the snooze butten once or twice or three times. we ended up seeing a pretty beautiful day after all the clouds in the morning. a repeat today? >> starting out a little wetter this morning than it was yesterday. in fact, we have in some parts of the bay area like the north bay, along the coast, and in san francisco, visibility topping down to a half mile or less, with fog rolling in. you're looking at the current temperatures right now, and three microclimates and it's 56 degrees in the tri-valley. we look at three other microclimates now. in the north bay, it's 55 degrees with light rain there. we will have that chance of spotty showers as we go into this afternoon. expect a high of 68 degrees. in the south bay, north bay, and 62 degrees in the east bay. i'll have a look ahead to some drier and warmer conditions before the weekend. and as we head over to mike now, reporting some major damage in the north bay. >> major damage, but not a major crash or major injuries from what i understand. we're looking at the south bay

peninsula. tri-valley and east bay, all at speed. it's in the north bay, southbound 680 coming off the split, reports of one vehicle involved with major damage to the front end of the vehicle. no slowing shows up on the sensors. there is slowing right at the scene because this is affecting at least one lane. we'll track that. meanwhile, a little farther south, interstate 80 across the carquinez bridge to the bay bridge, 14 minutes, so no delays. >> thank you very much. >> we have breaking news we're following out of san jose this morning where police say a woman was injured in some sort of altercation outside a jack-in-the-box. it happened after midnight at fourth and east san carlos street right next to san jose state. police are not releasing a lot of details but they do say a woman, possibly in her 20s, did suffer head injuries in front of the restaurant. our crew found blood on the pavement outside. employees tell us they didn't see what happened. we reached out to san jose

police about whether or not they're looking for any suspects. stay with us for any developments on this story. now to a story that many people here will remember. happening today after much back and forth and countless delays, the man accuse said of a deadly shooting, a school shooting rampage at oikos university in 2012 is go to be back in court facing murder charges. >> live at the courthouse, bob, this comes less than a week after he was found competent to stand trial. >> reporter: correct. good morning to you, laura and sam. later this morning, a few hours from now, he is expected to enter a plea in alameda county superior court on charges he murdered seven people during a mass shooting five years ago at oikos, a university also here in oakland. the man who is a 48-year-old man from alameda, was ruled competent to stand trial by a judge just this past friday. you might recall a couple years uz go, a judge placed the trial on indefinite hold because she

believed go was incapable of rationally assisting his attorneys in his defense and would require annual mental health evaluations. go said he wanted to plead not guilty. he believed the teachers and administration at oikos university were responsible for the murders. had conspired against him, bugged him home and tracked his vehicle. in 2012, he went to oikos, which was a small nursing college, to demand a refund of his $6,000 tuition. he dropped out of the program several months prior. when told the administrator was not in, go allegedly started shooting. he hit ten people, including the receptionist and several of his former classmates. six women, one man died. only three people survived. reporting live here in oakland, bob redell, today in the bay. >> thank you very much. 5:03 right now, and some scary moments as bullets went flying near a well known mall. now new this morning, a police source tells us an arrest has

been made in that shooting in the south bay mall. this happened yesterday afternoon in the parking lot behind the chilli's restaurant. a man in his 20s got shot. he is expected to be okay. a nearby car was also hit as well as a window. the source is in custody, but two others are on the run. >> the first two were like pop, pop. and then it was a little pause and then pop, pop, pop, like someone was unloading. >> search for more evidence, police are reviewing surveillance video of the incident. >> 5:04. b.a.r.t. is being more cosh in the wake of the train robbery involving dozens of teenagers. police say 50 teens jumped the gates and forced riders to hand over their valuables. yesterday, they saw three or four young fare jumpers. when they went downstairs, the

station agent called police. >> later today, we're expected to learn more about a lawsuit filed following the deadly apartment fire in oakland. 15 residents of the low-income building are now suing the landlord. they claim the owner knew of severe code violations years before the fire broke out. they also said the living conditions were deplorable. it killed four people and injured six others as well. press conference is expected at 10:30 this morning. 5:05. happening today, east palo alto remembers one of the most deadly house fires in history. happened 20 years ago killing nine people, 5 were children. it happened on a home near jack thorough park. this is a look at the aftermath. the fire was determined to be arson and it remains one of san mateo county's largest unsolved cases. they will hold a remembrance

