6:00 am
now. >> a very good morning to you. thanks so much for joining us. i'm laura garcia-cannon. >> i'm sam brock. we have been noting that we have been feeling some changes the last few days in the weather front. now today really kicks in. >> much cooler, even inland today. yesterday, it was still hot, but today, we get a nice fresh breeze, and cooler temperatures. looking live at all of our microclimates and looking at the palo alto camera, it's 54 degrees. and 53 degrees in san francisco. north bay also 53. but you're noticing as you head out the door in parts of the bay area, kind of misty with the cloudy skies, and a look at the high temperatures today, up to 72 degrees in the south bay. going to be so nice. but not a lot of sun today, and it will be windy. we'll talk about all of this coming up in about six minutes. mike is still tracking the crash in san jose. >> kari, we could be clearing lanes for over an hour now. at one point, highway 101 was
6:01 am
completely closed, as we get a look at the overall commute. the southbound side of the bay shore freeway at brokaw, we have traffic restoring southbound two lanes are open. two lanes are still closed. major injuries after a crash, originally with a disabled vehicle and then a crash resulted. be very careful on the roadways and watch for anything unusual along the drive. northbound 101, we have that normal slowing, north from 68 toward 880. and a slower drive developing for the east shore freeway, but nothing dramatic. metering lights are on. >> we're following a developing story out of the south bay. as early as this morning, we could get a verdict in the high-profile sierra lamar murder case. >> bob redell joining us from the hall of justice to explain what lies ahead for the suspect antolin garcia torres, and we have been watching it closely. bob, good morning. >> reporter: good morning to you, sam and laura. today will mark the first full day of jury deliberations in the
6:02 am
trial of garcia torres when a panel of six men and six women meet later at the hall of justice. they'll weigh both sides presented to them during trial that lasted for three months. and will try to decide whether or not to convict garcia torres for the kidnapping and murder of 15-year-old sierra lamar who disappeared on the way to her bus stop in morgan hill in march of 2012. do they believe the prosecution, which presented evidence that the suspect's dna was found on lamar's clothes and lamar's dna in the suspect's car, or do they side with the defense which questioned whether lamar is actually still alive given the fact her body has never been found. a santa clara university lawfessor tells us it could take the jury quite some time to come back with a verdict. >> could take at a minimum several days. but it could even take longer for them to work through the evidence. and some of it depends on whether or not there's any disagreement in the jury room. >> been a long trial, but it's
6:03 am
just a blink of an eye compared to how much time we haven't had sierra with us. >> the same jury will also decide if torres should be sentenced to death, assuming they come back with a guilty verdict. if the jury finds him not guilty, that means torres would never be able to be tried again in the case, eve if new evidence emerges. reporting live outside the hall of justice in san jose, bob redell, today in the bay. >> now time to wait for the decision here. bob, that you recollect very much. >> 6:03. we're following breaking news for you this morning. out east, a cargo plane crash. we have been following it for the last hour. in the last couple minutes, we learned two people were killed when a cargo plane crashed at around airport in charleston, west virginia. this is our first picture from the ski, what you're looking at right now. more information, that plane was contracted by u.p.s. the aircraft is being described as a twin-engine turbo prop that

6:07 am
the market, but the bill gives states an option to loosen regulations for charging sick people more. president trump says he's fulfilling a campaign promise. house minority leader nancy pelosi says when the first version of the bill was scored, the results were 24 million americans losing their health care. >> live now to san jose. does the air in the bay area seem any healthier to you? especially if you suffer from asthma? turns out it is. bay area air quality regulators say the region has really cleaned up its air and it comes after a long and controversial campaign. no doubt you'll remember this, to reduce wood burning. we now meet federal health standards. summer. firefighters in the south bay are preparing for the upcoming fire season. santa clara fire department will conduct a wildfire training exercise in cupertino's stevens creek county park. coming up on 6:08 on this

6:09 am
slowing, but a major injury crash. we're following up on the rest of that story. northbound 101 shows a little slowing and also at 87th, southbound, there may be a road crew clearing there. let me take you to the mass transit system where none of these have delays now except for ace train. ace train number one reports signal problems. a closure between fruitvale around the lake merritt station will mean closures for ace transit. that includes for people going to the a's game on saturday and on sunday. back to you. >> thanks very much. >> so many changes. obviously, san francisco skyline in recent years but the reshaping far from over. >> the new technology that can project future images across the city. >> plus, good news, the american economy back on track. we just got the latest job numbers and they're phenomenal. ==mike/trx==

6:13 am
we'll take a look ahead to this weekend's forecast at about 6:19. >> a hazy shot of the san mateo bridge. tracking westbound with headlights heading toward what i'm told is a disabled vehicle around the high rise. you'll see the brake lights tapping. >> thank you very much, kari and mike. new video we're just getting in of southern california. a cliff rescue near dodgers stadium. l.a. fire department crews had to hoist two hikers to safety last night from a steep hillside where they were stranded. they used a two-line rope system to try to lift the young men out. they were evaluated by paramedics and found to be okay before being released to their parent. >> the future or maybe futuristic san francisco skyline appeared to be getting closer to reality. here's a live look. you see the transamerica pyramid there. an artist rendering shows what the skyline may soon look like with a new installation on top of the sales force tower.
