quote if the ban were announced with a one-week notice. >> exactly. you just said that. he is quoting you. it's your word. he's using your words when you use the words and he uses them back, it's circular using of the word and that's from you. >> she was really good. >> my god. >> alex baldwin will host the show this coming saturday. my gosh. a lot of material there. >> when she starts using props, i lost it. >> it's a good one. 6:00 right now. we're tracking another wet commute as you get ready to head out the door this morning. >> a lot of green on the radar. steady downpour for parts of the bay area. and it will get heavier as we go into this evening. we're tracking the rain and the wind coming up. tearful reunions around the country as people turned around at the border because of the president's travel ban were let into the u.s.reuniting with
6:01 am
families. >> a lot of emotion there and jubilee here as history is made at super bowl li. dramatic overtime win for the patriots. bay b "today in the bay" continues right now. good morning to you. thank you for joining us. i'm laura garcia-cannon. >> i'm sam brock. i like that you used the word jubilee but there was jubilation last night for anyone rooting for the patriots. >> it was a good game. that's always good to see too. >> good story lines. we'll get to more of that in a second. first, the wet start which has been the story line for the last month -- >> it still continues. a lot of rain on the way this weekend. it starts out with this first storm system that moves in last night and brought in some heavy rain and still some lingering showers. especially as you go through the peninsula over toward the east bay and farther to the north. that's where we do have a steady downpour coming down creating
6:02 am
some wet roadways and some breezy winds as well. for the north bay, more of the scattered activity that you're seeing there but it is still coming down on some of our bridges as well from the richmond to san rafael bridge to dumbarton bridge we see rain farther to the south and peninsula getting in on more of that widespread activity. it's not only affecting the roads but also the rails. >> we're having a couple issues for a couple sets of mass transit systems. in the south bay, there's a bus bridge for the light rail. bus bridge in place but sounds like an issue getting staffing in place and not as far as equipment goes. equipment problem out of glen park station so minor delay possible out of san francisco as well heading over in toward the east bay. we're tracking both of those. no major problems as far as word on the street but we warned you. on the street itself, wet roadways with rain coming down the peninsula and through oakland. we'll track that. new crash on 880. i'll get details and this crash westbound 84 around ruby hill
6:03 am
drive. that crash is blocking part of one lane and causing more congestion on this major surface street to a delay toward 680 for dublin interchange moving well through the area. nice flow of traffic through the bay bridge. just 20 minutes from highway 4 over toward berkeley curve and toll plaza where metering lights are on. back to you. >> happening today, court resumes. the man accused of killing morgan hill teenager sierra lamar is back in court for the second week of his murder trial. garcia-torres is expected in court in just a couple hours. >> "today in the bay" kris sanchez joins us this morning with what we're expecting for court today and what we learned during the trial. good morning, kris. >> reporter: good morning to you, laura and sam. as the trial begins at 9:00 in just three hours in the courthouse behind me, we expect that the defense will continue to try to chip away at some of that evidence which is said to be so critical because there is no body we expect they will also continue to try to paint sierra
6:04 am
lamar as the kind of teenager who could have just taken off. that is not the portrait that the prosecutors are trying to paint in calling three of sierra lamar's friends to the stand. they are young women but around the same age when she disappeared as a 15-year-old high school sophomore. they sat just yards away from the man accused of killing their friend as they had to recount what she was like and what her last moments might have been. one of their mothers told us what it was like for her daughter to prepare to answer those questions about whether her friend could have had a secret life and could have just run away. >> it was not a good night at our house. it was very silent. a lot of nerves. >> garcia-torres' lawyer got an officer to admit part of his police report was inaccurate and defense honed in on one of the sergeants that processed evidence at the scene including sierra lamar's backpack, jeans
6:05 am
and sweater. one person we don't expect in court yet is sierra lamar's mother and that's because our legal analysts expect she will be called to testify as the last person who saw her daughter alive. week two starts at 9:00 this morning. in san jose, chris sanchez, "today in the bay." >> thank you very much. at 6:05 this morning, a 45-year-old man has major injuries after he was hit by a car while changing a flat tire. the driver who hit him is still on the run this morning. it happened just after 4:00 yesterday morning along interstate 280 in san jose. the victim reportedly got out of his van to start changing a tire when a toyota corolla driver hit him and did not stop. investigators found parts of the front bumper and fender at the scene and are looking for a 2006 to 2013 red toyota corolla with damage to the front end. a live look right now at the ninth circuit court of appeals
6:06 am
in san francisco this morning where the court could decide as soon as today whether president trump's travel ban will be reinstated or suspended. it appears the issue could go all of the way up to the supreme court. >> it all comes as the president is also threatening to pull federal funding from california if state lawmakers vote to make california a sanctuary state. >> "today in the bay" edward lawrence is live in washington with details. >> reporter: good morning. president donald trump doesn't like the fact that san francisco is a sanctuary city. he's come out trying to end the protest across the nation. in an interview during the super bowl with fox news, the president took it to a whole other level saying he would defund the entire state of california if it becomes a sanctuary state saying that california is out of control.