event at the fire station on middlefield road. >> people in san rafael are going to be seeing a lot of action at smart train tracks today. it's just a training exercise. doing to include lots of emergency responders, the scenario they're practicing involves a smart train with multiple injuries. a couple different training exercises at the tracks near main drive. >> it's denim day, meaning people are encouraged to wear their favorite pair of jeans to support a worldwide rape prevention campaign. why jeans? well, the movement started back in 1999 after the italian supreme court overturned a rape conviction because the teen victim, quote, wore very, very tight jeans. the judges ruled the jeans were so tight, the victim had to have helped her attacker take it off, therefore making the sex consensual. now, that sparked the denim day movement that has now gone global. >> april, in fact, happens to be sexual awareness month.

today an noon, san francisco's district attorney will meet with bar owners at a popular club. the group will focus on fighting drug-induced sexual assault. they'll speak on vstrategies to prevent sexual crime. >> happening later today, governor brown will be in san francisco today at a conference on sustainability. the conference is taking place at the westen st. francis. this is a nonprofit group working with corporations to better build sustainability. governor brown will be there making an address, but his appearance is not open to the public. it is 5:07, with some dense fog around parts of the bay area, also some mist and drizzle as we get a look at the golden gate bridge and the cars making it across there with low visibility at times. now, as we head through san rafael, not so bad as you head down 101. so in some parts of the bay area, we're seeing it. other parts, we are not. then as we go through the day, expect a high temperature in the

south bay and san jose to reach 68 degrees. 69 in morgan hill. a couple degrees cooler in a couple spots, especially along the coastline. thanks to the clouds and the fog and heading throughout the forecast, it will be clearing out and warming up. i'll take you to lake tahoe at 5:13. mike takes us out on the roadways and what's happening now. >> we have a smooth drive, most of the bay has no problems. we had one crash up in fairfield, we talked about it for south 680 at the scene. that's where we do have the delay. you saw from the map, the speeds show nothing as far as slowing around the inner bay, and we only have this for the tri-valley. a little build out of the altamo altamont. the quick look you showed them, the golden gate bridge or what we can see of it, shows the only impact is the fog for the visibility. cars are moving well. >> 5:08. coming up, the legal fight over sanctuary cities comes to a head. how the latest court decision will affect bay area cities. >> we'll hear reaction from president trump in three

some light fresh powder at the base of squaw valley. heading into the forecast, we will see some sunshine. more on that coming up at about 5:17. >> and the transit agencies, no delays. b.a.r.t. at the top, 43 trains. i'm going to talk about the scheduled closure they had for this weekend. >> thank you very much, kari and mike. 5:12 right now. this is develop news out of washington this morning. strong reaction from president trump after the ninth circuit court in san francisco blocked an executive order on sanctuary cities. now, here you see what he tweeted just a little over an hour ago. first, the ninth court rules against the ban and now it hits again on sanctuary cities. both ridiculous rulings. see you in the supreme court. >> that was not all. minutes after that, president trump tweeting out that the ninth circuit has a terrible record of being overturned. the president was trying to cut federal funding from sanctuary governments. >> tracie potts is live in washington with more details on

the overnight developments for us. good morning. >> good morning. and as you know, it's been a story that's been front and center in the bay area this morning. the chief of staff or actually i should say overnight, the choef of staff at the white house calling the ninth circuit, and i'm quoting here, bananas. for this ruling. what the circuit court decided was the judge decided is that the government cannot withhold federal funds, grants and such up to $2 billion in the bay area, because you decide as a city or a county to not cooperate with immigration officials. not hold suspects for deportation and such. the judge said it's unconstitutional, too broad, and it will affect money that's already been approved. the trump administration argued that it's really too early to even consider this lawsuit because they haven't put it into effect yet. it hasn't been implemented at this point. but this is a big road block for

