one. >> a lot of spoken word poetry. just kidding. a lot of great music. >> we'll get to that in just a bit. but first a check on the headlines. back in the spotlight on capitol hill sally yates scheduled to testify the first time about her warnings to the trump administration. she is expected to tell senators more about contact between michael flynn and the russian ambassador. a federal appeals court is hearing arguments on president trump's revamped travel ban. attorneys will try to convince the fourth u.s. circle court of appeals that the ban is motivated by national security and not by religion. a very long and historic night at wrigley field in chicago. the cubs and new york yankees battling it out for 18 innings, guys. the yankees eventually won that one, 5-2. it was over after 2:00 a.m. eastern. marked the longest interleague game ever.

and a lot of records set. i'm sure a lot of weary people this morning. let's start this half hour with some new developments out of penn state university. 18 students have now been charged in connection with the alleged hazing death of one of the fraternities pledges. thomas has been following this one. >> good morning. really sad story out of penn state and the prosecutor in this case has filed 850 charges in the death of timothy piazza. a sophomore engineering major from new jersey. according to his family attorney, just wanted to belong. >> anything to say? >> reporter: this morning 18 members of the fraternity are charged in the hazing death of a pledge. eight of them are facing involuntary manslaughter charges. the other ten face lesser charges including hazing and providing alcohol to minors. 19-year-old timany piazza died after falling down the stairs in

february known as the gauntlet. >> they made the pledges run from station to station and drink enormous amounts of alcohol. >> reporter: the 80-page indictment reveals stunning details including instant messages, google searches and surveillance video. piazza's blood alcohol content is as high as .36. at 11:53 prosecutors say one fraternity brother sends a group message to his brothers, tim piazza might be a problem. he fell 15 feet down a flight of stairs. going to need help. >> they knew he was in danger and they back packed him which was a way to making sure he didn't roll over. >> reporter: within an hour he tried to stand up and fell head first three separate times into the hardwood floor, iron railing and front door. the next morning fraternity brothers found him in the

basement. >> some of them googled things like, what to do with a head injury. >> reporter: the brothers finally called for help, almost 12 hours after piazza first fell. >> if 911 had been called immediately as any decent human being would have done, the life of tim piazza would have been saved. >> reporter: sickening and difficult to understand. the national fraternity called the charges incredibly disheartening. but it's no consulation for his parents who say they're shattered. >> this did not have to happen. no parent should have to deal with this. >> so, their national chapter says it does not tolerate hazing and alcohol abuse and disbanded its penn state chapter which, itself, has been charged with involuntary manslaughter. penn state has put out other fraternities on notice and underage drinking and reached out to attorneys representing the young men charged. as for the piazza's their tern

tell us that none of the young men involved in the story have reached out to their family to express their remorse for this. penn state had their commencement ceremonies over the weekend. any male student scheduled to walk and has been charged is on hold right now. we'll continue to follow this story. so sad for tim piazza and his family. >> unspeakable, thomas, thank you. let's get another check of the weather from al roker. hey, al. >> the story we have been following about the fire. only 12% contained. you can see the smoke plume reaching to jacksonville and right now for the state of florida, eight active wildfires and 29 fires that have more than 100 acres covered and just continue there 110 wildfires statewide. it is a mess and the problem is the drought. there's a lot of drought across the state. about 65% of the state in drought. but 5.5% of the state in extreme

cable. craig? >> al, thank you. now to new trouble for stephen colbert. his crew joke acaught the attention of the federal communication and he's not the only late night host under fire. stephanie gosk is here with more on that story. good to see you. >> the problem is they're not going away after a number of complaints. the fcc now says it's going to investigate and their response will depend on whether or not they deem his remarks to be obscene. one of president trump's harshest critics is in hot water this morning. now, under investigation by the fcc for possibly being indecent or obscene after delivering this scathing off-color joke about the president. >> you talk like a sign language gorilla that got hit in the head. the only thing -- >> after an instant online backlash the joke caught the attention of the federal communication commission and its chairman. >> i have had a chance to see the clip now and, so, as we get

complaints and we have gotten a number of them, we are going to take the facts that we find and we are going to apply the law as it has been set out by the supreme court and other courts and we'll take the appropriate action. >> reporter: appropriate action could mean a fine. while that's not unprecedented, in recent years it has become uncommon. one high-profile indecency case janet jackson's wardrobe malfunction in 2004. the fcc initially levied a $550,000 fine against cbs for that incident. but the fine was later struck down in court. >> sign language -- >> reporter: when the network first aired colbert's joke his mouth was blurred and the offending word bleeped out. >> am i still the host? i'm still the host! >> reporter: colbert acknowledged his language was harsh, but he's not apologizing. one of colbert's guests actor

jim parsons laughed it off. >> you taught me new terms. as a gay man, i didn't know certain things that you -- that's i wouldn't call it home phobic. >> reporter: not the only late night host taking fire. bill mahr is also facing criticism for a crude joke about ivanka trump. >> what do you make of ivanka? >> reporter: implying a -- online critics pounced. i can't believe bill mahr just did that. another slammed the host for poor taste. on set on friday was gabe sherman. >> i felt uncomfortable being on set. i didn't know where the segment was going and he is a comedian and really being provocative and that's part of his brand. >> the show airs on hbo which is outside of the fcc jurisdiction for regulating indecency.

this morning on "today food," we're celebrating our moms in honor of mother's day. i'm happy to have my mom, linda here. to make my favorite dishes when i was growing up. i don't know who is more nervous, me or you, mom. when i thought about what i like to eat in the kitchen, i thought of beef wellington. and jell-o mold. beef wellington sounds like a fancy dish. >> this is a working woman's beef wellington. >> quick and easy. i love it. one of my favorites. starting with the ingredients here. beef tenderloin. >> of course. >> what are some of the other stuff?
