george clooney news. we'll have more on that later. let's start with our top story, president trump vogue to keep fighting for that controversial travel ban. after a panel of federal judges ruled unanimously against reinstating it. our team has it all covered this morning beginning with nbc's peter alexander. good morning. >> another busy night here in washington. the president's health secretary tom price was also confirmed. and president trump today is digging in vowing he's going to prevail before the supreme court after that federal appeals court unanimously refused to reinstate the president's order temporarily halting visitors and immigrants from seven countries. first the ruling then the reaction. president trump blasting the court's finding as political. >> this is just a decision that came down, but we're going with the case. >> reporter: mr. trump taking to twitter writing in all caps see you in court. the security of our nation is at

stake. the response from washington's governor. >> we just saw him in court. he lost. >> reporter: the president's former rival hillary clinton noting the three judges unanimous ruling tweeting simply 3-0. the appeals court said the president's travel ban violates the constitutional rights of people who are already here on visas, failing to give them any chance for a hearing as well as the reits of people who traveled overseas and want to come back. addressing the government's claim of presidential authority over the borders that can't be second guessed by judges the court said quote, there is no precedent to support this claimed unreviewability. but it did not rule on the state's lame that the immigration order discriminated on the basis of religion by singling out muslims. that will be left to a lower court. still former director of national intelligence, james clapper says the ban may be damaging. >> i worry about this creating a recruiting tool for the

extremists. that they -- that they will point to this proof that there is, in fact, a war on all muslims. >> reporter: just hours after being sworn in attorney general jeff sessions justice department said it is reviewing the decision and considering its options. meanwhile top trump aid kellyanne conway is facing accusations of violating federal ethics laws. >> go buy ivanka's stuff. >> reporter: the top republican on the oversight committee firing off a scathing bipartisan letter to the white house and the government ethics office. after conway's high-profile pitch plugging ivanka trump's fashion line on fox news. >> i'll give a free commercial go buy it today. >> oversight committee will call out wrong when we see it. >> reporter: federal rules bar government employees from using their public office for private gain. conway acknowledging the committee's letter late thursday insisting her boss has her back. >> at some point in your life you taught have a boss that treated me that the way the president of the united states

treated me today. >> reporter: conway's comments coming a day after donald trump attacking nordstrom. a decision the company said based on poor performance. sean spicer wouldn't say what, if any consequences conway might face. >> she has been counselled and that's all we're going with. >> reporter: a source close to the president tells me mr. trump disagreed with his own press secretary's use of that word counselled telling aides he thought it made it sound like kellyanne conway was in trouble. today the president will hold a news conference here with the japanese prime minister abe and president said the u.s. will honor the one china policy that says taiwan is a part of china. that's significant. it's a reverse jacksonville his earlier suing beg it should be on the negotiating table. peter alexander thank you very much. let's bring injustice correspondent pete williams. pete, good morning to you.

so, the president says see you in court. this is the first full day for jeff sessions as attorney general. how quickly are we going to see action on this? >> reporter: probably very quickly. all the justice department is saying right now is it's reviewing the decision but it's a virtual certainty the government will try again. could even file something in the supreme court as early as today. >> you've read the decision from this panel of the 9th circuit court. are there areas in that decision that you think are left open for the administration to kind of revamp them and go the supreme court? >> reporter: i think it's a matter of emphasis. the government will stress with the supreme court that the president has very broad authority to control the borders and that the courts can't second guess him. i think it's possible the supreme court might be more open to that argument than the appeals court was. >> there is another option, of course, pete for administration. they can rescind this order. go back to oxon it. rewrite it in a way that does not perhaps cause this kind of a legal firestorm. that would require, though, them

admitting some form of defeat. how likely would that avenue be? >> reporter: i think one of the messages of this ruling is that if the white house had limited the executive order just to people in those seven countries who want to come here for the first time, that would have been much harder to challenge in court. it's because the order was so broad covering people here with green cards, people who have been here before and want to come back like those students, the faculty at the universities, that the court said it harmed the states. >> all right. pete williams. thank you very much. politically this marks the president's biggest defeat during the first 100 days of his administration. pete is an expert on taking us through the legal side of this immigration order. what's the political fallout of this court's decision? >> it's not uncommon for a photo be shot down by the supreme court. that happens to every president. what's uncommon is donald trump decided to make this the central fight of the early days of his

