ready to step out the door. 58 degrees in san francisco. 59 in oakland, and 62 already in san jose. 63 in palo alto. look at these high temperatures today. 93 in concord and napa. 90en san jose, livermore, and morgan hill, and san francisco will be up to 82 degrees. so coming up in seven minutes, i'll have a look at the temperature trend, and right now, mike gives us an update on a new crash in pinole. >> just caught scythe of this before the 6:00 a.m. show. it's not right here on the peninsula or in much of the east bay affected, but we have the upper east shore freeway. a critical point, as we have that build for the commute now coming off the carquinez bridge. reports of a crash which may be blocking a lane. we see a slee slower drive. that's where we typically see a build at this time. this is affecting our travel time off the upper east shore freeway. about 24 minutes past the crash and into the bay bridge toll plaza. the drive through oakland

maintains a steady flow. back to you. >> thank you very much. at 6:01, breaking news this morning. we're getting this dramatic look of a fight on a plane bound for los angeles. >> essentially, a brawl playing out in real time. a warning that the video you're about to see could be disturbing. >> help. this guy is crazy. [ bleep ]. >> that's how it starts. it's motclear what actually led up to this fight. after that exchange, the two passengers were separated by the flight attendant. she was trying to do that. this all happening last night in japan on a flight. >> it wasn't it. after a brief break, the man in the red returned for more. the shirt is ripped there. police eventually dragged that passenger off the plane and arrested him. he's believed to be an american. police in japan say the man was allegedly intoxicated and choked an employee as well.

>> happening today, we're one step closer to the end of the case that has gripped the south bay for half a decade now. closing arguments set to begin in the sierra lamar murder case in just a few hours. >> bob redell joins us outside the hall of justice in san jose with some of the major developments we are expecting today. bob. >> reporter: good morning to you, laura and sam. in just over three hours here at the hall of justice in san jose, the prosecution will try to convince the jury to convict antolin garcia torres in the murder of sierra lamar, a 15-year-old girl who was abducted and murdered on her way to her school bus stop five years ago in morgan hill. then the defense will get its final chance to plant a seed of reasonable doubt in the minds of the jury to convince them to return a verdict of not guilty. the trial did wrap up yesterday at the hall of justice after three months of testimony. the judge confirmed with garcia torres that he would not be testifying in his own defense. his response in court yesterday,

quote, nothing has changed. even though lamar's body has never been found, the prosecution presented other physical evidence that might link garcia torres her disappearance, including dna found in his car and dna on her clothes, which were recovered in a field near her home. the last person called to the stand was a digital evidence forensic examiner for the sheriff's office who testified about lamar's final activity on her e-mail and social media accounts. and surveillance cameras that may or may not have recorded garcia torres driving his car around the time of lamar's disappearance. if convicted, garcia torres, who is 26 years old, could receive the death penalty. reporting live here in san jose, bob redell, today in the bay. >> all right, bob, thank you for following that for us. >> 6:04. all new this morning, had writers guild of america did stop a deal froemming a strike from happening. they reached a deal for better pay and health care benefits. for now, the show goes on.

the last time writers went on strike was almost ten years ago. >> at 6:04, the search is on for a rescued dog who was stolen from his owner's home in the east bay. police are asking for help to find the german shepherd named murphy. he was taken from his yard near palomars road on saturday. he was last seen wearing a lime green collar with i.d. tags. he was rescued as a puppy and is used to mentor other rescued dogs. he also has his own facebook page called find murphy. >> a vehicle crashed straight into a santa rosa pet store. take a look at the damage here. it happened monday night around 9:20. fire officials say the vehicle crashed into the village pets and supply on montgomery drive. luckily, no one was hurt, including the animals. developing right now otof san francisco, the search continues this morning for a shooter who killed a 15-year-old boy police say the victim was driving at the time. a white two-car sedan. it's not clear if he was driving legally. he was killed in the outer