6:14 am
it will project digital images you can see from almost anywhere in the city. bay area based artist jim campbell created the project. no word on when the lights might turn on. >> holy toledo. >> this is pretty cool. that's obviously part of the call from a '03 post season game won by the oakland a's. if you grew up listening to kings play by play, you know that familiar phrase. holy toledo. and tonight, the a's pay tribute to king with a new holy ledo sign in center field. so cool. going to be unveiled before the start of their game against the tigers. >> let's take a live look at churchill downs in kentucky with tomorrow horse racing's premier event will take place, the kentucky derby. the 143rd running of the derby. the full field of 20 horses will take part. you're probably wondering, can
6:15 am
the horses sense that excitement? jockeys say yes. >> they're usually pretty fired up when they step on the track. you know, obviously, they feel the energy. >> a lot of energy there. classic empire is this year's favorite. nbc bay area will tell aseveral hours culminating with the fastest two minutes in sports. >> horses racing, the economy and roaring. for the month of april, the latest job numbers. >> they just came out. a real turn around. >> previous month's numbers were remarkably terrible. but that was the last report. this report, absolutely what we wanted to see. 211,000 jobs added. the unemployment rate falls to 4.4%. its lowest since may of 2007. really tremendous numbers. ironically, that bad report from the month previous you were talking about actually got revised even farther downward. so this is good, but march in our rear view mirror.
6:16 am
uber's misbehavior has caught the attention of the feds. uber misbehaved a lot. in this case, the controversy is over software uber used code named greyball. it was a way of making uber x cars invisible to city regulators. in cities where they were cracking down on ride share. . for instance, in portland, the city regulator might fire up his ooub app. uber knew he was a city regulator and he wouldn't be able to see any uber x cars on his app even though they were all around him. uber x drivers would know not to pick him up. "the new york times" was the first to reveal the greyball software. but reuters reports federal prosecutors here in the bay area have launched an inquiry. an inquiry is not to the same level as a criminal investigation, but either way, attracting the attention of the feds, not very good. there are a number of start-ups who operate in a legal gray area. for instance, anyone in the cannabis business. state law allows it, federal law does not. this week on our sunday morning
6:17 am
show, press here, we'll talk with the ceo of ease, who runs a legal business delivering marijuana to patients by car in san francisco. cannabis is a growing business, but not risk. >> one thing we do is we have a legal team, lobbying team. we don't have the uber approach of plowing into a city. you work with local regulators. we use our data and things before we go in, we always have the green light. >> i like that. hey, we sell drugs but we're not uber. definitely threw them under the bus. blatantly right there. sunday morning after "meet the press." >> we look forward to it. >> you're a movie buff. >> absolutely. >> are you into guardians of the galaxy? >> i wasn't so much, but the second one is coming out. >> yes, it is. the summer blockbuster is here. gets started this weekend with the guardianoffs the galaxy volume two. chris pratt is back. he's in the movie playing star lord. he and his team are up against a group trying to get rid of
6:18 am
imperfections in the galacy. a lot of space to cover. the sequel has made more than $100 million in the overseas markets and analysts predict a bigger box office in the u.s. could be in store. it's rated pg' 13. >> going to go see that? >> yeah. >> we have to do that. there's a snap chat filter for guardians of the galaxy. >> my son is excited. >> full family affair. >> i have a baseball game to attend. not working the snack shack, but you still have to bundle up? >> much cooler this weekend and long sleeves in order. we have seen temperatures in the bay area drop. we're coming down from the 90s, and this weekend in the 60s. how about that? a live look outside over san francisco. low clouds rolling by. mist and drizzle. a little breezy too to start out the day. it's 54 degrees, heading up to 64 this afternoon. the clouds will be with us all morning long, and you want to hold on to the hat. the winds will be gusting later on today and into tomorrow as
6:19 am
well as tomorrow with spotty light rain in the forecast for the weekend, as you head out the door, right now, 54 in napa. 55 in palo alto, and san jose at 57 degrees with highs this afternoon reaching into the upper 50s for half moon bay and then 76 degrees in concord. look at temperature spread. at least it will be much more comfortable, and here's the change. we have a cold front dropping in from the north that will make it windy. our wind speeds coming in from the northwest and then look at this afternoon in san francisco. these numbers, wind speeds and miles per hour, very gusty along the coast. even the inland areas will be breezy. that stays up into tonight and tomorrow with the winds at about 25 miles per hour. and there may be some higher gusts. we will also have mostly cloudy skies going hour by hour, and we will also have a slight chance of some rain in the forecast. not really a whole lot of it shows up here, but there may be a couple quick moving sprinkles. something you won't be surprised by. i want to give you the heads up.
