sonoma county. i guess accumulation is part of the story here. strong winds too. >> all it takes is rain coming down at really hard pace. rainfall coming down. over an inch of rain her hour. it is already wet. it causes a lot of problems. palo alto, drivers may be going a little too fast. winds gusting close to 50 miles per hour along the coast and hills. heavy rain and street flooding will be possible. rising rivers and creeks. we may get six inches in the santa cruz mountains and the north bay. all of this adding problems on the roadways. >> we have had spinouts reported. we have had trees down. highway 17 southbound by the summit. wet roadways all over. ponding and puddling near the walnut creek interchange. be very careful.

one major crash. northbound 280, all lanes blocked. the southern junction shy of daly city. the tow truck will arrive on scene shortly. hopefully clearing a little bit later. over towards the bay bridge, a smooth drive. tri-valley and the east bay commute. 680 from 580 in towards sinole and pleasanton. 580 pretty soupy as well. a live look at shellville. they saved six people from their cars after they got caught in the rising waters of the storm. >> no one who was rescued was

injured. that's the good news. you can see the street is just covered in water. you never want to cross the paths. it's happening so quickly. bob redell will join us with another look 20 minutes. >> today in the bay kris sanchez is monitoring water levels there. they're rising, aren't they, kris? >> reporter: good morning to you, laura and sam. we got here at 4:00 this morning. in the time that we have been here we watched this river really rise. some of it is covering part of the lower lying part of the bike trail here. and this could get close to flood stage later today. if you look at this graph. we won't keep it up for long. but the purple peak is for today when the river is forecast to reach 15.7 feet. flood stage is 17 feet.

so within about a foot. my photographer allen shows you the comparison there from last month. we don't expect it will be quite as bad as january. still, we will be close to flood stage. the flash flood watch is in the santa cruz as well. they are bracing for more rock slides. and the burn zone is particularly vulnerable. the series of storms stacked up will be a problem for folks whose homes have had enough of this wet weather as well. this man cannot even start to fix his roof which partially collapsed in the rain two months ago. if you want to see the rising levels, do it from a safe distance. the waters are very swift. don't drive-through standing water. you don't know what's underneath. if you get good weather pictures, even if they're pretty, we want to see them. tag nbcbayarea.com when you post them on your social media

platforms. >> always great to hear from viewers. talking about the wind gusts and what's going on. >> los gatos got a gust of 58 miles per hour. overnight we have seen the trees come down by the wind and the rain. the mudslides, hill slides unstable. they have blocked lanes of roads. they're wet. it is causing major problems. >> pete suratos, what's the latest. >> reporter: good morning to you, laura and sam. mike has been talking about this all morning. we want to show you we're on the hillside in the marketplace. you can see where the overturned cars are there. it is affecting the traffic in this area. you see is the lanes are blocked as you mentioned all morning. you're getting a bird's-eye view of it. exit before they hit highway 1. that is kind of the conditions we have seen all morning a very windy morning, wet morning.

it is affecting traffic in this area. of course we'll have an eta as far as when this area is going to reopen. it does have an effect on the driving. be careful when you're driving on the road. pete suratos, today in the bay. >> good advice, pete. our crews really across the bay area. this is a live look at niles canyon. mee da creek is expected to hit flood stage today. sadly, this is the same area where two cars plunged into the water at separate times last month. in one case a young woman was swept away. she still has not been found. >> we have seen many of those creeks and rivers just panned really by the hour here. this has taken an effect first with the storms and now with what's happening overnight. >> it will cause the creeks and rivers to rise through the afternoon.