the peds. it's a big setback for his immigration policy again. first the travel ban and now this. the white house saying that they will appeal. they think they will eventually win. >> tracie potts live from washington. >> thank you. appreciate that. >> international news. china's military is growing, the country launching a new aircraft carrier today. the first one that's actually built in china. this is the country's second aircraft carrier. the first one was bought second-hand ukraine. the new one isn't going into service until 2020, but the show of strength comes as tensions between china and the u.s. in the south china sea continue to rise. at 5:14 this morning, twitter continues to lose a lot of money this morning. >> yeah, scott mcgrew, unfortunately, a pretty regular pattern. >> it is. investors are pleased, though, because it lost money than expected which is a pretty low bar for pleasing investors. at this point, we really don't

care about the money. we care about growth. that's actually pretty good news. the company says it has 328 active million users. 7 million more than expected. 9 million more than the previous quarter. that's good news for twitter. there were quarters where essentially nobody joined twitter. the nasdaq crossed 6,000 for the first time tuesday. wall street pleased with the french election, corporate earnings, and of course, the promise of big tax cuts. we'll talk more about the tax plan coming up as we talk politics at 5:45. i promise to make it interesting. >> consumer reports says tesla model s is no longer one of the best luxury cars you can buy. the magazine says it's tired of waiting for tesla to update the car's software to enable automatic emergency braking, something tesla has been promising for months. something available on all kinds of cars that cost far less. the fcc ready to talk about net

neutrality in the changes there. we'll get a briefing later today from ajit pai, the new fcc chairman. the commission has undone a number of initiatives started under president obama. net neutrality is the idea that all data on the internet ought to be treated equally and money shouldn't be a factor. that way a brand-new start-up has just as much access to customers. >> and tennis star serena williams said she did not mean to reveal to the world that she is pregnant, but she hit the wrong button. she also spoke about the father, her husband-to-be, alexis ohanian, the founder of reddit. she said he's very loving, very kind, very considerate. >> that's a good thing to have in your mate. >> in a husband and father, it really is. i never thought of alexis in a romantic way, but i can guarantee you he's one of the most compassionate, kind people i have ever met. >> are you being sarcastic?

parts of the bay area, we have fog. so getting a live look out there now. this is what it looks like as you head across the golden gate bridge. misting and drizzling. the roads are wet. you to turn on the windshield wipers and it's 58 degrees. the high today will be 61. for the morning, will will still see the drizzle, and it staysy into the afternoon. for the rest of the week, clearing out and warming up. that will be the story all around the bay area as we take a live look outside at san jose where you don't have low visibility there and the temperature is at 58 degrees. 56 degrees in livermore, and 60 now in oakland. as we go into the day, expect a high temperature of 67 in east san jose. cupertino at 65. and for the east bay, up to 67 in fremont, antioch at 69, and the peninsula, san mateo, 62. daley city, only 59, and 61 in the mission district today, and 67 today in santa rosa.

we will see at times a little bit of sunshine. but we still have this steady stream of moisture coming onshore, and at times, it does bring in some light rain. we're seeing that now across northern sonoma county, and that will be the case as we go through the day. this is what it looks like on the hour-by-hour forecast and this is what the radar could look like. if you have the nbc bay area app, you can match up with the timeframe at 7:00 and see there will be light rain across san francisco, oakland, and down the peninsula. very hit-or-miss activity and at times cloudy skies and a dreary day for this wednesday. there will be a little clearing this afternoon into the evening, but don't expect a lot of that. this will be the last day we'll be socked in with clouds and times of showers. looking at the rest of the forecast, it will become sunny and breezy on friday as the temperatures get ready to warm up in san francisco will be in the mid 70s this weekend, and early next week, we continue on with that trend. inland areas, it's going to feel

more like summer time with low 80s on saturday, sunday, into the start of next week. and mike, are things looking good on the roads? >> looking great. the forecast looks great, but my roads right now are moving very well. for the south bay and peninsula, east bay, no problems, and no delays. a smooth drive through the maze. we're looking also at the rails. now, b.a.r.t. reports no delays. now 44 trains. i told you about this weekend's scheduled closure for the lake merritt station. that's not going to happen because the warriors are continuing through the playoffs. there may be a game, so b.a.r.t. has waved the construction and closure this weekend. you'll have the closures for the next two weekends after that. let's get you out to waze because there are no major slow drives right now. drive from the north bay across the golden gate bridge through some of the fog, still just 38 minutes on the purple route. if you extend it down to 283 and over to 380, it's a little longer. why would you do that? later on, things may get

