loo looks. right now 40s south bay 41 degrees. peninsula 48. san francisco nice 47 degrees. in the north bay it is about 39 degrees. here is a look at your temperature trend over the next couple of hours in san francisco. by about 10:00 a.m. we will be into the 50s. 55 degrees, fast forward and we'll finally see the 60s again in the bay area not just for the san francisco area but near the south bay and oakland area expecting to lime into the mid-to upper 60s as well. we will be expecting a slightly warmer day than yesterday by a few degrees thanks to the high pressure that will continue to keep us warm and dry. we are tracking an active weather pattern that is expected to make its return. i'll have more details and a look at your day planner coming up in a few minutes. >> okay.

thank you. feels good to get outside. a pilot removed from a flight after showing up in street clothes and ranting over the pa system. it took off from austin two hours later and ended in sfo last night. the pilot started to make comments about the presidential election and her recent divorce. they say it started as soon as she boarded the plane. >> the pilot is late. the captain is late. she shows up dressed up like a civilian and asked us to take a vote of whether she should change into her uniform or fly as is. passen. >> many passengers expressed concerns about the pilot's well being. sha say she did apologize before she left the plane. a mistier i don't say investigation. the body of two people were found inside a berkeley home yesterday morning.

investigators are not sure what killed them. first responders were called to a house far medical rescue. the couple was pronounced dead inside the moment. officers are looking into whether their deaths were cause bid carbon monoxide poisoning. we have new detail nss in r series of events. a man was shot and killed blocks away from the great mall. friend of a missing tenant are desperately trying to find out if he was the victim. police say they first got a call friday night from a woman who told them a man pointed two guns at her and stole her car. dau during a shofrt pursuit she was taken into custody by police. officers later discovered the body of a man inside the parking garage where the carjacking took place. friend oofs missing 28-year-old tenant fear the worst.

interchange. there is no time estimate on when this stretch of highway 37 will be dry enough to reopen. a terrifying wake-up call saturday morning for people in a home around. a tree smashed through and sending light fixtures flying. the daughter of the couple that runs the home runs the elderly care facility downstairs. >> i thought it was an overdue earthquake. i got up thinking something else was going to happen and i ran and started screaming earthquake. my mom thought it was an earthquake too. my dad sad no, the tree fell. >> the family who runs the facility says they are relieved no one was hurt. a major milestone for one of california's largest reservoirs.

rain. i did a have few folks tweet me. look at that beautiful sunrise. now, we will begin to warm up much like what we did yesterday. mount diablo 47 degrees. get ready for another day of sunshine thanks to high pressure that continues to dominate. it will keep us nice and warm across the bay area. peninsula rain now 48 degrees. south bay 41 degrees. trivalley at 46 degrees. san francisco waking up to 47 degrees and the north bay a tad chilly at 39 degrees. if you are wondering about the next couple of hours, if you're just now waking up and pouring yourself a nice cup of coffee here is what you can expect. by 10:00 a.m. warming up to about 55 degrees. if you fast forward to about 1:00 or 2:00 we are expected to hit our highs for the day from 60 to 61 degrees. definitely 1 or 2 degrees warmer

than yesterday. temperature trend for san jose, by about 11:00 a.m. we should hit about 56 degrees. san jose expected to warm up into the mid-60s as well. across the bay area, you don't have much to complain about. the entire bay area is expected to warm up again today. san francisco high of 61. san jose high of 64. if you're heading to the north bay or napa area it lab grewill great day for that. i know i still have to check out good wineries up there. let's take about that incoming rain. we are tracking another active weather pattern that is expected to make its arrival as early as wednesday. right now we are seeing high pressure dominating over san francisco and just off the coast. right now it looks like the arrival span is expected to come in as early as late wednesday.

it is 7:29. let's give you a live look outside. sun completely up from our cameras atop communications hill. this is what much of the bay area will look like as you step outside this morning. good morning. thank you for waking up with us. we have a look at that micro climate forecast. we are getting a series of dry days. this weekend has been wonderful. you also have rain in the forecast. >> yes. we do have rain. it is the month of february. it is expected. i have been enjoying iced coffee. it has been a nice change. if you're up here visiting the bay area app is expected to show you when the arrival is as well. if you log into that you'll notice it is about 46 degrees, mostly clear skies in san francisco and also in the oak and area as well. expecting 43 degrees. it will warm up into the 60s.