presidency, going after the judiciary in ways we've never seen a president do before, taking to twitter. he set this up as a fundamental early test of his clout as president. this defeat in the court is a much bigger blow to him. obviously the fact that he set the fight up this way, he also believes maybe there's politically some cover here. key tell his supporters hey i tried. >> so let's take a look. three weeks in. let's take a look at a report card we have. where do you think he is political iou on the things he talked about. he talked about voteder fraud, 3 million people launching an investigation. where does that stand? >> in term of the voter fraud investigation that he talked about we had word from the white house at one pointers going to sign an executive order on this and actually i think we got this up here. i wasn't sure if it would be loaded. miracles happen. donald trump claimed three to five million votes were illegally cast in the election. he said at one point there would be an actual executive order. that executive order is still hasn't come. now we're hearing it may be

indefinitely delayed. what's going on congressional republicans, donald trump's own party they do not want to stand with him on this. donald trump may still appoint a commission, his vice president maybe in charge of that. right now that's no long ear top item. >> another progress report we heard so much about repeal and replace obamacare. they did take some early steps in that process. where do we stand? >> this was a central promise of the campaign for donald trump. he said look one of the first things i'll do i will get rid of it and replace it. guess what? immediately repeal and replace obamacare. it's a little bit more complicated than that just in terms of some of the things, some of the benefits people already have for instance pre-existing condition you're covered no matter what right now. there's a lot of issues they have to work out with. what are the signals we're getting? we're getting signals from republicans in congress hey policies are written for the year. this may take a year or so to actually go through. a much slower version now. >> another thing we heard so much about in addition to obamacare the wall. where does that stand?

>> so he did sign the executive order. that's what you're seeing right here, donald trump on january 25th signed an executive order. a lot of it a dramatic moment. here's the thing. the question of how to pay for it. he said mexico would pay for it. obviously no progress there. congress will have to come up with some money. no progress there at this point either. >> real quickly before you go the kellyanne conway story about this ivanka trump clothing line. is this a two day story, is this something more serious? >> it looks like you have the members of congress the committee members saying look they want this ethics office to look at it and recommend a punishment. ultimately it's up to donald trump. does donald trump reach a point with kellyanne conway where he says enough is enough with these distractions. >> okay. well done. now let's take a look at the problems left behind by thursday's massive winter storm that dumped more than a foot of snow in parts of the northeast with temperatures dipping even lower overnight. we're seeing dangerous conditions on the roads. thousands of cancelled flights

leaving to chaos at some airports across the country. we have two reports starting with blake mccoy who is in boston. blake, good morning to you. >> reporter: matt, good morning. folks all across the northeast digging out this morning after that fast and powerful nor'easter. 11 inches of snow here in boston piled up on the side of the road. school has been cancelled here for a second day. this morning the northeast is digging out after the biggest snowfall of the season. 50 million people impacted by the fast-moving nor'easter. in new york city thursday snow fell at a rate of three inches per hour. in virginia a trucker died after his semi was swift off the chesapeake bay tunnel. in connecticut -- >> thundersnow. >> reporter: a rare burst of thundersnow. >> this is something else. >> reporter: in boston, blizzard conditions made roads tough to navigate.

airports where we've seen more than 4,000 flights cancelled since wednesday and that was when that storm was first approaching. now 300 flight cancelations. hardest hit airporting right here at laguardia airport where we've seen 71% cancelations yesterday. that was all the flights coming in and out. this morning it's boston that's feeling the pinch. they've already seen 62 cancelations and that's just so far. right now airport authorities are warning people to really budget a little bit of extra time and certainly extra caution if they are headed here or driving here. cities like new york already put out thousands of tons of salt across the airport area roads and parking lots to make sure people can get here safely. officials say if you are planning to fly today make sure you call your airline carriers because they will know if your flight is in fact taking off. got an update on a story we told you about on thursday an undocumented woman at the center of an immigration uproar in arizona has now been deported. the 35-year-old woman was taken

into custody on wednesday. that prompted a demonstration in downtown foek. protesters blocked vance from leaving a u.s. immigration office. back in 2008 she was caught using a fake social security number to work in this country. immigration be officials say the mother of two u.s. born children had no legal basis to remain in this country. back to the scary incident at jfk we told you about at the top of the show. a flight bound for buenos aires never got off the ground after an engine burst into flames. inside the plane, other pilots reported seeing fire coming from engine. the plane was checked out and then taxied back to the gate and taken out of service. >> we want to show you a story about a ucla cheer leader who had a bad night. take a look on the left of your

[ cheers and applause ]i'm ... ==vo== there "earthake safet concerns good morning on your friday. i'm sam brock. we want to tell you about earthquake safety concerns surrounding morgan hill. look at that gushing water. that's water released from the reservoir because it's too full. the santa clara valley water district put a restriction capping it at 68% because the dam which was built in 1950 has seismic vulnerabilities. right now, it's more than 80% full. if a major earthquake were to strike, the dam would be damaged, unleashing water onto morgan hill. >> more water trouble in one of california's biggest dams. the oroville dam could be filled
