you got used to the sunshine and then suddenly it was raining. we still have that same pattern over the bay area right now. and it's 53 degrees with cloudy skies in the tri-valley as you step out the door it's also 53 degrees in the north bay and in, heading into today. highs reaching into the upper 60 in the tri-valley and the peninsula. 70 in the south bay. not bad. it will get warmer as we head toward the weekend, as all of the rain will die out. i'll have details on that in eight minutes. vianey is tracking a major slowdown for parts of it bay. >> the biggest slowdown is on the toll road. that's eastbound and westbound 80. right now, also seeing slowing in morgan hill. northbound 101, it appears to just be a fender bender, but it's just enough to have the cars backing up and it looks like the southbound side is also seeing slowing, and that's because people typically tend to look over. the drive times right now, tri-valley drive times, we're reporting that accident. we have been reporting it all

morning long. westbound 580 to 680. it's seeing a delay of 26 minutes, which is not that good for this hour. southbound 680 to vargas road, about 15 minutes, and westbound 84 to 680, about ten minutes. all in all, in san jose, 101 is looking like a smooth commute, although we have a lot more cars out on the roads. back to you. >> thank you. coming up today, we have been following this for the last several days. a group of tenants rights activists continuing a hunger strike as the san jose city council gets ready to consider an eviction ordinance. >> bob redell is outside city hall to explain why activists are pushing for this ordinance to pass. landlord groups say it's just not necessary. good morning to you. these people, some of whom say they have not eaten since friday, they're on a hunger strike. to try to convince the san jose council who meets later today to pass a new law that would limit

the reasons why landlords could evict tenants. currently, you can be evicted for no causesoever. according to city records, there were 2200 so-called no cause evictions in san jose between the year 2010 and 2016. the silicon valley renters rights coalition which has organized the hunger strike believes that number could be higher because some evictions go unreported. the proposed new ordinance which does have support on the city council would require that landlords have a just cause to evict. it would also push landlords to be more attentive to tenants complaints. they counter with a statement, against the proposed ordinance. they say, san jose already has lawed to prevent landlords from eviblthing tenants for financial gain. the city needs to enforce those laws rather than create new legislation, more regulations and additional layers of

bureaucracy. bob redell, today in the bay. >> we know we'll be tracking this all day. >> 6:03. day three of the manhunt for the suspect who killed an elderly man and then posted that murder on facebook. police are now expanding that search nationwide. federal and local law enforcement officers are looking for this man, 37-year-old steve stephens, in at least five states. 74-year-old robert godwin was killed on sunday in cleveland. and yesterday, dozens of family and friends held a vigil for that man. the mother of his -- two of his ten kids says that the outpouring of love and support she's received from the community is helping her to cope with the tragedy. >> i never knew how many people cared. how many people show support. showing me and my kids love. i mean, it fills my heart. it makes me feel better. >> there is now a $50,000 reward

for information leading to stephens' arrest. >> there is more fallout this morning in berkeley after violent protests broke out over the weekend. of course, 20 people were arrested this weekend. now, there's concern over how police handled an escalating situation. berkeley's mayor weighing in at a meeting last night and praising the police chief's decision not to move more aggressively. he said it would have made matters worse as pro-trump supporters and self-described anti-fascists clashed in the streets. the mayor says free speech with stay, but outside agitators have to go. >> i imagine it will not be the last time that, you know, right-wing provocateurs will come to our city to send a message, and we'll be ready to respond. >> as for berkeley's police department, they say they're focused on the peaceful expression of free speech and will seek prosecution for those who infringe on that right.