morning. some folks hitting the road, getting ready to go to work. a live look from san jose. you will notice when you get out of your car, it's warmer today. good morning. thank you for joining us. i'm sam brock. >> not sweltering just yet. i'm laura garcia-cannon. that's right. a cool start to our morning. kind of a cool evening, at least in the south bay last night. >> yeah, and it will be postally cloudy today. that's going to help hold the temperatures down as we go through the day. especially along the coastline. we will get a little bit of clearing in spots, and that will help us spread out the temperatures. let me show you what it looks like right now as you cross the golden gate bridge. visibility is low, drizzlindriz and the roads may be wet. it does feel milder and we have seen upper 50s starting out. as we go into the day, we're at 58 at half moon bay, but 68 in san jose, and 70 today in concord. so you see that spread in temperatures? well, we'll have a very end of the week coming up. i'll talk more about that in just a few minutes.

mike's got his eyes on the bay bridge right now. >> we have a number of eyes including our camera. we'll show that to youane second. we're showing the sensors all around the bay as well. pretty much green everyio look. the approach to the bay bridge, just 16 minutes down the east shore freeway. a little build for volume, no problem for speed. the camera shows the toll plaza and the backup because the metering lights were turned on a few minutes ago. we also have an outline of a spider there. and everybody is waiting, back to you. >> 5:31. happening today, a quieter commute. caltrain is launching a new project that could deuce the noise impact on neighbors. >> today in the bay's pete suratos is joining us from san carlos with all of the details. this impacts thousands of people. they hope it will help the problem. good morning. >> yeah, good morning to you, sam and laura. yes, the ultimate goal is to reduce the noise coming from the trains if you live mere a caltrains station like the one

here in san carlos, but it may mean more noise at least in the short term as they start this project. it's going to start tonight, starting at the caltrain station in san francisco. now, crews will use a rail mounted grinder to smooth out the rail. the hope there is to reduce noise from the tracks and also make a smooth ride for passengers. as i mentioned, it's going to begin in san francisco and move along the peninsula, eventually ending in the south bay. that equipment will be used from 10:00 p.m. to 4:30 a.m. we won't see much of an impact on riders. more so for folks who live mere the station. it's going to take about three weeks to finish the project. the goal is to finish it by may 19th. more on the impacts of the project in the next hour. live in san carlos, pete suratos for today in the bay. >> thank you very much. >> right now, authorities are investigating a shooting that left two people critically injured in hayward. this happened a little after 7:00 last night near medford avenue. deputies there say the victims were sitting in a car and this could have been the result of a

drive-by shooting. we're told the victims are in serious condition. we don't have any more information on the shooter at the moment or the vehicle involved. we're talking with hayward police. >> 5:33. continuing coverage. it looks like ann coulter's visit to the cal campus might be off, but then again, maybe it's not. that's because her latest tweet says she plans to visit cal, invited or not. in the meantime, two campus republican groups that organized the visit are both saying they will not host tomorrow's event. uc berkeley is only saying, the university does not have the desire or the ability to keep members of thelic from coming on campus. here's what students are saying. >> the movement has to be built. we're going to come out, fight, and defend. >> people have the right to protest. she has the right to speak. i just hope that it all goes well on thursday. >> school republican groups, by the way, are still suing the school, calling the decision to delay coulter's visit a violation of their freedom of

speech. >> happening today, the first store opening for a controversial east bay development in the works for a long time. university village is a property that sits in albany. it made headlines five years ago when a group called occupy the farm took over the land, demanding it be preserved for agricultural use. today, a spouts farmers market will be open. >> the bay area is officially out of the drought for no. we're learning about the lasting effects on california, that includes billions of dollars in unexpected costs. kris sanchez joining us live from the anderson dam with details on a new study. good morning. >> reporter: good morning to you, sam. this is a study that was just released this morning. we want to show you how hard the anderson flow is right now here at the dam. now, when the water flows like this at all of our hydroelectric dams in california, that creates power. the problem is there wasn't enough of that power created in

