over to 880 itself westbound, reports of a disabled big rig. i'm watching for that, one lane might be blocked but it's not as heavily used as the rest of the maze. we had a few folks waiting in the cash lanes. a little more backup starting to form on the right cash lanes but we should see all lanes open in the next couple minutes and clear up just in time for the metering lights in just under a half hour. back to you. >> start your timers. thank you very much. >> 5:00 right now. breaking news this morning, we're getting dramatic video of a fight onboard a plane bound for los angeles. >> this is pretty crazy. a warning right now that the video you're about to see could be disturbing. >> this guy is crazy! >> wow. two passengers there really having it out on that flight. it's not clear exactly what led up to it, but after the exchange, the two passengers were separated, at least you see the airline employee trying to separate them.

this happened last night in japan on an airways flight. >> that wasn't all. after a brief break, the man in the red, you see him there? he returned for more. the shirt is eventually ripped. police eventually drag that passenger off the plane and arrested him. he is believed to be an american. police in japan say the man was allegedly intoxicated and choked an employee as well. quite violent. >> that is frightening. an all-out brawl inside of the plane. closing chapter. a case that has gripped the bay area for years now. today, it reaches a critical juncture. closing arguments are set to begin in the sierra lamar murder trial. >> bob redell is live with what is next for the high profile case for the bay area. good morning, bob. >> reporter: good morning to you, laura and sam. starting at 9:00 this morning, the prosecution will try to convince the jury here at the hall of justice in downtown san jose to convict antolin gar

ceasa torres in the murder of sierra lamar, the girl who was abducted five years ago on the way to her bus stop. then the defense will get its final chance to plant a seed of reasonable doubt in the minds of the jury to convince them they should return a verdict of not guilty. the trial did wrap up yesterday at the hall of justice after three months of testimony. the judge confirmed with garcia torres that he would not be testifying in his own defense. his response in court, quote, nothing has changed. even though lamar's body has never been found, the prosecution presented other physical evidence that might link garcia torres to her disapiens, including dna found on his car and on her clothes. the last person called to the stand was a digital evidence forensic examiner for the sheriff's office who testified about lamar's final activity on her e-mail and social media accounts and surveillance cameras that may or may not have

recorded garcia torres driving his car around the time of the disappearance. if convicted, garcia torres, who is 26 years old, could receive the death penalty. reporting in san jose, bob redell, today in the bay. >> one we have been following for so long. thank you very much, bon. 5:03. all new this morning, the writers' guild of america striking a deal to stop a strike from happening. the writers union reaching an agreement with film and tv producers for better pay and also for health care benefits. for now, the show goes on. the last time writers went on strike was almost a decade ago. >> also new this morning, a vehicle crashed straight into a santa rosa pet store. it happened monday night, about 9:20. fire officials say the vehicle crashed into village pets and supply on montgomery drive. no one was hurt, including the animals. good news there. >> authorities are concerned for a rescued dog stolen from his owner's home in alameda county

sunday. authorities want help finding german shepherd named murphy who was taken from his yard in castro valley. murphy had a lime green collar on with an i.d. tag when he was last seen. he was rescued as apuppy and is used to help mentor other dogs. he also has his own facebook page called find murphy. >> following up on a developing story out of san francisco, the search continues this morning for a shooter who killed a 15-year-old boy. the victim was driving a white two-door car when he was shot and killed in the outer sunset. this happened yesterday on sunset boulevard. the shooter was in another car and investigators believe the suspect targeting the teen and that road rage could be what's behind it. the shooting has left that entire neighborhood stunned. >> we went to the corner and saw the young boy just laying there. we didn't know if he was alive or dead. and we thought it was a car accident. we didn't know it was a shooting