6:20 am
now i want to show you the live look outside at kirkwood. if you're planning to head to the sierra this weekend, we have clouds and a gorgeous sunrise this morning. and there's snow in the forecast this weekend. yes, for tomorrow. the high will only be 39 degrees. it will also be cooler here in the bay area. looking at temperatures in san francisco right at about 60 degrees, and lower 60s through next week. we'll have some more seasonable weather, but warming up just a bit for next tuesday. and mike, you're showing what's happening now across the san mateo bridge. >> watching for some debris there, but also, i want to call the bay bridge, just before we got to set, reports debris and flat tires out of san francisco on the lower deck heading to treasure island. we'll watch that for i-80 eastbound out of san francisco, and the san mateo bridge, a livelic, we'll show you we have traffic flowing westbound, but also reports of a stalled vehicle around the high rise. you're still moving well on the flat section at least. now, waze shows you what would happen if you were planning a
6:21 am
drive over from cast row valley to palo alto. you see these three routes. you can still head across the san mateo bridge, although it's slower than the dumbarton bridge. if you take that route, that's a lot more mileage, so not a good choice. a good choice is if you're waze or have been for years, make sure you select our team, nbc bay area wazers. you go to your profile, select a team by that name because that would be the right team to choose and that would help you help the right people. that's all of our friends watching in the morning. back to you. >> thank you, mike. >> guiding us down the right path. thank you. this is not the right path. desperate measures here. >> coming up next on today in the bay, the dramatic way two university students tried to steal their final exams and how they ended up getting caught. >> restaurants concerned a big company is misleading hungry consumers like you. i'm consumer investigator chris chmura. nbc bay area responds next. the time is 6:21. we'll be back. nbc bay area responds.
6:22 am
6:23 am
6:24 am
to local restaurants that say a san francisco welcome back. it's 6:24 right now. nbc bay area responds to a local restaurant that says a san francisco start-up is using their business names and logos without permission. >> in the process of doing that, misleading you, the consumer. chris chmura looking into this for us. he joins us with a story about meal delivery. >> we have a conflict between a new company absolutely on fire and an established small business feeling burned.
6:25 am
barbara rowe owned mulberry street pizzeria in san rafael. a few months back, she saw a restaurant delivery service picking up a to-go order. barbara called that unethical. >> we never authorized anything like that. >> she later learned the delivery service posted her logo on its website. taking orders and giving customers the impression the two companies were partners, but they're not. shely does not authorize any food delivery, afraid it might arrive cold and leave a bad taste in the customer's mouth. our team's research found dozens of local restaurants listed on the middle man's website without their permission. tonight at 11:00, a large chain restaurant takes that case to federal court. and a legal scholar weighs in with an opinion that might give you food for thought the next time you want dinner delivered. if you have a consumer complaint, please let us know.
6:26 am
888-996-tips or online. sometimes i feel like i'm the only one who cooks at home. these services are so popular. >> they are. i like to cook, but it is nice to have an order. speaking of liking to cook, we understand you brought us a gift. what did you make for us? >> i guess it doesn't make sense with cinco de mayo, but key lime pie. there's a saying that america runs on duncan. i think this newsroom runs on fat and sugar. >> your key lime pie will be worth the calories. twobes up. >> it is friday here. it's cinco de mayo. many parties may be missing a key part of celebrating, guacamole. avocado prices have soared this year. depending on the variety, prices are up by as much as 55%. the average price of an avocado was $1.43. that's nearly 50 cents higher than last year. >> all right, two university of kentucky students facingany burglary charges after a mission impossible style stunt to steal
6:27 am
a final examine. >> it happened wednesday morning early. university officials say one of the students climbed through the air duct system of the campus building trying to steal a copy of the final exam. the instructor was pulling an all night and spotted the two. >> if they could have just spent the time studying. >> and they would have done it honestly. >> we all know the bay area has so much to offer. >> coming up next, sam brock, where the bay area stacks up when it comes to the hottest travel spots in california. parents in one bay area city are spending the night outside in tents, braving the cold weather all for their kids. the limited opportunity that awaits them this morning. you're watching today in the bay. right now at 6:30...