>> two men accused of a fraud scheme involving the closure of a golf course are now being sought by authorities in contra costa county. this is a photo of one of the two sus. kevin fitzgerald from brentwood. he was general manager of a golf course which closed last year. the other, mark madsen, is a contractor from southern california. financial troubles as the golf course were made worse by the theft and fraud allegedly committed by fitzgerald. >> 6:06, and a north bay mcdonald's turning into a gruesome crime scene. a novato man is accused of taking a bite out of his ex-girlfriend's face there. happened sunday at the mcdonald's on hamilton parkway. police say oscar aguilar got into a fight with his ex and then bit her face and took off. the woman lost some facial tissue above her but has been released from the hospital. >> we're now learning what likely caused a shutdown on bartd's line last week.

b.a.r.t. says power surges are likely to blame once again. that disruption on friday put 22 rail cars out of service. b.a.r.t. engineers say this is a result of power spikes. similar shutdowns happened in the same area just last year. >> happening today in vallejo, a public hearing to try to help people understand the recently approved water rate hike there. rates are going up 18% in june and then 3 every year until 2021, which means a family paying about $42 monthly for water right now will be paying $57 by 2021. that money is needed, the city says, to repair the city's aging water system. tonight's public meeting is at city hall at 6:00 if you want to weigh in. serious headway to report for you on much needed repaired to the heavily damaged oroville spillway. a deal has been made to immediately start on permanent repairs and to have the dam there fully operational in time for next fall's rainy season. the department of water resources says the winning bid came in at more than $275

million. of course, problems with that spillway during our heavy rains recently led to nearly 200,000 people being evacuated. >> it is 6:08, with cloudy skies and mist and drizzle around parts of the bay area, but no heavy rain. you may still want to grab the umbrella just in case as the spotty showers continue. if you have plans to head to the s.a.p. this evening for the sharks game, it will be at times some rain falling as you celebrate before the game starts. at 7:00, looks like it will be clear. temperatures in the low 60s and all clear also as you head out of the shark tank, as our temperatures drop back into the mid to upper 50s. for the next couple days, still some rain in the forecast before this weather system clears up. i'll have a look at what to expect as we go into the rest of the week with some warming temperatures in the forecast coming up at about 6:11, the temperature trend as well. as you get ready to head out the

declining in some racial groups in 6:24 right now. pretty interesting study to tell you about, about breast cancer rates this morning. the rates have been declining in racial groups in recent years but a startling new study finds the rates are rising among asian americas, specifically in california. the murky news reports in this california' based study, it was released by the fremont cancer prevention institute of california. the largest increase was among koreans and southeast asians. the risk of breast cancer

increases as people start to adopt a western lifestyle. it makes sense rates are increasing among these groups who more recently immigrated to the united states. >> 6:25. nbc bay area respandz to a san jose man who paid $1400 for a professional course which the school then wouldn't let him complete. we studied the situation. consumer investigator chris chmura is here with the result. >> paul mcdonald enrolled in an emt course through national university. paul said the school told him the only prerequisite for the course was a high school diploma or ged. paul went to high school in the uk. he asked if he could use his bachelor's degee from a florida college to meet the requirement. he said the school said, yeah, you could. he turned over his college transcripts. fast forward a few months. paul was ending the emt course and said national university told him they needed his high school transkrift after all.

show us the tributes held there as well, and little giant, that fire hydrant behind you, pete, good morning. >> good morning, sam and kris. yes, the fire hydrant is called little giant. right near dolores park. their just wrapping up the annual painting of the hydrant, which is said to have saved the mission district on that day of the 1906 earthquake. but as this is wrapping up now, has been going on since about 5:30, we'll show you new video from earlier where you can see folks taking turns spraying the fire hydrant gold. as i mentioned, the fire hydrant is said to have saved the mission district as the fire began to head west in the area following the earthquake. this is the second event this morning in commemoration of the 1906 earthquake. we'll show you the video from the fountain of the commemoration event taking place at the fountain on market street this morning honoring the estimated 3,000 lives lost

xikted of the murder of two. morrison lampley is facing 100 years in prison. lila alligood could face 50 years behind bar, and sean angold struck a plea deal and testified against the other two. he'll receive 15 years. >> 6:35. a disturbing crime on a busy bay area trail is putting more officers on patrol. a jogger says a man tried to rape her while she was on the sonoma overlook trail this easter sunday. someone posted this homemade warning at the head of the trail where sonoma sheriff's investigators say the 24-year-old victim fought that attacker off. she told them that he pushed her, hit her, and tried to sexually assault her. now hikers say they're thinking twice about using the trail. >> it's really scary because i do go up there often. so it's like now i'm like, um, do i really want to go up there by myself or even not by myself but with other people. you never know what you can find. >> the suspect is described as a

