mike is tracking a crash in san francisco. >> the crash has been successfully cleared from the freeway on the city streets now, but no longer than issue as wow get off the bay bridge. we'll zoom over to where we saw slowing. looks like that has cleared. a little slowing north 280. not sure what's going on there. i'll check on that. i did talk about the bay bridge. that approach clear now to san francisco. chp says there may be gusty winds on the benicia bridge. we'll track that as well. back to you. >> thank you very much. 5:01 now. it's been two months since these devastating floods destroyed san jose communities, and today, there's a crucial deadline for an agency's impact. in order to get public assistance from the state of california, all organizations impacted have until the end of today to ask for help. >> important deadline. kris sanchez joining us live in san jose with the details. this is all happening only days before the flood assistance center is closing for good. >> right.

if you drive through the neighborhoods that were so impacted, you can sill see that folks are struggling to get back to normal. that's why this deadline is so critical. the deadline to get the paperwork in to the state to qualify for the federal low-interest loans. the money is still on the table, and the deadline, as you mentioned, is today. local government agencies, also nonprofits eligible for low-interest loans up to $2 million to replace or repair their real estate, also the machinery and other business assets that make their businesses run. homeowners can apply for low interest loans up to $200,000 to repair or replace their buildings and up to $40,000 for personal property that was damaged or destroyed. according to the small business administration, the sba, it has approved already more than $6 million in disaster relief to victims of the coyote creek flood and other floods and disasters here in california following our active weather. the small business

administration office that opened here inside san jose city hall, that's going to close on friday. the paperwork is due today, but you can ask your questions up until then. in san jose, kris sanchez, today in the bay. >> good to note, thank you very much. >> 5:03 on your tuesday morning. all new, a group of burglars robbed an apple store on monday night. they got away with about $24,000 in apple products. this happened during the store's closing time. five people in their late teens or early 20s entered the store, they grabbed a couple computers, three ipads, and 17 iphones. a security guard last saw them running toward the back of macy's but couldn't see whether or not nay got in a car. >> the investigation continues into a mob style attack on b.a.r.t. right now, investigators are poring over surveillance video of the violent robbery. as many as 60 young people hopped the turnstile saturday night. they swarmed into a b.a.r.t. train at the coliseum station, robbing seven passengers of their money and phones. two people were punched in the

face. we spoke to the son of an elderly couple who were onboard during the attack. they wouldn't talk for privacy reasons, but they told their story. >> they all kind of piled up on one person and started beating her up. a melee there for a few minutes. >> there was a very noticeable increased b.a.r.t. police presence last night at the coliseum station. b.a.r.t. says the suspects appeared to be juveniles, so the surveillance video is not being released to the public but it is being released to local school districts. >> a developing story right now. the free speech fight at uc berkeley over ann coulter's visit appears to be headed to court. the student groups who invited her are now filing a lawsuit against berkeley. this as the debate over free speech comes to a head. pete, coincidentally, the police and fire department are holding a public safety open house

today. >> that will take place later this morning. there's a good chance this topic may be brought up. ann coulter was scheduled to speak just a couple days from now on thursday on the uc berkeley campus. that was canceled by the university due to security concerns. even suggesting she comes back next week. now, of course, these concerns come months after the violent protests we saw on campus before a scheduled appearance by another controversial voice, milo yiannopoulos. they claim the decision to cancel her appearance is an effort by the campus to restrict the free speech of conservatives at the university. >> ms. coulter will never be able to speak at the same time, place, and manner as liberal speakers on the campus. this is unconstitutional. >> i believe -- >> she says she plans on coming this thursday. now, the opinions have been mixed from the student body on

this morning are that president trump may budge on his demand for funding for a border wall. we're keeping a close eye on this. >> happening today, much cloeter to home at 5:11, santa clara county leaders will consider new protections from federal immigration laws and hate crimes. supervisors are expected to propose new services for immigrant families if one of their family members gets picked up for deportation. they will also discuss the need to provide safe shelter bends for transgender homeless people. >> a possible soda tax in the south bay. the board of supervisors are discussing new policies on sugar sweetened beverages. this coming as this fight has been waged in several cities across the bay area, and they're now preparing to roll out a new soda tax. san francisco, oakland, albany all passed taxes on sugary drinks last year. those are expected to go into effect some time this summer. berkeley was the first city in the u.s. to do so. they approved a soda tax back in 2014.