at that time. it's sad that has to happen at all. i mean, guns. >> while the 16-year-old passenger in the victim's car was there at the same time was not injured, so far, police haven't released any information about the shooter. >> 5:05. streets of san francisco have been dangerous these days. two people have died in accidents in the last couple days. the first happened close to midnight on saturday. a 77-year-old woman was hit while crossing lake merced boulevard. the second was yesterday. a 56-year-old was hit on octavia street on-ramp to highway 101 at 3:00 in the morning. those streets have been described as some of the most dangerous in the city by safety advocates. >> laura, of course, we were covering the may day protests here locally yesterday. they were pretty peaceful. that was not the case in oregon, where it took a violent turn last night. this is a look from the nbc chopper out of portland. look at that. items being lit on fire. police say the city canceled the permit for the march after a group of so-called anarchists

started setting small fires and throwing objects including molotov cocktails and fireworks directly at police officers. some businesses were also damaged in the city's downtown area and a police car was destroyed. in olympia, in washington state, nine people were arrested there in violent protests in that part of the state as well. right now, continuing coverage of the may day protests here in the bay area. as we mentioned, there were big crowds in san jose, san francisco, and in oakland. the biggest may day demonstration in the bay area taking place in oakland. that's about 2,000 marchers who took to the streets of oakland, with messages of solidarity, immigrants' right. before they started rallying in san antonio park. four people were arrested after they chained themselves to the doors of the county building to protest the deportation of undocumented immigrants. overall, protests remained

peaceful across the bay area. >> to capitol hill this morning where republican leaders are busy counting votes. do they have enough to repeal and replace obamacare this week? republicans are working hard to convince nearly a dozen lawmakers to vote yes on a health care plan that president trump insists will cover pre-existing conditions. but what's on the table now could allow sick patients in some states to be charged more for health insurance. the kaiser family foundation based right here in menlo park, finds the new plan could dramatically increase premiums for the sick. >> extremely high rates. three, four, five times what the normal rate would be. >> we want to protect people with pre-existing conditions. >> that is representative charlie dent, a moderate republican from pennsylvania. a vote could happen before congress takes a break this thursday. the white house is optimistic it will pass this time. well, they're back at it again. a live look from oracle arena this morning. i know it's been like a week for

many players from the team, including the guys you see there, will be here tonight as the team honors them. the team is asking fans to once again believe in the team, as coach steve kerr will miss his third playoff game in a row. steph curry talked to reporters and weighed in on the situation. >> i know for coach, it's important for him, obviously, to get 100% healthy before he comes back so he's not doing that. i'm here for a day or two and then away for a day or two. he wants to come all the way back and be ready to go. >> now, that 2007 team, after they beat dallas, went on to face the jazz. they lost in the playoffs. tonight, the warriors ten years later are facing the jazz. we're hoping for a much different result. i want to point out for all of your warriors fans, these are the we believe shirts. they're going to be actually for sale after the game, but these are shirts that are going to be up for sale for people to check out after the game to bring back memories from the team.

it's 5:14 on this tuesday morning as we get ready for sunrise, getting a little light in the sky as we take a live look outside over san jose. the temperature trend for los gatos will start out in the upper 60s at 9:00. already a warm start, and going well above our average high of 71 degrees. reaching into the upper 80s to low 90s inland. we will catch a break as we head closer to the weekend. we'll talk about it coming up at 5:19. and an easy drive. we see a little build for the tri-valley. nothing unusual or unexpected. 580 and 84 cutting through livermore and pleasanton. >> mike, kari, thank you very much. >> we're coming up on 5:15 your tuesday, and later today, state lawmakers introducing a new bill

they say will help victims of bank fraud. this all comes after the recent wells fargo scandal where employees opened up millions of accounts without customers' knowledge. napa state senator bill daud's legislature would eliminate clauses. those contracts stop consumers from having their day in court to try to recover damages. >> at 5:15 right now, airline executives will face congress this morning to explain among other things while they overbook their flights. >> scott mcgrew, united's ceo gets the center seat. >> he certainly does. we expect oscar munoz to continue to apologize, continue to explain all of those new policies at united that will prevent scenes like this one that all but ruined united's already tenuous reputation among passengers. they asked for the meeting with house executives after this video went viral. the meeting starts at 6:30 our time. we don't expect new laws but we