6:07 am
>> i think it's ridiculous sanctuary cities as you know i'm very much opposed to sanctuary cities. they breed crime. there's a lot of problems. if we have to, we'll defund. we give tremendous amounts of money to california. california in many ways is out of control as you know. obviously the voters agree or they wouldn't have voted for me. >> you hear donald trump believes he has mandate from voters now. california actually takes the least amount of money to run from the federal government. however, the university system uses more. a lot of the universities have a large portion of their budget for research and other things from the federal government. the legislation for a state is one step closer. >> we're tracking that sanctuary state legislation in california. appreciate that report. edward also mentioning the travel ban.
6:08 am
live look at sfo where a young yemeni girl was finally reunited with her family. >> the last leg of the young girl's journey was delayed by the travel ban. >> the 12 year old walked into the arms of her 14-year-old sister at san francisco international airport. hugs and tears. the girls and their family crying tears of joy there. when her parents moved to the united states seven years ago, she had to stay behind and live with her grandparents. she received a visa finally last month to come to the states. the travel ban postponed her homecoming eight more days and she ultimately ended up stuck at an airport in africa. >> there's about 240 people still trapped who are not able to board airplanes. she was able to only because of heroic efforts. >> her father traveled back to yemen this week to be at the airport with her until the ban was lifted and this morning the entire family is waking up in
6:09 am
their home. >> house minority leader nancy pelosi and of course the bay area representative voiced her displeasure about the federal judge that halted the immigration ban. >> for him to say a so-called judge. it's one thing to criticize a decision and it's another thing to say a so-called judge. >> ms. pelosi was objecting to verbiage of the response to the judge's decision that you see in a tweet. "the opinion of the so-called judge takes law enforcement away from our country is ridiculous and it will be overturned." much more to come on that topic. something else that everyone is discussing this morning, plenty of football fans floating around the words greatest ever to describe last night's super bowl. >> toss to white. he's in. patriots win the super bowl. >> they did it. the new england patriots came back from 25-point deficit to
6:10 am
defeat atlanta in overtime. some say tom brady left no doubt he's the greatest quarterback ever. he won his fifth super bowl and fourth most valuable player super bowl award. on top of that amazing comeback, brady threw for a super bowl record. 466 yards. a victory parade is scheduled for tomorrow morning. super bowl mvp tom brady and head coach bill belichick will hold news conferences. we expect that later today. this is patriots fifth nfl championship and the most ever for a coach and a quarterback. lots of records there. it is 6:10 now on this monday morning. clouds and wet roads leftover from heavy downpours late last night and light rain this morning. it's 56 degrees in the peninsula. 57 in the south bay. also 57 in san francisco and the east bay. a look at more of that rain rolling in for this morning's commute creating some slick
6:11 am
spots on the roadways. we'll keep an eye on this as this rain continues to fill in on the radar and more heavy rain that will be moving in for the next couple of days. coming up in about three minutes, i'll have a look at the planner for los gatos and a problem for muni. wires down. >> we have wires down and muni using electrical overhead wires that power is an issue so bus ridge rerouting 30 line. that will be a problem at least right now for the 30 line of the muni system and that is in combination with the issues coming off the glen park station for b.a.r.t. where there are possible ten-minute delays because of an earlier equipment problem which sounds like they are still addressing that and in the south bay you're not free from issues. a problem with light rail having bus bridge service in place there. minor crashes are not a problem for the commute and we're
6:12 am
looking at east bay times. standard. back to you. >> thanks a lot, mike. >> coming up next, problems for commuters in one south bay town. the storm damage left behind overnight as we get prepared for more rain later this week. plus, mystery solved. find out where tom brady's jersey turned up after being reported missing after the super bowl. >> the patriots great day could mean a lousy year on the stock market. we'll take a look coming up in business in ten.