guadalupe will rise at 4:00, reaching the highest peak of 12 feet. and russian river at guerneville just near flood stage. we will have to keep a close eye on that one. it is flooding above that flood stage of nine feet. and also for the san lorenzo river, it is expected to reach flood stage. >> thank you very much, kari. as more rain rolls through, a great source is our free nbc bay area app. you can take it with you. click on the weather tab for your live radar and get the forecast for your neighborhood. moving from l to politics now. an issue that is hitting right here at home. a federal appeals court in san francisco is going to hear oral arguments on president trump's executive order on immigration. the case comes after a federal judge in seattle temporarily blocked the president's order on friday. the executive order banned immigrants from entering the u.s. from seven different muslim

majority countries. the battle over the president's travel ban as democrats plan to block the secretary of education nomination. >> edward lawrence is live in washington with on the overnight talk-a-thon aimed at denying a vote to betsy devos. hopefully you didn't have to stay up for this entire event edward. good morning. >> reporter: good morning, sam and laura. i was up for most of it, actually. it is still going on inside the senate right now. very busy. this is the democrats's way to delay a vote. the senators are trying to stand up against the nominee for secretary of education, betsy devos. president donald trump tweeting out they are keeping a false or failing status quo saying that devos would be a reformer in this policy. some of the democrats along the senate floor are their reasons for why they don't believe devos should be secretary of education. senator elizabeth warren saying

devos never went to public school, therefore doesn't know enough about public school. as it stands now, the vote will come down 50/50 divided evenly on the floor. two republicans have changed sides on this vote. that means the vice president mike pence would actually be the deciding vote. that's the first time that could happen. democrats can only hold on to this 24 hours. that means noon today, 9:00 a.m. your time, that means this would end. and soon after republicans would have a vote on betsy devos. live in washington, edwards lawrence. back to you, sam and laura. thank you, edward. a cupertino church possibly targeted because of its stance on immigration. they hung a banner reading

immigrants and refugees welcome. in early january, someone stole the sign. the church replaced it. but just this past weekend, someone damaged one of the sign's poles. the church intends to keep displays that sign. you saw the drones during the super bowl half-time. they were magic. maybe more magic than we realized. that's coming up in business and tech. >> we are seeing heavy rain in less than three minutes. we'll talk about the wind that is coming along with the rain and bringing down trees in the microclimate forecast. look how soupy it is. rain falling on your lens 101 north of 680. we are talking about progress, hopeful progress on that crash and closure on the peninsula. you're watching today in the bay.

we are coming up on 6:14 on this tuesday morning. we have some very gusty winds along with this rain. we have seen a few of the wind gauges pigging up on gusts up to 58 miles per hour in some of the hills. most of those wind gusts right now are at about 25 to 30 miles per hour. we'll keep an eye on this and see if any more trees go down. it's coming up in the microclimate forecast. they are working on this mudslide. one tree down. two more a possible problem for southbound lanes. we have one lane open right now. all of this activity, this cleanup going on will track the santa cruz mountains and possibly on the bridges coming up. >> crews fanned out across the bay area during this

microclimate weather alert. this is video just into our newsroom of a mud that shut down part of the santa cruz highways in los gatos. we expect to see more scenes like this throughout the day as the rain continues to come down across the bay area. two so-called drifters have entered a guilty to first degree murder. that case rocked the bay area months ago. they were charged in the kill of a canadian tourist in golden gate park and hiker in marin county in 2015. landsley will be sentenced to 100 years to life. the second will be charged 50 years to life. a third testified against the other two in exchange for a 15-year prison sentence. courageous actions taken by a flight attendant on a bay area

flight are changing the way the airline industry trains employees to look for signs of human trafficking. alaska airlines employee in 2011 noticed something unusual with two passengers on her flight from seattle to sfo. the passengers were an older man and teenage girl. the teen had reported bruises on her arms and odd demeanor. frederick said she could tell something wasn't right. so she urged the girl to go to the bathroom where she left a note and a pen. i said, if you need help, write on this note. and i left my phone number at the bottom. and she wrote, "i need help." >> the captain called police. the man was arrested in san francisco. that story is used as a campaign to train flight attendants on how to spot human trafficking. 6:16 right now. uber hired a nasa veteran to spearhead its plans for flying cars. it is being touted as a way to ease traffic jams. the ride-hailing service

envisions a future where cars can take off and land vertically. it will be decades before we see such cars flying overhead. u.s. news and world report is out with its annual list of the best places to live. austin, texas takes the top spot, bumping off denver, san hoe saw, washington, d.c., and fayetteville, arkansas round out the top five. san francisco is 15th. the list ranks the top 100 metro areas based on affordability, job prospects, and quality of life. we are doing well in the second and third. clearly not affordability.