expect a lot of politicians on both sides to show up angry. other news, the nasdaq hit an all-time high monday as did apple. more about apple in a moment. bank stocks stumbles after trump said he may work to break big banks up. futures calling for a higher opening again this morning. as for apple, it reports profits in the speculation is it will say it has as much as $250 billion in cash. investors want the company to do something with the money. either give it to them in dividends or buy something to make the company even more powerful. now, what can you buy? well, $250 billion is a staggering number. you could buy the company that owns this tv station. you would get nbc, universal, universal studios and comcast cable, or you could buy gm, ford, and tesla and have money left over. now, you can't buy the country

of chile. it's not for sale, but you could buy everything chile makes in an entire year. we keep getting new details about the federal budget. the latest includes a rider that would prevent the feds from spending money to prevent states from implementing their own laws about pot. that budget is still being hammered out. it will be a relief to a lot of pot-based businesses in california. that has been in the budget before. it's a reason we have state laws that appear to conflict with federal laws. basically, the feds aren't going to pursue it. with jeff sessions saying he was doing to pursue marijuana-based businesses, a lot of california based businesses weren't sure what their future was. it looks like at least for one budget year, they're safe. >> there you go. >> the key there being at least for one year. thank you. happening today, big birthday shoutout right now otthe uk princess, charlotte, turns two years old already. a new picture of the little

morning, not only there but all around the bay area with near record high temperatures today, spaelths for the inareas, and the rest of the week, it will be cooling down. we're getting ready for some dry weather, too, for the next several days. then we'll be watching a slight rain chance for the weekend. looking outside right now in livermore, 58 degrees there. also 58 in napa. oakland is at 60 degrees, and 63 in palo alto. highs this afternoon reaching 90 degrees in east san jose. morgan hill, 89 degrees in milpitas up to 88 degrees. danville, 92. 92 in pleasanton. for the peninsula, at 70 at half moon bay. san mateo is at 85. the mission district, up to 81 degrees today. and 91 for novato. santa rosa, a high of 92 degrees. if you want somewhere cooler, you know the water will be very cold and refreshs. we start out in santa cruz at 59 degrees at 8:00, and by noon, we're at 76 degrees.

now, downtown santa cruz reaching into the 90s, while the coastline will be in the low 80s today. and for some hot temperatures, but maybe some cool wine, you'll head to sonoma. up to 91 degrees today by 4:00 this afternoon. looking at the pollen count, we have a lot cedar, pine, and grass pollen in the air. and ragweeds are fairly low at this point. we'll take a look at some cooler temperatures in the forecast coming up. mike has a nice calm start to this commute. >> yeah, and we'll preface that by saying it's tuesday, but we have a nice start. tuesday tends to see a heavier volume of trafficthen the other days, but you know, once spring break kicks in as it had already, we tend to see a lighter overall volume. you saw the speed sensors. no major delays on the roadways. no delays reported for any of our transit systems. that's a great start. i want to get you a study from waze. we'll compare some drives. some of the longer communities we take from antioch all the way over to the bay bridge and continuing to the city. from there, toward i-80, the

will go dark. crews are finishing up 5:24 on your tuesday morning. tonight, the statue of liberty will go dark. crews are finishing up work on a new emergency backup generator for libertyland. it's one of the last remaining repair projects from hurricane sandy. the lighting system that illuminates lady liberty will be turned off from 6:00 a.m. to 5:00 a.m. thursday.