6:13 am
6:14 am
good monday morning. it's 6:14. as you step out the door now headed out on the roadways, it
6:15 am
will be wet. here's a live look outside at san jose. it will be raining off and on with temperatures holding steady in the upper 50s and the rain gets heavier as we go into this evening. a look at two more storms on the way. details coming up at 6:20. >> we have wires down between columbus and green all of the way down to market. this will be a problem for riders there. b.a.r.t. and cta reporting delays. a lot of talk and maybe buzz this morning about the super bowl. it's not all about the game. one of it has to do with the most valuable article of clothing worn by the game's most valuable player. >> someone stole my game jersey. >> where did it go? what a mystery. that's what tom brady was talking about with patriots owner robert kraft in the locker
6:16 am
room. he left the stadium last night believing his jersey had been stolen. this morning a boston based station reports that the equipment manager actually picked up brady's jersey and locked it up for safe keeping. in the hub of everything, he didn't get word to brady about it. >> that might have been a good idea. google home has a fine tuned ear. several people reported on social media when google's ad ran during the super bowl that their device at home perked up a little bit confused saying things like i'm sorry. something went wrong. last night a tv news broadcast set off amazon's alexis device as well. things work well. >> alexa, are you listening now? >> did you hear the drone last night. >> i saw them. they looked like fireworks behind lady gaga but they were drones from here in the bay area. >> it's amazing. i thought it was super cool. about the size of a volleyball. you can see they are mostly just
6:17 am
lights with propellers. drones behind her making some pretty amazing effects during the halftime there. it only takes one operator to tell the drones what to do and they keep each other separate and stay away from each other and can do things like make the american flag. you can see them at disney world as well. lots of people watched the commercials and they were notably liberal leaning this year. did you notice that? encouraging people to roespect each other no matter where they are from and budweiser pointing out that they were created by immigrants. google's ad had rainbow flag. coca-cola's ad featured people singing "america the beautiful" in several languages and audi suggested that women should be as valuable as men. type those company names and boycott into twitter if you want
6:18 am
to read mean tweets. dow had the best day of the year last week and the worst day of the year last week as well. we're coming off a much better than expected jobs report on friday. there's an old rule of thumb that says when the team from the old afc wins, the dow will have a losing year. this has been true 40 out of 50 years. obviously we won't know about 51 until the end of this year. but 40 out of 50. that's 80%. so 100% of the time it works 80% of the time. >> there's math for you. >> sounds like a quote from "anchorman." a live look outside on this monday morning from our san francisco camera. beautiful look at the city. we are still tracking scattered showers across the bay area creating some wet conditions for your morning commute. >> that live shot there dotted with different colored lights which is really cool. we'll see some sprinkles dotting our windshield at some point over the course of the next week. saw plenty last night. >> i want to mention that we do
6:19 am
have breaking news into our newsroom. an earthquake was reported. it was a magnitude 3.2, i believe, reported 17 miles north of napa at about 6:08 this morning. about 11 minutes ago. we're keeping tabs on that. don't know reports of any damage or injuries. >> we'll wait for that. no change right now in the forecast. a continuation of what we've seen. >> a lot more rain in the forecast. and you're seeing it this morning. falling from the sky. more of the spotty activity that we have seen and a lot of activity on the roadways. roads are wet. looks like the drivers are making it okay but windshield wiper is on with more of that rain moving in. so we're seeing that rain continuing to roll in with this system that moved in from the pacific yesterday. still some lingering showers and then we'll see this tapering off for a little while before some
6:20 am