>> reporter: once again, all eyes will be here in san francisco as the ninth circuit court of appeals decides the future of president trump's tramp ban. >> it is clear the tech companies push back came from the employees themselves. very grassroots action. many are greenholders, visa holders themselves. they are worried about future actions which may in validate their right to work here. remember, the executive order kept legitimate residents out. people who lived in america for years and were returning from vacation or from work conferences. though some workers i talked to take a bit of issue with the filings language. tech companies complain they will be unable to attract great talent. to which american workers said, what am i, chopped liver. there are two fights.

one against illegal immigration, building the wall. but there is a real pushback against legal immigrants as well. senator tom cotton from arkansas who once said hezbollah was crossing into america from mexico tells politico he is proposing a law that would greatly reduce green cards to families by half. if you are here legally you can get a visa for your spouse or unmarried minor children, but that will be about it under the bill. no other family members, except in rare cases aging parents. remember the magic drones from the half-time at super bowl? they have been more magic than we thought. intel is now acknowledging the drones were videoed and composited on television. at the same time it looked very much like they were there. they tweeted out.

will be the main concern. and trees going down as we look at busty winds around the bay area. a lot of problems with this storm system that is moving in. and we have stormranger on at all. the mobile doppler radar truck. it is parked on san bruno. lighter activity. steady rain after problems earlier this morning there. in san francisco, pockets of heavy rain across the golden gate bridge and the bay bridge towards the east bay where we are seeing heavy rain at this point. also for the peninsula, redwood city. and the rain will get even heavier for you the south bay. pretty good coverage of steady rain that is getting heavier through the south county. you can see the wet roads. also for the peninsula and palo alto, rain coming down.

temperatures steady in the upper 50s to right at about 60 degrees. there will be this last push of heavy rain moving through the main morning commute. later today, a little bit of a break before the next storm system moves in. heavier rain moving through during the afternoon, the evening hours early thursday. so a lot of this moisture streaming in. we can see just how far that connects awe to the west. all of that has to work its way through the bay area, bringing additional inches of rain for especially for the mountains and the coastline.

something. >> a lot of wind along with heavy rain. that is causing quite a few issues as you head out for the drive. we're picking up on the heaviest rain as well as the east bay and south bay. that's where you see a lot of reds and yellows on the map. also, our stormranger scanning around the bay area. this gives us a very high detail of what's happening. and it gives us the most accurate information as it happens. so we are looking at pockets of some heavy rain moving through the tri-valley, especially near san ramon, dublin, pleasanton. fremont, heavy rain will get even more intense within the next few minutes. the peninsula and the south bay pretty much soaked. that's causing a lot of problems. mike has better news for one way. pete suratos is over there. in fact, i think they will show us the clearing. a slower drive on the far side.

cars are coming up towards the scene of the crash. let me show you the crash. it was blocking all lanes. we saw traffic flowing smoothly. i'm going to assume the clearing was successful. more update from pete, though, coming up. he's out there probably gathering information. this should recover nicely. by the time you get toward daly city, fine up towards san francisco. getting away from san raf, on the bridge itself. crash blocking at least one lane. westbound commute towards the san rafael side. wet roads ponding and puddling by the walnut creek interchange off dublin. may be a factor for your morning commute. nothing major going on for the roads. we talked about the potential for weather to affect the ferry service. the 6:30 departure has been canceled. we'll let you know if it cascades down. no changes right now for the

golden gate ferry system. back to you. thank you very much, mike. >> team coverage hitting the bay area. new video overnight showing dangerous conditions we're seeing in the north bay. >> crews in the community of schellville rescued several people caught in the rising waters. >> that's where we find bob redell with details on the overnight rescues. bob, what happened? >> good morning, sam and laura. is double the rainfall from last year. the ground is saturated. factor in the most recent storm and the sonoma creek can't take anymore. it is coming from the brush in the dark over there, heading across highway 21 where we're at and flooded the intersection with highway 12. so much water to the right that it has turned into rapids. just to give you a sense of how vast this is, if you look past the green light, it is darkness. that is this flooding extends into this intersection here in