6:28 am
6:29 am
6:30 am
we )re off to a cooler and foggier start in parts of the bay right now at 6:30, we're off to a cooler and foggier starts in parts of the bay area. taking a live look outside from downtown san jose. looking forward to a cool and mild weekend. looking forward to it because it's friday morning. thanks for joining us. i'm laura garcia-cannon. >> i'm sam brock. friday morning, the fifth of may. otherwise known as cinco de m o mayo. 90 degrees laz weekend. this is normal weather for this time. >> bringing it back to spring, because we went to summer, and i got so tired of that hum of the air conditioning. well, we are going to have the
6:31 am
possibility to turn the air conditioners off this weekend. as we will have much cooler air moving in, and then look at all these clouds. we're looking at those current temperatures in the mid to upper 50s as you head out the door. in san francisco, 52 degrees and some drizzle too. it's going to be up to 73 in the tri-valley today. peninsula, 69. east bay will also be topping out at 69 degrees, and 64 in san francisco. going to be a nice one, but windy, too. we'll talk about the winds, and i'm getting ready for the weekend in seven minutes. mike sees some flashing lights. >> i do. the san mateo bridge, look with me, westbound. now jammed up as the flashing lights arrive right there. can you see that? just about outside of our vision. flashing light and one lane blocked, perhaps two, as chp and a bridge crew arrive. this is a jam that forms as i think they have now blocked two of your three lanes. it's the san mateo bridge as we look at the spencers. that's the slow drive developing
6:32 am
from the they hayward side. the dumbarton bridge is clear, you might use that as an alternate. getting out of san francisco, the other issue is the bay bridge. debris toward treasure island out of san francisco has resulted in a number of flat tires. i don't know what's going on with the debris. they may have to have a quick traffic break and a sweeper. over all, the rest of the bay moves very well. >> thank you very much. >> a tough story. a south bay school ransacked. investigators trying to find the suspects who vandalized the mont asariy school. >> good morning, kris. >> good morning to you, sam and laura. parents will be scrambling because instead of welcoming children here at the montessorm, staff will be dealing with this, broken glass all over the outside, and look at the inside. this is the room that served the infants here, and you can see that the little caughts there on the ground have been tossed around. piles of diapers, glass, toys,
6:33 am
all strewn together on the carpet. this school also serves preschoolers in the other room and has a rather large body here. now, you can see from one of the parents that all of the rooms were damaged, or one of the parents tells us all of the rooms were damaged, many windows were broken. it happened sometimes between tuesday night and yesterday morning. yesterday was may 4th, the star wars day. that's where the insult to injury comes in. the owners had to cancel the school's star wars day to the disappointment of kids who were ready to show up in costumes and have a fun day at school. the damages, though, are estimated at about $10,000. so the parents set up a go fund me page, and at last check, it was about halfway to their goal of $10,000. parents should check the tomorrow montessori school website for information on when child care will be available here again.