heavier rain moves in. stormranger on top of all of it. our mobile doppler radar truck giving us high definition view and picks up rain ahead of other radar showing it in realtime and rain is coming down in novato and also for parts of napa county over toward fairfield as well. and then some more spotty activity once again for parts of marin county and moving across the bridge toward richmond. and then you see some rain that's been tapering off for oakland but moving into san leandro for the peninsula, san mateo down to redwood city, belmont you're seeing rain right now. more of that rain moving in. we'll start to see much of the downpours for much of late morning early afternoon for the north bay and then the rest of the bay area seeing this radar filling in with some heavy rain for the entire bay area later on this evening and into early tomorrow morning. and then we start to see the rain ramping up once again.
6:21 am
we see this coming in in waves for the next couple of days with two more storm systems moving in. the first one once again started last night. still seeing the after-effects of that one and second storm system midweek with a third one before the weekend comes in so with all three of these storms moving in, we have the potential of at least getting 5.5 inches of rain for parts of the north bay and napa county and just to the north of santa rosa and also for the santa cruz mountains. some spots will see up to an inch of rain. keepi ining you updated on this facebook and twitter and the forecast as we see more rain in the forecast but check out the weekend. it is looking like a nice one with temperatures in the 50s and mid 60s for the inland areas. mike has a look at what's happening. >> the rails is the issue now. we have a number of systems with delay. the biggest one affecting folks right now is muni because two
6:22 am
lines are affected. 30 and 45 as they travel down the area from columbus and green around the bend because of wires down they had to reroute and using bus bridge in place because you can't use overhead wires so you can't use tracks either. b.a.r.t. delay on tracks at glen park and can't use light rail for the line for south bay. these are all separate incidents but happened about the same time. there will be delays for many of our agencies. the roadways are looking really good but they are wet. that will be a factor as rain travels across the bay and we see that build toward the san mateo bridge. slowing for highway 84 and 680. typical patterns here. live look at the san mateo bridge as that rain came through. now you do see water on the lens there that will be a factor. back to you. >> thank you very much, mike. 6:22 now. coming up next, changes coming to the way the hpv vaccine is given to children. information parents need to know. nbc bay area responds is
6:23 am
handling questions about filing your income taxes. april only a couple months away. consumer investigator is here with the truth about irs audits. >> it doesn't mean you'll be forced to answer questions in a dark room with a detective. most irs audits are handled by the mail and some result in bigger refunds. >> if you have a tip for our consumer team, give us a call. number is on your screen. 1-888-996-tips or visit nbcbayarea.com/responds. a high-speed chase through thes
6:24 am
6:25 am
6:26 am
at 6:26 right now. high-speed chase through the streets of los angeles came to an end thanks in part to a police dog. that chase started late last night when officers tried to pull over a driver. turned out the car had been reported stolen. the driver ran red lights, weaved through traffic, drove on the wrong side of the road even at one point. people inside ditched that car and tried to run from officers you see there. that's when a police dog pounced on one of the suspects. the other continued to run but was taken into custody also shortly thereafter. >> what a takedown. there is a change when it comes to the hpv vaccine for your kids. researchers are consolidated treatment so instead of three shots, some kids only need two. doctors are hopeful that parents will commit because they only
6:27 am
need two shots. they say it's most effective before the age of 15. if you get your child vaccinated before they turn 15 years old and they haven't started the three-part series yet, they only need two doses. 6:27. coming up next on "today in the bay," winter storm warning in the sieaierra as we track more n hitting northern california. >> we're seeing that rain moving in now. some of the downpours starting to move in with a lot of green here on the map. this will become more widespread and heavy as we go through the day. details coming up next. >> president trump's travel ban facing some uncertainty. how a federal court in san francisco could determine what happens next. >> reporter: a police officer shoots and kills a man here in the east bay. the reason law enforcement says this officer drew their weapon in the first place. you're watching "today in the bay."