>> bay area responds to a man who needed help recovering $8,000. >> it happened in shipping and now value was declared. >> russell a high-end sewing machine on ebay for $8600. he shipped the machine to his buyer using fed ex, and in doing that, he said he asked fedex for the paperwork to declare the value of the machine. he was nervous because it was a very expensive item. he says the clerk at fedex told him there was no such paperwork, and russell trusted her. that machine ended up arriving badly damaged. so buyer returned it to russell who had to refund the entire purchase. next, high filed a claim with fedex. about a week later, fedex issued him a check for $241. he was shocked because that's more than $8,000 short. he said fedex told him it was he didn't declare the value of the package at the of shipping. he explained what happened when

the tri-valley, the only color change from there in the tri-valley. we'll bring up travel times. 580, 29 minutes from grant line to the dublin interchange. slowing there, fluctuating between green and yellow there for the cut through on 84. the bay bridge toll plaza, right on schedule, the metering lights and backup. all lanes, company waiting for you on your approach from west grand, the slowdown all the way to the toll plaza. >> thank you very much. all new this morning at 5:31. flames break out at branham high school, and now an investigation is under way to find out what happened. kris sanchez joins us live with the details. >> firefighters say this fire is suspicious? >> reporter: yeah, and let me show you why. you can see the snack shack here on the campus is pretty much a total loss. if you look down toward the bottom of where the doorway used to be, that's where firefighters say the fire started. and because that fire started and it appears it started on the stoop outside of the building,

firefighters believe that this fire is suspicious and not likely an accident. crews arrived here on scene around 2:30 this morning, and thoughs had the flames out in about ten minutes, they did remain on scene for more than an hour. crews mopping up and watching for hot spots. you can see how close the snack shack here is to the other buildings as well. if you're a sports parent, you know how critical the snack shack is as a source of revenue to support the athletic program. i have reached out to the branham sports boosters. i'll let you know their response as soon as i get it. at 6:30, i'll tell you why eagle scouts might also be upset and why this sign may provide some clues as to what happened here. it says that this could be under video surveillance at any time. if it was a fire bug at work, perhaps they were caught on camera. in san jose, kris sanchez, today in the bay. >> looking into that for us. thank you very. >> 5:32 right now. all new on your tuesday, talking about fires. a milpitas family forced out of

their home by an overnight fire there. this happened about 2:00 this morning. the home is right by milpitas high school. in a second, you'll see piece displaced from their house, there they are, with their blankets watching from the outside as they were not able to get back in. we're still waiting for more details as to how the fire started. >> 5:33, should five east bay schools be allowed to split from their current school district to form a new one? the contra costa county board of education will take up their controversial issue today. there's a big push from so-called advocates to separate north gate high school in walnut creek and its cedar schools from the mt. diablo school district. backers say the district ignored the needs of the schools, but the mt. diablo uninighified school district says it's a plan to, quote, carve out the most affluent portion of the district leading to racial segregation and an unfair distribution of resources. regardless of what the county

decides, the state will have the final say. the accused oikos university shooter is now going to be back inside of an oakland courtroom today for a plea hearing. this coming after a continuation from last week. back in april, one goh was found mentally competent to stand trial for killing seven people in a 2012 mass shooting. last month also marked the fifth anniversary of the shooting. >> the walnut creek man accused of killing a woman and then leading police on a 19-hour-long standoff could be officially charged later today. that killing, of course, happening last thursday, and the suspect eventually surrendering peacefully friday morning. now, police say that 38-year-old gregory shot and killed a 47-year-old woman last week. the contra costa d.a.'s office says that prosecutors will be reviewing the case this morning and charges could come as early as this afternoon. investigators say the suspect was in a, quote, relationship with the victim. >> watch your step. the weather is getting warmer, so snakes are coming back out.

rattlesnake bit a san jose man while he was climbing miz peak in fremont yesterday. he was on a trail with his wife. he took a seat on a rock and that's when the snake bit him. a chp chopper was nearby and was able to rescue him. >> he was a 47-year-old male from san jose who went to sit down after hiking on a peak, and he put his hand down and was bitten by a rattlesnake. >> the bite was considered so bad that he had to be taken to washington hospital, one of the few places with anti-venom medicine for snake bite victims. that is awfully frightening. 5:35. a disturbing crime on a bay area campus. three boys are accused of targeting a woman at san jose state. at 8:00 at night on the west side of the center, a woman said three teenagers about 12 to 15 years old, rode by on bikes and one grabbed her. last month, a man was arrested. he's accused of groping five women on campus. >> it's 5:35 right now. cracking down on human trafficking in california.