sunset neighborhood of san francisco. all of this happening yesterday on sunset boulevard at kirkham. the shooter was in another car, and investigators believe the suspect targeted the teen and road rage might have been a reason why. the shooter has left the entire neighborhood stunned. >> we went to the corner and we saw the young boy just laying there. we didn't know if he waw alive or dead. we thought it was a car accident. we didn't know it was a shooting at that time it's just sad that has to happen at all. i mean, guns. >> a 16-year-old passenger in the victim's car wasn't injured, so far, police have not released any information the shooter. it's not clear whether the victim was licensed to drive. >> 6:06. may day marches a violent turn in oregon last night. this is a look from our nbc chopper in portland. police say the city canceled the permit for the march after a group of anarchists started fires and threw objects including molotov cocktails and fireworks at officers. some businesses were damaged and

a police car was destroyed. in olympia, in washington state, nine people were arrested in the violent protests there. >> now to continuing coverage on may day protests here in the bay area. there were pretty big crowds in san jose and san francisco. the biggest may day demonstration in the bay area took place in oakland. about 2,000 marchers took to the streets of oakland with messages of solidarity and immigrant rights. earlier in the day, four people were arrested after chaining themselves to the doors of the alameda county building to protest the deportation of undocumented immigrants. overall, protests remained peaceful across the bay area. it's been so long since the last basketball game, you might have thought we forgot about the warriors. we didn't. a live look this morning at oracle arena. the warriors getting ready to finally host the first game of their second-round series against the utah jazz. this is game one of the western

conference semifinals tonight. >> no forgetting them. today in the bay's pete suratos got the tough assignment this morning. he joins us inside oracle with a look at what we can expect from the ws tonight. i know you probably want to hide in the bleacher seats. >> reporter: good morning to you, laura and sam. yes, a very good idea. i might think about doing that. and w nation is expected to sell out oracle arena tonight for game one of the western conference semifinals as the warriors take on the jazz. there are still tickets available. if you want a ticket in the rafters, it will cost you roughly $140. if you have the means to get a courtside seat, it will cost more than $2,000. if you the money, go for it. fans will be here for a special event because the warriors are going to honor the iconic 2007 we believe playoff team. let's show you a picture of members of the team. you see on the left in the picture, monta ellis, al harrington, and jason richardson wearing the we believe t-shirts in 2007. that was right after their

historic playoff upset of the dallas mavericks. if you're a lifelong fan like, you loved that team because it broke a 13-year playoff drought for the golden state warriors. now, many players from the team will be here tonight. that will be a pretty cool event. right now, the team is asking fans to believe again. because their coach, coach steve kerr, is expected to miss his third consecutive playoff game in a row. i had a chance to speak to steph curry who talked to reporters about it before tonight's big game. >> i know for coach, it's important for him obviously to get 100% healthy before he comes back so he's not doing that, i'm here for a day or two and you know away for a day or two situation. he wants to come all the way back and be ready to go. >> time does fly. it's the tenth anniversary of the we believe team. they would go on to lose to the jazz in the playoffs. ten years later, the warriors are taking on the jazz in the second round. we're hoping for a better

and a crash in the soug bay. >> we continue to follow the issue farther south on 101. most of our bay t looks great. we're showing a smooth flow of traffic. got my eyes on the dublin interchange. may be an incident nearby, but so far, no slowing showing up there. it's 101 northbound, coming out of gilroy and up to san martin, the two big rigs, i think the tractor trailers there on the shoulder, and it's blocking the slow lane. there's no injuries and no fuel has leaked, but it is a slower drive there. looking at b.a.r.t. as an option and moving slowly for all of your transit from the south bay into san francisco. back to you. >> glad it's smooth there. >> 6:11 right now. two pedestrians killed in two days on some of the bay area's most dangerous. >> coming up in three minutes, the new legislation designed to keep you safe. >> and airline executives get the middle seat in front of congress. tough questions ahead.