this town of schellville. this is one reason, a reminder why if you're out driving in the dark in the rain, you want to be careful driving. between midnight and 1:00 last night, the schellville fire department had to rescue six people in three different vehicles that got stuck in this respective area here where the flooding took place. it is our understanding all of them are okay. it is not clear if this were a flash flood situation for them or they tried to drive-through and did not realize how strong and deep this water is. it is hard to tell from our vantage point. it is up to the knees in perhaps of the section. maybe a little bit deeper than that. highway 121 is shut down at 116 behind our camera position all the way through the intersection of highway 12. this is part of on your commute. you will want to find an alternate route. bob redell, today in the bay. >> thanks for the latest there, bob. we're getting the latest information on the alameda creek this morning as we give you a

live look in fremont. we're getting varying reports from the usgs. it is already three feet above flood stage at 12 feet, making it at flood stage right now. early reports that it wasn't going to hit until earlier this afternoon. you may recall this is the same area where two cars plunged into the water last month. sadly, a woman was swept away and her body has still not been recovered. that is one area where there are very big concerns about flooding and slides. some residents are getting nervous with each passing storm as the ground is saturated. we spoke to a woman who sees all the rain as a mixed blessing. >> huge amount of earth that just keeps seeping through.

on the one hand, i'm ready to see it stop. on the other hand, we've seen so much drought that i can't help but be glad. keeping a close eye on our rivers and creeks. this is the guadalupe river. the banks there widening. another river that is expected to be near or possibly hit flood stage this morning. the flood stage is 13 feet for the guadalupe river. we're also watching the santa cruz mountains, another area expected to get hit hard during the latest round of rain. flash flood watch through tonight. four to six inches is expected in total. many folks are bracing for the worst as many are still recovering from last month's. as more rain rolls through, as kari has been talk building this morning, it will be on and off throughout the week.

really through friday. a good resource is our free nbc bay area app. click on the weather tab to access live radar. get forecasts for your neighborhood. 6:37. the battle over president trump's travel ban continues this morning in a bay area courtroom. the ninth circuit court of appeals will hear oral arguments which banned immigrants from entering the u.s. from seven muslim majority countries. >> pete suratos is at the court where all eyes, once again, will be on san francisco. good morning to you, guys, in the newsroom. all eyes will be on san francisco as the ninth circuit court of appeals decides the future of president trump's travel ban. all legal briefings have been filed by both sides, which would be the opposition and the department of justice. some opposition is saying this

ban would unleash chaos. former secretary of state's madeline albright and john kerry, as well as tech companies such as apple, google and facebook. the department of justice, on the other hand, is saying that the president is simply trying to protect national security. a three-judge panel will review the briefs. oral arguments will be heard by phone. experts say the president faces a tough battle. proving the ban will keep the country safer after it was suspended by a federal judge on friday. >> this is a huge civil rights case with enormous implications as to people's rights to travel and overall rights in a democratic society. of course there are many organizations that are incredibly troubled. >> reporter: oral arguments will be heard at 3:00 p.m. today. from there the decision will be made. each side will get 30 minutes. in san francisco, pete suratos, today in the bay. thank you so much, pete. 6:39. alameda county leaders will approve a new seven-figure legal fund to assist undocumented immigrants.

supervisors announced their support for the measure, which sets aside $750,000 to fund legal aid for immigrants. a matching grant from the san francisco foundation will double that amount of money. today's hearing is scheduled to start at 9:30. taking a live look outside from one of our san francisco cameras this morning. we continue to monitor our microclimate weather alert. we track all the rain hitting the bay area. >> shades of blue trying to peek out behind an overcast and rainy start. kari, good morning. good morning. right now at 6:40 as you head out the door, a lot of heavy rain, especially south of the golden gate bridge. we're still seeing a steady downpour for the north bay. stormranger mobile doppler radar showing pockets of some really heavy rain here. we are getting a little bit lighter in san francisco. but still coming down at a pretty good clip around oakland, extending off to the east.