>> in burlingame, a community meeting wants to address the threat of rising sea levels. in the bay area, rising sea levels threaten billions worth of infrastructure. jackie speier has called san mateo county ground zero for this because how many assets are located at sea level. >> happening today, talks certainly starting to heat up in a discussion about building a new high school for the tri-valley. dublin school board members are holding a hearing on applying for a bond waiver request for a second high school. classes in dublin are filled to the limit and total student numbers are only forecast to go higher. frustrated parents recently launched a petition drive to pry the district into moving more quickly to build the fucyst. >> five bay area high schools are among the nation's top 100. u.s. news and world report ranks more than 22,000 high schools every year. coming in 23, nationally, was

view and google glass. >> that united airlines flight is back in the news this morning. we now have seen copies of reports made by the chicago police officers who took the passenger, david dao, off the plane. those reports don't match what happened. the reports made by four officers who have been placed on adminive leave by the chicago aviation authority. david dao was, they say, swinging his arms up and down with a closed fist, and the subject started flailing and fighting the officer, according to the report. the los angeles tribune first obtained the reports through a freedom of information act. the newspaper also discovered two of the officers have faced disciplinary action before. one failed to show up to work without notifying a supervisor seven times in ten years. stocks up on monday. emanuel macron who wants to keep france in the european union and the euro won a spot in the run-off scheduled for may.

weather system streaming some clouds over the bay area. and every now and then, rains, but it hasn't been heavy rain. as we get a look now at the seven-day forecast at the bottom of the screen. you'll seay have a couple more days with a chance of showers in there before it all clears out. looking at now as you step out the door in the peninsula, it's 53 degrees right now at 5:18. and it's 56 degrees in the east bay. not too bad of a start this morning with mainly dry conditions. and then as we go into this afternoon, expect a high of 66 degrees in the peninsula. 63 in san francisco. while the north bay today will be at 68 degrees. warmer than yesterday. and if you do plan to head out to some of the hiking trails, it will be cloudy in the south bay at 7:00. we'll be at 49 degrees. and then a slight chance of a spotty shower. otherwise, partly cloudy skies throughout the day as our high temperatures reach into the mid 60s. also, good for just going out to the park. and we have seen an improvement in the pollen report, especially

for trees and grasses. still moderate on the scale here. but we're going to see that continuing to go down as we have seen a lot of clouds and some breezy winds in the mix. we're also going to see a little built of some light rain. we're seeing that to the north of us now. this is how it plays out as we get a look at the hour-by-hour forecast for today. just looking at mostly cloudy skies and once again some times of sun. but we could still see those clouds dropping a little bit of some light rain. shows some sprinkles for the north bay by tomorrow morning into the afternoon, and then all of this clears ow. we are going to see the temperatures warming up over the next couple days. as we getty to head out there on the roadways, we'll also have a steady stream of traffic. how is it looking? >> let me take you out there. a smooth flow of traffic. i'm going to step up and interrupt all this wonderful sensor read. look at all that green. we have no problems on mass transit either. the roadways and transit lines are moving well.

metering lights. it looks like they turned the metering light on a couple minutes early and i suspect there might be a fender bender mid. i'll check in with chp and the bridge crew to see what they have to report. there's the backup. >> thank you very much. >> happening today, a progress report. today marks one month since the warm springs b.a.r.t. station opened up in fremont. >> it was a project decades in the making. we want to see how it's going so far. b.a.r.t. happy with the number of riders using the station so far, bob? >> it's not quite meeting expectations, but warm springs station has only been in operation for a month. we asked b.a.r.t. roughly how many riders are using the station. they say they have calculated about 2,400 exits in an average week day, meaning 2,400 riders exiting through the fare gates. the transit agency is expecting the ridership to eventually double. they're hoping for 4,700. just a matter of time as more