break. we'll talk about some cooler temperatures and the sierra snow pack coming up in five minutes. and we look at the travel times. a little build, of course, in the east bay. and tri-valley. your usual suspects right here, and we'll tie to get you around the unusual slowing for highway 101. >> thank you very much, kari and mike. it's 6:15 right now. the streets of san francisco have been very dangerous. two people have died in accidents just in the last couple days. the first happened close to mide nite on saturday. a 77-year-old woman was hit while crossing lake merced boulevard. the second was yesterday, a 56-year-old was hit on octavia street on ramp to highway 101 at 3:00 in the morning. the streets have been described as some of the most dangerous in the city by safety advocates. 6:15 right now on your tuesday. and happening now, a pushback on banks. today, some state lawmakers are introducing a new bill they say will help victims of bank fraud. of course, this comes in light of the recent wells fargo sandal

where employees opened millions of accounts without customer knowledge. legislation would eliminate arbitration clauses in contracts. those kinds of clauses stop consumers from having their day in court to recover damages. airline execs are going to be facing congress this morning to explain among other things while they overbook flights. >> scott mcgrew, united's ceo gets the middle seat this morning. >> he does. we expect oscar munoz to continue to apologize, continue to explain all those new policies that united will prevent scenes like this one, but that all ruined united's already tenuous relationship with passengers. the house transportation committee asked for the meeting with airline executives shortly after the video went viral. the meeting starts at 6:30 our time, just in a few minutes. we don't expect new laws but we do expect a lot of politicians on both sides to show up angry. >> other news, the nasdaq hit an

all-time high monday and apple. bank stocks tumbled after president trump said he might work to break the big banks up. that pulled the dow lower. futures call for a higher opening again this morning. as for apple, they're trading over $146. the new iphone is due in september, and apple reports profits today. apple is expected to say it's got a pile of cash that continues to grow. more cash than any company has ever had in the history of companies. more cash than the gdp of lay. you could buy uber and tesla and have $65 billion left over. about a $billion short of buying netflix as well. speaking of net flix, the company says it's going add a new warning to its controversial series 13 reasons why that deals with teen suicide. a number of school districts have sent letters home to parents saying them not to let

kids watch or not let them watch alone. they say the new warnings will appear before the show. they call them cards. and they'll be strengthened. already, it's rated tv-ma, which is basically the equivalent of r. >> like mature audience. >> i think a lot of parents don't realize the content on netflix and maybe are not paying that attention. one you want to watch where your family if you want to watch it at all. >> right, because a lot of people ares chooing not to watch it. >> right. >> have those questions answered with your parents. >> it's not easy being a parent, but this is a great stage of life with kids. look at this. happening today, uk princess charlotte turns two years old. >> yes, she does. you may have heard of her parents, the duke and duchess of cambridge, known as william and kate to their friends. they say they're, quote, delighted to share this picture. she's so adorable. they're thanking everybody for the lovely birthday wishes charlotte has been getting. 2 years old already.

>> it flies. let me tell you. >> all right, going to be hot today, too. little sweaty kids coming home from school. >> get ready for that. also, air conditioners up on full blast. and the temperatures will be heating up quickly as we go through the day. as you step out, it's already feeling warm with all clear skies. let's get a look at three of our microclimates right now. the peninsula showing at 61 degrees there. bright and sunny, and 62 degrees in the south bay. we have upper 50s in the north bay as we get a live look at the sunrise from tiburon and san francisco at 60 degrees. looking at highs today reaching into the 90s. it is going to be really hot. up to 90 degrees in the south bay, tri-valley 92 degrees. and 89 degrees in the peninsula. looking live from the fremont camera in the east bay. expect a high of 85 degrees and 92 in the north bay. i want to talk about some cooler temperatures and a cool snow pack, too. we have snow pack yesterday after the measurements.

a state wide average of 196%. the central sierra doing the best, double the amount we normally have for may 1st. and here's a live look outside at heavenly right now. gorgeous sunrise over lake tahoe right now. and look at how warm these temps will be. it will be in the low 70s for tomorrow and thursday as well with a lot of sunshine. we have been talking about how those nearby rivers will be melting rather flooding with that snow melt happening right now. as we take a live look at kirkwood, i want to show you what's going to happen this weekend. temperatures dropping, and look at that. there will be some snow in the forecast on sunday. so some huge changes under way here. let me show wru what it looks like for the bay area. by thursday, we see the morning fog returning to the coastline. a cool onshore flow will help bring down our temperatures and there will also be a slight chance of weekend rain moving in to the bay area, especially for sunday into monday, and this is