it will wind down in the next couple hours but bringing sloppy conditions for this morning's commute. heavy rain in palo alto. you see the bright yellows and reds. we will continue to monitor all of this. mike is checking in on the north bay. >> we are concerned about the entire bay because of the soupy conditions all over. we had that tree down across 17. cleared. the south bay starting to see the build. the north bay has unusual backup. advisers from chp saying, you know what, larger, high-profile vehicles like the bigger trucks, avoid that san rafael bridge due to high winds in the area. that might be playing a factor. that truck mid span eastbound getting away from san rafael to the richmond side. that's the reason for slowing there. that's unusual. the rest of the pattern pretty typical. not as bad for a tuesday. bottom of the screen, slowing towards the san mateo bridge. water on the lens causing an issue for visibility. and definitely will be a factor for traction.

good tuesday morning. it is 6:44. as you head out the door, not only dealing with some rain but gusty winds. we have had some of those wind gusts within the last hour at 20 to 25 miles per hour. along the coastline, up to 38 miles per hour in san francisco. we'll continue to watch the potential of downed trees is and power lines and also some flooding around the bay area coming up in about five minutes. and we're looking at a slower commute building this tuesday. chp says watch out for the bridge. eastbound there's a crash and wind may take your higher profile vehicles for a little ride. thank you so much, kari and mike. new video coming into our newsroom during this microclimate weather alert. we have had crews across the bay area trying to find problem spots for you like this one. a slide near santa rosa.

it blocked the road earlier this morning. it happened at rover road, sunset avenue. even bringing down trees. the road has just reopened. more live team weather coverage in just minutes. in other news at quarter to 7:00 this morning, the santa clara board of supervisors will deliver the state of the county address 5:30 tonight in san jose at the county government office. the city council will look further into removing 980. demolition of the freeway is gaining support. and in san francisco, leaders will focus on developing candle stick point today.

the area previously housed 49ers former stadium. supreme court justice ruth bader ginsburg did not weigh in on neil gorsuch during her bay area appearance last night, but she did address of other hot-button issues. >> ginsburg appeared at stanford memorial church and touched on feminism, the death penalty and partisan politics ripping the country at the seams. she never mentioned president trump by name but she did take a jab at the congress. >> some day we'll be great people, great elected representatives who will say enough of this nonsense. let's be the kind of legislature the united states should have. justice ginsburg avoided talking about the president's travel ban. she said if it were up to her there would be no death penalty or electoral college. 6:47. a deal announced by the mayor commits $5 million of city monday to provide free

now. a live look at san jose. traffic is to go there at the interchange. in oakland, we are also seeing the cars stacking up, the camera shaking around. we have had high wind gusts this morning. we expect some of those winds to calm down just a bit after this round of rain continues to roll off towards the south and east. our stormer mobile doppler radar truck on san bruno mountain picking up on the rain as it scans around the bay area. san francisco seeing lighter activity now as well as the north bay. we are getting a little bit more of a break. but still times of rain moving through. and the ground is already saturated. some of theier rain 880, and 680. and san mateo, redwood center, heavier through redwood city and saratoga. a pretty heavy rain near gilroy. so the south county getting a

soaking at this point. we will see the activity winding down by early afternoon. lingering spotty showers today. this will be basically our time in between those storms. we will see some of those river levels and creeks going back down as we go towards early tomorrow. we are looking at times of heavy rain in the north bay until that next storm system moves in. looking at those river stages, guadalupe river. it is expected to reach 12 feet today at 4:00. and the russian river at guerneville, it is expected to be also just below flood stage but reaching the highest level early tomorrow morning. and the san lorenzo river may reach above flood stage later this afternoon. just got clarification from the national weather service that niles canyon, the creek there is not flooding at this point but it may later on today. as we see a lot more moisture moving. and while this is definitely