6:30 am
a good monday morning. we are starting this week off in a pretty similar way to the one we ended last week. a live look at the radar this morning. we're tracking the remnants of the first of three storms to hit the bay area. >> let's take a live look outside from our downtown san jose camera this morning showing you wet conditions out there this morning. something to get used to. careful on the roads. happy monday morning to you. thank you for joining us. i'm laura garcia-cannon. >> i'm sam brock. what's been the wettest year since 1995 continues to be a
6:31 am
really wet year here on monday. >> you're pretty used to this sending kids out the door with umbrella and rain boots and rain jackets. you'll need it again today and pretty much every day this week until we start to see these three storm systems winding down. this first storm system moved in last night. still the after effects with some lingering rain on the other side of that low pressure system still a lot of that rain rolling on in. stormranger mobile doppler raider truck parked on san bruno mountain picking up on a lot of that rain what's become more scattered since yesterday. and still some wet roads as you drive around the bay area seeing a lot of that green on the map for the north bay and san rafael and it's moving out of richmond. you see the rain there. also in san leandro down to castro valley and for the peninsula getting ready to move back into woodside and redwood city once again. so more of this throughout today and gusty winds. we'll talk about what else to expect and mike is tracking some
6:32 am
improvement on the transit. >> because the muni line for example in san francisco and power lines were down. power just restored we're told. that should be better for the line 30 and possibly for 45 as well. there were complications with wires down and power to those trains. we still have some minor delays reported for b.a.r.t. system. track problems around glen park station. we're tracking that. in the south bay, an issue with getting staffing in place. we have a bus bridge in place for light rail which will be the same route there. roadways are wet. areas in north bay hit with rain earlier and moving to east bay but now build comes on so half hour from highway 4 to berkeley curve area. not bad. metering lights on for the bay bridge. moving in toward the san mateo bridge. we'll show you oakland as rain comes through the area. soupy. be careful out there. back to you. >> thank you very much, mike. more problems for commuters this morning. road crews this morning at the scene of a washed out road in
6:33 am

6:34 am
the emergency stay request to keep that travel ban in place from the department of justice but they did not deny the appeal so today they're asking for legal briefings from both sides before they make that final decision but of course that controversial travel ban sparking discussion nationwide and especially here in the bay area. you had president trump not too happy about that district judge in seattle suspending the travel ban on friday night even sending off a series of tweets calling this federal judge a "so-called judge." this court in san francisco is considered one of the most liberal courts in the u.s. we talked to a legal expert on what's expected today. >> they would have to show that there's good reason to think that this order is constitutional. and they would also have to show that the states are not going to suffer irreparable harm while awaiting a final decision by the trial court. >> reporter: now here's how it's going to work. a three-judge panel from the
6:35 am
court will be selected randomly to make the final decision and those opposed to the ban responded to the appeal. the department of justice has until this afternoon to do so. we expect to get a final decision by the court this afternoon or early evening. live in san francisco, pete suratos for "today in the bay." >> thank you very much, pete. at 6:35, we are following a developing story out of the east bay this morning. police are investigating a deadly officer-involved shooting in fremont. >> it happened yesterday afternoon on mowry avenue. >> "today in the bay's" live at fremont police headquarters to explain what led up to the deadly incident. good morning, bob. >> reporter: good morning to you, laura and sam. fremont police tell us that one of its officers was around 4:15 yesterday afternoon was responding to a fight between at least two people. this taking place on mowry avenue possibly near a business located there. when the officer arrived at the found the officer short distance

6:46 am