50-year-old white man with a bushy white beard who could be homeless. >> the salono county high school teacher in trouble with the law once again, but this time, the charges are far more serious. accused of having sex with a 17-year-old student. reony lane turned herself in on monday. she's an english and special needs teacher at benicia high school. earlier in the month, shoo was found with wanna and stolen property in her car on campus. the teenager she's accused of having a relationship with admitted to stealing the items and putting them inside of lane's car with her permission. it was then detectives discovered she was having an inappropriate relationship with the teenager. >> 6:36. an unbelievable story out of the peninsula. a family dog snatched off a bed while the family was sleeping, and the intruder left paw prints. wildlife officials think a mountain lion went into this home in the pescudara hills yesterday morning. vicky and her daughter said they

often leave the back door open to get fresh air and so the dogs can come and go. they said as they leapt, one of their two dogs, the 15 pound dog, started barking viciously and then violence. vicky said she got up and looked at what she thought was the other dog going outside. >> as it walked down our path, i thought, that looks a lot like a lion. >> the family saw large paw prints on the floor and now the state wildlife warden says there was blood on the bedroom door. there has been no sign of lenoir. >> projects right now already being planned with money brought in by governor brown's 12 cent gas tax hike. part of his larger transportation package. yesterday, state senators approved nearly a billion of road and train projects. the governor's transportation bill is expected to raise more than $5 billion per year for road and other transportation projects. speaking of the specific ones,

>> ofteny cloudy out there. thank you very much. a live look at san jose city hall this morning. that's where housing activists who have been on a hunger strike since friday going to show up ahead of a key vote scheduled for tonight. council members are voting on new protections for renters that include requiring landlords to cite just cause prior to any eviction. as we have reported, there have been more than 2,000 such evictions just since 2010. they say the city already has laws in place. hunger strikers vow not to eat until tonight's meeting. >> the path to the hollywood sign just got harder to get to. not like it was all that easy to begin with. but what many are calling the most easy and direct trail of your options, officially closed this morning. that closure is supposed to be permanent. and here's why. the horse stable that owns the land behind the gated beachwood drive sued to have it closed. while the trail is still accessible from other points, hikers say the way is typically more treacherous.

>> 6:45. new this morning, parents in palo alto are voicing concern about the school district's new sex education curriculum. the palo alto unified school district is asking a redwood city nonprofit called health connected to teach sex ed to seventh graders. some concerned parents say some of the lessons are a little too graphic for their kids and encourage risky behavior rather than prevention. the district says the curriculum is updated to be in compliance with state law. >> a massachusetts man accused of killing a former google employee will be arraigned today. angelo ortiz is facing attempted murder charges and attempted rape charges in the death of vanessa marcote, killed out on a jog near her mother's home about 50 miles west of boston. it happened last august. >> great resort and casino looking to expand again by adding another 200-room motel. a public hearing on that

proposed expansion tonight. the new wing will be built on an existing parking lot and it would employ 150 people. you remember the casino added a 200-room hotel last november for $175 million. >> 6:47. happening today, former mexican president vicente fox will speak at stanford university about the future of u.s./mexico relations. during his speech at palo alto high school yesterday afternoon, fox criticized president trump as he has plenty of times before. he said leadership without compassion will fail. he also said that the nafta agreement is not the disaster that president trump claims and that it should be renegotiated and improved rather than scrapped. also happening today, president donald trump heads to wisconsin to speak with employees of a tool company. the president will tour the headquarters of snap-on tools in kenosha this afternoon. the facility is within house speaker paul ryan's congressional district, though ryan himself will not be there today.