what it looks like as far as temperatures. we're up to 82 degrees today in san francisco. breezy tomorrow. a little bit of an onshore flow, and then cooler temperatures for the rest of the week and a chance of sprinkles by the end of the weekend. very hot for the inland areas. and we don't catch that breeze until thursday into friday. more clouds and a chance of showers sunday into monday. we'll have more on that. mike is checking in on that crash in pinole. >> i am, and also those south bay drivers stick with me, south county is an issue. the tri-valley and at the castro valley area, a smooth flow of traffic. the upper east shore freeway which continues with about the same amount of slowing over the last 15 minutes. that crash sounds like everything is off to the shoulder, someone may have been an ambulance necessary, minor injuries from what i understand. there's the tri-valley, there's the castro valley, and the build for hayward west across san mateo and the dumbarton bridge build as well right on schedule

for the tuesday commute. we'll take you to the south bay with our waze system. we show you typical slowing building in for the bulk of the morning commute starting here as well as highway 85. farther south, coming in through gilroy and into san martin and you're jammed up. this blue line on highway 101 takes you about 49 minutes. that's holding steady just shy of an hour. if you do get adventurous and take some side streets, that will save you about 15 minutes waze can saver you time here or wherever you're driving from wherever you're departing. grammatical. we'll looking here, make sure you're on nbc bay area wazers. we'll join you on the roadway and we won't check your grammar but we will check your travel times. >> your english teacher just called. thumbs up. >> speaking of syntax in school, good news for people. more people graduating from high school and moving on to junior college. >> the person credited with

it turns fewer african-americans are dropping out of high school. that, according to the national urban league state of black america 2017 report, which is said to be released later this morning. usa today reports that not only is the number of high school dropouts on the decline overall, but more african-americans are also earning degrees from junior colleges. that report credits the obama administration for the improvements, but says there are still huge racial disparities in the u.s. education system. >> it's 6:twish right now. nbc bay area responds to a san jose man who needed help recovering more than $8,000. heed to our consumer team for a hand. chris chmura is here now with that story. >> russell maynard sold a high-end sewing machine on ebay for $8600. he shipped the machine to his buyer using fedex and in doing that, he asked fedex for the pap paperwork to declare the value of the machine. he was nervous because it was a very expensive item. he said the clerk at fedex told

him there was no such paperwork, and russell trusted her. that machine ended up arriving badly damaged. so the buyer returned it to russell, who had to refund the entire purchase. next, russell filed a claim with fedex. about a week later, fedex issued russell a check for $241. he was shocked because that's more than $8,000 short. he says fedex told him it was because he didn't declare the value of the package at the type of shipping. russell explained what happened when he shipped the machine and was shuffled around to few different people within the claims division, but in the end, fedex stood its ground, so russell reached out to us for help. we contacted fedex and it aed to cut russell another check for $8600. in a statement, fedex didn't really explain anything, but it did say that it regretted the delay in resolving mr. maynard's claim. lesson learned. declare a value when shipping items, especially the pricey ones. if you have a complaint, let us

hills, and the spider has made a web right there over the camera lens. that's just the sun shining through. 60 degrees as you head out the door. 59en santa rosa, 58 in fairfield. a mild start to the day. look where the high temperatures will go. up to 85 in oakland and up to 93 in concord and napa. that's what we were talking about. 82 in san francisco. i'm getting you ready for the weekend coming up in six minutes. right now, mike has a pleasant commute. >> right along the bay, things looking really good. volume is building, so we see over here in hayward and across the san mateo bridge a little more slowing. same thing for the tri-valley and just starting northbound routes for the south bay. we're going to move the map up to see the sensors over here for highway 4, concord, bay point, and the walnut creek interchange. build, no surprises and no major crashes down here in the upper east shoreway moves well down to the toll plaza where the metering lights are on. we'll show you the volume of