the peak years of the drought. according to a nonprofit pacific institute out of oakland, that drop in hydroelectric power increased the cost of electricity nearly $2.5 billion between 2012 and 2016. that breaks down to about $12 a year per person in your power bill. without that clean energy source, utilities used more natural gas, increasing smog and greenhouse gases as well. a january study by the same group, the pacific institute, also pointed toer water costs as providers tried to make up for the fact that people were using less water by charging more. and then, of course, many families, maybe yours is one of them, incurred costs buying low flow appliances. and coming up at 6clerk 30, we'll tell you what the nonprofit's idea is going forward to make sure if we go into another drought or when we go into another drought, we're better prepared and it doesn't

cost you money. >> thanks so much. 5:35 right now. more troubles for pg&e. the utility is now facing more than $8 million in fines related to the butte fire. you may recall that fire back in 2015. it was east of sacramento, destroying 549 homes and killing two people. the california public utilities commission says a tree hit an overhead electric conductor which ignited the fire. pg&e has been cited for failing to remove trees near the power lines. >> people living in the bay view neighborhood of san francisco say there's a dangerous intersection there and they contend that nothing has been done about it. so now, the neighborhood is launching a campaign to try to get the city of san francisco's attention. the intersection in kwekz is at third and revere street. for the last six years, activists have complained it's too dangerous for pedestrians, especially senior citizens and those with disabilities. today, they'll announce a two mf month-long campaign to push city leaders to make changes. >> pushing for a win.

mike. look at this, a developing story we're following from southern california this morning. a 5-year-old boy is missing after his father was found unconscious in a park. the boy was last seen in a skype video talking to his mother from an undisclosed location. his mother reported him missing when her estranged husband failed to bring him home. police found the father unconscious outside his car at a pasadena park. the boy was not with him. when he came to. officers arrested the father after they say his story kept changing. he was eventually released. san francisco police are seeking two men believed to be involved in a shooting last fall in the tinder loin. police just released these images. take a. they say two men seen here walked into a market and shot a 61-year-old man on sixth street. police say the gunman is the man in the peacoat. happened on november 6th at 1:30 in the morning. the victim was sent to the hospital with a nonlife threatening injury. >> 5:43 right now.

we all get frustrated with machines sometimes. this seems like it might have been uncalled for. surveillance video you're looking at captures a bizarre crime in mountain view. that's a robot there police say jason was picking a fight with it at a company called night scope last week. the robot ended up sounding off its alarm and employees ran outside to see what was happening. here's the man being arrested for prowling and being drunk in public. >> high speed rail opponents will have one last chance today in their latest effort to try to block the project entirely. the judge in the case has already issued a tentative ruling saying he plans on dismissing a lawsuit seeking to block funding for the $64 billion bullet train project. at least those are the projections right now. it could grow. attorneys will be presenting one final round of arguments today in sacramento. >> happening today, the entire u.s. senate, all 100 senators, are expected to attend a special briefing on north korea at the white house. it will be led by the secretary of state, secretary of defense

and other high level cabinet officials. the briefing was originally scheduled to take place at the capitol, but president trump suggested it change to the white house. there has been concern in washington over north korea's nuclear and missile tests. trump is not confirmed to attend the session. >> president trump, however, is expected to unveil his big tax plan today, and it could include huge tax cuts for corporations. >> scott mcgrew, it could also add to the debt significantly. >> or bigly, if you would like to use the president's terminologist. that seems okay with many in the gop. we expect to get details today from the white house, which will include cutting corporate tax, including the so-called pass throughs which might benefit many of the president's businesses and it could also include an increase to the standard tax deduction families take. that's where middle class families could benefit most right now. a family can $12,600 off

declared income. the new tax plan could increase to $30,000. that's for people who don't take other deductions. yesterday, president trump said don't believe the fake media. his wall is going to be built. well, it looks like it's not going to be built anytime soon. word from washington is that the wall will not be in the budget, which should allow the budget to pass, and the government will not shut down on friday. really been a hard week for the president. he lost the wall. his former national security adviser may face criminal charges. and the white house lost in court again. a judge in san francisco issued a temporary response to the white house plan to withhold funding because they both contain sanctuary cities. nbc bay area's tracie potts is going to debrief us on that coming up in about 15 minutes. but i do want to point out one thing, mr. trump's understanding of how courts work. in his tweet this morning, he says out of our very big country
