this afternoon you may not. we have heard it raining since yesterday afternoon. we have seen it too. and we have been measuring quite a bit. looking at the radar now hitting the last little push of the rain rolling on shore. pockets of heavy rain in the santa cruz mountains. some of the rain approaching saratoga, los gatos and san jose. it will be heavier before it tapers off. this is the type of activity we can expect for the next three or four hours. i'll detail a look ahead to the day and help you make plans. that's coming up in eight minutes. heading over to mike, a fallen tree in los gatos. >> the tree was just reported cleared from the roadway. here is video from a short time ago.

as soon as we get it. michael tyree died behind bars. and in a few hours, the trial will begin for three santa clara county jail guards charged with beating him to death. kris, this case highlighted a lot of problems at the county jail. we are expecting that to play out as well. >> the himself is not on trial, but we expect she will be brought up. opening statements scheduled to begin in four hours. it is here at the hall of justice we expect to see what the strategy is for those attorneys. we were at the courthouse yesterday as the jail guards accused of beating michael tyree left the court after the jury was selected. sheriff smith has been criticized for the policies and

training at the jail that she oversees. the attorney is watching this trial closely. he represents another inmate who claims he was beaten by other guards at the same jail. >> the text messages between the guards where they are talking about going to the inmate's cells at 1:00 or 2:00 in the morning and taking care of business. that basically is very strong evidence to suggest there was a pattern of behavior amongst guards of getting very physical. >> now, we expect defense attorneys for the three correctional deputies will argue that the death was not intentional. the trial picks up at 9:00 this morning. the rain, by the way, just picks up as well. in san jose, kris sanchez, today in the bay. thank you very much, kris. a san francisco neighborhood is taking an unwanted trip back in time. only after a mistake made by a

that's been the only lightning strike i have seen so far. we are looking at the last a little bit of rain rolling through right now. and still pockets of heavy rain starting to move on shore into the peninsula and approaching the south bay as well. it is expected to stay pretty wet out there. this is moving through saratoga, san jose, and moving north east. >> santa rosa, foggy. a little bit of drying south of there. for the east bay, going to see showers rolling through from san ramon to the tri-valley. the roads are wet. but they are also moving well. that's good so far. easy start to the morning commute.

looking at rain at 7:30 this morning. when you see the oranges and reds that indicate heavier rain. a lot rolling off to the east by early afternoon. then clearing today. mild temperatures. it wasn't be that bad. we will do it with more wet weather for the morning commute. tapering off as we go through the day. we will see more rain on friday. we are seeing several rounds looking at the potential of this next round, up to three-quarters of an inch of rain. and giving you the timeline what to expect today. thursday, dry weather. sunshine really cool. and then the heaviest rain with the storm system rolling through friday but clearing out saturday and more rain late sunday night. so staying very active here with several storm systems rolling through the next several days. following me on facebook and twitter, i'll keep you up to date on all the changes we have.

the investigation into last week's police shooting of a naked man. he drove off. police chased him through a supermarket. they thought he was armed but it was a caulking gun. boles has a history of mental illness. 5:25. nbc bay area responds to ala fayette woman who says her $1,000 fedex shipment was damaged and the company wouldn't reimburse her. >> chris chmura joins us with another success tore. >> mary shipped a box from north carolina where she was visiting her son is, to her home in

lafayette. she used fedex ground shipping and paid $1,000 to ensure the box. two weeks later, the box arrived, split open. that's a picture she sent to us. she immediately called and said the company told her to takes her box to a claims office 35 miles away. they examined the box, took pictures of it but mary's claim was denied. she appealed, but that was denied too. she asked us for help. fedex learned mary shipped it from inside of an office depot. according to fedex that means the claim should have been filed through the office depot location. mary says no one told her that. luckily, we got through the process and got it squared away from her. she received a check for $1,350, the cost of insurance, plus the shipping.

it's been raining since yesterday afternoon. 101 to 280, soggy on both roadways. and the south bay seeing a little bit of break in san jose moving off to the east. saratoga seeing the rain winding down. for the south county, it is getting a little bit wet or there. expect the rain to get heavier. we are seeing the pockets moving through san mateo, north. as we head over to mike, it is also affecting the commute. >> you see the index growing in the green highlighted area.

a large tree is down on a home there, pete. we know you just got on scene. how is it looking out there? yeah. good morning to you, sam. we're here at capital and glen street in va is lay hoe. you see the oak tree is down into this home. i talked to the home owner. it is is about 100 years old. it happened at 2:00 a.m. they thought it an earthquake. when they came out of their rooms, they saw the tree was coming through the window. the home has been red tagged by pg&e. they are afraid this part of the tree may come down next. so they are keeping an eye on this. you did speak to them off camera. tell me they wanted to cut down this tree about 11 years ago but there was some red tape as far as the permit process with the city. i'll chat with them one more time. we'll bring you that update in the next hour. back to you in the newsroom. thank you, pete. appreciate that.

while you were sleeping, the tsa released the exact airlines and airportsffected by a new ban onlectronic devices. bob redell live with the details on some of the new restrictions coming out. people need to know about this. good morning, bob. >> good morning to you, laura. the trump administration and the department of homeland security say they have intelligence that indicates terrorists are still trying to smuggle explosives whereon to airlines in electronic devices. the government won't saw whether the threat is on newly obtained intelligence. the last five and a half hours, the dhs started a clock on nine airlines based in the middle east and north africa, giving them 96 hours to implement these restrictions. passengers on flights can only carry on their smartphones and medical devices. all over devices tablets, portable dvd players, video

a look at the seven-day forecast at the bottom of the screen now in the south bay, cool weather the next couple of days. more waves of rain. we will still have a chance of heavy downpours at 8:00. that's when a lot more people will be getting out on the roadways. so there may be issues there. once that moves through, look at early afternoon. not a lot of rain here. in fact, it looks like we pretty much will dry up and take a break. another round early in the morning. more pockets of heavy rain. a slight chance of thunderstorms. that's what we have been watching for this morning. we will keep a chance of rain in the forecast and a chance on of thunderstorms. additional rainfall on top of what we have already have, a half an, up to three-quarters of an inch in the north bay. and this round of rain rolls on out of here. thursday looks dry. making plans for friday, it looks good this may be the

northbound 238 off westbound 580, things have calmed down. whatever road was being done, it has cleared the area. more traffic now through hayward for southbound 880. 680, light, towards pinole boulevard. looking at the drive times. again, you saw how it improved on our speed sensors. we should see improvement. it's just five miles at the most coming out of astro valley and 880. a smooth flow of traffic on the rails. we have the bay bridge toll plaza. backup all throughout the area. you see the rain just starting to come down. fast track moving well.

mother of five died in new york whe a carjacker ran over her with an emergency vehicle. her partner was struck but survived injuries. members are coming together to support the family, friends, and firefighters who worked with her. 5:58. today witness testimony will begin in the trial of antolin garcia torres, accused of killing sierra lamar. the trial is in its eighth week. the prosecution is still presenting its evidence. garcia torres is being charged with the attempted kidnapping of three other women in 2009. all charges that could send him to death row if convicted. one robber drew the attention of police, sheriff's deputies and highway patrol all in one night. he is accused in a string of armed gas station robberies.