6:34 am
you can go to nbcbayarea.com.com or go to our social media plat fom forms. a lot of damage here, and this is another blow for the willow glen neighborhood which has had a rough couple nights. this school serves a lot of families here in willow glen, and it is a tough time to find alternate child care. so sympathy for the parents there this morning as well. in san jose, kris sanchez, today in the bay. >> thanks for the latest there. >> it's 6:34.é@ happening now, a sign of the times and the rising cost of raising a child. >> right now, dozens of parents are sfending the morning in the cold, hoping to get affordable child care. pete is joining us from south san francisco to show us some of the determined parents who have been waiting for more than 24 hours. we know earlier, we saw tents. they have been camping out. good morning. >> good morning to you. yes, when we showed up, there were about 20 to 25 tents surrounding this rec center in south san francisco. they have broken down the tenlts, as you can see behind me. they're now just waiting in line to go inside the rec center to
6:35 am
see if they'll get a chance to get affordable child care for the next school year. this is being offered by the south san francisco department of parks and recreation they're going to offer it at six of their locations, and the cost to the parents who do get the chance, about $399 per month. to give the idea of the expenses of child care, according to care.com, the web for child care providers, the average cost per day for child care is nearly $200. that's why parents are sleeping in tentsicide the building for more than 24 hours, and i spoke to one moments ago. >> getting emotional. you said that important. can you explain that. >> very important. we're trying to bring up in a really good school. and we're trying to do something that's going to help us as well as her because we have to find somewhere that is accommodating for us. >> director of parks and recreation says the line is longer this year due to
6:36 am
uncertainty regarding federal funds for the program. i want to take you back out here live. you see the line for folks waiting to get inside. only 40 spots remain as far as getting a chance for affordable child care for the next school year. the doors open behind me at 7:00 a.m. we're live in san francisco, pete suratos for today in the bay. >> thank you, pete. >> 6:36. continuing coverage this morning, bracing for more testimony in a police officer killing that rocked the hayward police department and the law enforcement community in general two years ago. the preliminary hearing continues for mark estrauta who is accused of murdering sergeant scott lunger in 2013. yesterday, officer justin green testified that he drove up to the scene as quickly as possible and heard a gunshot from the suspect'sp. officer green said he then shot multiple times into estrada's car, but the suspect was able to drive away. estrada was arrested the next day where he was at a hospital
6:37 am
in oakland being treated for a gunshot wound. >> we're expecting to learn more details on a salvage operation. they're trying to pull up a sunken barge that capsized last month in stormy weather. all that happening near the bridge. crews have been working on rotating barge upright for months, at one point, it was essentially sitting over the transbay tube. the coast guard will bring us an update. >> let's take a look at the golden gate bridge, one of the reasons the state is considered a hot spot. the bay area brings in california's highest travel spending dollars every year. that's part of the bad news is the same study finds california may see a slowdown in tourist spending that's because a strong dollar may encourage u.s. tourists to flock to other worldly locales. >> good morning. hey, i got big news coming out of san francisco right now. other than that, well, we have two other issues. the san mateo bridge and a friday commute. friday means a lighter commute
6:38 am
around the bay. we'll talk about the san mateo bridge in just a bit. just got word from san francisco fire department exactly what's going on at seventh, we heard buzz about that. a big sinkhole reported there. about the size of five feet by 14 feet. that's the size of a car. we're following more information, but san francisco fire does say that no one is injured. not a public safety issue as long as you mind where they're saying to stay away from. traffic between those roadways is likely going to be an issue between 280 and 101 or the skyway. we're tracking that and also the san mateo bridge where the disabled vehicle traveled westbound. as you look at the camera, we see traffic starting to move on the flat section. over here, still some flashing lights on the high rise just before you get to the high rise on the flat section. we're tracking, at least that's moving better. they may have two lanes open now. meanwhile, low clouds, but not a problem here. now, we send it back to you for the weekend forecast. >> it is friday.
6:39 am
we all made it. >> a little extra lift in mike's voice. the weekend. time for the weekend. >> and it's going to be a great weekend all around the bay area. i'm glad we don't have to deal with heat, and it will be cooler. there's a lot of events going on. let's get a look at the valleys and inland forecast for tomorrow. it will be cloudy to tart out the day and 56 degrees. low 70s in the afternoon, and still windy. at times the gusts up to 30 miles per hour. breezy on sunday with a morning start in the upper 50s. noon time temperature at 64. and 73 degrees with some breezy winds. also a slight chance of rain. it should not have you changing your plans as we'll have a lot of events going on and the chance of rain will be slight. it will be cool. long sleeves needed if you're going out to the cinco de mayo festival tomorrow in san francisco. in the mission district, only reaching 60 degrees throughout the day. with the winds, it will feel smooth. the a la carte and art fest happening in mountain view.
6:40 am
on castro street, 55 degrees at the start of the festival. throughout the day, high temperatures reaching to the upper 60s. we'll start to feel much more comfortable, and in foster city, there will be the polynesian festival tomorrow atleo j. ryan park, and starting out in the upper 50s there. a mix of sun and clouds. then we'll get more sunshine as we go through the day as the high temperatures reach into the lower 60s. also, the kentucky derby party happening at golden gate field. it will be broadcast live right here on nbc throughout the day, but if you're going out to see some horse racing, it will be in the mid 50s at 10:00 in the morning, and then rising into the low 60s. so still some long sleeves needed over your derby dress, and still a, of course, but hold on to it because it will be breezy. and paso robles in the 80 toodz and then dropping back to the 60s with a mix of sun and clouds for the weekend and for the parade in palo alto, it will be cool to start.