protesters are planning to meet in a park across the street from that company's headquarters. and the president is going to use that event in wisconsin to sign an order to buy and hire american. >> scott mcgrew, that is an order that is mostly an encouragement, really. >> that's right. an executive order, but it doesn't mean you have to buy a chevy instead of a hyundai. the president is going to direct the labor department to pay close attention to the hiring of foreigners, particularly through the popular h1b visa. that's one that high-tech uses to bring in workers, generally from yeah and china, when the companies say they can't find skilled american workers. now, the current h-1b lottery is currently under way, and we saw far fewer applications this year, about 200,000. that's 16% less than last year. of course, keep in mind, those 200,000 are chasing 80,000 visas. the president want you to hire

american. he wants to buy american as well. that's the other half of today's announce. sometimes hard to do. nbc news has documented even ivanka trump's clothing line doesn't buy american sometimes. since the election day, the apparel brand run by trump's daughter has imported 56 shipments of ivanka trump's products from china and singapore. north korea still an issue this morning. not much new to report to you, but the fear of a catastrophe on the korean peninsula hasn't balted. the u.s. is sending anti-missile missiles to strategic spots right now. the missiles by the way, created and designed in sunnyvale. finally, a close eye on an election in georgia. a special election to replace tom price, who is now on president trump's cabinet. can a democrat win the seat? this happened in kansas last week and a democrat did not win, but they're hoping traditionally republican voters are disappointed enough they might switch sides in georgia. so far, though, guys, democrats 0-1.

going to see that mix of sun and clouds. temperatures reaching 67 degrees in milpitas, and in morgan hill, 68. also 68 in danville today. mid to upper 60s in a few spots hitting the low 70s. on the peninsula, we're in the mid to upper 60s there. palo alto, 69 degrees. and the embarcadero too at 62 degrees today. santa rosa, 66 degrees. looking at a little bit of rain. some of the heavier rain we had this morning has since pushed off towards the east. we still have the clouds left behind. and the low visibility and the mist and drizzle from the north bay to san francisco. you're looking out the window. it looks really soggy, and you might want to make sure you grab a hat and some long sleeves. it's one of those days where it will be at times wet but then you want to be comfortable as the sunshine comes out. and there will be still some rain moving through as we go hour by hour. at 8:30, rain moving back into san francisco and parts of the south bay. and then other times we just

have cloudy skies. still some spotty showers and early afternoon for the santa cruz mountains and the south bay and a slight chance that a few of those downpours could contain thunder and lightning. we'll watch out for that. all clear for most of the day tomorrow, and then here we are late tomorrow night into early thursday morning, there will be some more showers moving through. but it looks like a lot of that will be clearing out in time for the end of the week and temperatures reaching into the upper 60s in san francisco. inland areas, take a look at these temps for the weekend. up to 79 degrees on sunday. we're going to go from early spring to late summer that quickly around the bay area. as we head over to vianey, tracking what's happening on the waze app. any slowdowns? >> a few slowdowns. if we take a look at the map right now, chp is also reporting it looks like a traffic collision here. 101, right at 114 near willow road, a lane blocked. we're seeing some backup, but our wazers, nbc bay area wazers,

6:57 on your tuesday morning. welcome back. before you head out the door, here are the top stories right now. >> people in san francisco marking one of the city's darkest days. a great quake of 1906. hundreds gathered at the fountain as they do every year to commemorate the moment the earthquake struck. that was at 5:12 this morning. a little later, firefighters painted another coat on the golden fire hydrant at 20th and church street. that fire hydrant remained in working order as most of the city burned. saving the mission district. >> just minutes ago, cleveland's police chief held a news conference on the manhunt for a suspect who killed an elderly man and posted the video on facebook. the chief says the search continues right now. breaking developments. the search is now entering its third day. federal and local law enforcement officers are looking for 37-year-old steve stephens.