a bill passed on monday aims to help prosecutors convict sex traffickers. state senator tony adkins crating that bill to add sex trafficking to the list of crimes that don't ally character evidence in trial. it will also help prosecutors use traffickers' past activities as evidence for current charges. the bill now heads to the state assembly. an update right now in sonoma. the county jail there is deci deciding it's limiting cooperation with immigration and customs enforcement officials or i.c.e. according to the press democrat, the county sheriff imposed that new restriction yesterday. the goal is to protect undocumented immigrants minor violations. the jail will continue to provide i.c.e. with information about violent felons. the sheriff took the action at the urging of the county's independent law enforcement auditor. >> a beautiful look outside. the sunrise at least. the traffic not so much. this is the bay bridge toll plaza where the entrance to the

new bike path will be open. today is the opening of the vista furesult. the new path will be available every day instead of just on the weekends. caltrans blocked a part of the during construction due to heavy diesel fumes and smoke from demlution crews removing the old eastern span. >> everything looks beautiful there. instability here. concerns over the hillside that is causing an indefinite road closure in the east bay. palomares road has been closed to all traffic. that's been the case when the hillside started sliding back in january. the road connects interstate 580 and castro valley. crews doing cleanup found unstable boulders and debris on the roadside so it's expected to stay closed until at least june. >> it's 5:37. as you get ready it head out on this tuesday morning, let's take a live look outside at oracle arena. 60 degrees, so it feels very mild. all clear skies and going to be a hot day. it will also be hot inside

oracle arena as we get ready for the warriors to play tonight. it will be 82 degrees at 5 clack. and then as we look at tip-off, the start of the game, 72 degrees. it will be a nice cool evening with mostly clear skies. and it will be a very nice night for a celebration. heading into the next few days, i want to show you the temperature trend for san jose, coming up at 5:41. right now, mike is checking in on a problem for 101. >> i did catch that, you're talking about temperature outside for the dance party after the show. looking over here, a smooth drive around the inner bay. we want to take you farther south. 101 has a problem out of gilroy into san martin. we hear about a crash involving two larger trucks, maybe two tractor trailers over there. at least one lane is blocked. no injuries, but this is causing quite a slowdown coming up from gilroy. that may keep traffic moving better through morgan hill. we'll track this for highway 101.

poolside party. he then called his ex-girlfriend and told her what he was doing as the shooting was happening. selis is white and his victims were minority, race is not a factor. >> 5:43. happening now in southern california, firefighters continue to monitor hot spots from a wildfiring in san bernadino national forest. this as we learn a man is behind bars accused of sparking the flames. investigators say he set several fires around the same area on purpose. the largest fire charred about six acres on monday night. fire crews are considering to make some pretty good progress this morning in slowing the spread of the flames. >> all right, a little more flexibility. contra costa county could soon join communities around there to choose their own source of energy. county supervisors will vote on a community choice energy plan that would allow people to bye electricity not just from pg&e but also from alternative

sources. the options can give consumers access to cheaper and cleaner power. the city of san jose is also voting on the same kind of plan later this month. >> the trump administration is looking to cut back on some of the obama administration's healthy food initiatives. the obama administration regulated stricter nutritional values for school meals. this included more fruits and vegetables and phasing in low sodium foods. some schools reported the rules were costly and kids were throwing the food away. the trump administration announced it was rolling back the regulations. secretary of agriculture sun sonny perdue said the schools will have more flexibility. >> meals can't be nutritious if they're put in the trash. >> the losers are the children who will have less healthful meals. >> rules will go into effect this fall. >> new video to show you of joint military drills run by the u.s. and south korea. those drills happening monday with south korea's air force. during the drills, two u.s.