traffic on highway 101 is manageable and no problems between silicon valley and san francisco. back to you. >> thank you very mump, mike. 6:32 right now. new this morning, a fire breaks out at a south bay high school campus, and this morning, investigators are calling it suspicious. kris sanchez joins us live at branham high school to show us some of the damage left behind this morning. good morning, kris. >> good morning, now that the sun is up and the custodian has arrived, we know this is worse than it seemed when it was still dark outside. apparently, whoever set this fire also vandalized two of the sheds there. and used some of the tools to also vandalize the snack shack. you can see it is nearly a total loss and the reason that the fire department believes this is suspicious, even before knowing about the vandalism at the shed, is because the fire started on the stoop outside the door. and thus, it appears it may have been set on purpose. now, adding to the suspicious nature, in the last half hour, i talked to the custodian who said

just last weekend, someone broke into the snack shack, the same one for the baseball team, and stole all of the sodas, the candy, other fund-raising items. as for this morning, crews arrived on scene around 2:30 in the morning and after putting the flames out, they did remain on scene for more than an hour to make sure that the fire did not spread. now, crews did mop up, they watched for hot spots. there is a sign here on campus, and we can show it to you live. there is video surveillance here. so perhaps this will lead to a clue for investigators to figure out what happened here if this was set on purpose to try to track down the folks who did it. the vandal who took out that storage shed and perhaps even the people who broke in and stole the items that were fund-raising items for the booster club. we're sports parents. we know how critical the fund-raising opportunity is for our sports programs. now, this is clearly disappointing for the athletes, for the booster club, for the school. but it's also disappointing for

an eagle scout here because the fire department tells us that this was just redone as part of an eagle scout project. and so that person is going to be disappointed this morning as well. at branham high school in san jose, kris sanchez, today in the bay. >> tough hit for the school, tough hit for the eagle scout. thank you very much. 6:35 right now and a milpitas family forced out of their home by an overnight fire. this happened about 2:00 overnight. the home's right near milpitas high school. in a second, you'll see some of the people who were iinside, able to get outside, but clearly shaken up. we're still waiting for more information as to how the fire actually started. >> 6:35. happening today, the accused oikos university shooter will be back in an oakland courtroom today for a pleaing. the hearing is a continuation from last week. back in april, one goh was found mentally competent to stand trial for killing seven people in a 2012 mass shooting. last month also marked the fifth

anniversary of the shooting. >> watch your step. the weather getting warming outside, and the snakes are coming back out. proof of this, a rattlesnake bit a san jose man while he was climbing peak in fremont yesterday. he was on the trail with his wife at the time. he ended up sitting down on a rock for a second. as he was doing that, he got bitten. luckily, a chp officer or chp chopper was nearby and was able to rescue him. >> he was a 47-year-old male from san jose. when went to sit down after hiking on the peak, and he put his hand down and was bitten by a rattlesnake. >> the bite was bad enough that the man had to be taken to washington hospital for antivenom treatment. we'll keep you updated on his condition. in the meantime, a live look right now. there's that sun coming up over the bay bridge toll plaza this morning. you see the entrance is packed there. also going to be some bike riders out too as there is a new opening to announce. today is the grand opening of the new vista point facility in

yerba buena island for bicyclist. the new path will be available every day during the week, not just during the weekends. caltrans had blocked that part of the bridge during construction due to heavy duzal fumes and smoke from demlution crews removing the old eastern span. >> you'll still have to watch for fumes. you saw the backup at the bay bridge, but the breeze will blow it clear, i believe. we're showing a smooth flow. i wouldn't say driving is a breeze, but it's not a major problem for any of your commutes. a build through the northbound routes and the south bay. here's 101, 87, and 85. over the last 15 minutes, we have seen the speeds dip to the 50s at times and also slowing by san jose international airport. a pretty typical pattern there. highway 101 having a prubl out of gilroy and san martin. a crash involving two trucks blocking the slow lane has traffic tied up and it has not