people become aware of the new station and atheir commutes. for some perspective, the b.a.r.t. fremont station which used to be the end of the line, saw over 9,000 rider exits per week day last year. embarcadero, close to 48,000. we spoke with warm springs riders who tell us the new station is saving them a significant amount of time in their morning commute. >> what does that do for your level of stress? >> drastically reduced. drastly reduced. a lot nicer station, too. >> it's more relaxing, a better commute. >> i can actually finish breakfast with my family in the morning. you know, and just kind of have a little bit nicer morning. >> i'm not stressed out. i mean, now my commute, i have a routine, so i'm more calm. >> more calm? >> yeah. >> b.a.r.t. is working on a ten-mile extension south of here with stops milpitas and san

jose. scheduled to open later this year. reporting live outside the b.a.r.t. at warm springs in fremont, bob redell, today in the bay. >> nice to see that people are calm. thank you very much. >> 5:33 right now. now to a story you'll only see on nbc bay area. was it road rage? this morning, san francisco police are looking for a man accused of attacking a female construction worker. she was in the middle of the street doing her when the attack happened. >> i told him the light is green, you can through. he told me, like [ bleep ] this, [ bleep ] that. >> so here's a look at the cell phone video. showing spng like a street fight as her coworkers tell us they stepped in to defend her. witnesses described the man as an angry driver who exchanged words with the woman as she directed traffic at haight and steiner yesterday morning. after the exchange, she said he got out of his car and attacked her. >> he just shoved me first. when i went down, i grabbed him by his t-shirt. after that, just swing, swing,

swing. >> people nearby as well as some coworkers wrestled that man to the ground. at one point, the video shows him beinged in the head. he walked away before police arrived. now once out of the melee, the woman took a picture of the man and his car. police are using that information to identify the suspect. 5:34. and the search continues this morning for suspects involved in a brazen attempted robbery in walnut creek posing as construction workers. happened last week but we just obtained the surveillance images. three men dressed as workers walking into the oc watch company. one handed a clipboard to the owner of the store, when he looked down, the suspect pepper sprayed him and another man broke a display case with a bat. those are the three images from the scene, the store owner and a nearby customer did manage the scare the men off before they could get away with anything. >> a search for a suspicious device in san francisco turned up not one bomb but two.

police found a pipe bomb and a grenade. it was not too far from the fire department. the bomb disposal team used a controlled plosion to try to neutralize the device. they had the area cleared by about 7:00. it rerouted traffic and a bus line. testimony continues today for three santa clara county jail guards accused in the beating death of inmate michael tyree. the medical examiner testified yesterday about the injuries he suffered before dying in his jail cell. the coroner report listed 34 separate injuries. the worst of which was a torn liver and spleen. it's believed he bled to death in his cell within an hour of being injured. an amber alert is out for a 1-year-old girl allegedly kidnapped by her father. lexi segura waw last seen monday about 5:30 at night in rancho cucamonga in california.

san bernadino police department said daniel sugura kidnapped her. he's considered armed and threa and lexi after a fight with her mother. >> at 5:36, just a look -- we want to look at the rescue on the peninsula where a worker fell more than 15 feet from ground level of a construction site. menlo park firefighters sent us images of the rescue from friday. a construction worker fell into a basement at a home under construction in atherton. rope and rigging equipment helped bring that worker to the ground level eventually. he apparently suffered head and back injuries but no update so far on his condition. >> we hope he's okay. >> 5:36 right now. a traffic alert you need to know about today. highway 35 closed this morning starting at 8:00 a.m. a full day-long closure of the highway between gist and black roads. caltrans will get to work

temperature wise. we're in the lower 50s. if you're going out to the giants game later on this evening, we'll still see the clouds overhead. and temperatures will be cool, too. make sure you're wearing something nice and warm. tailgating, it will be 60 degrees. at the first pitch, at 57, and temperatures will stay in the mid 50s throughout the game with a mix of clouds and at times some clear skies. looks like the rain, though, will pretty much hold off. as we go through the forecast, we're going to see more dry weather rather than showers. and temperatures will be warming up, too. i'll talk about that in a few minutes, but mike's tracking a crash on the bay bridge. >> we suspected something was going on, so i put that on the map early. we don't have a lot else on the map. mild slowdowns. a little build in san jose. expect it there. the metering lights, we exthose as well. a little stronger slowdown. they may have slowed the metering lights down because of a crash reported at treasure island. there's no slow sensors on the incline. thats the metering lights are doing their work.