bombers were flown out to deter any provocation from north korea. >> north korea, meantime, is warning president trump that it is ready for war. >> scott mcgrew continuing our coverage this morning. scott, pretty strong language, even for north korea. >> a country that does not mince words. here's north korean television as the newscaster warns of nuclear war. >> what he's saying specifically is due to the u.s. military provocations that are becoming more explicit day by day, the situation on the korean peninsula that is already sensitive is driven to a point close to nuclear war. america's placed thaad missiles in south korea, they're capable of knocking down north korean missiles. those are created by bay area workers in sunnyvale. president trump startled his own staff when he said he would be willing to meet one-on-one with north korean leader kim jong-un.

it's been american policy not to meet with north korea at all but to incorporate other countries in the negotiations. president trump said kim was, quote, a smart cookie. and said i would be honored to meet with him under the right circumstances. trump has a very different approach to dictators and strong men than past administrations, both democrat and republicans have had. he's invited duterte of the philippines to the white house. he's willing to meet with kim and has repeatedly praised putin. in each of these cases, mr. trump has pointed out how popular these men are with their populations. trump is going to speak with putin today by phone. inpresident continues to insist the new republican health care bill tains protections for patients with pre-existing conditions. but that's not the case. certain states can clear the way for insurance companies to charge far more. many republican leaders are worried what this means for

a great idea. and time for rain, so a parasolto give you shade. as we get a live look across all of our microclimates, we're looking at three current temperatures and three of our microclimates and it's 58 degrees as we get a live look at the tri-valley from our pleasanton camera. 60 degrees in the peninsula and 63 degrees heading out the door in the south bay. 64 degrees in the north bay. you know when we start out in the 60s, it's going to be a hot day. we don't get many of these temperatures where we start out with some mild weather, but look at how warm it be later on today. the peninsula from our palo alto camera showing the high today will be up to 89 degrees. low 90s for the south bay and tri-valley, and san francisco up to 82 degrees today. while the east bay looking in from our fremont camera will be up to 85 degrees. we could be setting some new reports. and for mejy of those spots, we'll be close. in napa, the forecast is 93.

and the record is 93. in san francisco, it will be very warm, but i don't think we'll set a new record here or in oakland, richmond will be very warm. and we may set a new record there. our old record is 86 degrees set in 2014, and livermore will be up to 90 degrees, and the record is 95. san jose, up to 90, and the record is 92. so we're very close. and as we take a live look outside this morning, you're getting ready for the day, it will be one of those days you want to make sure the sunglasses are cleaned off and if it's a casual day, you can sport the flip-flops. and also, the t-shirt and shorts. this is going to be a very hot day. so make sure you're prepared. you have some lightweight light colored clothing. that's the best to keep you cool. and also, of course, the shorts. now, as we head through the next couple days, we are going to have some changes. we are going to be all clear for the nextal days, but looking at the bigger picture as we head into the weekend, we'll start to see more clouds moving in. a couple weather systems passing

stretch fm 5:55 on your tuesday morning. placed end to end, they would stretch from to new york city and back. what i'm talking about is the 13,000 miles of levees in california. and our investigative unit has discovered more than half of them remain at high risk of failing. >>ier investigative reporter stephen stock is here to tell us what that could for all of us living in the bay area. stephen. >> well, good morning, guys. seepage, erosion, earthquakes, and yes, even rodents are all posing a threat to california's levee system. that's according to this latest report put out by the state of california. according to this report, about half of the levees protect california's cities from major flooding do not meet modern day standards that's because most of the levees were built in the 1800s and have not been properly

maintained or modernized since. if a levee were to break in the wrong place, it could be catastrophic all of us here in the bay area. we wanted to see the problem first-hand, so we went out with officials from the state department of water resources and took a tour of the most vulnerable levees on the sacramento delta. we learned a levee failure there could cut off drinking water supplies here to the bay area. in fact, two thirds of the drinking water for the bay area and southern california travel through aqueduct systems guarded by these very levees. according to a five-year survey issued by the state last december, 60% of all non-urban levelees are at high risk of veilier from under seepage, structural instability, and erosion. that's about 1230 miles of levees at high risk of failure. the cost to fix all of this, an estimated $3 billion. that's billion with a "b." to learn more about what the