helped the tie-up in morgan hill where things have slowed down there. and mass transit from the south bay, vta, up through b.a.r.t. and muni, a smooth drive for riders. >> thank you very much. it's 6:38 right now. we made it past monday, so we're already looking forward to the weekend. and hoping for some good weather, but thinks will change. >> yeah, we're going to have huge changes. we're coming off a warm and sunny weekend. this weekend coming up, it looks like it will be a little more cloudy and also cooler. looking at the valleys and inland areas on saturday. we start out at 9:00 with some cloudy skies. and temperatures in the mid 50s. by noon time, we're at 64. and 68 degrees. and there will even be a slight chance of some showers rolling through that may linger into early sunday morning as well. high temperatures in the upper 60s. it will be comfortable. it won't be bad at all. we also have a lot of cinco de mayo celebrations for saturday in san francisco. in the mission district, their temperature holding steady in

morning long and bring you updates on nbc bay area news at 11:00 a.m. >> a question confronting a local school board right now. should five east bay schools be allowed to split up from their current district to form a new one. the contra costa board of education will take up that issue later today. there's a big push from so hch called advocates to separate the north gate high school and its feeder schools from the mt. diablo unified school dwiktd. backers of the plan says the district has ignored the needs of the cools, but they say they're against the plan, saying it's a plan to out the most affluent portion of the district, leading to racial segregation and unfair distribution of resources. regardless of what the county decides, the state will the final say. >> you have noticed temperatures heeding up here and across the united states right now. as that happens, wildfire risk is also going up. forecasters say that's significantly higher for parts of california and nevada as well

as the southwest, florida, and georgia. experts say heavy winter snow and spring rains just delay some of the worst wildfires. according to calfire, wildfires last year burned close to 150,000 acres just in california. >> it's quarter to 7:00 right now. the walnut creek man accused of killing a woman then leading police on a 19-hour-long standoff could officially be charged later today. the killing happened last thursday and the suspect eventually gave up peacefully. the 38-year-old shot and killed a 47-year-old woman last week. the contra costa d.a.'s office tells nbc bay area that prosecutors will be reviewing the case this morning and that charges could come as early as this afternoon. investigators say the suspect was in a relationship with the victim. >> there are still concerns over an unstable hillside causing an indefinite road closure in the east bay. palomars road north of highway 84 has been closed to all

traffic. that hillside first started sliding in heavy rains back in january. the rote connection interstate 580 to niles canyon road. and crews doing cleanup work recently noticed unstable boulders and more debris on the hill side. the road is expected to be closed until june. >> happening today, ivanka trump's book is hitting stores. women who work, offers advise for women trying to advance in the work place and also balancing family life. she's donating the proceeds to charity and has opted not to do publicity. >> north korea is warning president trump it is ready for war. >> scott mcgrew continuing the coverage now. that's pretty strong language, even for north korea. >> a country that does not mince words. here's north korean television as the newscaster there warns of nuclear war.

will be today. we're up to 89 in morgan hill. milpitas up to 88 degrees and also all of that sunshine as we go through the east, 92 in danville and pleasanton. antioch today up to 93 degrees. half moon bay will be a nice cool 70, and then the other side of the hill, up to 89 degrees in palo alto. in san francisco, on the embarcadero, 82 degrees, and 91 in novato. santa rosa today up to nodegree. all of this sunshine heating up the temperatures and some spots may be close to setting some new records. napa, the forecast high is 93 degrees. and the record is 93, set back in 1966. we'll be close in san francisco, oakland, richmond will also be one of the spots we're watching for the responsibility of setting a new record. the old record is 86. and livermore will be up to 90, but the old record is 95, and san jose will also be maybe within two degrees of setting a new record. so getting a live look outside

dramatic video just into our newsroom this morning showing a flight on an l.a.-bound plane. the person who took the video said one of the passengers was assaulting other passengers before all this started. it happened last night in pan on an airways flight. those two passengers were separated after the exchange. the flight attendant trying to do that, but one of the men returned for more. he was eventually dragged off the plane and arrested. >> live now to san jose's branham high school this morning where a suspicious fire overnight destroyed the school's snack shack. fire started about 2:30 this morning. a firefighter tells our kris sanchez on the scene it seems the fire started at the base of the door outside, and that is why they're considered it suspicious. we're told in the last hour that the snack shack was broken into last week. they're a key source of revenue to support the athletic programs. >> police trying to figure out the motive a stabbing rampage on