history has any state attempts to carry out so many executions in such a short period of time. >> there were eight executions total that were originally planned. four so far have received stays. the state of arkansas has met legal challenges to the rapid pace of executions and has been able to move forward with three now. the next is scheduled for thursday. >> it looks like california prisoner executions here in this state on hold for at least another few months. the department of corrections is delay new regulations for lethal injexz until late august. the original deadline was this week, and the last time an inmate was executed on death row, not since 2006. >> alameda county leaders will educate immigrants on their rights. it includes an update on the current immigration legislation. >> president trump may be backing away from a key campaign

promise, that wall along the mexican border. >> and scott mcgrew, time is running out to get the wall into the budget. >> it is. that's our budget, sam. we'll pay for the wall, not mexico. that wall, which could cost as much as $25 billion, has become a real sticking point in the budget. republicans say we don't have the money. democrat say we don't need it. and predictions say if the wall is in the budget, it won't pass. and the government will have to shut down. there have been several hints from the white house, both in public and in private, the president trump is willing to compromise. time is tight. the deadline to either approve a budget or at least some kind of temporary fix, is friday. president trump's first 100 days come to a close on saturday. president trump will deliver the keynote speech today at the day of rem ceremony marking the holocaust. presidents routinely make that speech. the trump administration has had notable trouble addressing

issues surrounding the holocaust. >> the two candidates for french president attended the memorial for the french police officer who was shot on thursday. the islamic state has claimed responsibility. president trump has hinted strongly he supports populist candidate marine le pen and has tweeted that the terror attack would affect the elections in france. in an interview with the asosiated press on sunday, he said she's the strongest on borders and the strongest on what's been going on in france. terror experts say in that sense, the islamic state would also like to see le pen win. >> and secretary of state steve mnuchin made an appearance at monday's white house briefing where he hinted the big tax reform bill that trump administration promises to reveal will come tomorrow. we believe the white house will try to cut corporate tax in half, though it's not clear how the president will make up for

fremauntd. it's a busy tuesday morning already. but at least you don't have to deal with rain as of yet. we get a look at the seven-day forecast at the bottom of the screen. a couple sprinkles here and there, but don't expect any really heavy downpours. it will be mostly dry. but at times, we do have to keep the chance of rain in the forecast. we are now at 56 degrees in oakland and 52 degrees in san jose. san francisco at 53 degrees as you head out now at 5:49, and looking at the highs today, up to 69 degrees in morgan hill. los gatos, 68. in the east bay, we're going to have upper 60s and even some low 70s antioch today, up to 71 degrees, and 65 in san mateo. san francisco up to 63 in the mission district. and 70 today in sonoma. a very warm day, and then as we get a live look outside at san jose, we start out with some of the dry streets, and then also going to see some cool temperatures to start. it will be a day for some long sleeves and also some pants.

>> 5:56 this morning, the price of insulin has shot up more than 1,000% in the last two decades. now some families are taking desperate measures to get the medication their children to survive. with deductibles rising and patients paying more out of pocket, some are turning to the black market. we spoke with one family whose 10-year-old daughter is a type i diabetic. she's allergic to the insulin covered by her insurer. her doctor prescribed a different form, but the insurance doesn't cover the entire cost. they pay nearly $400 a month. >> it's a struggle. i have spent many days on the phone crying with the insurance. because i can't let my daughter have her medicine, and it's hard because it's just not fair. she can't help that she's allergic to it. >> the family turned to the underground market to swap the insulin their insurance covered with the insulin their daughter
