewer. how could only have extremists advise him be possibly good? elon musk has a lot of government contracts and benefits from government tax breaks as well defending his relationship with president trump. >> very interesting. >> breaking it all down for us. thank you, scott. >> let's talk about the royals, shall we? queen elizabeth is now the first

bridge. windshield wipers on and some slick streets. so that's what you have to deal with. hurry up and get ready and slow down on the roadways. stormranger mobile doppler radar truck showing a lot of green here on the map with a steady downpour across much of the north bay and as we get a closer look around fairfield and we are seeing some of the rain moving in, moving off to the east, and it kind of lingers for a while. san rafael seeing the downpours there as well heading over toward richmond. also for oakland where you see the green. good coverage there. and some light downpours becoming heavier as you go through burlingame at this point. so also some rain for parts of the south bay and down toward gilroy. we see some of the rain moving in. so much of the heavier rain will be in the north bay as we go into the late morning, early afternoon and then look at what happens tonight at 9:00. at 9:30, pretty good coverage and a lot of more yellows and oranges here indicating some

heavier rain and that will be with us through early tomorrow morning bringing an additional half inch to an inch of rain and throughout the day still some waves of rain tomorrow as well and then tapering off tomorrow night. so this is the kind of story we'll have throughout the week. three storm systems move in. first one moving in now. second one well to the west of us. third one for the end of the workweek. it does all clear out in time for the weekend though and a look at how much rain we could see for the north bay the potential of at least 5 inches of rain. maybe 5.5 inches in spots like san rafael. you see a shade of purple corresponding with 5 inches of rain throughout the next two storms. santa cruz mountains will have at least 4 to 5 inches of rain there and for south bay and valley, about an inch of rain which will be quite a bit not only that but you'll also have some gusty winds. the wind advisory continues into early tomorrow morning at 6:00. and a look at the forecast where

those wind speeds rush onshore at 45 miles an hour at half moon bay by late tonight and still early in the morning we may have drowned trees and power lines. something we'll be watching for as more rain moves in. mike has a new problem for south bay transit. >> we' got word there's a bus bridge instead of light rail. i think they're having trouble getting a driver for that line. we'll wait for more detail. a problem for folks waiting for light rain. there's a bus bridge currently in place and b.a.r.t. experiencing problems out of the glen park station for san francisco lines heading toward east bay. nothing further has developed so i guess holding steady. roadways starting a mild build as you expect around the bay. typical pattern. toward tri-valley the build for 680 standard. quick look at the san mateo