a former kaiser permanente charged are sexually assaulting a patient. they say she was arrested last friday. he is seen here. investigators say on january 25th a woman said she was assaulted by a medical assistant during her appointment. they are now investigating whether there could be more victims. in a largely divided nation san jose mayor says he is trying to tell a different story. he delivered his third state of the city address calling it a tale of one city. major addressed the crowd. he enlisted some of his accomplishments including staffing up the city's police department expanding housing and increasing minimum wage. he also had a message for the large immigrant community. >> to those who seek to divide new americans from the rest of

of speakers addressed the crowd. nbc bay area responded how does a $25 fix it ticket lead to a $25 fine? chris says it all comes down to a single consumer protection law that many people don't know about. >> reporter: berkeley based photographer mark lily often spends his mornings in santa cruz capturing the sunrise. last winter an early morning excursion started off all wrong when a police officer pulled him over. >> i made a rolling stop. he pulled me over. >> he wasn't ticketed for the rolling stop but he was sited for something else, not having his insurance card with him. >> he said i will give you a fix it ticket. >> it allows do you pay a $25 fine later if you can show proof of insurance to the court. he tried to do that but ran into roadblocks. the story gets messy because the

wrong address was was on his ticket. he admitted he gave up! i thought it was a fix it ticket, $25. >> months later that minor $25 ballooned into a $1,200 fine. the court sent mark's case to a debt collector. it demanded $900, plus $300 collections fee. zbli didn't know what to say. >> mark asked if we could help. he is still being told he has to pay. there is something he could have done. he could have pulled out his cell phone. it allowed drivers to show proof of insurance on their smart phones. mark said he had no idea and said the police officer didn't suggest it. >> he did not tell me that. >> we were curious how many

other drivers were issued fix it tickets when they could have pulled out their smart phone and paid nothing at all. that data is difficult to get but we did get numbers from san mateo and marin counties. redwood city issued 1,100 fix it tickets. san carlos 640, san rafael a thousand. they paid 320,000 in fines when they could have paid zero if they had a smart phone to show proof of insurance. >> armon is with an insurance trade group that backed the electronic insurance card law. >> this is not even the way. this is what's happening now. everybody has a phone. understand this is how it works. >> mark wishes he had been

larry zwroi larry joins us. what is this significance? >> temporary ruling, this ruling keeps the president from immediately imposing a travel ban. travel's lawyers argued he add sweeping power. opponents argued the first amendment's ban were more important. so the decision was handed down unanimously, by the way, bay panel of two democratic appointed judges and one republican appointed judge. let's remember, all the turmoil we have been talking about centered about whether the ban could be imposed immediately. only after that the question is decided, will the lawyers do battle in the courts over the merits of the ban itself. >> so it is now in the courts. how did this rollout get so mutt muddled? >> they believe he was in too much of a hurry to impose the

ban. these ordered are circulated to the management of the budget as well as effected agencies. in this case it would be the department of homeland security, department of justice, legislative leaders. the key people in these units could have really helped the president draft a tighter order with fewer questionable decisions. he relied on his small circle of advisers instead. >> i have a feeling had it been written tighter we would see some opposition. what do you think mr. trump's options are moving forward? >> he has three choices. he can appeal the decision to a larger group of judges. it is a process that includes 11 jurors in the same ninth district. it will accept the case only if four justices agreed to hear it.

given the court's current make up we have eight justices. it would be a long shot or he can write another executive order which is more specific perhaps targeting those not green card holders who have not been awarded refugee status. it would be the cleanest way to extra kate himself from the mess. he may view it as defeat. we know this is something donald trump does not like to admit defeat. >> it is all about winning. let's talk about the potential upside and the risks moving forward. >> some pretty important risks here, already considerable fallout. airlines have been working on a day-to-day basis and refugee families have been placed in a sea of uncertainties. disarray to americans but countries all over the world. there is another problem for the

good morning. it is now 7:53. you're bawaking up to chilly temps. this is our weather underground sky cams. we can expect to keep this sunshine through today and of course the next couple of hours we are expecting a nice warm up. peninsula at 48 degrees. south bay 41 and we are seeing mostly clear skies. it is 46 in the trivalley. east bay 43.

north bay always slightly cooler at 39 degrees. now, the temperature trend over the next couple of hours, it's a good day to wake up and work out. by about 10:00 or 11:00 we will be climbing into the 50s. fast forward through 1:00 or 2:00 we will be hitting an expected high of about 60, 61 degrees for san francisco. it will feel very nice out there. a very california winter. 41 in san jose right now. by 11:00 a.m. expect high of 56 and fast forward to about 1:00 or 2:00 and we will be expecting a high of about 64 degrees. here is a look at today's forecast. mostly clear skies all the way from the coast to the bay and inland areas as well. santa r santa -- morgan hill area expecting a high of about 63

degrees. right now we are seeing a lit of this upper ridge dominating. that's what keeping the area dry with seasonal temperatures. as this upper ridge keeps a dry right behind it we do have a disturbance. let's talk about the time line. when will that rain return? we are going to keep nice conditions at least through tuesday, which means your valentine's day is going to be off to a good start. if you notice we do have this low pressure system sitting just offshore. it will be making its arrival as early as wednesday. what's going to happen is wednesday afternoon it is going to start turning cloudy and winds are also expected to pick up as well. late into wednesday and thursday morning we see the storm system and line of showers start moving into thursday morning, which means on thursday morning we could see widespread showers from the north bay to the south bay with periods of moderate
